Chapter I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1 ||| This Decree details and guides the implementation of certain Articles and Clauses regarding ownership of housing, development of housing, management and use of housing, transactions concerning housing, and state management of housing in Vietnam as stipulated in the Housing Law No. 65/2014/QH13 (hereinafter referred to as the Housing Law).
2 ||| The detailed regulations on certain Articles and Clauses regarding social housing development; management and use of social housing not owned by the State; renovation and reconstruction of apartment buildings; construction, management, and use of information systems for housing; transactions involving the purchase, lease, and lease-purchase of commercial housing by enterprises and cooperatives engaged in real estate business; inspection and administrative penalties in the field of housing shall be carried out according to other Decrees of the Government.
Article 2. Applicability
1 ||| Organizations, households, individuals within the country, overseas Vietnamese, organizations, and foreign individuals related to ownership, development, management, use, and transactions concerning housing in Vietnam.
2 ||| State management agencies related to housing.
||| Article 3. Programs and plans for housing development at local levels
1 ||| Provincial People's Committees (hereinafter collectively referred to as Provincial People's Committee) have the responsibility to organize the development of programs and plans for housing development at the local level and implement these programs and plans in accordance with Article 15 and Article 169 of the Housing Law.
2 ||| The content of the five-year and ten-year or longer housing development program of the locality includes:
a) Evaluation of the current status of various types of housing (individual houses, apartment buildings) and housing for groups specified in Article 49 of the Housing Law within the locality;
b) Analysis and evaluation of results, existing issues, causes, difficulties, and obstacles in housing development and management, land use planning, and construction planning related to housing development in the locality;
c) Determination of housing needs (number, type, total floor area); land area requirements for constructing various types of housing in each area within the locality; specifically, the housing needs of groups requiring support to improve their housing conditions as stipulated in Article 49 of the Housing Law must be identified; capital requirements (state budget funds and other sources of funding) for housing investment;
d) Determination of housing development indicators (including average per capita housing area, minimum floor area indicator, number and floor area of new housing construction for each type of housing, quality of housing in urban and rural areas);
đ) In urban areas, clear requirements for the relationship between housing development and urban development must be determined;
e) Measures to implement the program, including specific measures on housing policies issued by the locality, construction planning, land allocation, and forms of housing construction investment, scientific and technological construction solutions to reduce construction costs, mobilization of funding sources, financial and land incentives, and implementation plans for social housing support policies for each group as stipulated in Article 49 of the Housing Law;
g) Implementation schedule and responsibilities of relevant local authorities in implementing the program;
h) Other related contents.
3 ||| The content of the five-year and annual housing development plan of the locality includes:
a) Location, area for housing development, number of housing projects to be constructed, number of houses, total floor area of houses to be constructed, specifying the five-year and annual plans;
b) Proportion of various types of housing (individual houses, apartment buildings) to be constructed; number and floor area of social housing to be constructed over five years and annually, specifying the floor area of social housing for rent;
c) Determination of average per capita housing area in urban and rural areas and throughout the locality; minimum housing area indicator;
d) Determination of land area for constructing various types of housing (commercial housing, social housing, resettlement housing, public service housing) over five years and annually; forms of housing construction investment;
đ) Determination of funding sources for housing development; implementation timeline over five years and annually;
e) Methods of organization and responsibilities of relevant local agencies in implementing the housing development plan;
g) Other related contents.
4 ||| During the mid-term and final stages of implementing the housing development program and when approving the housing development plan for the following year, the Provincial People's Committee must conduct interim evaluations and assessments of the implementation of the program and plan, and adjust any content and indicators that are inconsistent with reality.
In cases where there are changes in the National Housing Development Strategy or the economic and social development planning of the locality, the Provincial People's Committee must revise the content of the housing development program to submit to the same-level People's Council for approval before implementation in accordance with Article 169 of the Housing Law.
5 ||| Indicators in the housing development program, including average per capita housing area, minimum housing area, number of houses, total floor area of new housing construction, quality of housing in urban and rural areas, must be included in the local economic and social development tasks and evaluated during the interim and final reviews of these tasks.
Article 4. Procedures and formalities for developing housing development programs and plans at local levels
1. The procedures and formalities for developing five-year and ten-year or longer housing development programs at local levels shall be carried out as follows:
a) The Construction Department shall prepare the outline of the housing development program, including the content of the program, estimated budget, and the proposed consultancy firm to build the program, and report to the Provincial People's Committee for approval;
b) After receiving the approval opinion on the outline from the Provincial People's Committee, the Construction Department shall directly implement or hire a competent and experienced consultancy firm to collaborate with relevant agencies, organizations, individuals, and district-level People's Committees within the province to conduct surveys, compile data, draft the program, and report to the Provincial People's Committee for comments;
c) Following the Provincial People's Committee's comments on the draft program, the Construction Department shall supplement, revise, and finalize the draft for the Provincial People's Committee to submit to the Provincial People's Council for approval. For centrally-administered cities, the Provincial People's Committee must seek the unified opinion of the Ministry of Construction on the content of the program before submitting it to the Provincial People's Council for approval;
d) The Provincial People's Council shall examine and approve the local housing development program; after its approval, the Provincial People's Committee shall endorse and organize the implementation of the program;
2. The procedures and formalities for developing five-year and annual housing development plans at local levels shall be carried out as follows:
a) Based on the approved local housing development program by the Provincial People's Committee, the Construction Department shall directly implement or hire a competent and experienced consultancy firm to collaborate with relevant provincial agencies to develop the five-year and annual housing development plans to be submitted to the Provincial People's Committee for approval. District-level People's Committees and related provincial agencies shall provide information related to housing as requested by the Construction Department and cooperate with the Construction Department and consultancy firms to develop the housing development plan;
If the plan includes provisions on the use of state budget funds for housing development, the Provincial People's Committee must seek the opinion of the Provincial People's Council on the plan for using funds before approving it;
b) Based on the Construction Department's proposal on the housing development plan, the Provincial People's Committee shall review, approve, and organize the implementation of the plan;
For the annual housing development plan, the Provincial People's Committee must approve it before December 31 of the preceding year; for the five-year housing development plan, the Provincial People's Committee must approve it before December 31 of the final year of the planning period;
3. After approving the housing development program and plan, the Provincial People's Committee must publicly announce the program and plan on the provincial People's Committee's and Construction Department's electronic portals, and the Provincial People's Committee is responsible for allocating local budget funds to build the housing development program and plan in accordance with this Decree;
The Ministry of Construction shall provide detailed guidance on the budget for building local housing development programs and plans;
Chapter II
HOUSING OWNERSHIP
Article 5. Documents Proving the Subject's Right to Own Housing
1. For organizations, households, and individuals within the country when applying for issuance of the Certificate of Land Use Rights, Housing Ownership, and Other Assets Attached to the Land (hereinafter referred to collectively as the Certificate), they must have personal identification documents in accordance with the laws on land.
2. For Vietnamese citizens residing abroad, they must have the following documents:
a) In cases where they hold a Vietnamese passport, it must still be valid and stamped with the entry inspection seal of the Vietnamese immigration management authority in the passport;
b) In cases where they hold a foreign passport, it must still be valid and stamped with the entry inspection seal of the Vietnamese immigration management authority in the passport, accompanied by documents proving their continued Vietnamese citizenship or documents confirming their Vietnamese origin issued by the Department of Justice of provinces and centrally-administered cities, Vietnamese representative offices abroad, or other relevant authorities in accordance with Vietnamese law.
3. For foreign organizations and individuals, they must have documents proving the subject in accordance with Article 74 of this Decree; in cases where foreign individuals have documents confirming their Vietnamese origin, they may only choose to apply either as Vietnamese citizens residing abroad or as foreign individuals to determine their right to own housing in Vietnam.
Article 6. Issuance of Certificates to Housing Owners
1. Organizations, households, and individuals within the country, Vietnamese citizens residing abroad, foreign organizations, and individuals who have documents proving the lawful establishment of housing (in compliance with conditions and forms) in accordance with the Law on Housing, real estate business laws, and related laws (including housing constructed according to approved planning schemes under projects specified in Clause 2, Article 17 of the Law on Housing) and have documents proving the right to own housing in accordance with Article 5 of this Decree shall be granted Certificates by the State for such housing.
For Vietnamese citizens residing abroad who are not allowed to enter Vietnam but are given housing through gifts or inheritance, their ownership rights shall not be recognized, and they must comply with the provisions of Clauses 2, 3, 4, and 5 of Article 78 of this Decree.
2. For standalone houses built with two floors or more, each floor designed and constructed with two or more closed units (with separate living rooms, kitchens, bathrooms, and showers), each unit having a minimum floor area of 30 square meters, and if such housing meets the conditions for apartment buildings as stipulated in Clause 2, Article 46 of the Law on Housing, then the State shall issue Certificates for each unit in such housing; in cases where the owner sells, leases, gives as a gift, or leaves as an inheritance a unit in such housing to another organization, household, or individual eligible to own housing in Vietnam, the land use rights attached to such housing shall belong to the common use of those who have purchased, leased, received as a gift, or inherited the unit.2 3. In addition to the contents recorded in the Certificate in accordance with the laws on land, the issuing authority must also record the following additional information:
a) Information about the housing as prescribed in Clause 3, Article 9 of the Law on Housing;
b) The term of housing ownership and the rights to sell, give as a gift, leave as an inheritance, or contribute capital using the housing of the buyer in accordance with the agreement in the housing purchase contract with a term as stipulated in Article 123 of the Law on Housing, or record the term of housing ownership of foreign organizations and individuals in Vietnam as prescribed in Article 161 of the Law on Housing, Articles 7 and 77 of this Decree;
c) In cases of purchasing social housing as prescribed in Clauses 4 and 5, Article 62 of the Law on Housing, the term during which the owner has the right to resell such social housing must be recorded.
4. The procedures for issuing Certificates to housing owners are carried out in accordance with the laws on land; the project developer is responsible for processing the issuance of Certificates for buyers and lessees of housing; in cases where buyers and lessees voluntarily process the issuance of Certificates, the developer must provide them with the necessary files and legal documents related to the purchased or leased housing.
4. The procedures for issuing the Certificate to the owner of the housing shall be carried out in accordance with the laws on land; the project investor of housing construction is responsible for handling the procedures for issuing the Certificate to the buyer or lessee of housing; in cases where the buyer or lessee of housing voluntarily handles the procedures for issuing the Certificate, the project investor must provide the dossier and relevant legal documents related to the purchased or leased housing to the buyer or lessee of housing.
Article 7. Duration of Ownership of Housing
1. In cases where housing ownership has a duration as prescribed in Article 123 of the Law on Housing, the seller and buyer shall specifically agree on the following contents, including the duration during which the buyer may own the housing; the rights and obligations of the buyer during the period of housing ownership; the responsibility for registering and issuing the Certificate of House Registration to the buyer; the transfer of housing attached with land use rights and the person receiving the transfer of housing after the expiration of the ownership period; the handling of the Certificate of House Registration upon the expiration of the ownership period and the responsibilities of the parties in performing the housing purchase contract. During the period of housing ownership, the buyer shall be granted the Certificate of House Registration for that housing through the form of recovering the Certificate of House Registration from the seller and issuing a new Certificate of House Registration to the buyer or supplementing the third page of the Certificate of House Registration already issued to the seller and handing it over to the buyer.
In cases where the buyer and seller have agreed that the buyer of the housing has the right to sell, give as a gift, leave as inheritance, or contribute as capital with the housing during the period of housing ownership, the buyer again, the recipient of the gift, the heir, and the contributor will only be able to own the housing according to the duration agreed upon by the first-time buyer with the initial owner.
2. Foreign organizations specified in Point b Clause 1 Article 159 of the Law on Housing shall have the maximum ownership duration not exceeding the term recorded in the Investment Registration Certificate issued to such organization. Upon the expiration of the ownership term recorded in the Certificate of House Registration, if the owner wishes to extend the term, they shall be considered and extended according to the provisions of Article 77 of this Decree; in cases where the Investment Registration Certificate does not record a term, the Certificate of House Registration issued to the owner shall also not record a term.
In cases where foreign organizations are declared bankrupt, dissolved, or cease operations before the ownership period stipulated in this Clause or their Investment Registration Certificate or permit to operate in Vietnam is revoked by the Vietnamese State, the handling of such housing shall be carried out according to the provisions of Clause 1 Article 8 of this Decree; in cases where a foreign organization becomes a domestic organization through merger or capital transfer as prescribed by law within the ownership period, such organization shall be entitled to stable long-term ownership of the housing.
3. Foreign individuals specified in Point c Clause 1 Article 159 of the Law on Housing shall have the maximum ownership duration not exceeding fifty years from the date of issuance of the Certificate of House Registration; upon the expiration of the ownership term recorded in the Certificate of House Registration, if the owner wishes to extend the term, they shall be considered and extended according to the provisions of Article 77 of this Decree.
4. In cases where foreign organizations or individuals sell or give as a gift housing before the expiration of the ownership period, the buyer or recipient of the gift shall be entitled to housing ownership as follows:
a) In cases where housing is sold or given as a gift to domestic organizations, households, or individuals, or overseas Vietnamese, the buyer or recipient of the gift shall be entitled to stable long-term ownership of the housing;
b) In cases where housing is sold or given as a gift to foreign organizations or individuals eligible for housing ownership in Vietnam, the buyer or recipient of the gift shall only be entitled to ownership during the remaining period; upon the expiration of the remaining ownership period, if the owner wishes to extend the term, they shall be considered and extended according to the provisions of Article 77 of this Decree;
c) The seller or donor of the housing must pay taxes and other financial obligations to the Vietnamese State as prescribed by Vietnamese law.
Article 8. Handling in cases where the ownership period of housing expires
1. In cases where the ownership period of housing expires according to the agreement between the seller and the first-time buyer as stipulated in Clause 1, Article 7 of this Decree, the right to own housing and the right to use residential land shall be handled according to the agreement of the parties in the first-time housing purchase contract; if the parties have no agreement on the handling of housing, the right to own housing and the right to use residential land shall be transferred back to the first-time owner of the housing or the lawful heir of the first-time owner.
In cases where the first-time owner is an organization that has gone bankrupt, dissolved, or ceased operations, the housing of such organization shall be handled according to the laws on bankruptcy, dissolution, or cessation of operations, and the right to own housing shall be transferred to individuals or organizations entitled to ownership under the laws on bankruptcy, dissolution, or cessation of operations; during the time to determine the owner of the housing, the organization or individual currently managing the housing shall continue to manage it and shall not exercise the rights to sell, lease-purchase, gift, inherit, mortgage, lease, or contribute housing as capital; the transfer of this housing shall be carried out within three months from the date the owner of the housing is determined.
In cases where a foreign organization has its Certificate of Investment Registration or permit for operation in Vietnam revoked by the Vietnamese State, the owner must sell or gift the housing to an entity eligible to own housing in Vietnam.
2. In cases where the parties to the first-time housing purchase contract as stipulated in Clause 1, Article 7 of this Decree have no agreement on the handling of the Certificate of Conformity when the ownership period of housing expires, the competent authority issuing the Certificate of Conformity shall be responsible for revoking the Certificate of Conformity issued to the current owner of the housing and reissuing the Certificate of Conformity to the entity determined as the first-time owner of the housing according to Clause 1 of this Article; in cases where the Certificate of Conformity cannot be revoked, the competent authority issuing the Certificate of Conformity shall issue a Decision to revoke the Certificate of Conformity issued to the current owner and reissue the Certificate of Conformity to the entity determined as the first-time owner. The procedures and formalities for issuing the Certificate of Conformity specified in this Clause shall be implemented according to the regulations on issuing Certificates of Conformity under the Land Law.
3. Prior to the expiration of the ownership period of housing as stipulated in Clauses 2 and 3, Article 7 of this Decree (including cases extended according to Article 77 of this Decree), foreign organizations and individuals may directly or authorize other organizations and individuals to exercise the rights to sell or gift housing legally owned by them as stipulated in Clause 4, Article 7 of this Decree. If the foreign organization or individual does not exercise the right to sell or gift housing legally owned by them beyond the ownership period, such housing shall belong to the ownership of the Vietnamese State; the Construction Department shall be responsible for submitting to the People's Committee of the province where the housing is located a decision establishing public ownership and proceeding to reclaim the housing for management, leasing, or sale according to the regulations on managing state-owned housing.
In cases where foreign organizations or individuals are ordered by authorized Vietnamese agencies to leave the country or cease operations in Vietnam due to violations of Vietnamese laws in the use of housing owned by them, such housing shall be handled according to the decision of the authorized Vietnamese agency.
Chapter III
DEVELOPMENT OF HOUSING
Section 1
HOUSING INVESTMENT AND CONSTRUCTION PROJECT
Article 9. Decision or approval of investment orientation for housing construction projects
1. Organizations and individuals must complete procedures to request a decision or approval of investment orientation as prescribed in this Decree before establishing an investment project for housing construction as stipulated in Clause 2 of Article 17 of the Law on Housing.
2. In cases where housing construction is funded by sources specified in Clause 3 of Article 36 and Clause 1 of Article 53 of the Law on Housing, the dossier, procedure, process, and authority to decide on investment orientation shall be carried out according to the provisions of the Public Investment Law; the leading agency responsible for examination must send for examination opinions from the Ministry of Construction regarding contents related to housing for projects using central funds, and send for examination opinions from the Construction Department at the location of the project regarding contents related to housing for projects using local funds.
Where the Minister of Construction decides on investment orientation for housing construction projects within the scope of authority prescribed by the Public Investment Law, the Ministry of Construction shall organize an examination prior to deciding on investment orientation.
3. In cases where housing construction does not fall under the projects prescribed in Clause 2 of this Article but falls under projects prescribed in Point a of Clause 1, Clause 2 of Article 31 and Point a of Clause 1, Clause 2 of Article 32 of the Investment Law, the dossier, procedure, process, and authority to decide on investment orientation shall be carried out according to the provisions of the Investment Law; the leading agency responsible for examination must seek examination opinions from the Ministry of Construction regarding contents related to housing if the project is decided on investment orientation by the Prime Minister, and seek examination opinions from the Construction Department regarding contents related to housing if the project is decided on investment orientation by the People's Committee of the province.
4. In cases where housing construction does not fall under the scope prescribed in Clauses 2 and 3 of this Article but falls under any of the following categories, procedures must be completed to submit to the Ministry of Construction for examination to present to the Prime Minister for approval of investment orientation:
a) Projects with land use area of 100 hectares or more, or with land use area less than 100 hectares but with a number of houses of 2,500 units or more (including detached houses, individual houses, and apartment units) in non-urban areas;
b) Projects with land use area of 50 hectares or more, or with land use area less than 50 hectares but with a number of houses of 2,500 units or more in urban areas;
c) Projects regardless of land area size or number of houses but located within the administrative boundaries of multiple provinces or centrally-run cities.
5. In cases where housing construction does not fall under the scope prescribed in Clauses 2, 3, and 4 of this Article but falls under any of the following categories, the People's Committee of the province must seek opinions from the People's Council at the same level before approving investment orientation:
a) Projects with land use area from 20 hectares to less than 100 hectares and with a number of houses less than 2,500 units in non-urban areas;
b) Projects with land use area from 10 hectares to less than 50 hectares and with a number of houses less than 2,500 units in urban areas;
c) Projects regardless of land area size or number of houses but located in restricted development areas or historical inner city zones (determined in planning schemes) of special-class cities.
6. For cases that do not fall under the scope prescribed in Clauses 2, 3, 4, and 5 of this Article, they must be submitted to the People's Committee of the province for approval of investment orientation.
Article 10. Documents and procedures for requesting decisions or approvals on investment proposals for housing construction projects in
1. For cases stipulated in Clauses 2 and 3 of Article 9 of this Decree, in addition to the contents required by laws on public investment and investment laws, the following additional contents regarding housing must be included:
a) The area of paddy land, protective forest land, and special-use forest land that needs to be converted for the housing investment project (if applicable);
b) The ratio and number of various types of housing units (apartments, villas, individual houses); total floor area of housing construction;
c) Construction of technical infrastructure and social infrastructure projects, parking areas for public use and for households and individuals living in the project area;
d) Area allocated for social housing and rental housing as prescribed by the Law on Housing; management plans or handover plans to local authorities for technical infrastructure projects after completion of the investment and construction;
đ) Responsibilities of local authorities and investors in implementing the project and constructing social infrastructure projects within the project area, except where the project area already has social infrastructure projects;
2. For cases stipulated in Clauses 4, 5, and 6 of Article 9 of this Decree, the documents for requesting approval of the investment proposal shall include:
a) Legal documents of the entity assigned as the investor, including proof of real estate business functions, legal status, financial capacity, and experience of the investor as prescribed by law; if the investor has not yet been selected, there shall be a report on the selection method and anticipated conditions for selecting the investor;
b) A document proposing approval of the housing construction project, specifying the legal basis for the request, the contents proposed for approval as stipulated in Clause 2 of Article 11 of this Decree, reasons for the request, and evidence of the project's alignment with the approved local housing development program;
c) Decision approving the master plan accompanied by detailed planning drawings of the area with the project, approved by the competent authority;
d) Contents of the approved local housing development program relevant to the implementation of the project requiring approval of the investment proposal;
3. Procedures for approving the investment proposal for housing construction projects as stipulated in Clauses 4, 5, and 6 of Article 9 of this Decree shall be carried out as follows:
a) In cases of approval of the investment proposal as stipulated in Clause 4 of Article 9 of this Decree, the Department of Construction shall take the lead in preparing the documents and submit a report to the provincial People's Committee to request the Ministry of Construction to review; if the project uses paddy land, protective forest land, or special-use forest land, the provincial People's Committee must also seek opinions from the Ministry of Natural Resources and Environment. After reviewing, the Ministry of Construction shall submit a report to the Prime Minister for approval of the investment proposal;
The time for review and reporting to the Prime Minister for approval of the investment proposal is 30 days from the date the Ministry of Construction receives all the documents for review from the provincial People's Committee; the time for the Ministry of Natural Resources and Environment to provide comments (if applicable) is 15 days from the date of receipt of complete valid documents;
b) In cases of approval of the investment proposal as stipulated in Clause 5 of Article 9 of this Decree, the Department of Construction shall take the lead in preparing the documents and submit a report to the provincial People's Committee to seek opinions from the same-level People's Council before approving the investment proposal;
c) In cases of approval of the investment proposal as stipulated in Clause 6 of Article 9 of this Decree, the Department of Construction shall take the lead in reviewing and submitting a report to the provincial People's Committee to issue a document approving the investment proposal;
4. After receiving the decision or document approving the investment proposal for the housing construction project from the competent state agency, the provincial People's Committee shall direct the implementation of preparatory steps and execution of the project according to the provisions of the law.
Article 11. Content of the decision or approval document for the investment orientation of housing construction projects
1. In cases prescribed in Clause 2, Clause 3 of Article 9 of this Decree, in addition to the content of the investment orientation decision as stipulated by the Public Investment Law and the Investment Law, the competent authority must also decide on the name of the project according to Point a of Clause 2 hereof and the contents prescribed in Clause 1 of Article 10 of this Decree.
2. In cases prescribed in Clauses 4, 5, and 6 of Article 9 of this Decree, the content of the approval document for the investment orientation includes:
a) The name of the project in Vietnamese; if it is a commercial housing investment project and the investor wishes to name it in a foreign language, then the full name in Vietnamese must be written first followed by the name in the foreign language;
b) The name of the investor (if the investor has been selected);
c) Location, boundary, land area scale of the project; if there is use of paddy land, protective forest land, special-use forest land, the converted land use area must be clearly stated;
d) Objectives of the project; investment form;
đ) Main content of the project (tasks to be implemented, quantity of each type of housing to be constructed, total floor area of housing construction, implementation plan);
e) Total investment amount; sources of investment capital;
g) Land allocation method, land lease, transfer of land use rights (if applicable); land area for social housing construction, rental housing; floor area of housing that must be reserved for rental;
h) Infrastructure works that the investor manages or must transfer to the State upon completion of construction;
i) Timeframe and progress of the project; phased investment (if applicable);
k) State support mechanisms and incentives for the project and conditions for application (if applicable); responsibilities of the investor and local authorities in implementing the project;
l) Validity period of the approval document for the investment orientation.
3. The Ministry of Construction shall provide specific guidance on the procedures and formalities for requesting approval of the investment orientation, sample request documents, and sample approval documents for the investment orientation in cases prescribed in Clauses 4, 5, and 6 of Article 9 of this Decree.
Article 12. Content of the project investment dossier for housing construction
1. For housing construction projects under the scope prescribed in Clause 2 of Article 17 of the Housing Law, the explanatory section includes:
a) The name of the project as specified in Point a of Clause 2 of Article 11 of this Decree;
b) The necessity and legal basis of the project;
c) Objectives, investment form; location; scale of the project; land use needs; natural conditions of the area where the project is located;
d) Implementation solutions: Compensation, land clearance, support, resettlement plans (if applicable); construction technology plan; construction standards and regulations applicable to the project; environmental impact assessment; fire prevention and firefighting plans; technical infrastructure solutions and connection with the common technical infrastructure of the area; ability to utilize social infrastructure of the area;
đ) Public parking areas and parking areas for households and individuals living in the project area after completion of housing construction (including bicycles, motorbikes, cars, and disabled persons' vehicles);
e) Areas for constructing social infrastructure systems (kindergartens, schools, healthcare facilities, services, sports, entertainment, parks), except where the project area already has social infrastructure;
g) Quantity and proportion of various types of housing (including individual houses, apartments), total floor area of housing construction; land area for social housing construction or floor area for social housing (if applicable); product consumption plan (number of houses for sale, rent, or rent-to-own);
h) Proposals regarding applicable mechanisms for the project (regarding planning, building density, finance, and other mechanisms);
i) Total investment amount, sources of investment capital, methods of raising capital, ability to repay capital, ability to recover capital;
k) Responsibilities of the State for the construction of technical infrastructure outside the fence and through the project;
l) Timeframe and progress of the project (progress by each phase) and project management form;
m) Works transferred to the State without compensation; works or areas within the project that the investor can organize management after completing the investment and construction;
n) Organization and operation management plan for the project and public works within the project (organizational model, management operation form, service fees);
2. For the basic design portion of housing construction projects under the scope prescribed in Clause 2 of Article 17 of the Housing Law, they shall be carried out in accordance with laws on construction.
3. In cases of housing construction on land acquired through auction as prescribed in Point a of Clause 1 of Article 18 of this Decree, after winning the auction, the successful bidder must implement the establishment, review, approval, and execution of the housing construction investment project in accordance with the Housing Law and this Decree; if the investor wishes to transfer land use rights through lot division and sale in this project, they must comply with relevant laws on land and related laws.
Article 13. Establishment, Review, and Approval of Housing Investment Projects
1. For housing investment projects funded from sources specified in Clause 3, Article 36 and Clause 1, Article 53 of the Law on Housing (excluding housing construction projects for official residence as stipulated in Clause 2 of this Article), such projects shall be established, reviewed, and approved in accordance with laws on public investment and construction; the Ministry of Construction shall provide comments on housing-related contents if the project is approved by the Prime Minister, while the Department of Construction shall provide comments on housing-related contents if the project is approved by the People's Committee at provincial level.
In cases where the Minister of Construction approves housing investment projects within the scope of authority prescribed by the Law on Public Investment, the Ministry of Construction shall organize the review of the project before approval.
2. For housing construction projects for official residence, such projects shall be established, reviewed, and approved in accordance with the provisions of Article 23 of this Decree.
3. For housing investment projects not falling under the scope specified in Clauses 1 and 2 of this Article, the establishment, review, and approval of the project shall be carried out in accordance with laws on construction.
4. For projects falling under the scope specified in Clauses 2, 3, 4, and 5 of Article 9 of this Decree, except for projects approved by the Ministry of Construction, after approving the project, the investor must submit one set of project files to the Ministry of Construction for monitoring and inspection.
Article 14. Housing Investment Projects Implemented Under the Build-Transfer Model
1. Based on the construction planning already approved by the competent authority, the Department of Construction shall be responsible for compiling a list of housing investment projects implemented under the build-transfer model (BT), including social housing and resettlement housing, and determining the conditions for selecting BT investors to report to the Provincial People's Committee for approval and public announcement on the website of the Provincial People's Committee and the Department of Construction so that eligible and capable investors can register to participate.
2. The investor of a housing construction project under the BT model is defined as follows:
a) For the construction of housing for resettlement purposes, the investor is defined in Clause 2, Article 38 of the Law on Housing;
b) For the construction of social housing, the investor is defined in Article 57 of the Law on Housing.
3. The selection of BT investors for housing construction projects shall be conducted in accordance with the bidding laws if there are two or more investors registering as the investor or through the designation of the investor if only one investor registers as the investor. The Department of Construction shall take the lead in advising the Provincial People's Committee to implement the selection of investors as prescribed in this Clause; in cases where the project requires a decision or approval of the investment policy from the Prime Minister, the Provincial People's Committee must complete the procedures to request the Prime Minister to make a decision or approve the investment policy before selecting the BT investor.
4. After the results of the investor selection are obtained, the Department of Construction shall report to the Provincial People's Committee for consideration to sign the BT contract or authorize the Department of Construction to sign the BT contract. The BT investor shall be responsible for organizing the preparation and submitting to the competent authority for review and approval of the detailed planning at a scale of 1/500 (in cases where the project area does not yet have a detailed plan at a scale of 1/500) and organizing the preparation of the housing construction investment project for review and approval in accordance with Article 13 of this Decree.
5. After completing the investment and construction of the housing project according to the BT contract and accepting the completion inspection, the BT investor shall be responsible for transferring the housing fund to the Department of Construction for management and exploitation.
6. Payment to the BT investor shall be carried out in accordance with current laws.
Article 15. Implementation of housing construction investment projects
1. The investor of a housing construction project must comply with the provisions of the Law on Housing, this Decree, and laws on construction when implementing investment in housing construction.
2. The investor of the project must construct a synchronized system of technical infrastructure and social infrastructure according to the content and schedule of the project that has been approved; in cases where social infrastructure projects must be constructed according to the decision approving the project or according to the decision or approval document for the investment proposal of the competent state agency, they must implement according to the content and schedule of the project that has been approved and according to the content of the approval document.
Article 16. Completion of the investment construction phase of housing projects
When completing the investment construction, the investor of the housing construction project must fulfill the following requirements:
1. Report to the Construction Department at the location of the project about the results of the project; for housing construction projects that must have a decision or approval document for the investment proposal from the Prime Minister, the investor must also submit a report to the Ministry of Construction.
2. Complete all files and documents required for archival purposes in accordance with the Law on Housing, this Decree, and laws on construction.
3. Conduct final acceptance of the housing works and technical infrastructure, social infrastructure serving residential needs within the project in accordance with the provisions of laws on construction.
4. Transfer technical infrastructure and social infrastructure to local authorities or specialized management agencies according to the content of the project that has been approved or manage them according to the approval document or investment proposal decision. Handing over houses to users can only be carried out after the completion of the final acceptance and putting into use of housing works and social infrastructure works serving residential needs as specified in the approved project content in accordance with the provisions of laws on construction.
5. Submit final settlement reports in accordance with the provisions of laws on finance.
6. Process procedures to request the competent authority to issue Certificates of Ownership for houses within the scope of the project for the owners in accordance with the Law on Housing, this Decree, and laws on land.
7. Coordinate with local authorities to resolve administrative management issues in the area of the project.
8. Organize operation management of works not transferred to local authorities or specialized management agencies.
9. Fulfill other tasks as prescribed by law.
Article 17. Management of individual housing areas in housing construction investment projects in
1. The investor is responsible for organizing the management of the exterior architecture of individual houses and the use, maintenance of technical infrastructure, and social infrastructure serving the owners and users of individual houses within the project according to the content of the project that has been approved.
2. The investor may divide and name each area of individually planned and constructed houses within the project to facilitate management. For social housing and resettlement housing construction projects, the investor must name them in Vietnamese; for commercial housing construction projects, naming the project and areas within the project must comply with Clause 3 of Article 19 of the Law on Housing and be clearly stated in the decision or approval document for the investment proposal (if it falls under the category requiring approval of the investment proposal) or must be approved by the provincial People's Committee if it does not fall under the category requiring application for a decision or approval of the investment proposal.
3. After houses are handed over and put into use, the investor may organize the establishment of a Residents' Self-Management Board to manage the maintenance of the exterior architecture of houses, care for greenery and flower gardens, and maintain utility works or technical infrastructure serving that housing area, except for infrastructure systems that have been handed over to the State or entrusted by the State to the investor for management and maintenance. The composition of the Residents' Self-Management Board includes representatives of the owners and users of that area and representatives of the investor (if any).
4. Owners and users of houses in the individual housing area organize meetings to unify the election of the Residents' Self-Management Board (including the number and participants), approve the charter, term of operation of the Residents' Self-Management Board, management and use regulations of the housing area, and decide on contributions to cover payment for remuneration of Board members and services for caring for greenery and flower gardens, maintaining utility works serving that housing area.
5. The first organization of the election of the Residents' Self-Management Board is the responsibility of the investor to host; subsequent organizations are the responsibility of the Residents' Self-Management Board to carry out or delegate the investor to organize and implement; in cases where owners and users of houses cannot agree on the election of the Residents' Self-Management Board, the investor is responsible for managing this housing area according to the content of the project that has been approved.
6. The investor may provide additional funding for the Residents' Self-Management Board to care for greenery and flower gardens and maintain utility works or technical infrastructure serving that housing area. The implementation of the tasks stipulated in this Clause is undertaken by the investor; if the investor does not implement, the Residents' Self-Management Board hires another capable entity to do so.
Section 2
DEVELOPMENT OF COMMERCIAL HOUSING
Article 18. Procedures and formalities for selecting the project investor for commercial housing construction projects
1. In cases where the State grants land or leases land for housing construction, the selection of the project investor shall be carried out in accordance with the following provisions:
a) For areas where compensation and clearance have been completed, the project investor shall be selected through a public auction of land use rights; the time and procedures for the public auction of land use rights shall be implemented in accordance with the laws on land and the laws on public auctions.
In cases where the auctioned land belongs to an area that has been planned for investment in housing construction according to a project, organizations and individuals participating in the public auction of land use rights in this area must meet the conditions to become project investors as stipulated in Article 21 of the Law on Housing, Clause 2 of Article 119 of the Land Law, and the laws on real estate business; the organization winning the auction must establish, review, approve, and implement the project in accordance with Articles 12, 13, 15, 16, and 17 of this Decree.
b) For areas where compensation and clearance have not yet been completed, the project investor shall be selected through a bidding process if there are multiple investors meeting the conditions stipulated in Article 21 of the Law on Housing who have registered to participate as project investors; in cases where only one investor meeting the conditions stipulated in Article 21 of the Law on Housing has registered to participate, such investor shall be designated as the project investor. The Construction Department shall take the lead in assisting the Provincial People's Committee in organizing the bidding process to select the project investor as provided in this point. The time and procedures for the bidding process to select the project investor shall be carried out in accordance with the laws on bidding.
c) The Provincial People's Committee is the competent authority to decide on the selection of the project investor in cases specified in points a and b of this clause.
2. In cases where organizations, households, or individuals legally possess residential land use rights, which are consistent with the housing construction planning and land use planning and plan approved by competent authorities, and meet the conditions to become project investors as stipulated in Article 21 of the Law on Housing and have the need to participate in housing construction investment, the Construction Department shall inspect and report to the Provincial People's Committee to decide on entrusting such investor with the role of project investor.
The time limit for selecting the project investor as stipulated in this clause is thirty days, starting from the date when the Construction Department receives the registration document for becoming a project investor.
3. In cases where the project falls under the category requiring approval of the investment proposal by the Prime Minister as stipulated in Clause 4 of Article 9 of this Decree, the Provincial People's Committee must complete the necessary procedures to request the Prime Minister to issue an approval of the investment proposal in accordance with Articles 10 and 11 of this Decree before implementing the selection of the project investor; if the project falls under the category stipulated in Clause 5 of Article 9 of this Decree, the Construction Department must report to the Provincial People's Committee to obtain an approval of the investment proposal before implementing the selection of the project investor.
4. The Ministry of Construction shall provide detailed guidance on the legal documents required for registering as a project investor and the procedures for selecting the project investor as stipulated in this Article.
Article 19. Signing contracts for raising capital for the development of commercial housing
1. The signing of contracts for raising capital to invest in commercial housing construction can only be carried out through the forms prescribed in Clauses 2, 3, and 4 of Article 69 of the Law on Housing; in cases where the contract for raising capital is signed contrary to the provisions of Article 68, Article 69 of the Law on Housing, and the provisions of this Article, it will not be recognized by law, the project investor will be subject to penalties under the law, and must compensate for losses suffered by capital contributors.
2. The signing of contracts for raising capital for the development of commercial housing must comply with the following provisions:
a) In cases where the contract for raising capital is signed in accordance with Clause 2 of Article 69 of the Law on Housing, it must meet the forms and conditions prescribed by the Law on Housing and Clause 3 of this Article.
Capital contributors, joint venture partners, business cooperation partners, joint venture partners, and associated partners as stipulated herein may only share profits (in cash or shares) based on the agreed contribution ratio in the contract; the project investor may not apply the form of raising capital prescribed herein or other forms of raising capital to distribute housing products or to prioritize registration, deposit, purchase rights, or to distribute land use rights in the project to the capital-raised party, except in cases where capital contributions are made to establish a new legal entity to be entrusted by the State as the project investor for housing construction.
b) In cases where contracts for the sale, lease, or lease-purchase of future housing are signed in accordance with Clause 3 of Article 69 of the Law on Housing, they must comply with the conditions and forms for the sale, lease, or lease-purchase of future housing as prescribed by the laws on real estate business.
The project investor must submit a letter to the Construction Department at the location of the housing accompanied by documents proving that the housing meets the conditions for sale or lease-purchase as stipulated in Clause 1 of Article 55 of the Law on Real Estate Business; in cases where the project investment or housing intended for sale or lease-purchase is mortgaged, the project investor must submit documents proving that the mortgage has been released or a consensus document between the buyer, lessee, and mortgagee regarding the non-release of the mortgage and the right to sell or lease-purchase the housing; in cases where there is no mortgage on the project or housing intended for sale or lease-purchase, the project investor must clearly state their commitment to responsibility in the letter submitted to the Construction Department.
Within fifteen days from the date of receiving the application file from the investor, the Department of Construction must examine the file; if the file contains all required documents as stipulated herein, the Department of Construction must issue a notification stating that the housing unit meets the conditions for sale or lease purchase and send it to the investor; if the file does not contain all required documents, it must issue a document clearly stating the reasons. In the case where the investor has submitted the file but exceeded the time limit specified herein and the Department of Construction has not issued a notification, and the housing unit already meets the conditions for sale or lease purchase, the investor is entitled to sign a sales or lease purchase contract for future housing units but shall bear responsibility for such sales or lease purchase; the Department of Construction shall be responsible for issuing or failing to issue a notification regarding the housing unit meeting the conditions for sale or lease purchase after receiving the application file from the investor.
In the event that the Department of Construction issues a notification stating that the housing unit meets the conditions for sale or lease purchase, but the investor does not sell or lease purchase the housing unit and instead pledges it, the sale or lease purchase of this housing unit after pledging can only be carried out when it meets the conditions and receives a notification from the Department of Construction as stipulated herein;
c) In the case of borrowing funds from financial institutions or financial organizations or issuing bonds to raise the remaining capital to serve the construction of housing units, they must meet the conditions agreed upon in the loan contract or the regulations on bond issuance.
3. The raising of capital for investment in housing construction as prescribed in Point a Clause 2 of this Article must be through a joint venture agreement or a cooperation investment agreement or a business cooperation agreement; the investor may only enter into these agreements after meeting the following conditions:
a) Having an approved housing development project file in accordance with the provisions of the law;
b) The housing development project has completed land clearance according to the approved project implementation schedule;
c) Having a handover record of the boundary markers of the project;
d) Receiving a notification from the Department of Construction at the location of the project stating that the conditions for raising capital have been met. The investor must submit a document along with proof of meeting the conditions for raising capital as stipulated in Points a, b, and c of this Clause to the Department of Construction requesting a notification of meeting the conditions for raising capital for housing construction investment.
Within fifteen days from the date of receiving the application file from the investor, the Department of Construction must examine the file; if the file contains all required documents as stipulated herein, the Department of Construction must issue a notification stating that the housing unit meets the conditions for raising capital and send it to the investor; if the file does not contain all required documents proving the conditions for raising capital, it must issue a document clearly stating the reasons. In the case where the conditions for raising capital as stipulated in Points a, b, and c of this Clause have been met and the investor has submitted the application file but exceeded the time limit specified herein and the Department of Construction has not issued a notification, the investor is entitled to sign a capital-raising contract but shall bear responsibility for such capital-raising; the Department of Construction shall be responsible for issuing or failing to issue a notification regarding meeting the conditions for raising capital after receiving the application file from the investor.
4. Organizations and individuals raising capital as prescribed in Clause 1 and Clause 2 of this Article must use the raised capital for the specific purpose of constructing housing units at the project; strictly prohibiting the investor from raising more than the amount of advance payment for purchasing or leasing housing units as stipulated by law; in the case of misusing the raised capital or appropriating the raised capital or raising more than the advance payment for purchasing or leasing housing units, they must return the improperly raised capital, compensate (if causing damage), and be subject to administrative penalties under the law on administrative penalties or criminal liability under the law on criminal responsibility.
5. The Ministry of Construction shall provide detailed guidance on raising capital as prescribed in Clause 2 and Clause 3 of this Article.
Section 3
DEVELOPMENT OF PUBLIC HOUSING
Article 20. Plan for Developing Public Housing
1. The establishment and approval of the plan for developing public housing shall be carried out in accordance with the provisions of Clause 3, Article 27 of the Law on Housing.
2. The contents of the plan for developing public housing include determining the type and quantity of housing (individual houses, apartment units); total usable area of housing; construction location and land area for investment in building housing or the number and type of commercial housing to be purchased or rented for public housing purposes; sources of capital and methods of raising capital for investment in building or purchasing or renting commercial housing for public housing purposes; annual and five-year investment phases; anticipated progress schedule for implementing the plan; determination of responsibilities of the main agencies drafting the plan and cooperating agencies.
3. Central agencies specified in Point a, Clause 3, Article 27 of the Law on Housing shall have the responsibility to determine the demand for public housing according to the form guided by the Ministry of Construction and submit it to the Ministry of Construction for review; after reviewing the demand for public housing of central agencies, the Ministry of Construction will develop the plan for developing public housing to report to the Prime Minister for approval.
4. The Ministry of National Defense and the Ministry of Public Security shall have the responsibility to draft the plan for developing public housing for their own units and send the unified opinion of the Ministry of Construction. After receiving the unified opinion of the Ministry of Construction, the Ministry of National Defense and the Ministry of Public Security shall report to the Prime Minister for approval of the plan.
5. For localities, the Department of Construction shall take the lead and coordinate with relevant agencies of the locality to develop the plan for developing public housing to submit to the People's Committee of the province for approval within the local housing development plan or approve a separate plan for developing public housing and report to the Ministry of Construction for consolidation.
6. The Ministry of Construction shall provide specific guidance on the procedures and formalities for determining the demand for public housing and approving the plan for developing public housing.
Article 21. Forms of Investment in Building Public Housing
The State directly invests using budget funds, including central and local budgets, to build public housing or purchase commercial housing for public housing purposes.
The allocation of budget funds for investment in building or purchasing commercial housing for public housing purposes must be based on the plan for developing public housing, the investment project for building or purchasing commercial housing for public housing purposes that has been approved by the competent authority, in accordance with the laws on the state budget and public investment.
Article 22. Procedures and Formalities for Selecting the Project Investor for Building Public Housing
1. In cases where the investment project for building public housing is approved by the Prime Minister for lease to the target groups of central agencies (excluding the target groups specified in Point d, Clause 1, Article 32 of the Law on Housing), the Ministry of Construction shall propose the unit to be the investor and report to the Prime Minister for decision.
Within a maximum period of 30 days from the date of receipt of the Memorandum from the Ministry of Construction, the Prime Minister shall issue a decision on selecting the investor or delegate the Ministry of Construction to select the investor for the project.
2. In cases where the investment project for building public housing is approved by the Ministry of National Defense or the Ministry of Public Security for lease to the target groups specified in Point d, Clause 1, Article 32 of the Law on Housing, the Ministry of National Defense or the Ministry of Public Security shall decide on selecting the investor.
Within 30 days from the date of receipt of the application to become the investor, the Minister of National Defense or the Minister of Public Security shall issue a decision on selecting the investor.
3. In cases where the investment project for building public housing is approved by the People's Committee of the province, the selection of the investor shall be carried out as follows:
a) The Department of Construction shall report to the People's Committee of the province for a decision on selecting the investor or delegate the People's Committee of the district to make a decision on selecting the investor if the People's Committee of the province delegates the People's Committee of the district to approve the project;
b) Within a maximum period of 30 days from the date of receipt of the Memorandum from the Department of Construction, the People's Committee of the province must issue a decision on selecting the investor or delegate the People's Committee of the district to issue a decision on selecting the investor; within a maximum period of 30 days from the date of receipt of the delegation document from the People's Committee of the province, the People's Committee of the district must issue a decision on selecting the investor for the project for building public housing.
4. The investor of the project for building public housing specified in Clause 1, Clause 2, and Clause 3 of this Article may be an organization, a state agency, or a real estate business enterprise.
5. The Ministry of Construction shall provide specific guidance on the documentation and procedures for selecting a real estate business enterprise to register as the investor for the project for building public housing.
Article 23. Establishment, Review, and Approval of Projects for Construction of Official Housing
1. Projects for construction of official housing shall be established, reviewed, and approved in accordance with the Law on Housing, this Decree, and laws on construction.
2. For projects decided to be invested in by the Prime Minister pursuant to Point a, Clause 2, Article 28 of the Law on Housing, the Ministry of Construction shall organize the establishment, review, and submit to the Prime Minister for approval; in cases where the Prime Minister delegates authority, such projects shall be approved according to the delegation of the Prime Minister.
3. For projects decided to be invested in by the Ministry of National Defense and the Ministry of Public Security pursuant to Point b, Clause 2, Article 28 of the Law on Housing, the Ministry of National Defense and the Ministry of Public Security shall organize the establishment, review, and seek the unified opinion of the Ministry of Construction before reporting to the Prime Minister for approval. After receiving the Prime Minister's approval, the Ministry of National Defense and the Ministry of Public Security shall approve the project.
4. For projects decided to be invested in by provincial People's Committees pursuant to Point c, Clause 2, Article 28 of the Law on Housing, the Department of Construction shall organize the establishment, review, and submit to the provincial People's Committee for approval.
In cases where houses are constructed to allocate for lease to individuals assigned or transferred to work at district, county, town, or city-level provincial units as specified in Points c, d, e, and g, Clause 1, Article 32 of the Law on Housing, the provincial People's Committee may delegate authority to the district People's Committee to approve the project.
Article 24. Purchase of Commercial Housing for Official Housing
1. Where there is insufficient official housing stock on the territory but commercial housing built under a project meets the quality standards stipulated by laws on construction and is suitable for the type and area standards of official housing, the competent authority specified in Clause 2, Article 28 of the Law on Housing may purchase such housing for official housing purposes.
2. The purchase of commercial housing for official housing purposes shall be regulated as follows:
a) In cases where housing is used for tenants from central agencies (excluding those specified in Point d, Clause 1, Article 32 of the Law on Housing), the Ministry of Construction shall take the lead and coordinate with the Ministry of Finance to establish a project to report to the Prime Minister for approval or implement approval if delegated by the Prime Minister;
b) In cases where housing is used for tenants specified in Point d, Clause 1, Article 32 of the Law on Housing, the Ministry of National Defense and the Ministry of Public Security shall organize the establishment of a project, seek the unified opinion of the Ministry of Construction, the Ministry of Finance, and the Ministry of Planning and Investment before submitting to the Prime Minister for approval; after receiving the Prime Minister's approval, the Ministry of National Defense and the Ministry of Public Security shall approve the project to purchase housing;
c) In cases where housing is used for local tenants, the Department of Construction shall take the lead and coordinate with the Department of Finance to establish a project and report to the provincial People's Committee for approval;
d) The content of the project to purchase commercial housing for official housing purposes shall include location, type of house, number of houses, usable area of each type of house, price of housing purchase, related costs, funding source for purchasing housing, payment method for housing purchase, contracting agency for the sale and purchase of housing, management agency responsible for housing after purchase, and responsibilities of relevant agencies in implementing the project.
3. The procedures for purchasing commercial housing for official housing purposes shall be carried out as follows:
a) Based on the content of the approved housing purchase project, the agency entrusted as the project owner shall sign a sales and purchase contract with the developer of the commercial housing project; the signing of the sales and purchase contract shall comply with regulations on the sale and purchase of commercial housing;
b) Based on the signed sales and purchase contract, the developer of the commercial housing project shall be responsible for delivering the housing and providing legal documents related to the purchased housing to the buyer;
c) After receiving the delivered housing, the project owner of the official housing project shall manage and lease the housing in accordance with the Law on Housing and this Decree;
d) The developer of the commercial housing project shall be responsible for processing the application for the issuance of the Certificate of Ownership to the buyer; in cases specified in Point a, Clause 2 of this Article, the Ministry of Construction shall represent the name on the Certificate of Ownership; in cases specified in Point b, Clause 2 of this Article, the Ministry of National Defense shall represent the name on the Certificate of Ownership for housing purchased by the Ministry of National Defense, and the Ministry of Public Security shall represent the name on the Certificate of Ownership for housing purchased by the Ministry of Public Security; in cases specified in Point c, Clause 2 of this Article, the representative name on the Certificate of Ownership shall be the provincial People's Committee or the Department of Construction (if authorized by the provincial People's Committee).
The procedures for issuing Certificates of Ownership to the agencies specified herein shall be carried out in accordance with the laws on land.
Article 25. Leasing Commercial Housing for Official Housing
1. In cases where there is not enough official housing fund available for leasing on the territory and there is commercial housing that meets quality standards and is suitable to the type and area standard of official housing, the competent authority prescribed in Clause 2, Article 28 of the Law on Housing may lease such housing for official housing purposes.
2. The leasing of commercial housing for official housing shall be carried out as follows:
a) In cases where housing is used for leasing to the target groups of central agencies (excluding the target groups prescribed in Point d, Clause 1, Article 32 of the Law on Housing), the Ministry of Construction shall take the lead and coordinate with the Ministry of Finance to report to the Prime Minister for consideration and decision;
b) In cases where housing is used for leasing to the target groups prescribed in Point d, Clause 1, Article 32 of the Law on Housing, the Ministry of National Defense and the Ministry of Public Security shall seek the unified opinion of the Ministry of Construction and the Ministry of Finance before submitting to the Prime Minister for approval; after receiving the Prime Minister's approval, the Ministry of National Defense and the Ministry of Public Security shall decide to lease the housing;
c) In cases where housing is used for leasing to the target groups of local authorities, the Department of Construction shall take the lead and coordinate with the Department of Finance to report to the People's Committee of the province for decision;
d) The content of the proposal for leasing commercial housing for official housing purposes shall include location, address, type of housing, number of housing units, usable area of each type of housing, rental price of housing, rental period, related costs, funding source arranged for leasing housing, responsible agency for payment of rent, agency signing the lease contract and managing the housing after leasing.
3. Based on the approval opinion of the competent authority prescribed in Clause 2 of this Article, the agency entrusted with managing the housing shall implement the lease contract with the owner of the commercial housing, then sign a sublease contract with the person renting official housing and bear responsibility for managing the housing. The signing of the lease contract with the owner of the commercial housing shall be carried out according to the regulations on leasing commercial housing; the signing of the sublease contract with the person renting official housing shall be carried out according to the guidelines of the Ministry of Construction.
Section 4
DEVELOPMENT OF HOUSING TO SERVE RESIDENTIAL RELOCATION
Article 26. Forms of Investment in Building Housing to Serve Residential Relocation
The investment in building housing to serve residential relocation shall be implemented through the following forms:
1. The State directly invests using the capital prescribed in Clause 3, Article 36 of the Law on Housing to build housing or purchase commercial housing to serve residential relocation.
2. The State invests in building housing through the Build-Transfer (BT) form as prescribed in Article 14 of this Decree.
3. The developer of a commercial housing project or an industrial zone infrastructure project implements investment in building housing to serve residential relocation as prescribed in Clause 3 and Clause 4, Article 35 of the Law on Housing.
Article 27. Selection of Developers for Housing Construction Projects to Serve Residential Relocation
1. The developer of a housing construction project to serve residential relocation is organizations prescribed in Clause 2, Article 38 of the Law on Housing.
2. The selection of developers for housing construction projects to serve residential relocation shall be regulated as follows:
a) For projects investing in building housing using the capital prescribed in Clause 3, Article 36 of the Law on Housing to serve national key projects, the Ministry of Construction shall propose the unit to be the developer and report to the Prime Minister for decision or authorize the Minister of Construction to make the selection decision;
b) For projects investing in building housing using the capital prescribed in Clause 3, Article 36 of the Law on Housing but not falling under the provisions of Point a of this Clause, the Department of Construction shall propose the unit to be the developer and report to the People's Committee of the province for decision;
c) For projects investing in building housing using other sources of capital other than the capital prescribed in Clause 3, Article 36 of the Law on Housing but falling under the provisions of Clause 3, Article 26 of this Decree, the developer of the commercial housing project or the industrial zone infrastructure project shall be the developer of the project; in other cases, the developer shall be selected through public bidding. In cases of building housing through the BT form, the developer shall be selected according to the provisions of Article 14 of this Decree.
3. In cases where a real estate business enterprise is selected as the developer of a housing construction project to serve residential relocation, the registration dossier for the developer shall be regulated as follows:
a) For projects investing in building housing using the capital prescribed in Clause 3, Article 36 of the Law on Housing, the registration dossier for the developer shall be applied as in the case of selecting the developer of a housing construction project for official use;
b) For projects investing in building housing using other sources of capital other than the capital prescribed in Clause 3, Article 36 of the Law on Housing, the registration dossier for the developer shall be applied as in the case of selecting the developer of a commercial housing construction project.
4. The procedures for selecting the developer of a housing construction project to serve residential relocation shall be regulated as follows:
a) For cases prescribed in Point a, Clause 2 of this Article, the Ministry of Construction shall review the registration dossier for the developer and report to the Prime Minister for decision or authorize the Ministry of Construction to make the selection decision;
b) For cases prescribed in Point b, Clause 2 of this Article, the Department of Construction shall review the registration dossier for the developer and report to the People's Committee of the province for decision;
c) For cases prescribed in Point c, Clause 2 of this Article and selected through public bidding, it shall be carried out according to the provisions of Point b, Clause 1, Article 18 of this Decree; in cases of building housing through the BT form, it shall be carried out according to the provisions of Article 14 of this Decree;
d) The time limit for selecting the developer prescribed in Points a and b of this Clause shall be a maximum of 30 days from the date of receipt of all valid dossiers; in cases prescribed in Point c of this Clause, the time limit shall be carried out according to the legal regulations on public bidding (if public bidding is organized) or according to the procedures for selecting BT investors (if selected through the BT form).
Article 28. Purchase of commercial housing and use of social housing for resettlement
1. The purchase of commercial housing and the use of social housing to serve resettlement must be based on Article 35, Article 39 of the Law on Housing and compensation, support, and resettlement plans approved by competent authorities.
2. In cases where commercial housing must be used to serve resettlement according to Paragraphs 1 and 2 of Article 35 of the Law on Housing, the following shall be implemented:
a) The unit entrusted by the State to arrange housing for resettlement shall be responsible for determining the location of the investment project for constructing commercial housing to be purchased and discussing with the investor about the plan to purchase housing; based on discussions with the investor, the unit entrusted to arrange resettlement shall establish a plan to purchase housing, specifying the legal documents of the investment project for constructing housing, location, quantity, area of each type of housing, estimated purchase price, handover schedule, and report to the Department of Construction if there is a project.
Within thirty days from the date of receiving the proposal letter from the unit entrusted to arrange resettlement accompanied by the housing purchase plan and legal documents of the project, the Department of Construction shall be responsible for leading and coordinating with financial, natural resources, and environmental agencies at the local level to review and submit the plan for approval by the provincial People's Committee.
b) The purchase price of commercial housing for resettlement shall be determined based on market prices at the time of sale, including land use fees; in case the leading agency and cooperating agencies cannot agree on the purchase price plan, they may hire an independent valuation unit to calculate the price; the cost of hiring the valuation unit shall be included in the budget for purchasing commercial housing as stipulated in this paragraph.
Within fifteen days from the date of approval of the housing purchase plan by the provincial People's Committee, the unit entrusted by the State to arrange resettlement shall be responsible for signing a sales contract for housing with the investor of the commercial housing construction project in accordance with Article 41 of the Law on Housing.
After signing the sales contract for housing, the unit entrusted by the State to arrange resettlement housing shall notify households and individuals eligible for resettlement to sign a sales contract for housing in accordance with Article 31 of this Decree.
3. In cases where social housing is used for resettlement according to Paragraphs 1 and 2 of Article 35 of the Law on Housing, the following shall be implemented:
a) Individuals requiring to purchase, lease, or lease-purchase social housing for resettlement shall submit a request detailing their needs to the district-level People's Committee where they reside.
b) The district-level People's Committee shall be responsible for verifying and confirming that the individual has not been compensated by the State with housing or land in the request and compiling a list of individuals requiring resettlement to send to the Department of Construction for review and verification.
c) After verification, the Department of Construction shall compile a list of households and individuals eligible to purchase, lease, or lease-purchase social housing and submit a proposal requesting the provincial People's Committee to approve the list; based on the supply of social housing in the locality and the demand for social housing among individuals requiring resettlement, the provincial People's Committee shall decide to approve the list.
d) Based on the list of households and individuals approved by the provincial People's Committee, the Department of Construction shall send the list to the district-level People's Committee to notify the households and individuals, and request the investor of the social housing construction project to sign contracts for purchasing, leasing, or lease-purchasing housing according to the needs recorded in the list.
4. The signing of contracts and delivery of commercial housing or social housing for resettlement shall be carried out in accordance with Article 31 of this Decree.
Article 29. Capital for Developing Housing to Serve Resettlement
1. The mobilization of capital for developing housing to serve resettlement shall be carried out in accordance with the forms prescribed in Article 72 of the Law on Housing.
2. In cases where housing development is conducted using the capital specified in Clause 3, Article 36 of the Law on Housing, the allocation of capital shall be implemented in accordance with the laws on public investment and state budget.
3. In cases where housing development is carried out under the BT form, it shall be implemented in accordance with the provisions of Article 14 of this Decree.
4. In cases where capital is mobilized from compensation and support funds for resettlement when the State recovers land, it shall be implemented in accordance with the laws on land; if capital is mobilized from the Land Development Fund, it shall be decided by the People's Committee of the province.
5. In cases where capital is mobilized through forms such as capital contribution, joint investment, business cooperation, joint venture, and collaboration, the parties must conclude a capital contribution contract or a joint investment contract or a business cooperation contract; the party participating in capital contribution under these contracts may only share profits (in cash or shares) based on the agreed capital contribution ratio in the contract, except in cases where the owners of housing participate in capital contribution, joint investment, or business cooperation to demolish housing and invest in building housing to serve resettlement in accordance with the Law on Housing and the laws on renovation and reconstruction of apartment buildings.
6. In cases where the State advances capital from the budget to invest in constructing or purchasing housing to serve resettlement, it shall be carried out as follows:
a) Based on the compensation, support, and resettlement plan that has been approved by the competent authority, the Department of Construction shall prepare a plan for allocating and the schedule for providing housing for each resettlement housing project, including cases where resettlement is arranged to implement national key projects in the area, and report to the People's Committee of the province for approval;
b) Based on the approved resettlement housing allocation plan and the proposal of the investor, the competent authority shall decide to advance capital from the local government budget for the investor to implement the project;
c) The investor of the resettlement housing project shall be responsible for repaying the local government budget through the sale or lease-purchase of housing to households and individuals eligible for resettlement or deducting from the compensation and support funds for resettlement of households and individuals when the State recovers land and clears housing within sixty days from the date of receiving payment for the sale or lease-purchase of housing or the date of receiving compensation and support funds for resettlement.
Chapter IV
MANAGEMENT AND USE OF HOUSING
Section 1
MANAGEMENT AND USE OF HOUSING TO SERVE RESIDENTIAL RELOCATION
Article 30. Subjects and Conditions for Leasing, Lease-Purchasing, and Purchasing Housing to Serve Residential Relocation
1. The subjects eligible for leasing, lease-purchasing, and purchasing housing to serve residential relocation include:
a) Households and individuals with lawful housing subject to clearance when the State recovers land to implement projects for national defense, security, national interests, and public interest according to the planning scheme approved by the competent authority;
b) Households and individuals whose land attached to housing is recovered by the State and who must move but do not meet the conditions for land compensation under the laws on land and have no other place to live;
c) Households and individuals who are the owners of apartment buildings required to be demolished for renovation and reconstruction in accordance with Article 110 of the Law on Housing.
2. The conditions for leasing, lease-purchasing, and purchasing housing to serve residential relocation are stipulated as follows:
a) In cases where the subjects specified in Points a and b of Clause 1 of this Article wish to purchase commercial housing or lease, lease-purchase, or purchase housing to serve residential relocation invested by the State, they must be listed in the resettlement plan approved by the competent authority and submit a request for resettlement housing placement in the format issued by the Ministry of Construction;
b) In cases where the subjects specified in Points a and b of Clause 1 of this Article wish to lease, lease-purchase, or purchase social housing, they must be listed in the resettlement plan approved by the competent authority, submit a request for resettlement housing placement in the format issued by the Ministry of Construction, and must not have been compensated by the State with housing or land;
c) In cases where the subjects fall under Point c of Clause 1 of this Article, they shall be allocated resettlement housing in accordance with Articles 115 and 116 of the Law on Housing and the laws on renovation and reconstruction of apartment buildings.
Article 31. Procedures for leasing, purchasing on installment, purchasing, and handover of housing for resettlement
1. In cases of purchasing commercial housing as stipulated in Point a Clause 1 Article 41 of the Housing Law, the following shall be carried out:
a) The unit entrusted by the State to arrange housing for resettlement shall enter into a sales contract for housing with the developer of the commercial housing project; the execution of the sales contract for housing shall comply with regulations governing the sale of commercial housing;
b) Within ten days from the date of signing the sales contract for housing with the developer, the unit entrusted by the State to arrange housing for resettlement must issue a written notice to households and individuals eligible for resettlement as provided for in Article 30 of this Decree and directly sign sales contracts for housing with these entities;
c) Based on the signed sales contract for housing with the developer of the commercial housing project, the unit entrusted by the State to arrange housing for resettlement shall be responsible for receiving housing from the developer and handing it over to households and individuals purchasing housing or authorizing the developer of the commercial housing project to hand over housing to the purchasers. The handover of housing shall be carried out in accordance with the agreements in the contract, when the conditions for handing over housing as prescribed in Clause 4 Article 16 of this Decree and the laws governing real estate business are met, and must be recorded in a protocol accompanied by relevant legal documents related to the purchased housing.
2. In cases of purchasing commercial housing as stipulated in Point b Clause 1 Article 41 of the Housing Law, the following shall be carried out:
a) The unit entrusted by the State to arrange housing for resettlement shall enter into an order contract for purchasing housing with the developer of the commercial housing project;
b) Within ten days from the date of signing the order contract, the unit entrusted by the State to arrange housing for resettlement must issue a written notice to households and individuals eligible for resettlement as provided for in Article 30 of this Decree to sign sales contracts for housing with the developer of the commercial housing project; the execution of the sales contract for housing shall be carried out according to the guidelines of the Ministry of Construction;
c) Based on the signed sales contract for housing, the developer of the commercial housing project shall be responsible for handing over housing to households and individuals purchasing housing. The handover of housing must comply with the agreements in the contract, when the conditions for handing over housing as prescribed in Clause 4 Article 16 of this Decree and the laws governing real estate business are met, and must be recorded in a protocol accompanied by relevant legal documents related to the purchased housing.
3. In cases where social housing is used for resettlement housing, based on the notification of the People's Committee at the district level as prescribed in Clause 3 Article 28 of this Decree, households and individuals eligible for resettlement shall directly sign lease, lease-purchase, or purchase contracts for housing with the developer of the social housing project. The handover of housing shall be carried out according to the agreement in the contract, as prescribed in Clause 4 Article 16 of this Decree, and must be recorded in a protocol with confirmation from the unit entrusted by the State to arrange housing for resettlement, accompanied by relevant legal documents related to the leased or purchased housing.
4. In cases of purchasing, leasing, or lease-purchasing of housing for resettlement constructed by the State, households and individuals listed in the compensation and resettlement plan approved by the competent authority shall sign sales, lease, or lease-purchase contracts for housing with the developer of the housing project. The handover of housing shall be carried out according to the agreement in the contract, when the conditions for handing over housing as prescribed in Clause 4 Article 16 of this Decree are met, and must be recorded in a protocol accompanied by relevant legal documents related to the leased or purchased housing.
5. In cases of arranging housing for resettlement as prescribed in Clause 3 and Clause 4 Article 35 of the Housing Law, based on the approved compensation, support, and resettlement plan, households and individuals eligible for resettlement shall sign sales contracts for housing with the developer of the project. The execution of the sales contract for housing shall comply with regulations governing the sale of commercial housing; the handover of housing shall be carried out according to the agreement in the contract, when the conditions for handing over housing as prescribed in Clause 4 Article 16 of this Decree and the laws governing real estate business are met, and must be recorded in a protocol accompanied by relevant legal documents related to the purchased housing.
6. The developer of the housing construction project as prescribed in Clauses 1, 2, 3, 4, and 5 of this Article shall be responsible for processing procedures to request the competent authority to issue Certificates of Title for households and individuals who have purchased or lease-purchased housing for resettlement, except in cases where households and individuals voluntarily process the Certificate of Title issuance procedures; the procedures for issuing Certificates of Title shall be carried out in accordance with the laws on land.
7. The Ministry of Construction shall prescribe model contracts for purchasing, leasing, or lease-purchasing housing for resettlement as prescribed in Point b Clause 1, Clauses 2, 3, and 4 of this Article.
Article 32. Purchase Price, Rental Price, and Lease-Purchase Price for Housing to Serve Resettlement
1. In cases where households or individuals eligible for resettlement have a need to purchase housing constructed according to a project to serve resettlement or to purchase commercial housing for resettlement purposes, the sale price of such housing shall be determined in the compensation, support, and resettlement plan approved by the competent authority.
2. In cases where households or individuals eligible for resettlement have a need to rent or lease-purchase housing to serve resettlement which is invested by the State or purchased by the State for rental or lease-purchase purposes, the rental and lease-purchase prices of such housing shall be determined in accordance with the guidelines issued by the Ministry of Construction.
3. In cases where households or individuals eligible for resettlement have a need to use social housing for resettlement purposes, the purchase price, rental price, and lease-purchase price of such housing shall be determined in accordance with Articles 60 and 61 of the Law on Housing and the regulations on the management and use of social housing.
Article 33. Management and Use of Housing to Serve Resettlement resident
1. The management and use of housing to serve resettlement shall be regulated as follows:
a) The owner of resettlement housing has the responsibility to manage, operate, and maintain the housing under their ownership in accordance with the Law on Housing, this Decree, and related laws;
b) For apartment buildings, they must comply with the regulations on the management and use of apartment buildings; owners must pay maintenance fees for the common parts of the apartment building in accordance with the Law on Housing and this Decree, pay management and operation fees for the apartment building, and other service usage fees agreed upon with the service provider;
c) For housing owned by the State, they must also comply with the provisions of Chapter V of this Decree; if it is social housing, they must also comply with the regulations on the management and use of social housing;
d) For housing in rural areas, they must ensure hygiene, environmental protection, fire prevention, and firefighting; they must comply with the regulations on community cultural and civilized living habits, and the management and maintenance of technical infrastructure facilities in the area where the housing is located.
2. The exploitation of business and services within apartment buildings serving resettlement shall be regulated as follows:
a) In cases where some apartments or floors in commercial apartment buildings are purchased to serve as resettlement housing, priority shall be given to households and individuals eligible for resettlement to exploit the business and service areas within the apartment building (if any) through public auction if these entities bid at the same price as other entities in the apartment building;
b) In cases where apartment buildings are constructed for resettlement purposes, the developer must allocate at least one-third of the business and service area of the apartment building for households and individuals eligible for resettlement to lease (if there is a need) through public auction based on the principle of transparency to create employment opportunities for these households and individuals; the revenue from the business activities in the entire business and service area, after deducting reasonable business expenses, may be used by the provincial People's Committee to support the maintenance fees for the common parts and partially support the management and operation costs of housing serving resettlement in the locality;
c) The management and operation of housing specified in Points a and b of this Clause shall be carried out in accordance with the Regulations on the Management and Use of Apartment Buildings issued by the Ministry of Construction.
Section 2
MANAGEMENT AND USE OF VILLA AND APARTMENT HOUSING
Article 34. Classification and Management, Use of Detached Houses
1. Detached houses are classified into three groups as follows:
a) Group One detached houses are those classified as historical and cultural relics according to the laws on cultural heritage; detached houses with typical architectural value and ancient houses identified and listed by the Council specified in Clause 2, Article 79 of the Housing Law for submission to the approval of the Provincial People's Committee;
b) Group Two detached houses are those not covered under Point a of this Clause but have artistic, historical, and cultural value as determined and listed by the Council specified in Clause 2, Article 79 of the Housing Law for submission to the approval of the Provincial People's Committee;
c) Group Three detached houses are those not covered under Points a and b of this Clause.
2. The management, use, maintenance, and renovation of detached houses must comply with the following principles:
a) Adherence to the provisions of the Housing Law; in cases where the house is state-owned property, additional regulations on the management and use of state-owned housing must also be followed; in cases where the house has artistic, historical, and cultural value, compliance with the legal provisions on the management of cultural heritage must be observed;
b) For Group One detached houses, the external architectural appearance, internal structure, building density, number of floors, and height must remain unchanged;
c) For Group Two detached houses, the external architectural appearance must remain unchanged;
d) For Group Three detached houses, the provisions of the laws on planning, architecture, and construction must be followed.
Article 35. Prohibited Acts in the Management and Use of Apartment Buildings
1. Misusing management and operation funds, common area maintenance funds, contrary to the provisions of the Housing Law, this Decree, and the Management and Use Regulations for Apartment Buildings issued by the Ministry of Construction.
2. Causing leakage, dampness, excessive noise beyond legal limits, or improperly disposing of waste, sewage, exhaust gases, or harmful substances contrary to environmental protection laws or internal rules for managing and using apartment buildings.
3. Raising livestock or poultry within the premises of apartment buildings.
4. Painting or decorating the exterior of apartments or apartment buildings contrary to design and architectural regulations.
5. Unauthorized conversion of the function or purpose of common areas or shared-use areas of apartment buildings; unauthorized conversion of non-residential areas in mixed-use apartment buildings from their approved design or authorized purpose.
6. Prohibition of conducting the following businesses or selling goods in the commercial areas of apartment buildings:
a) Flammable and explosive materials and businesses that pose danger to the lives and property of apartment residents as stipulated by fire prevention and control laws;
b) Operating nightclubs; repairing motor vehicles; slaughtering livestock; other commercial activities causing pollution as stipulated by environmental protection laws.
In the case of operating restaurants, karaoke bars, or bars, soundproofing must be ensured, fire prevention and control requirements must be met, escape routes must be provided, and all other business conditions as prescribed by law must be adhered to.
7. Committing other prohibited acts related to the management and use of apartment buildings as stipulated in Article 6 of the Housing Law.
Article 36. Transfer of maintenance funds for the common ownership portion of multi-owner apartment buildings
1. The buyer, lessee of housing, and developer must pay 2% of the maintenance fund for the common ownership portion of the apartment building as stipulated in Article 108 of the Law on Housing; this amount shall be calculated before tax (the State does not levy tax on this amount). The developer must open a settlement account at a credit institution operating in Vietnam to receive maintenance funds from the buyer, lessee of the apartment unit or other areas in the apartment building; when opening the account, the developer must clearly state that the account name is the deposit of maintenance funds for the apartment building in the form of a term deposit.
2. The developer must uniformly record the account opened according to Clause 1 of this Article in the purchase-sale or lease-purchase contract for the apartment unit or other areas in the apartment building signed with customers (including the account number, account name, and name of the credit institution where the account is opened); the buyer, lessee must submit 2% of the maintenance fund as prescribed into the account recorded in this contract or submit it to the developer to transfer into the account recorded in the contract before receiving the handover of the housing; if the developer does not collect this fund but still hands over the apartment unit or other areas in the apartment building to the buyer, lessee, then the developer must submit this 2% fund.
3. For the area of the house that the developer retains without selling or has not yet sold or leased for purchase up to the time of acceptance for full operation of the apartment building and which falls under the category required to pay 2% maintenance fund to the Management Board of the Apartment Building (hereinafter referred to as the Management Board) according to the provisions of the Law on Housing, the developer must transfer this maintenance fund into the account established as prescribed in Clause 1 of this Article.
4. After the Management Board is established and requests the transfer of the maintenance fund that the developer is temporarily managing, the developer and the Management Board must jointly prepare the final settlement report on the maintenance fund data; based on the agreed final settlement data, the developer is responsible for transferring the maintenance fund required to be transferred according to the laws on housing to the Management Board for management through a transfer method. The procedure for establishing a management account for the maintenance fund of the Management Board and the procedures for transferring the maintenance fund for the common ownership portion of the apartment building to the Management Board are carried out according to the Regulations on the Management and Use of Apartment Buildings issued by the Ministry of Construction.
After transferring the maintenance fund to the Management Board of the apartment building, the developer must issue a written report to the Department of Construction where the apartment building is located for monitoring.
Article 37. Procedures for Forced Transfer of Maintenance Funds for the Common Ownership Portion of Apartment Buildings
1. In cases where the developer fails to transfer the maintenance fund as prescribed in Article 36 of this Decree or transfers it incompletely or late, the matter shall be resolved as follows:
a) The Management Board must issue a written request to the People's Committee of the province where the apartment building is located to require the developer to transfer the maintenance fund for the common ownership portion of the apartment building as prescribed in Article 36 of this Decree;
b) Within 15 days from the date of receipt of the Management Board's document, the People's Committee of the province must examine and inspect; if the parties have settled the maintenance fund data according to Clause 4 of Article 36 of this Decree but the developer has not yet transferred the maintenance fund, the People's Committee of the province must issue a document requiring the developer to transfer the fund to the Management Board. Within no more than 7 days from the date of receipt of the provincial People's Committee's document, the developer must transfer this maintenance fund.
If the parties have not yet prepared a final settlement report on the maintenance fund data, the parties must agree to settle the data and transfer the maintenance fund to the Management Board within 10 days from the date of receipt of the provincial People's Committee's document.
The transfer of the maintenance fund for the common ownership portion of the apartment building must be documented in a protocol confirmed by the developer and the representative of the Management Board; after transferring this fund, the developer must issue a written notice to the provincial People's Committee.
c) If the developer still fails to transfer the maintenance fund beyond the deadline specified in Point b of this Clause, the provincial People's Committee must issue a decision to enforce the recovery of the maintenance fund to transfer to the Management Board and send this decision to the developer, the Management Board, and the credit institution where the developer has an account; in the enforcement decision, the provincial People's Committee must clearly state the amount of the maintenance fund the developer must transfer after deducting the maintenance fund the developer must use for the common ownership portion (if any), the transfer deadline, enforcement measures, and the responsibilities of the relevant parties to implement this decision;
d) The enforcement measures for transferring the maintenance fund include compelling the developer to transfer the maintenance fund deposited in the account established according to Clause 1 of Article 36 of this Decree or transferring the fund from another developer's account to the account managed by the Management Board or disposing of the developer's assets. The enforcement of the transfer of the maintenance fund for the common ownership portion of the apartment building must be completed within 30 days from the date of issuance of the enforcement decision. The maintenance fund to be transferred is the entire amount of the maintenance fund (both principal and interest) based on the settled maintenance fund data; if the parties cannot agree on the final settlement data, the transfer will be made according to the data recorded in the provincial People's Committee's enforcement decision.
đ) Within three days from the date of receipt of the compulsory enforcement decision of the provincial People's Committee, the credit institution managing the account for maintenance funds of apartment buildings or managing other accounts of the developer according to the compulsory enforcement decision shall be responsible for transferring the maintenance funds to the account established by the Management Board for management and use in accordance with the laws on housing and the compulsory enforcement decision; in cases where it is necessary to dispose of the developer's assets to recover maintenance funds for the Management Board, the provincial People's Committee must specify in the compulsory enforcement decision the measures for asset disposal, the responsibilities of the unit disposing of the assets, the form of disposal, and the transfer of recovered funds to the Management Board.
During the process of enforcing the transfer of maintenance funds, if violations of criminal law by the developer are discovered, the provincial People's Committee must request the competent authority to investigate and handle them in accordance with the law.
2. The handover of maintenance funds for the common ownership of apartment buildings must be recorded in a protocol confirmed by the developer and the representative of the Management Board; in cases stipulated in Clause 1 of this Article, there must also be confirmation by the party implementing compulsory enforcement and the representative of the credit institution transferring these funds or the representative of the party disposing of the developer's assets (if applicable).
Chapter V
MANAGEMENT AND USE OF HOUSING UNDER STATE OWNERSHIP
Section 1
GENERAL PROVISIONS
Article 38. Principles for Managing and Using Housing Under State Ownership
1. Ensuring proper use for intended purposes, achieving efficiency, avoiding loss and waste; renting, leasing, and selling housing must comply with the prescribed objects, meet the required conditions, and conform to the provisions of the Law on Housing and this Decree.
2. Ensuring unified management, close cooperation, and clear division of responsibilities for management among relevant agencies and units.
3. Housing under management must ensure quality and safety for users; in cases where it is housing for resettlement, it must also comply with the provisions set out in Section 1 of Chapter IV of this Decree.
4. Exemptions and reductions in rent and purchase prices for housing must comply with the provisions of Articles 59, 66, 67, and 68 of this Decree, except for those renting official housing, student housing, and those renting housing under the provisions of Points c and d of Clause 1 of Article 61 and Clauses 1 and 3 of Article 71 of this Decree.
5. For old housing created using state budget funds or other sources of ownership that have been transferred to state ownership and allocated for residential purposes as prescribed by law (including self-managed housing), management, sale, and rental must be carried out strictly in accordance with the provisions of this Decree.
6. Any violation of regulations on managing and using housing under state ownership must be promptly and strictly handled in accordance with the law; in cases where housing is subject to recovery as prescribed in Article 84 of the Law on Housing and this Decree, after recovery, the housing management agency must manage and use such housing in accordance with the prescribed purpose.
Article 39. Agencies and Units Managing Housing Under State Ownership
1. The representative of the owner for centrally funded housing construction is specified as follows:
a) The Ministry of Construction is the representative of the owner for government official housing; social housing under state ownership constructed using central funds; student housing managed by educational institutions directly under the Ministry of Construction, excluding social housing under state ownership purchased or constructed by the Ministry of National Defense and the Ministry of Public Security as stipulated in Point b of this Clause;
b) The Ministry of National Defense and the Ministry of Public Security are the representatives of the owner for official housing and social housing under state ownership purchased or constructed by the Ministry of National Defense and the Ministry of Public Security; student housing managed by educational institutions directly under the Ministry of National Defense and the Ministry of Public Security. Specifically, for old housing managed by the Ministry of National Defense, the Ministry of National Defense is the representative of the owner for this housing, except as provided in Clause 2 of Article 64 of this Decree;
c) Other ministries, sectors, and central agencies are the representatives of the owner for official housing and student housing managed by educational institutions directly under these ministries, sectors, and central agencies.
2. The provincial People's Committee is the representative of the owner for various types of housing under state ownership assigned to manage within their jurisdiction.
3. The housing management agency is the agency designated by the owner representative stipulated in Clause 1 and Clause 2 of this Article to implement the management of housing under state ownership, including:
a) For ministries, sectors, and central agencies, it is the agency assigned the function of housing management directly under these ministries, sectors, and central agencies;
b) For localities, it is the Department of Construction;
c) Educational institutions manage housing for students that they are assigned to manage.
4. The housing operation management unit for housing under state ownership is an organization or enterprise with functions and professional capabilities in housing management and operation as stipulated in Article 105 of the Law on Housing, appointed by the housing owner representative to manage and operate housing under state ownership.
Article 40. Rights and responsibilities of the representative of the owner of state-owned housing
1. The agency representing the owner of state-owned housing as stipulated in Clause 1 and Clause 2, Article 39 of this Decree shall have the following rights and responsibilities with respect to the housing assigned for management:
a) Decide on persons renting official housing, persons renting or purchasing old housing; decide on persons renting or purchasing social housing under state ownership;
b) Select units managing and operating housing;
c) Approve plans for maintenance, renovation, demolition, and reconstruction of housing;
d) Issue or decide on rental prices, purchase prices, and sale prices of housing;
đ) Decide on the recovery of housing;
e) Other rights and responsibilities assigned by the Prime Minister according to regulations.
2. The agency representing the owner of state-owned housing as stipulated in Clause 1 and Clause 2, Article 39 of this Decree may delegate to the housing management agency as stipulated in Clause 3, Article 39 of this Decree to perform the right specified in Point b, Clause 1 of this Article and the approval of maintenance plans for housing. Specifically, for the Ministry of National Defense and the Ministry of Public Security, they may delegate to the housing management agency to perform the rights specified in Points a, b, and đ, Clause 1 of this Article.
Article 41. Rights and responsibilities of the agency managing state-owned housing
The agency managing state-owned housing as stipulated in Clause 3, Article 39 of this Decree has the following rights and responsibilities:
1. Review, statistics, and classify housing assigned for management; accept self-managed housing transferred from central agencies (if any) for management in accordance with this Decree.
2. Develop plans for maintenance, renovation, or reconstruction of housing to submit to the representative agency of the owner for approval or approve maintenance plans if delegated to do so.
3. Collect, compile, and store housing files and hand over one set of completion files (for new construction) or redrawing files (for old housing) to the housing management operation unit; the cost of redrawing is funded by the state budget.
4. For the Department of Construction, it is responsible for establishing a Council to determine the selling price of old housing within its jurisdiction (including old housing managed by the Ministry of National Defense); the Council includes representatives from the Department of Construction, the Department of Natural Resources and Environment, the Department of Finance, the Department of Planning and Architecture (if applicable), the Department of Investment, the Provincial Vietnam Fatherland Front, the Provincial Trade Union, the Tax Office; in cases where the selling price of housing managed by the Ministry of National Defense needs to be determined, the Housing Selling Price Determination Council will include additional representatives appointed by the Ministry of National Defense.
5. Draft and submit to the representative agency of the owner decisions on persons renting official housing, persons renting or purchasing social housing under state ownership, persons renting or purchasing old housing. Specifically, for housing managed by the Ministry of National Defense and the Ministry of Public Security, the housing management agency has the right to decide on persons renting, purchasing, or buying housing if delegated to do so.
6. Report to the representative agency of the owner on the decision regarding the selection of housing management operation units or independently decide on selecting such units if delegated to do so; report to the representative agency of the owner on the decision on using revenue from business activities in areas designated for service resettlement to support common property maintenance costs and housing management operations.
7. Base on legal provisions concerning the framework for rental, purchase, and sale prices of state-owned housing to establish rental, purchase, and sale prices of housing under its management and submit to the representative agency of the owner for decision.
8. Report to the representative agency of the owner on the decision to recover housing. Specifically, for housing managed by the Ministry of National Defense and the Ministry of Public Security, the subordinate housing management agency has the right to decide on recovering housing if delegated to do so.
9. Manage, inspect, urge the leasing, warranty, maintenance, and operation management of housing, implement the sale and rental-purchase of housing in accordance with this Decree.
10. Coordinate with financial agencies to guide and inspect the financial activities of housing management operation units.
11. Inspect, supervise, and handle violations or propose competent authorities to handle violations related to housing management and use.
12. Summarize and report on the management and use of housing in accordance with Article 47 of this Decree.
Article 42. Rights and responsibilities of units managing and operating state-owned housing
1. Accept the housing fund assigned by the competent authority as stipulated in Clause 3, Article 39 of this Decree to implement management and operation in accordance with this Decree and relevant laws. The content of housing management and operation shall be carried out according to the guidelines of the Ministry of Construction; the activities of managing and operating state-owned housing shall enjoy mechanisms similar to public services as prescribed by law.
2. Implement leasing and manage the use of housing in accordance with the tasks assigned or through service management contracts signed with housing management agencies.
3. Develop and issue the Internal Regulations on the management and use of housing in accordance with the guidelines of the Ministry of Construction and disseminate these regulations to tenants, purchasers, and users of housing.
4. Strictly manage the areas of housing within the state-owned housing complex that have not been sold.
5. Extract a portion of the rental fee for housing as prescribed in Article 44 of this Decree to serve the management and operation of housing.
6. Collect and store files related to the construction, operation, warranty, maintenance, and renovation of housing; if there are insufficient files, they must be supplemented, restored, redrawn, and the newly generated and supplementary files must be handed over to the housing management agency for storage as prescribed.
7. Carry out maintenance and renovation of housing after being approved by the competent authority.
8. Inspect and monitor to promptly detect and propose the competent authority to handle violations in the management and use of housing; carry out the recovery of housing according to the decision of the competent authority.
9. Coordinate with local functional agencies to ensure security and order for tenants, purchasers, and users of housing.
10. Summarize and report periodically or upon urgent request on the situation of housing management and use as prescribed in Article 47 of this Decree.
11. Implement accounting and reporting of financial income and expenditure for housing management and operation as prescribed; perform other rights and obligations as prescribed by law.
Article 43. Provisions on the conversion of functions of civil servant housing; sale of social housing under state ownership or civil servant housing after conversion of function
1. The conversion of the function of civil servant housing as prescribed in Clause 4, Article 81 of the Housing Law to be used as leased housing shall be implemented as follows:
a) The representative body of the owner of civil servant housing shall prepare a proposal to convert the function of housing, specifying the current status of civil servant housing usage, reasons for converting the function, management and leasing plans after conversion, application of rental prices, eligible tenants, and responsible agencies for housing management. Rental prices and eligible tenants after conversion shall be carried out according to the regulations on leasing state-owned social housing or through auctioning rental rights.
b) The representative body shall submit a report along with the project dossier to the Ministry of Construction for review and report to the Prime Minister for consideration and approval.
c) In case of approval by the Prime Minister, the representative body shall approve the proposal and organize management and leasing in accordance with the content of the proposal, the Prime Minister's approval document, comply with the provisions of the Housing Law, laws on the management and use of state assets, and annually report to the Ministry of Construction for monitoring and management.
2. In cases where the representative body of the owner has the need to sell civil servant housing after converting its function as prescribed in Clause 1 of this Article to reinvest in building other civil servant housing or sell social housing to reinvest in building other social housing, it shall be implemented as follows:
a) The representative body must prepare a sales proposal, specifying the address, quantity of housing; reasons for selling; selling price of housing; land use fees payable; eligible buyers and conditions for purchasing; procedures and formalities for selling; payment methods; implementation deadlines; expected revenue; plans for using the proceeds to reinvest in building other housing.
For the sale of social housing, it must ensure compliance with the eligible buyers as stipulated in Clause 1, Article 50 of the Housing Law; the selling price of housing (including house price and land use fees) shall be implemented according to the laws on the sale of social housing. For the sale of civil servant housing after conversion of function, the selling price of housing shall be determined based on the remaining quality of the housing and land use fees collected according to the laws on land.
b) The representative body shall submit a report along with the project dossier to the Ministry of Construction for review and report to the Prime Minister for consideration and approval.
c) In case of approval by the Prime Minister, the representative body shall approve the proposal and implement it in accordance with the content of the proposal and the Prime Minister's approval document.
d) Proceeds from the sale of housing must be used for the specific purpose of reinvesting in building social housing or civil servant housing; the representative body must report to the Ministry of Construction on the use of these funds, and the Ministry of Construction shall be responsible for checking the use of funds and reporting to the Prime Minister.
3. For civil servant housing and social housing under state ownership managed by the Ministry of Construction which require conversion of function or sale as prescribed in this Article, they must prepare files as prescribed in Clauses 1 and 2 of this Article to be submitted to the Prime Minister for consideration and decision.
Article 44. Management of Revenue from Leasing, Sale and Purchase of State-Owned Housing
Clause 1. Revenue from leasing, sale and purchase of state-owned housing shall be used to maintain and develop the state-owned housing fund according to the following provisions:
Point a) For revenue from leasing housing, it must be used for the purpose of maintaining and managing the operation of state-owned housing currently being leased.
Point b) For revenue from sale and purchase of housing, after deducting costs to organize the sale and purchase of housing, the seller or lessor must pay into the state budget at the current budget level, except for housing specified in Clause 2 of this Article to be used for reinvestment in building social housing or state-owned official housing in the locality.
Clause 2. For old housing managed by the Ministry of National Defense and directly sold to tenants, the proceeds shall be deposited into an account managed by the Ministry of National Defense to reinvest in building social housing for the subjects specified in Clause 6 of Article 49 of the Law on Leased Housing or Purchased Housing; the Ministry of National Defense is responsible for obtaining the unified opinion of the Ministry of Construction regarding the use of these funds and the reinvestment in building housing before construction begins; after completing the construction of housing, the Ministry of National Defense is responsible for reporting to the Ministry of Construction to compile and report to the Prime Minister.
Clause 3. The Ministry of Finance shall take the lead and coordinate with the Ministry of Construction to provide specific guidance on using revenue from leasing housing for maintenance and management of leased housing; to guide the costs to organize the sale and purchase of state-owned housing as stipulated in this Article.
Article 45. Procedures and Formalities for Recovering State-Owned Housing
Clause 1. When there is one of the cases subject to recovery of housing as prescribed in Article 84 of the Law on Housing or when state-owned housing is illegally occupied, the unit entrusted with managing and operating the housing must issue a document clearly stating the reasons and requesting the lessee, purchaser, or occupier (hereinafter referred to as the direct user of the housing) to return the housing within 60 days from the date of receiving the notification document; if the direct user of the housing fails to return the housing beyond the deadline, the unit managing and operating the housing must report to the housing management agency to request recovery of the housing within 5 days from the expiration of the return period.
Clause 2. Within 10 days from the date of receipt of the document from the unit managing and operating the housing, the housing management agency has the responsibility to inspect, and if the housing is subject to recovery, submit a proposal to the agency or representative of the owner of the housing for consideration and issuance of a decision to recover the housing; if the housing management agency discovers that the housing is subject to recovery upon self-inspection, it must follow the procedures to request recovery of the housing as stipulated in this Article.
Clause 3. Within 10 days from the date of receipt of the proposal from the housing management agency, the agency representing the owner of the housing has the responsibility to inspect, and if the conditions for recovering the housing as stipulated in Clause 1 of this Article are met, issue a decision to recover the housing and send the decision to the housing management agency, the unit managing and operating the housing, and the direct user of the housing subject to recovery for implementation. In the case where housing is managed by the Ministry of National Defense or the Ministry of Public Security, the housing management agency may issue a decision to recover the housing (if authorized) and send the decision to the unit managing and operating the housing, the direct user of the housing for implementation, and to the agency representing the owner for reporting.
Clause 4. The decision to recover housing includes the following contents:
Point a) Legal basis for recovering housing;
Point b) Address of the housing and name of the direct user of the housing to be recovered;
Point c) Reason for recovering housing;
Point d) Name of the agency or unit implementing the recovery of housing; responsibility for handing over the housing;
Point đ) Deadline for recovering housing;
Point e) Plan for managing and using the housing after recovery.
Clause 5. Within 5 days from the date of receipt of the decision to recover housing, the unit managing and operating the housing has the responsibility to notify the direct user of the housing in writing along with a copy of the decision to recover housing; the direct user of the housing has the responsibility to hand over the housing to the unit managing and operating the housing within the time limit specified in the decision to recover housing; the recovery and handover of housing must be recorded in a protocol signed by all parties; if the direct user of the housing does not accept the notice of recovery or sign the handover protocol, the unit managing and operating the housing must invite a representative of the People's Committee of the commune, ward, or town where the housing is located to witness and sign the protocol.
Clause 6. Within 5 days from the date of receipt of the decision to recover housing from the competent authority, the unit managing and operating the housing or the housing management agency must terminate the lease, sale, or purchase contract (in cases where contracts have been signed); in cases where housing is recovered due to unauthorized sale or non-compliance with the Law on Housing and this Decree, the buyer is entitled to a refund of the purchase price paid, except in cases where the buyer falsifies purchase and sale documents.
Clause 7. The maximum time limit for recovering housing is 30 days from the date of issuance of the decision to recover housing. For student housing, the unit managing and operating the housing is responsible for recovering the housing.
Clause 8. After recovering the housing, the unit managing and operating the housing must issue a report to the housing management agency on the completion of the recovery of the housing. Housing recovered must be used according to the purposes prescribed by the Law on Housing and this Decree.
Article 46. Procedure and Formalities for Forced Recovery of State-Owned Housing
1. In cases where the person directly using the housing does not return the housing according to the decision on recovery of housing as stipulated in Article 45 of this Decree, within five days from the expiration date specified in Clause 7, Article 45 of this Decree, the housing management and operation unit must issue a report requesting forced recovery of housing to the housing management agency.
2. Within five days from the date of receiving the report from the housing management and operation unit, the housing management agency must inspect and prepare a draft decision on forced recovery of housing along with a proposal for the housing ownership representative agency to consider and issue the decision on forced recovery of housing.
3. Within ten days from the date of receiving the report from the housing management agency, the housing ownership representative agency shall be responsible for inspecting and comparing with the provisions of Article 45 of this Decree to issue the decision on forced recovery of housing and send this decision to the housing management agency, the housing management and operation unit, and the person directly using the housing for implementation; in cases where ministries, central agencies issue decisions on forced recovery of housing, such agencies must accompany the decision on forced recovery of housing with a request for the People's Committee of the province where the housing is located to organize forced recovery of housing.
In cases where housing does not require organization of forced recovery, the housing ownership representative agency must issue a notice to inform the housing management agency and the housing management and operation unit to continue managing according to regulations.
For housing managed by the Ministry of National Defense and the Ministry of Public Security, the housing management agency of the Ministry of National Defense and the Ministry of Public Security has the right to issue a decision on forced recovery of housing if assigned to do so.
4. Based on the decision on forced recovery of housing, the People's Committee of the province where the housing is located may directly or assign the People's Committee of the district where the housing is located to organize forced recovery of housing and hand over the housing to the management and operation unit according to regulations. The handover of housing must be recorded in a protocol confirmed by the participating agencies in the forced recovery.
5. The maximum time limit for implementing forced recovery of housing is thirty days, starting from the date the housing ownership representative agency issues the decision on forced recovery of housing.
6. After recovering the housing, the housing management and operation unit must issue a report to the housing management agency about the completion of housing recovery. Housing recovered must be used according to the purpose prescribed by the Law on Housing and this Decree.
Article 47. Procedure, System, and Content of Reporting on Management of State-Owned Housing
1. The procedure for reporting on the management of state-owned housing is as follows:
a) The housing management and operation unit reports to the housing management agency;
b) The housing management agency reports to the housing ownership representative agency regarding the housing under its management;
c) The People's Committee of the province, ministries, central agencies managing state-owned housing report to the Ministry of Construction on the situation of management and use of housing within their jurisdiction;
d) The Ministry of Construction compiles and reports to the Prime Minister on the situation of management and use of state-owned housing nationwide.
2. The content and system of reporting are as follows:
a) The content of the report includes: Total number and usable area of each type of state-owned housing (villa, apartment, individual house); total number of houses currently rented, leased for purchase, and sold; total revenue from renting, leasing for purchase, and selling houses up to the reporting date; situations where housing has been recovered and the management and use situation after recovery;
b) Agencies specified in Clause 1 of this Article are responsible for regularly reporting on the management and use of housing by December of each year or upon urgent request by the Prime Minister and the Ministry of Construction.
Section 2
MANAGEMENT AND USE OF PUBLIC SERVICE HOUSING
Article 48. Subjects eligible for official accommodation rental
1. The subjects specified in Point a Clause 1 Article 32 of the Law on Housing shall reside in official accommodation according to security requirements.
2. The subjects specified in Point b Clause 1 Article 32 of the Law on Housing shall be transferred or rotated to work in central agencies to hold positions from Deputy Minister level or positions with a job position allowance coefficient of 1.3 or higher, including Party agencies, State agencies, and political-social organizations (Central Committee of the Vietnam Fatherland Front, Communist Youth Union Ho Chi Minh, Vietnam General Confederation of Labor, Vietnam Women's Union, Vietnam Veterans Association, Vietnam Farmers' Union).
3. The subjects specified in Point b Clause 1 Article 32 of the Law on Housing shall be transferred or rotated to work in local agencies to hold positions from Chairman of the People's Committee at district level, Director of Departments or positions with a job position allowance coefficient of 0.9 or higher, including Party agencies, State agencies, and political-social organizations (Central Committee of the Vietnam Fatherland Front, Communist Youth Union Ho Chi Minh, Vietnam General Confederation of Labor, Vietnam Women's Union, Vietnam Veterans Association, Vietnam Farmers' Union).
4. The subjects specified in Points c, d, đ, e, and g Clause 1 Article 32 of the Law on Housing.
Article 49. Conditions for renting official accommodation
1. For the subjects specified in Point a Clause 1 Article 32 of the Law on Housing, they must be currently holding a position.
2. For the subjects specified in Point b Clause 1 Article 32 of the Law on Housing, they must meet the following conditions:
a) Having a decision on transfer or rotation of work and proof of the job position allowance coefficient;
b) Not having their own housing property or not being rented, purchased, or allocated social housing in the place of work assignment, or having their own housing property in the place of work assignment but the average housing area per person in the household is less than 15 square meters.2 floor/person.
3. For the subjects specified in Point d Clause 1 Article 32 of the Law on Housing, they must meet the following conditions:
a) Having a decision on transfer or rotation of work and proof that the subject is an officer or professional military personnel, except when the decision on transfer or rotation clearly states that the subject is an officer or professional military personnel;
b) Meeting the housing conditions stipulated in Point b Clause 2 of this Article;
c) Not belonging to the category required to reside in military camps according to regulations of the Ministry of National Defense and the Ministry of Public Security.
4. For the subjects specified in Points c, đ, and e Clause 1 Article 32 of the Law on Housing, they must meet the following conditions:
a) Having a decision on transfer, rotation, or assignment to work in areas as prescribed by the Law on Housing;
b) Meeting the housing conditions stipulated in Point b Clause 2 of this Article;
c) In cases of assignment to work in rural areas of the delta, midland regions, it must be outside the district administrative boundaries and at least 30 kilometers away from their residence to the place of work; in cases of assignment to work in remote and extremely difficult economic and social conditions, border, and island areas, it shall be determined by the provincial People's Committee in accordance with the actual situation of each area but must be at least 10 kilometers away from their residence to the place of work.
5. For the subjects specified in Point g Clause 1 Article 32 of the Law on Housing, they must meet the following conditions:
a) Having a decision to head a national-level important science and technology task as prescribed by laws on science and technology;
b) Meeting the housing conditions stipulated in Point b Clause 2 of this Article.
Article 50. Procedures and formalities for leasing public service housing and management operation of public service housing
1. In cases falling under the subject matter prescribed in Point a Clause 1 Article 32 of the Law on Housing, they shall be arranged to lease public service housing according to the decision of the competent authority.
2. In cases falling under the subjects prescribed in Points b, c, d, đ, e and g Clause 1 Article 32 of the Law on Housing, the following procedures shall be implemented:
a) The subjects prescribed in this Clause must submit a request to lease public service housing to the agency or organization where they are currently working; within ten days from the date of receipt of the request to lease public service housing, the agency or organization where the subjects prescribed in Clause 2 of this Article are currently working shall examine and issue a document to the competent authority for examination and decision on leasing public service housing.
b) Within twenty days from the date of receipt of the document requesting from the agency or organization prescribed in Clause 2 of this Article along with the application of the person requesting to lease public service housing, the competent authority responsible for deciding on leasing public service housing shall examine, if the conditions for leasing public service housing are met, issue a decision to lease public service housing; in case the conditions are not met, a document must be issued explaining the reasons.
c) Within ten days from the date of receipt of the decision to lease public service housing from the competent authority, the unit entrusted with managing and operating public service housing shall enter into a lease agreement with the lessee or enter into a lease agreement with the agency directly managing the lessee.
3. Management and operation of public service housing shall be regulated as follows:
a) For central public service housing (excluding public service housing of the Ministry of National Defense and the Ministry of Public Security), it shall be entrusted to organizations or units having functions and capabilities in managing and operating housing to carry out such management and operation; in remote areas, border regions, islands, and areas with extremely difficult socio-economic conditions, the management and operation of such public service housing shall be entrusted to the unit managing and operating such housing.
b) For public service housing of the Ministry of National Defense and the Ministry of Public Security, the Ministry of National Defense and the Ministry of Public Security shall decide on the organizations or units to carry out the management and operation.
c) For public service housing of localities allocated for subjects managed at provincial level, it shall be entrusted to organizations or units having functions and capabilities in managing and operating housing to carry out such management and operation; in cases where there are no organizations or units having such functions and capabilities on the territory, the Department of Construction may establish a subordinate department to manage and operate and hire services related to the management and operation of public service housing.
d) For public service housing of localities allocated for subjects managed at district level, it may be entrusted to organizations or units having functions and capabilities in managing and operating housing to carry out such management and operation (if there is a unit managing and operating) or entrusted to the housing management agency at district level to organize the management and operation.
đ) For public service housing intended for teachers, doctors, and health workers located within or adjacent to school premises or healthcare facilities, it may be entrusted to schools or healthcare facilities to carry out the management and operation of such public service housing.
4. Bộ Xây dựng hướng dẫn cụ thể mẫu đơn đề nghị thuê nhà ở công vụ, mẫu hợp đồng thuê nhà ở công vụ và việc quản lý, sử dụng nhà ở này.
Điều 51. Giá thuê và việc thanh toán tiền thuê nhà ở công vụ
1. Giá thuê nhà ở công vụ được xác định theo quy định tại Điều 33 của Luật Nhà ở.
2. Việc thanh toán tiền thuê nhà ở công vụ được quy định như sau:
a) Người được thuê nhà ở công vụ có trách nhiệm trả tiền thuê nhà ở theo đúng nội dung hợp đồng thuê nhà đã ký kết và phù hợp với thời điểm được Nhà nước thanh toán tiền lương theo quy định. Trường hợp người thuê không trả tiền thuê trong ba tháng liên tục thì đơn vị quản lý vận hành nhà ở công vụ có quyền yêu cầu cơ quan đang trực tiếp quản lý người thuê nhà ở công vụ khấu trừ từ tiền lương của người thuê nhà để trả tiền thuê nhà; cơ quan đang trực tiếp quản lý người thuê nhà ở có trách nhiệm khấu trừ tiền lương của người thuê nhà để trả cho đơn vị quản lý vận hành nhà ở công vụ;
b) Trường hợp thuê nhà ở thương mại để làm nhà ở công vụ mà tiền thuê nhà ở thương mại cao hơn số tiền thuê do người thuê phải trả thì người thuê phải trả tiền thuê nhà không vượt quá 10% tiền lương đang được hưởng tại thời điểm thuê nhà ở công vụ; ngân sách nhà nước chi trả phần chênh lệch tiền thuê nhà ở theo nguyên tắc ngân sách trung ương chi trả cho cán bộ thuộc diện cơ quan trung ương quản lý, ngân sách địa phương chi trả cho cán bộ thuộc diện cơ quan địa phương quản lý.
Thủ tục thanh toán phần tiền chênh lệch quy định tại khoản này được thực hiện theo hướng dẫn của Bộ Tài chính;
c) Trường hợp đơn vị quản lý vận hành nhà ở công vụ ký hợp đồng thuê nhà với cơ quan đang trực tiếp quản lý người thuê nhà ở công vụ thì cơ quan này có trách nhiệm trích từ tiền lương của người thuê nhà ở để trả cho đơn vị quản lý vận hành nhà ở công vụ theo quy định tại Khoản này.
3. Bộ Tài chính hướng dẫn tiền thu được từ việc cho thuê nhà ở công vụ được dùng để bảo trì và chi phí cho hoạt động quản lý vận hành nhà ở đó; trường hợp không đủ kinh phí thì ngân sách nhà nước hỗ trợ thêm để chi trả.
4. Bộ Xây dựng hướng dẫn phương pháp xác định giá thuê nhà ở công vụ.
Mục 3
QUẢN LÝ, SỬ DỤNG NHÀ Ở XÃ HỘI
Điều 52. Đối tượng và điều kiện thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước
1. Người được thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước phải thuộc các đối tượng quy định tại Khoản 1 Điều 50 của Luật Nhà ở.
Đối với đối tượng là học sinh, sinh viên quy định tại Khoản 9 Điều 49 của Luật Nhà ở (sau đây gọi chung là sinh viên) thì chỉ được thuê nhà ở trong thời gian học tập. Trường hợp không có đủ chỗ ở để bố trí theo yêu cầu thì thực hiện cho thuê theo thứ tự ưu tiên, gồm sinh viên là con gia đình thuộc diện chính sách, diện hộ nghèo, cận nghèo theo quy định của Nhà nước; sinh viên vùng sâu, vùng xa, ngoại tỉnh; sinh viên học giỏi; sinh viên học năm đầu tiên.
2. Trường hợp thuê nhà ở xã hội thuộc sở hữu nhà nước thì phải đáp ứng điều kiện về nhà ở, cư trú và thu nhập theo quy định tại Khoản 1 Điều 51 của Luật Nhà ở; trường hợp đã có nhà ở thuộc sở hữu của mình thì phải có diện tích bình quân trong hộ gia đình dưới 10 m2 sàn/người.
Trường hợp thuộc đối tượng quy định tại Khoản 10 Điều 49 của Luật Nhà ở thì không áp dụng điều kiện về thu nhập nhưng phải thuộc diện chưa được Nhà nước bồi thường bằng nhà ở, đất ở.
3. Trường hợp thuê mua nhà ở xã hội thuộc sở hữu nhà nước thì phải đáp ứng điều kiện quy định tại Khoản 2 Điều này và phải thanh toán ngay lần đầu số tiền thuê mua bằng 20% giá trị của nhà ở thuê mua; nếu người thuê mua đồng ý thì có thể thanh toán lần đầu số tiền bằng 50% giá trị của nhà ở thuê mua.
Điều 53. Hồ sơ đề nghị thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước
1. Hồ sơ đề nghị thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước bao gồm:
a) Đơn đăng ký thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước;
b) Giấy tờ chứng minh thuộc đối tượng và có đủ điều kiện về nhà ở, cư trú, thu nhập theo quy định tại Điều 52 của Nghị định này;
c) Giấy tờ chứng minh thuộc đối tượng được miễn, giảm tiền thuê nhà ở xã hội (nếu có).
2. Bộ Xây dựng quy định cụ thể mẫu đơn đề nghị thuê, thuê mua nhà ở xã hội; hướng dẫn cụ thể giấy tờ xác định thực trạng nhà ở, giấy tờ chứng minh điều kiện cư trú, điều kiện thu nhập quy định tại Điểm b Khoản 1 Điều này và giấy tờ chứng minh thuộc đối tượng được miễn, giảm tiền thuê nhà quy định tại Điểm c Khoản 1 Điều này.
Điều 54. Trình tự, thủ tục thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước
1. Người có nhu cầu thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước nộp 02 bộ hồ sơ quy định tại Khoản 1 Điều 53 của Nghị định này tại đơn vị được giao quản lý vận hành nhà ở hoặc tại cơ quan quản lý nhà ở nơi có nhà ở. Ngoài các giấy tờ quy định tại Khoản 1 Điều 53 của Nghị định này, cơ quan tiếp nhận hồ sơ không được yêu cầu người nộp đem nộp thêm bất kỳ loại giấy tờ nào khác.
2. Cơ quan tiếp nhận hồ sơ có trách nhiệm kiểm tra và phân loại hồ sơ; nếu hồ sơ không có đủ các giấy tờ theo quy định thì phải trả lời ngay để người nộp đơn bổ sung giấy tờ. Trường hợp đơn vị quản lý vận hành nhà ở tiếp nhận hồ sơ thì sau khi kiểm tra và phân loại hồ sơ, đơn vị này phải có báo cáo danh sách người đủ điều kiện thuê, thuê mua nhà ở kèm theo hồ sơ hợp lệ gửi cơ quan quản lý nhà ở xem xét, kiểm tra.
3. Trên cơ sở danh sách người đủ điều kiện thuê, thuê mua nhà ở kèm theo hồ sơ hợp lệ, cơ quan quản lý nhà ở trực tiếp xét duyệt hoặc thành lập Hội đồng xét duyệt hồ sơ để thực hiện xét duyệt từng hồ sơ đăng ký, xác định đối tượng đủ điều kiện hoặc chấm điểm xét chọn đối tượng ưu tiên (nếu có).
Trường hợp đủ điều kiện hoặc được ưu tiên xét duyệt thuê, thuê mua nhà ở thì cơ quan quản lý nhà ở có tờ trình kèm theo danh sách và biên bản xét duyệt hoặc biên bản chấm điểm báo cáo cơ quan đại diện chủ sở hữu quyết định; trường hợp không đủ điều kiện hoặc chưa được xét duyệt thì cơ quan quản lý nhà ở có văn bản thông báo cho đơn vị quản lý vận hành nhà ở để trả lời cho người nộp đơn biết.
4. Trên cơ sở báo cáo của cơ quan quản lý nhà ở, cơ quan đại diện chủ sở hữu nhà ở xem xét, ban hành quyết định phê duyệt danh sách người được thuê, thuê mua nhà ở và gửi quyết định này cho cơ quan quản lý nhà ở để ký hợp đồng thuê mua với người được thuê mua hoặc gửi cho đơn vị quản lý vận hành nhà ở để ký hợp đồng thuê nhà với người được thuê nhà ở.
5. Thời gian giải quyết việc cho thuê, thuê mua nhà ở xã hội là không quá 30 ngày, kể từ ngày đơn vị quản lý vận hành nhà ở nhận đủ hồ sơ hợp lệ; trường hợp phải xét duyệt hồ sơ, tổ chức chấm điểm thì thời hạn giải quyết là không quá 60 ngày.
6. Quyền và nghĩa vụ bên thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước được thực hiện theo quy định tại Luật Nhà ở và theo thỏa thuận trong hợp đồng thuê, thuê mua nhà ở.
7. Bộ Xây dựng ban hành mẫu hợp đồng thuê, thuê mua nhà ở xã hội; hướng dẫn cụ thể nguyên tắc, tiêu chí xét duyệt, việc chấm điểm đối tượng được thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước; hướng dẫn cụ thể việc quản lý, sử dụng nhà ở sinh viên thuộc sở hữu nhà nước.
Điều 55. Giá thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước và các chi phí liên quan đến việc quản lý, sử dụng nhà ở này
1. Giá thuê nhà ở xã hội thuộc sở hữu nhà nước được xác định theo quy định tại các Khoản 1, 3 và Khoản 4 Điều 60 của Luật Nhà ở. Giá thuê mua nhà ở xã hội thuộc sở hữu nhà nước được xác định theo quy định tại Khoản 2, 3 và Khoản 4 Điều 60 của Luật Nhà ở, trừ kinh phí bảo trì nhà ở do người thuê mua nộp theo quy định tại Điều 108 của Luật Nhà ở.
2. Ngoài việc đóng tiền thuê, thuê mua nhà ở theo mức giá được xác định quy định tại Khoản 1 Điều này, người thuê, thuê mua nhà ở còn phải nộp các chi phí có liên quan đến việc quản lý, sử dụng nhà ở, bao gồm chi phí quản lý vận hành nhà ở, chi phí sử dụng điện, nước, sử dụng dịch vụ thông tin, liên lạc, truyền hình, chi phí cho các dịch vụ khác theo quy định của pháp luật và theo thỏa thuận với nhà cung cấp dịch vụ.
3. Bộ Xây dựng hướng dẫn cụ thể nội dung chi phí cấu thành giá và phương pháp xác định giá thuê, thuê mua nhà ở xã hội thuộc sở hữu nhà nước.
Điều 56. Quản lý, sử dụng nhà ở xã hội thuộc sở hữu nhà nước
1. Việc quản lý, sử dụng nhà ở xã hội thuộc sở hữu nhà nước phải tuân thủ các quy định tại Điều 64 và Mục 2 Chương VI của Luật Nhà ở, Điều 38 của Nghị định này.
2. Người thuê nhà ở xã hội được miễn, giảm tiền thuê nhà ở như trường hợp thuê nhà ở cũ thuộc sở hữu nhà nước quy định tại Điều 59 của Nghị định này. Trường hợp hộ gia đình, cá nhân thuê mua, mua nhà ở xã hội để phục vụ tái định cư thì sau khi thanh toán đủ tiền thuê mua, mua nhà ở theo hợp đồng và được cấp Giấy chứng nhận thì được thực hiện các quyền và có các nghĩa vụ của chủ sở hữu nhà ở theo quy định của Luật Nhà ở.
3. Việc quản lý vận hành nhà ở xã hội thuộc sở hữu nhà nước do đơn vị hoặc tổ chức có chức năng, năng lực quản lý vận hành nhà ở thực hiện. Đơn vị quản lý vận hành nhà ở có trách nhiệm theo dõi, báo cáo về tình hình quản lý, sử dụng nhà ở theo quy định tại Điều 47 của Nghị định này.
Đối với địa phương chưa có đơn vị hoặc tổ chức có chức năng, năng lực quản lý vận hành nhà ở đáp ứng yêu cầu, điều kiện theo quy định của Luật Nhà ở thì Sở Xây dựng được tổ chức một bộ phận trực thuộc Sở Xây dựng để tổ chức quản lý vận hành và thuê các dịch vụ quản lý vận hành nhà ở; chi phí thực hiện quản lý vận hành nhà ở được sử dụng từ tiền cho thuê nhà ở này và hỗ trợ từ ngân sách của địa phương.
Mục 4
CHO THUÊ NHÀ Ở CŨ THUỘC SỞ HỮU NHÀ NƯỚC
Điều 57. Đối tượng và điều kiện thuê nhà ở cũ thuộc sở hữu nhà nước
1. Đối tượng được thuê nhà ở cũ thuộc sở hữu nhà nước theo quy định của Nghị định này là người đang thực tế sử dụng nhà ở và có nhu cầu tiếp tục thuê nhà ở đó, bao gồm đối tượng được bố trí sử dụng nhà ở từ trước ngày 27 tháng 11 năm 1992 (ngày ban hành Quyết định số 118/TTg của Thủ tướng Chính phủ về giá cho thuê nhà ở và đưa tiền nhà ở vào tiền lương) và các đối tượng được bố trí nhà ở theo quy định tại Khoản 1 Điều 61 của Nghị định này, trừ trường hợp chiếm dụng nhà ở trái pháp luật.
2. Người thuê nhà ở cũ phải thuộc một trong các trường hợp sau đây:
a) Trường hợp đang thực tế sử dụng nhà ở, có hợp đồng thuê nhà ở và có tên trong hợp đồng này thì không phải ký lại hợp đồng thuê nhà, trừ trường hợp hợp đồng thuê nhà ở hết hạn và các bên phải ký lại hợp đồng theo quy định;
b) Trường hợp đang thực tế sử dụng nhà ở, không có hợp đồng thuê nhà ở nhưng có quyết định, văn bản phân phối, bố trí nhà ở và có tên trong quyết định, văn bản này thì phải làm thủ tục ký hợp đồng thuê nhà ở với đơn vị quản lý vận hành, nhà ở;
c) Trường hợp đang thực tế sử dụng nhà ở, có hợp đồng thuê nhà ở nhưng không có tên trong hợp đồng này và nhà ở này không có tranh chấp, khiếu kiện thì được ký hợp đồng thuê nhà với đơn vị quản lý vận hành nhà ở theo quy định tại Điều 60 của Nghị định này;
d) Trường hợp đang thực tế sử dụng nhà ở, có quyết định, văn bản phân phối, bố trí nhà ở nhưng không có tên trong quyết định, văn bản này và nhà ở này không có tranh chấp, khiếu kiện thì được ký hợp đồng thuê nhà với đơn vị quản lý vận hành nhà ở theo quy định tại Điều 60 của Nghị định này.
Trường hợp chiếm dụng nhà ở trái pháp luật thì bị thu hồi; việc thu hồi nhà ở này được thực hiện theo quy định tại Điều 45 và Điều 46 của Nghị định này.
Điều 58. Giá thuê nhà ở cũ thuộc sở hữu nhà nước
1. Đối với nhà ở, nhà không có nguồn gốc là nhà ở nhưng được bố trí sử dụng trước ngày 05 tháng 7 năm 1994 (ngày ban hành Nghị định số 61/CP của Chính phủ về mua bán và kinh doanh nhà ở) mà chưa được cải tạo, xây dựng lại thì áp dụng giá thuê theo quyết định của Thủ tướng Chính phủ về giá thuê nhà ở thuộc sở hữu nhà nước chưa được cải tạo, xây dựng lại.
2. Đối với nhà ở quy định tại Khoản 1 Điều này đã được Nhà nước cải tạo, xây dựng lại; nhà ở hoặc nhà không có nguồn gốc là nhà ở nhưng được bố trí sử dụng từ ngày 05 tháng 7 năm 1994 đến trước ngày 19 tháng 01 năm 2007 (ngày ban hành Quyết định số 09/2007/QĐ-TTg của Thủ tướng Chính phủ về việc sắp xếp lại, xử lý nhà, đất thuộc sở hữu Nhà nước) thì áp dụng giá thuê như đối với nhà ở xã hội thuộc sở hữu nhà nước.
Điều 59. Miễn, giảm tiền thuê nhà ở cũ thuộc sở hữu nhà nước
1. Việc miễn, giảm tiền thuê nhà ở cũ thuộc sở hữu nhà nước được thực hiện theo nguyên tắc sau đây:
a) Người được miễn, giảm tiền thuê nhà ở phải là người có tên trong hợp đồng thuê nhà ở (bao gồm người đại diện đứng tên trong hợp đồng và các thành viên khác có tên trong hợp đồng thuê nhà);
b) Việc miễn, giảm tiền thuê nhà ở chỉ xét một lần cho người thuê; trường hợp thuê nhiều nhà ở thuộc sở hữu nhà nước thì chỉ được hưởng miễn, giảm tiền thuê đối với một nhà ở;
c) Trường hợp một người thuộc đối tượng được hưởng nhiều chế độ miễn, giảm tiền thuê nhà ở thì chỉ được hưởng mức cao nhất;
d) Trường hợp trong một hộ gia đình có từ hai người trở lên đang thuê nhà ở thuộc diện được giảm tiền thuê thì được miễn tiền thuê nhà ở.
2. Đối tượng được miễn, giảm tiền thuê nhà ở cũ bao gồm:
a) Người có công với cách mạng theo quy định của pháp luật ưu đãi người có công với cách mạng;
b) Hộ nghèo, cận nghèo theo quy định về chuẩn nghèo, cận nghèo do Thủ tướng Chính phủ ban hành;
c) Người khuyết tật, người già cô đơn và các đối tượng đặc biệt có khó khăn về nhà ở tại khu vực đô thị.
3. Mức miễn, giảm tiền thuê nhà ở cho các đối tượng quy định tại Khoản 2 Điều này được thực hiện theo quyết định của Thủ tướng Chính phủ.
Riêng hộ nghèo, cận nghèo, người khuyết tật, người già cô đơn và các đối tượng đặc biệt có khó khăn về nhà ở tại khu vực đô thị nếu được thuê nhà ở thì được giảm 60% tiền thuê nhà ở phải nộp; đối với hộ nghèo, cận nghèo thì mức giảm này được tính cho cả hộ gia đình (không tính cho từng thành viên trong hộ gia đình).
Điều 60. Hồ sơ, trình tự, thủ tục thuê nhà ở cũ thuộc sở hữu nhà nước
1. Hồ sơ thuê nhà ở cũ thuộc sở hữu nhà nước bao gồm:
a) Đơn đề nghị thuê nhà ở;
b) Giấy tờ chứng minh việc sử dụng nhà ở quy định tại một trong các Điểm b, c, d Khoản 2 Điều 57 của Nghị định này;
c) Bản sao Giấy chứng minh nhân dân hoặc Thẻ căn cước công dân hoặc hộ chiếu đang còn giá trị hoặc Thẻ quân nhân của người có đơn đề nghị thuê nhà ở; trường hợp là vợ chồng thì phải có thêm bản sao có chứng thực sổ hộ khẩu gia đình hoặc giấy đăng ký kết hôn;
d) Bản sao giấy tờ chứng minh thuộc đối tượng được miễn, giảm tiền thuê nhà ở (nếu có).
2. Trình tự, thủ tục thuê nhà ở cũ đối với trường hợp quy định tại Điểm b Khoản 2 Điều 57 được thực hiện như sau:
a) Người đề nghị thuê nhà ở nộp 02 bộ hồ sơ quy định tại Khoản 1 Điều này tại đơn vị quản lý vận hành nhà ở hoặc tại cơ quan quản lý nhà ở (do Ủy ban nhân dân cấp tỉnh quy định);
b) Cơ quan tiếp nhận hồ sơ có trách nhiệm kiểm tra, viết giấy biên nhận hồ sơ; trường hợp người nộp đơn không thuộc đối tượng được thuê nhà ở cũ thì phải có văn bản thông báo cho người hộp hồ sơ biết rõ lý do; nếu hồ sơ còn thiếu giấy tờ thì cơ quan tiếp nhận hồ sơ phải hướng dẫn ngay để người nộp hồ sơ bổ sung giấy tờ. Trường hợp đơn vị quản lý vận hành nhà ở tiếp nhận hồ sơ thì phải báo cáo cơ quan quản lý nhà ở xem xét;
c) Trên cơ sở hồ sơ đủ điều kiện tiếp nhận, cơ quan quản lý nhà ở có trách nhiệm kiểm tra, lập tờ trình kèm theo dự thảo quyết định phê duyệt đối tượng được thuê nhà ở cũ trình cơ quan đại diện chủ sở hữu quyết định;
d) Căn cứ vào đề nghị của cơ quan quản lý nhà ở, cơ quan đại diện chủ sở hữu nhà ở xem xét, ban hành quyết định phê duyệt đối tượng được thuê nhà ở, sau đó gửi quyết định này cho cơ quan quản lý nhà ở để thông báo cho đơn vị quản lý vận hành nhà ở thực hiện ký kết hợp đồng thuê nhà ở. Trường hợp nhà ở cũ do Bộ Quốc phòng đang quản lý mà giao thẩm quyền quyết định đối tượng được thuê nhà ở cho cơ quan quản lý nhà ở thì cơ quan này ban hành quyết định phê duyệt đối tượng được thuê nhà ở.
Sau khi có quyết định phê duyệt đối tượng được thuê nhà ở cũ, đơn vị quản lý vận hành nhà ở thực hiện ký kết hợp đồng với người thuê nhà ở.
3. Trình tự, thủ tục ký hợp đồng thuê nhà ở đối với trường hợp quy định tại Điểm c và Điểm d Khoản 2 Điều 57 của Nghị định này được thực hiện như sau:
a) Trường hợp người đang sử dụng nhà ở nhận chuyển quyền thuê nhà ở trước ngày 06 tháng 6 năm 2013, là ngày Nghị định số 34/2013/NĐ-CP ngày 22 tháng 4 năm 2013 của Chính phủ về quản lý sử dụng nhà ở thuộc sở hữu nhà nước có hiệu lực thi hành (sau đây gọi chung là Nghị định số 34/2013/NĐ-CP) thì người đề nghị thuê nhà ở nộp 02 bộ hồ sơ quy định tại Khoản 1 Điều này tại đơn vị quản lý vận hành nhà ở hoặc tại cơ quan quản lý nhà ở (do Ủy ban nhân dân cấp tỉnh quy định). Sau khi tiếp nhận hồ sơ, cơ quan tiếp nhận hồ sơ có trách nhiệm kiểm tra, nếu hồ sơ hợp lệ thì đăng tải 03 lần liên tục thông tin về nhà ở cho thuê trên báo của địa phương và trên Cổng thông tin điện tử của đơn vị mình; trường hợp cơ quan quản lý nhà ở tiếp nhận hồ sơ thì chuyển cho đơn vị quản lý vận hành nhà ở để thực hiện việc đăng tin.
Sau 30 ngày, kể từ ngày đăng tin lần cuối, nếu không có tranh chấp, khiếu kiện về nhà ở cho thuê thì đơn vị quản lý vận hành nhà ở ký hợp đồng với người thuê và báo cáo cơ quan quản lý nhà ở biết để theo dõi, quản lý; nếu có tranh chấp, khiếu kiện về nhà ở này thì chỉ thực hiện ký hợp đồng thuê sau khi đã giải quyết xong tranh chấp, khiếu kiện;
b) Trường hợp người đang sử dụng nhà ở là người nhận chuyển quyền thuê nhà ở từ ngày 06 tháng 6 năm 2013 thì người đề nghị thuê nhà ở nộp 02 bộ hồ sơ quy định tại Khoản 1 Điều này tại đơn vị quản lý vận hành nhà ở hoặc tại cơ quan quản lý nhà ở (do Ủy ban nhân dân cấp tỉnh quy định).
Trường hợp cơ quan quản lý nhà ở tiếp nhận hồ sơ thì cơ quan quản lý nhà ở có trách nhiệm kiểm tra, nếu nhà ở không có tranh chấp, khiếu kiện thì có văn bản đồng ý về việc chuyển nhượng quyền thuê và gửi văn bản này kèm theo bản sao hồ sơ đề nghị thuê nhà cho đơn vị quản lý vận hành nhà ở để thực hiện ký hợp đồng với người thuê; trường hợp đơn vị quản lý vận hành tiếp nhận hồ sơ thì đơn vị quản lý vận hành có trách nhiệm kiểm tra và báo cáo cơ quan quản lý nhà ở xem xét kiểm tra để có văn bản đồng ý việc chuyển nhượng quyền thuê trước khi thực hiện ký kết hợp đồng; trường hợp cơ quan quản lý nhà ở không đồng ý thì phải có văn bản trả lời rõ lý do cho người đề nghị thuê nhà ở biết.
4. Các trường hợp ký kết hợp đồng thuê nhà ở mới hoặc ký gia hạn hợp đồng thuê mà diện tích nhà ở thực tế đang sử dụng không đúng với diện tích ghi trong giấy tờ phân phối, bố trí hoặc hợp đồng thuê nhà ở thì đơn vị quản lý vận hành ở có trách nhiệm kiểm tra và xác định lại diện tích nhà ở sử dụng hợp pháp trước khi thực hiện ký kết hợp đồng cho thuê nhà ở.
5. Thời hạn giải quyết cho thuê nhà ở cũ là không quá 30 ngày, kể từ ngày cơ quan tiếp nhận hồ sơ đề nghị thuê nhà ở nhận đủ hồ sơ hợp lệ.
6. Bộ Xây dựng có trách nhiệm ban hành mẫu đơn đề nghị thuê nhà, hợp đồng thuê nhà ở cũ và giấy tờ chứng minh việc sử dụng nhà ở cũ.
Điều 61. Giải quyết cho thuê đối với nhà ở và nhà không có nguồn gốc là nhà ở nhưng được bố trí để ở từ ngày 27 tháng 11 năm 1992 đến trước ngày 19 tháng 01 năm 2007
1. Nhà nước tiếp tục giải quyết cho thuê nhà ở theo quy định của Nghị định này đối với các trường hợp sau đây:
a) Trường hợp nhà ở được cơ quan có thẩm quyền cho phép đầu tư xây dựng bằng nguồn vốn ngân sách nhà nước từ trước ngày 27 tháng 11 năm 1992 nhưng từ ngày 27 tháng 11 năm 1992 mới hoàn thành xây dựng và đưa vào sử dụng để phân phối cho cán bộ, công nhân viên thuê theo Quyết định số 118/TTg của Thủ tướng Chính phủ về giá cho thuê nhà ở và đưa tiền nhà vào tiền lương;
b) Trường hợp người đang thuê nhà ở trước ngày 27 tháng 11 năm 1992 nhưng thuộc diện phải điều chuyển công tác và Nhà nước yêu cầu phải trả lại nhà ở đang thuê, sau đó được cơ quan nhà nước bố trí cho thuê nhà ở khác sau ngày 27 tháng 11 năm 1992;
c) Trường hợp nhà ở hoặc nhà không có nguồn gốc là nhà ở nhưng được bố trí sử dụng trong khoảng thời gian từ ngày 27 tháng 11 năm 1992 đến trước ngày 05 tháng 7 năm 1994;
d) Trường hợp nhà ở hoặc nhà không có nguồn gốc là nhà ở nhưng được bố trí sử dụng trong khoảng thời gian từ ngày 05 tháng 7 năm 1994 đến trước ngày 19 tháng 01 năm 2007.
2. Giá thuê nhà ở đối với các trường hợp quy định tại Khoản 1 Điều này được quy định như sau:
a) Trường hợp nhà ở thuộc diện quy định tại các Điểm a; b và Điểm c Khoản 1 Điều này chưa được cải tạo, xây dựng lại thì áp dụng giá thuê theo quyết định của Thủ tướng Chính phủ đối với nhà ở chưa được cải tạo, xây dựng lại; nếu nhà ở quy định tại các Điểm a, b và Điểm c Khoản 1 Điều này đã được cải tạo, xây dựng lại thì áp dụng giá thuê như đối với nhà ở xã hội thuộc sở hữu nhà nước;
b) Trường hợp nhà ở thuộc diện quy định tại Điểm d Khoản 1 Điều này thì áp dụng giá thuê như đối với nhà ở xã hội thuộc sở hữu nhà nước.
3. Trường hợp bố trí sử dụng nhà ở từ ngày 19 tháng 01 năm 2007 thì thực hiện giải quyết theo quy định về quản lý tài sản nhà đất thuộc sở hữu nhà nước.
Mục 5
BÁN NHÀ Ở CŨ THUỘC SỞ HỮU NHÀ NƯỚC
Điều 62. Loại nhà ở cũ thuộc sở hữu nhà nước thuộc diện không được bán
1. Không thực hiện bán nhà ở cũ thuộc sở hữu nhà nước thuộc diện quy định sau đây:
a) Nhà ở nằm trong khu vực quy hoạch xây dựng nhà ở công vụ, quy hoạch xây dựng công trình trọng điểm quốc gia hoặc công trình trọng điểm cấp tỉnh;
b) Nhà ở đã có quyết định thu hồi đất, thu hồi nhà của cơ quan nhà nước có thẩm quyền;
c) Nhà không có nguồn gốc là nhà ở nhưng đang bố trí làm nhà ở và thuộc diện đang thực hiện xử lý, sắp xếp lại nhà, đất thuộc sở hữu nhà nước;
d) Nhà ở gắn liền với di tích lịch sử, văn hóa đã được xếp hạng theo quyết định của cơ quan nhà nước có thẩm quyền; nhà ở nằm trong quy hoạch, kế hoạch sử dụng làm nhà ở công vụ, công sở, trụ sở làm việc, trường học, bệnh viện, công viên, công trình phục vụ mục đích công cộng đã được cơ quan có thẩm quyền phê duyệt;
đ) Nhà chung cư bị hư hỏng, có nguy cơ sập đổ, không bảo đảm an toàn cho người sử dụng đã có kết luận kiểm định chất lượng của Sở Xây dựng nơi có nhà chung cư; căn hộ chung cư không khép kín chưa được Nhà nước cải tạo lại, trừ trường hợp người thuê đã tự cải tạo trước ngày Nghị định này có hiệu lực thi hành và việc sử dụng độc lập, tự nguyện, có sự đồng thuận thông qua cam kết bằng văn bản đề nghị được mua;
e) Nhà biệt thự nằm trong danh mục không thuộc diện được bán mà Ủy ban nhân dân cấp tỉnh đã báo cáo và đã được Thủ tướng Chính phủ chấp thuận trước ngày Nghị định này có hiệu lực thi hành.
Đối với biệt thự mà địa phương thống kê, rà soát sau khi báo cáo Thủ tướng Chính phủ thì các biệt thự này cũng được quản lý theo các tiêu chí mà Ủy ban nhân dân cấp tỉnh đã quy định và đã báo cáo Thủ tướng Chính phủ trước ngày Nghị định này có hiệu lực thi hành.
2. Đối với nhà ở thuộc diện không được bán quy định tại Khoản 1 Điều này, khi Nhà nước thực hiện xử lý nhà ở này thì căn cứ vào từng trường hợp cụ thể, người đang thuê được giải quyết theo chính sách hiện hành về nhà ở, đất ở.
Điều 63. Đối tượng, điều kiện được mua và điều kiện bán nhà ở cũ thuộc sở hữu nhà nước
1. Người mua nhà ở cũ thuộc sở hữu nhà nước phải thuộc các đối tượng được bố trí nhà ở theo quy định tại Khoản 1 Điều 57 của Nghị định này.
2. Người mua nhà ở cũ thuộc sở hữu nhà nước phải đáp ứng các điều kiện sau đây:
a) Có hợp đồng thuê nhà ở ký với đơn vị quản lý vận hành nhà ở và có tên trong hợp đồng thuê nhà ở này (bao gồm người đại diện đứng tên hợp đồng thuê nhà ở và các thành viên có tên trong hợp đồng thuê nhà từ đủ 18 tuổi trở lên); trường hợp có nhiều thành viên cùng đứng tên trong hợp đồng thuê nhà ở thì các thành viên này phải thỏa thuận cử người đại diện đứng tên ký hợp đồng mua bán nhà ở với cơ quan quản lý nhà ở;
b) Đã đóng đầy đủ tiền thuê nhà ở theo quy định trong hợp đồng thuê nhà ở và đóng đầy đủ các chi phí quản lý vận hành nhà ở tính đến thời điểm ký hợp đồng mua bán nhà ở;
c) Phải có đơn đề nghị mua nhà ở cũ đang thuê.
3. Điều kiện bán nhà ở, nhà không có nguồn gốc là nhà ở nhưng được bố trí sử dụng trước ngày 05 tháng 7 năm 1994 được quy định như sau:
a) Nhà ở phải không thuộc diện quy định tại Điều 62 của Nghị định này;
b) Nhà ở phải không thuộc diện đang có tranh chấp, khiếu kiện;
c) Trường hợp nhà ở cũ thuộc diện phải xác lập sở hữu toàn dân theo Nghị quyết số 23/2003/QH11 ngày 26 tháng 11 năm 2003 của Quốc hội về nhà đất do Nhà nước đã quản lý, bố trí sử dụng trong quá trình thực hiện các chính sách quản lý nhà đất và chính sách cải tạo xã hội chủ nghĩa trước ngày 01 tháng 7 năm 1991 và Nghị quyết số 755/2005/NQ-UBTVQH11 ngày 02 tháng 4 năm 2005 của Ủy ban Thường vụ Quốc hội quy định việc giải quyết đối với một số trường hợp cụ thể về nhà đất trong quá trình thực hiện các chính sách quản lý nhà đất và chính sách cải tạo xã hội chủ nghĩa trước ngày 01 tháng 7 năm 1991 thì cơ quan nhà nước có thẩm quyền phải hoàn tất thủ tục xác lập sở hữu toàn dân và thực hiện ký hợp đồng thuê nhà ở theo quy định trước khi thực hiện bán nhà ở này;
d) Trường hợp bán nhà không có nguồn gốc là nhà ở nhưng được bố trí sử dụng để ở từ trước ngày 05 tháng 7 năm 1994 thì nhà ở này phải đảm bảo các điều kiện: Khu đất đã bố trí làm nhà ở đó có khuôn viên độc lập hoặc có thể tách biệt khỏi khuôn viên trụ sở, cơ quan; nhà ở có lối đi riêng, không che chắn mặt tiền trụ sở, cơ quan, không ảnh hưởng đến không gian, cảnh quan xung quanh; cơ quan, đơn vị không có nhu cầu sử dụng và nhà ở này phù hợp với quy hoạch sử dụng đất ở tại địa phương đã được cấp có thẩm quyền phê duyệt. Cơ quan, đơn vị không có nhu cầu sử dụng diện tích nhà ở này phải chuyển giao cho Ủy ban nhân dân cấp tỉnh nơi có nhà đó quản lý để thực hiện bán theo quy định tại Nghị định này, trừ trường hợp nhà ở do Bộ Quốc phòng đang quản lý.
4. Trường hợp bán nhà ở, nhà không có nguồn gốc là nhà ở nhưng được bố trí sử dụng từ ngày 05 tháng 7 năm 1994 đến trước ngày 19 tháng 01 năm 2007 thì thực hiện theo quy định tại Điều 70 của Nghị định này.
5. Trường hợp nhà không có nguồn gốc là nhà ở nhưng được bố trí sử dụng để ở từ trước ngày 05 tháng 7 năm 1994 mà không đủ điều kiện quy định tại Điểm d Khoản 3 Điều này và trường hợp bố trí sử dụng nhà ở từ ngày 19 tháng 01 năm 2007 thì thực hiện giải quyết theo quy định của pháp luật về quản lý tài sản nhà đất thuộc sở hữu nhà nước.
Điều 64. Cơ quan bán nhà ở cũ thuộc sở hữu nhà nước
1. Ủy ban nhân dân cấp tỉnh, Bộ Quốc phòng chịu trách nhiệm về việc bán nhà ở và giao cho cơ quan quản lý nhà ở thực hiện việc bán nhà ở cũ thuộc sở hữu nhà nước theo quy định của Nghị định này.
2. Đối với nhà ở cũ tại các địa phương nhưng đang do Bộ Quốc phòng quản lý, nếu Bộ Quốc phòng có nhu cầu chuyển giao sang cho Ủy ban nhân dân cấp tỉnh nơi có nhà ở đó quản lý và bán thì Bộ Quốc phòng thống nhất với Ủy ban nhân dân cấp tỉnh về việc thực hiện bàn giao, tiếp nhận các nhà ở này. Sau khi tiếp nhận nhà ở từ Bộ Quốc phòng, Ủy ban nhân dân cấp tỉnh là đại diện chủ sở hữu đối với nhà ở này và có trách nhiệm tổ chức quản lý, cho thuê hoặc bán theo quy định của Nghị định này.
Điều 65. Giá bán nhà ở cũ thuộc sở hữu nhà nước
Giá bán nhà ở cũ áp dụng cho các trường hợp được bố trí sử dụng trước ngày 05 tháng 7 năm 1994 (kể cả nhà ở thuộc diện xác lập sở hữu toàn dân quy định tại Điểm c Khoản 3 Điều 63 của Nghị định này) được tính bao gồm tiền nhà và tiền sử dụng đất (không phân biệt trường hợp mua một hoặc mua nhiều nhà ở) và được quy định như sau:
1. Tiền nhà được xác định căn cứ vào giá trị còn lại của nhà ở và hệ số điều chỉnh giá trị sử dụng; giá trị còn lại của nhà ở được xác định theo tỷ lệ chất lượng còn lại của nhà ở nhân (x) với giá chuẩn nhà ở xây dựng mới do Ủy ban nhân dân cấp tỉnh ban hành có hiệu lực thi hành tại thời điểm ký hợp đồng mua bán và nhân (x) với diện tích sử dụng nhà ở.
Đối với nhà biệt thự có nhiều hộ ở mà có diện tích nhà sử dụng chung thì diện tích sử dụng chung này được phân bổ theo tỷ lệ sử dụng nhà ở (m2) cho mỗi hộ. Đối với nhà ở cấp IV mà người thuê đã phá dỡ, xây dựng lại trước ngày Nghị định này có hiệu lực thi hành thì giá trị còn lại của nhà ở này được tính bằng 0 (bằng không).
2. Tiền sử dụng đất khi chuyển quyền sử dụng đất cùng với việc bán nhà ở cũ được tính theo bảng giá đất ở do Ủy ban nhân dân cấp tỉnh ban hành có hiệu lực thi hành tại thời điểm ký hợp đồng mua bán và căn cứ vào vị trí của đất ở, tầng nhà như sau:
a) Đối với nhà ở nhiều tầng có nhiều hộ ở thì tính bằng 10% giá đất ở khi chuyển quyền sử dụng đất và phân bổ cho các tầng theo các hệ số tầng tương ứng;
b) Đối với nhà ở một tầng và nhà ở nhiều tầng có một hộ ở, nhà biệt thự có một hộ hoặc có nhiều hộ ở thì tính bằng 40% giá đất ở khi chuyển quyền sử dụng đối với phần diện tích đất trong hạn mức đất ở do Ủy ban nhân dân cấp tỉnh quy định cho mỗi hộ; đối với phần diện tích đất vượt hạn mức đất ở do Ủy ban nhân dân cấp tỉnh quy định cho mỗi hộ thì tính bằng 100% giá đất ở;
c) Trường hợp nhà biệt thự có nhiều hộ ở thì diện tích đất để tính tiền sử dụng đất của mỗi hộ bao gồm diện tích đất sử dụng riêng không có tranh chấp; diện tích đất xây dựng nhà biệt thự được phân bổ cho các hộ theo diện tích sử dụng nhà của mỗi hộ tương ứng với hệ số tầng; diện tích đất sử dụng chung trong khuôn viên của nhà biệt thự được phân bổ cho các hộ sử dụng chung (tính theo số hộ đang sử dụng nhà biệt thự). Việc tính tiền sử dụng đất của mỗi hộ được thực hiện từ phần diện tích đất xây dựng nhà biệt thự có nhiều hộ ở trước, sau đó tính các phần diện tích khác sau.
Ủy ban nhân dân cấp tỉnh có trách nhiệm quy định cụ thể việc phân bổ phần diện tích đất khi bán nhà biệt thự cho phù hợp tình hình thực tế của địa phương;
d) Đối với nhà ở riêng lẻ có khả năng sinh lợi cao tại vị trí mặt đường, phố thì Ủy ban nhân dân cấp tỉnh quyết định hệ số k điều chỉnh giá đất so với bảng giá do Ủy ban nhân dân cấp tỉnh ban hành để tính tiền sử dụng đất khi bán nhà ở và chuyển quyền sử dụng đất gắn với nhà ở này;
đ) Trường hợp nhà ở cũ khi xây dựng có một phần tiền góp của cá nhân và của tập thể mà không có nguồn gốc từ ngân sách nhà nước thì tiền mua nhà được tính theo quy định tại Khoản 1 Điều này nhưng người mua được trừ số tiền đã góp xây dựng nhà ở trước đây (tính trên tỷ lệ % số tiền đã góp so với giá trị quyết toán khi xây dựng công trình nhà ở); đối với tiền sử dụng đất thì thực hiện theo quy định tại Khoản này.
3. Trường hợp nhà ở một tầng có nhiều hộ ở và nhà ở nhiều tầng có nhiều hộ ở mà có diện tích nhà ở, đất ở sử dụng chung thì chỉ thực hiện bán phần diện tích sử dụng chung này cho các hộ đang sử dụng nếu tất cả các hộ đồng thuận được việc phân bổ diện tích cho từng hộ; trường hợp các hộ không đồng thuận được thì cơ quan quản lý nhà ở không bán phần diện tích này và có trách nhiệm quản lý theo quy định của Nghị định này.
4. Bộ Xây dựng hướng dẫn cụ thể về giá bán nhà ở, phương pháp xác định giá trị còn lại của nhà ở, hệ số điều chỉnh giá trị sử dụng của nhà ở, việc phân bổ hệ số các tầng khi chuyển quyền sử dụng đất đối với nhà nhiều tầng, nhiều hộ ở của nhà ở cũ.
Điều 66. Nguyên tắc miễn, giảm tiền mua nhà ở cũ thuộc sở hữu nhà nước
1. Tiền mua nhà ở cũ thuộc sở hữu nhà nước bao gồm tiền sử dụng đất và tiền nhà.
2. Việc miễn, giảm tiền sử dụng đất khi bán nhà ở và chuyển quyền sử dụng đất gắn với nhà ở này phải bảo đảm các nguyên tắc sau đây:
a) Việc miễn, giảm tiền sử dụng đất khi bán nhà ở cũ thuộc sở hữu nhà nước chỉ xét một lần cho người mua nhà ở; trường hợp một người được hưởng nhiều chế độ giảm thì chỉ áp dụng mức giảm cao nhất để tính. Trường hợp trong hộ gia đình có nhiều người đang thuê thuộc diện được giảm tiền sử dụng đất thì được cộng các mức giảm của từng người nhưng tối đa không vượt quá số tiền sử dụng đất mà người mua nhà phải nộp;
b) Không thực hiện việc miễn, giảm tiền sử dụng đất đối với trường hợp quy định tại Điểm c và Điểm d Khoản 1 Điều 61, Khoản 1 và Khoản 3 Điều 71 của Nghị định này;
c) Người đã được hưởng các chế độ miễn, giảm tiền sử dụng đất khi mua nhà ở thuộc sở hữu nhà nước hoặc đã được miễn, giảm tiền sử dụng đất khi được Nhà nước giao đất làm nhà ở hoặc đã được hỗ trợ cải thiện nhà ở bằng tiền trước ngày Nghị định này có hiệu lực thi hành thì không được hưởng miễn, giảm tiền sử dụng đất khi nhận chuyển quyền sử dụng đất gắn với mua nhà ở theo quy định của Nghị định này.
3. Việc giảm tiền nhà phải bảo đảm các nguyên tắc sau đây:
a) Việc giảm tiền nhà không được tính trùng về thời gian, đối tượng. Mỗi đối tượng chỉ được giảm một lần khi mua nhà ở đang thuê;
b) Không thực hiện giảm tiền nhà đối với trường hợp quy định tại Điểm c, Điểm d Khoản 1 Điều 61 và Khoản 1 Điều 71 của Nghị định này;
c) Trong một hộ gia đình có nhiều thành viên có tên trong cùng hợp đồng thuê nhà hoặc cùng hộ khẩu thường trú tại địa chỉ nhà ở thuộc diện được giảm tiền mua nhà thì được cộng số tiền mua nhà ở được giảm của từng thành viên để tính tổng số tiền mua nhà ở được giảm của cả hộ gia đình nhưng mức tiền nhà được giảm không được vượt quá số tiền mua nhà phải nộp (không bao gồm tiền sử dụng đất) trong giá bán nhà;
d) Số năm được tính, để giảm tiền nhà là số năm công tác thực tế trong các cơ quan, đơn vị thuộc khu vực nhà nước quản lý tính đến thời điểm ký hợp đồng mua nhà. Khi tính số năm công tác nếu có tháng lẻ từ sáu tháng trở xuống thì tính bằng nửa năm và trên sáu tháng thì tính tròn một năm.
Điều 67. Đối tượng được miễn, giảm tiền mua nhà ở cũ thuộc sở hữu nhà nước
1. Đối tượng được miễn, giảm tiền sử dụng đất khi mua nhà ở cũ thuộc sở hữu nhà nước gắn với việc nhận chuyển quyền sử dụng đất có nhà ở này bao gồm:
a) Người có công với cách mạng theo quy định của pháp luật ưu đãi người có công với cách mạng;
b) Hộ nghèo, cận nghèo theo quy định về chuẩn nghèo, cận nghèo do Thủ tướng Chính phủ ban hành;
c) Người khuyết tật, người già cô đơn và các đối tượng đặc biệt có khó khăn về nhà ở tại khu vực đô thị.
2. Đối tượng được giảm tiền nhà khi mua nhà ở cũ thuộc sở hữu nhà nước bao gồm:
a) Cán bộ, công chức, viên chức trong cơ quan hành chính, sự nghiệp, cơ quan Đảng và đoàn thể hưởng lương từ ngân sách nhà nước;
b) Người hưởng lương từ ngân sách nhà nước trong lực lượng vũ trang;
c) Hạ sĩ quan, chiến sĩ hưởng sinh hoạt phí có thời gian hoạt động ở các chiến trường A, B, C, K;
d) Cán bộ công tác tại xã, phường hưởng lương từ ngân sách nhà nước hoặc hưởng sinh hoạt phí theo định suất do Nhà nước quy định;
đ) Công nhân, viên chức làm việc thường xuyên từ một năm trở lên trong các doanh nghiệp nhà nước, các tổ chức, đơn vị được phép hoạt động sản xuất kinh doanh, dịch vụ thuộc cơ quan hành chính, sự nghiệp, lực lượng vũ trang, cơ quan Đảng và đoàn thể;
e) Những đối tượng quy định tại các Điểm a, b, c và đ Khoản này được cử sang làm việc trong các doanh nghiệp có vốn đầu tư nước ngoài, khu công nghiệp, khu chế xuất, khu công nghệ cao, khu kinh tế, các văn phòng đại diện kinh tế, thương mại được thành lập và hoạt động tại Việt Nam, các cơ quan đại diện ngoại giao, tổ chức quốc tế hoặc các tổ chức phi Chính phủ, cơ quan thông tấn, báo chí, phát thanh, truyền hình nước ngoài đặt tại Việt Nam và các đơn vị thuộc các thành phần kinh tế khác;
g) Người hưởng lương hưu, trợ cấp mất sức lao động, trợ cấp tai nạn lao động hay bệnh nghề nghiệp, trợ cấp công nhân cao su, trợ cấp bảo hiểm xã hội một lần, trợ cấp thôi việc trước và sau khi có Quyết định số 111/HĐBT ngày 12 tháng 4 năm 1991 của Hội đồng Bộ trưởng (nay là Chính phủ) hoặc trước và sau khi có Bộ luật Lao động năm 1994;
h) Người hưởng lương trong lực lượng vũ trang nhưng không đủ điều kiện hưởng lương hưu, trợ cấp mất sức lao động hàng tháng mà hưởng trợ cấp phục viên hoặc xuất ngũ; những người phục viên trước năm 1960;
i) Các đối tượng quy định tại Khoản 1 Điều này.
Điều 68. Mức miễn, giảm tiền mua nhà ở cũ thuộc sở hữu nhà nước
1. Mức miễn, giảm tiền sử dụng đất cho đối tượng quy định tại Khoản 1 Điều 67 của Nghị định này được thực hiện theo quyết định của Thủ tướng Chính phủ.
Riêng hộ nghèo, cận nghèo, người khuyết tật, người già cô đơn và các đối tượng đặc biệt có khó khăn về nhà ở tại khu vực đô thị được giảm 60% tiền sử dụng đất phải nộp; đối với hộ nghèo, cận nghèo thì mức giảm này được tính cho cả hộ gia đình (không tính cho từng thành viên trong hộ gia đình).
2. Mức giảm tiền nhà cho các đối tượng quy định tại Khoản 2 Điều 67 của Nghị định này được quy định như sau:
a) Mỗi năm công tác người mua nhà được giảm tương ứng với 0,69 lần mức lương tối thiểu dùng để áp dụng cho cán bộ, công chức, viên chức và lực lượng vũ trang theo quy định của Chính phủ. Trường hợp người mua nhà ở có thời gian làm việc trong lực lượng vũ trang thì mỗi năm công tác trong lực lượng vũ trang được giảm số tiền tương ứng bằng 1,24 lần mức lương tối thiểu quy định tại Điểm này;
b) Trường hợp người có công với cách mạng, người thuộc hộ nghèo, cận nghèo, người khuyết tật, người già cô đơn có năm công tác để tính giảm nhưng tổng số tiền được giảm tính theo năm công tác nhỏ hơn 6,9 lần mức lương tối thiểu theo quy định của Chính phủ thì được giảm bằng 6,9 lần mức lương tối thiểu cho một người; trường hợp không có năm công tác để tính thì được giảm bằng 6,9 lần mức lương tối thiểu.
Riêng đối với người thuộc hộ nghèo, cận nghèo thì thực hiện tính giảm cho cả hộ gia đình (không tính cho từng thành viên trong hộ gia đình).
Điều 69. Hồ sơ, trình tự, thủ tục bán nhà ở cũ thuộc sở hữu nhà nước
1. Hồ sơ đề nghị mua nhà ở cũ thuộc sở hữu nhà nước bao gồm:
a) Đơn đề nghị mua nhà ở cũ;
b) Bản sao Giấy chứng minh nhân dân hoặc Thẻ căn cước công dân hoặc hộ chiếu đang còn giá trị hoặc Thẻ quân nhân của người đề nghị mua nhà ở; trường hợp là vợ chồng thì phải có thêm bản sao có chứng thực hộ khẩu gia đình hoặc Giấy đăng ký kết hôn;
c) Hợp đồng thuê nhà ở được lập hợp pháp; giấy tờ chứng minh đã nộp đủ tiền thuê nhà ở và chi phí quản lý vận hành nhà ở đến thời điểm nộp hồ sơ đề nghị mua nhà ở.
Trường hợp người có tên trong hợp đồng thuê nhà ở đã xuất cảnh ra nước ngoài thì phải có văn bản ủy quyền (có xác nhận của cơ quan công chứng hoặc chứng thực theo quy định) cho các thành viên khác đứng tên mua nhà ở; nếu có thành viên có tên trong hợp đồng thuê nhà ở đã chết thì phải có giấy chứng tử kèm theo.
Trong trường hợp có thành viên thuê nhà ở khước từ quyền mua và đứng tên trong Giấy chứng nhận thì phải có văn bản khước từ quyền mua, không đứng tên trong Giấy chứng nhận và cam kết không có tranh chấp, khiếu kiện về việc mua bán nhà ở này;
d) Giấy tờ chứng minh thuộc đối tượng được miễn, giảm tiền mua nhà ở (nếu có).
2. Trình tự, thủ tục bán nhà ở cũ thuộc sở hữu nhà nước được thực hiện như sau:
a) Người mua nhà ở phải nộp hồ sơ đề nghị mua nhà tại đơn vị đang quản lý vận hành nhà ở hoặc tại cơ quan quản lý nhà ở (do Ủy ban nhân dân cấp tỉnh quyết định);
b) Cơ quan tiếp nhận hồ sơ có trách nhiệm tiếp nhận, ghi giấy biên nhận hồ sơ, kiểm tra hồ sơ và lập danh sách người mua nhà ở. Trên cơ sở hồ sơ đề nghị mua nhà ở cũ, Sở Xây dựng tổ chức họp Hội đồng xác định giá bán nhà ở để xác định giá bán nhà ở, quyền sử dụng đất. Sau khi Hội đồng xác định giá bán nhà ở xác định giá bán nhà ở, quyền sử dụng đất, Sở Xây dựng lập danh sách đối tượng được mua nhà ở kèm theo văn bản xác định giá bán nhà ở của Hội đồng xác định giá bán nhà ở trình cơ quan đại diện chủ sở hữu nhà ở xem xét, quyết định.
Đối với nhà ở do Bộ Quốc phòng đang quản lý thì cơ quan tiếp nhận hồ sơ đề nghị Hội đồng xác định giá bán nhà ở họp để xác định giá; sau đó trình Bộ Quốc phòng ban hành quyết định bán nhà ở cũ;
c) Căn cứ vào báo cáo của cơ quan quản lý nhà ở, cơ quan đại diện chủ sở hữu xem xét, ban hành quyết định bán nhà ở cũ, trong đó nêu rõ đối tượng được mua nhà ở, địa chỉ nhà ở được bán, giá bán nhà ở cũ và giá chuyển quyền sử dụng đất và gửi quyết định này cho cơ quan quản lý nhà ở, đơn vị quản lý vận hành nhà ở biết để phối hợp thực hiện ký kết hợp đồng mua bán nhà ở;
d) Sau khi nhận quyết định bán nhà ở cũ, đơn vị quản lý vận hành nhà ở thông báo cho người mua nhà biết thời gian cụ thể để ký kết hợp đồng mua bán nhà ở với cơ quan quản lý nhà ở;
đ) Thời gian thực hiện bán nhà ở cũ là không quá 45 ngày, kể từ ngày đơn vị quản lý vận hành nhà ở nhận đủ hồ sơ hợp lệ đến khi ký hợp đồng mua bán. Thời gian này không tính vào thời gian nộp nghĩa vụ tài chính và thời gian cơ quan có thẩm quyền thực hiện cấp Giấy chứng nhận cho người mua nhà ở.
Việc cấp Giấy chứng nhận cho người mua nhà ở được thực hiện theo quy định của pháp luật về đất đai. Cơ quan có thẩm quyền cấp Giấy chứng nhận phải gửi danh sách người mua nhà ở đã được cấp giấy và sao một (01) bản Giấy chứng nhận cho Sở Xây dựng lưu để theo dõi;
e) Trường hợp quá 90 ngày, kể từ ngày đơn vị quản lý vận hành nhà ở có thông báo thời gian ký hợp đồng mua bán nhà ở mà người mua chưa thực hiện ký hợp đồng, nếu có thay đổi về giá đất ở do Ủy ban nhân dân cấp tỉnh ban hành thì cơ quan quản lý nhà ở phải báo cáo Ủy ban nhân cấp tỉnh phê duyệt giá mới trước khi ký kết hợp đồng mua bán với người mua nhà ở.
3. Bộ Xây dựng hướng dẫn cụ thể mẫu đơn đề nghị mua nhà ở cũ, các giấy tờ chứng minh thuộc đối tượng được miễn, giảm tiền mua nhà ở, hồ sơ mua nhà ở, trình tự, thủ tục mua bán và mẫu hợp đồng mua bán nhà ở cũ thuộc sở hữu nhà nước.
Điều 70. Giải quyết bán nhà ở và nhà không có nguồn gốc là nhà ở nhưng đã bố trí để ở từ ngày 05 tháng 7 năm 1994 đến trước ngày 19 tháng 01 năm 2007
1. Trường hợp nhà ở, nhà không có nguồn gốc là nhà ở nhưng bố trí cho hộ gia đình, cá nhân sử dụng để ở trong khoảng thời gian từ ngày 05 tháng 7 năm 1994 đến trước ngày 19 tháng 01 năm 2007 (bao gồm cả nhà ở thuộc diện xác lập sở hữu toàn dân quy định tại Điểm c Khoản 3 Điều 63 của Nghị định này) thì thực hiện bán theo quy định sau đây:
a) Người mua nhà ở phải đáp ứng các điều kiện quy định tại Khoản 2 Điều 63 và nhà ở phải đáp ứng điều kiện quy định tại Khoản 3 Điều 63 của Nghị định này;
b) Giá bán nhà ở bao gồm tiền nhà và tiền sử dụng đất;
c) Tiền nhà được xác định theo tỷ lệ chất lượng còn lại của nhà ở nhân (x) với giá chuẩn nhà ở xây dựng mới do Ủy ban nhân dân cấp tỉnh ban hành có hiệu lực thi hành tại thời điểm ký hợp đồng mua bán và nhân (x) với diện tích sử dụng;
d) Tiền sử dụng đất khi chuyển quyền sử dụng đất được tính bằng 100% giá đất ở theo bảng giá do Ủy ban nhân dân cấp tỉnh ban hành có hiệu lực thi hành tại thời điểm ký hợp đồng mua bán (bao gồm cả tiền sử dụng đất tính theo hệ số k nếu nhà ở thuộc diện quy định tại Điểm d Khoản 2 Điều 65 của Nghị định này) và không phân biệt diện tích trong hạn mức đất ở hoặc ngoài hạn mức đất ở.
2. Đối với nhà ở hoặc nhà không có nguồn gốc là nhà ở nhưng đã được bố trí làm nhà ở từ ngày 05 tháng 7 năm 1994 đến trước ngày 19 tháng 01 năm 2007 mà không có đủ điều kiện bán theo quy định tại Điểm a Khoản 1 Điều này thì giải quyết theo quy định của pháp luật về quản lý tài sản nhà đất thuộc sở hữu nhà nước.
Điều 71. Giải quyết bán phần diện tích nhà sử dụng chung và chuyển quyền sử dụng đất đối với diện tích đất liền kề với nhà ở cũ thuộc sở hữu nhà nước
1. Trường hợp nhà ở có nhiều hộ ở mà Nhà nước đã bán hết phần diện tích nhà thuộc quyền sử dụng riêng cho các hộ nhưng chưa bán phần diện tích nhà ở và chuyển quyển sử dụng đất ở sử dụng chung trong khuôn viên của nhà ở đó, nếu tổ chức hoặc hộ gia đình, cá nhân đang sở hữu toàn bộ diện tích nhà ở mà Nhà nước đã bán có nhu cầu mua toàn bộ phần diện tích sử dụng chung này thì giải quyết như sau:
a) Tổ chức, hộ gia đình, cá nhân phải nộp tiền nhà và tiền sử dụng đất đối với phần diện tích sử dụng chung này;
b) Mức thu tiền nhà được xác định theo tỷ lệ chất lượng còn lại của nhà ở nhân (x) với giá chuẩn nhà ở xây dựng mới do Ủy ban nhân dân cấp tỉnh ban hành có hiệu lực thi hành tại thời điểm ký hợp đồng mua bán và nhân (x) với diện tích sử dụng;
c) Mức thu tiền sử dụng đất tính bằng 100% giá đất ở theo bảng giá do Ủy ban nhân dân cấp tỉnh ban hành có hiệu lực thi hành tại thời điểm ký hợp đồng mua bán (bao gồm cả tiền sử dụng đất tính theo hệ số k nếu nhà ở thuộc diện quy định tại Điểm d Khoản 2 Điều 65 của Nghị định này);
d) Trước khi thực hiện bán phần diện tích nhà thuộc sử dụng chung theo quy định tại Khoản này, cơ quan bán nhà ở không phải ký hợp đồng thuê đối với phần diện tích sử dụng chung này.
2. Đối với phần diện tích đất liền kề với nhà ở cũ thuộc sở hữu nhà nước mà khi bán hóa giá nhà ở hoặc bán nhà ở theo Nghị định số 61/CP của Chính phủ về mua bán và kinh doanh nhà ở hoặc bán nhà ở theo quy định của Nghị đinh số 34/2013/NĐ-CP, Nhà nước chưa giải quyết chuyển quyền sử dụng diện tích đất này hoặc khi bán nhà ở theo quy định của Nghị định này thì giải quyết phần diện tích đất liền kề này như sau:
a) Chuyển quyền sử dụng đất đối với phần diện tích đất liền kề với nhà ở thuộc sở hữu nhà nước cho người đang thực tế sử dụng hợp pháp nhà ở đó nếu phần diện tích này không có tranh chấp, khiếu kiện, phù hợp quy hoạch xây dựng nhà ở và quy hoạch, kế hoạch sử dụng đất ở;
b) Tiền sử dụng đất được tính bằng 40% giá đất ở đối với diện tích trong hạn mức đất ở, tính bằng 100% giá đất ở đối với phần diện tích vượt hạn mức đất ở trong khuôn viên nhà ở thuộc sở hữu nhà nước đó (hạn mức đất ở được tính bao gồm cả diện tích đất có nhà ở đã mua và diện tích đất liền kề). Giá đất để tính tiền sử dụng đất khi chuyển quyền sử dụng được áp dụng theo bảng giá đất ở do Ủy ban nhân dân cấp tỉnh ban hành có hiệu lực thi hành tại thời điểm chuyển quyền sử dụng đất đối với diện tích đất liền kề đó. Đối với phần diện tích đất ngoài khuôn viên nhà ở cũ thuộc sở hữu nhà nước thì thực hiện thu tiền sử dụng đất theo quy định của pháp luật về đất đai.
3. Trường hợp xây dựng nhà ở trên đất trống trong khuôn viên nhà ở cũ thuộc sở hữu nhà nước mà phù hợp với quy hoạch xây dựng nhà ở, quy hoạch, kế hoạch sử dụng đất ở và không có tranh chấp, khiếu kiện thì người đang sử dụng đất được Nhà nước công nhận quyền sử dụng đất; mức thu tiền sử dụng đất trong trường hợp này được tính bằng 100% giá đất ở theo bảng giá do Ủy ban nhân dân cấp tỉnh ban hành có hiệu lực thi hành tại thời điểm thực hiện công nhận quyền sử dụng đất.
4. Đối với phần diện tích nhà thuộc sử dụng chung mà chủ sở hữu nhà ở không mua thì cơ quan quản lý nhà ở chủ trì, phối hợp với Ủy ban nhân dân cấp huyện thực hiện quản lý theo quy định của Nghị định này, pháp luật về nhà ở và pháp luật về đất đai.
5. Căn cứ vào quy định của Nghị định này, Ủy ban nhân dân cấp tỉnh có trách nhiệm ban hành quy định cụ thể hồ sơ, trình tự, thủ tục giải quyết đối với trường hợp quy định tại các Khoản 1, 2 và Khoản 3 Điều này, bố trí kinh phí để đo vẽ, lập hồ sơ và thực hiện quản lý phần diện tích nhà thuộc sử dụng chung quy định tại Khoản 4 Điều này.
6. Bộ Xây dựng hướng dẫn cụ thể quy định tại Khoản 1 và Khoản 2 Điều này.
Chương VI
GIAO DỊCH VỀ NHÀ Ở
Điều 72. Giấy tờ chứng minh điều kiện nhà ở tham gia giao dịch đối với trường hợp không bắt buộc phải có Giấy chứng nhận
Giấy tờ chứng minh điều kiện, nhà ở tham gia giao dịch đối với trường hợp quy định tại Khoản 2 Điều 118 của Luật Nhà ở được quy định như sau:
1. Trường hợp thế chấp nhà ở hình thành trong tương lai thì phải có các giấy tờ theo quy định tại Khoản 1 Điều 148 của Luật Nhà ở; trường hợp mua bán nhà ở thương mại hình thành trong tương lai thì phải có giấy tờ theo quy định của pháp luật kinh doanh bất động sản và quy định tại Điểm b Khoản 2 Điều 19 của Nghị định này.
2. Trường hợp tổ chức tặng cho nhà tình nghĩa, nhà tình thương thì phải có giấy tờ chứng minh về việc xây dựng nhà ở của bên tặng cho.
3. Trường hợp cho thuê nhà ở cũ thuộc sở hữu nhà nước thì phải có giấy tờ theo quy định tại Điều 60 của Nghị định này; trường hợp mua bán nhà ở cũ thuộc sở hữu nhà nước thì phải có giấy tờ theo quy định tại Điều 69 của Nghị định này.
4. Trường hợp mua bán, thuê mua nhà ở xã hội (bao gồm cả trường hợp hộ gia đình, cá nhân thuộc diện tái định cư mua, thuê mua nhà ở xã hội) thì phải có các giấy tờ chứng minh đủ điều kiện theo quy định tại Điều 63 của Luật Nhà ở.
5. Trường hợp mua bán nhà ở được đầu tư xây dựng theo dự án để phục vụ tái định cư thì phải có Giấy chứng nhận hoặc quyết định giao đất, có quyết định phê duyệt dự án của cơ quan có thẩm quyền và hồ sơ dự án đã được phê duyệt, có Giấy phép xây dựng nếu thuộc diện phải có Giấy phép xây dựng, có giấy tờ nghiệm thu hoàn thành việc xây dựng và đưa nhà ở vào sử dụng theo quy định của pháp luật về xây dựng.
6. Trường hợp hộ gia đình, cá nhân mua nhà ở thương mại để phục vụ tái định cư thì phải có hợp đồng mua bán nhà ở hoặc hợp đồng đặt hàng mua nhà ở ký kết giữa chủ đầu tư dự án nhà ở thương mại với đơn vị được Nhà nước giao bố trí nhà ở phục vụ tái định cư kèm theo hồ sơ dự án đã được phê duyệt; nếu mua nhà ở có sẵn thì phải có thêm giấy tờ nghiệm thu hoàn thành việc xây dựng và đưa nhà ở vào sử dụng theo quy định của pháp luật về xây dựng; nếu mua nhà ở hình thành trong tương lai thì phải có biên bản nghiệm thu hoàn thành việc xây dựng phần móng của nhà ở theo quy định của pháp luật về xây dựng.
7. Trường hợp mua bán nhà ở theo quy định tại Khoản 4 Điều 62 của Luật Nhà ở thì phải có hợp đồng mua bán hoặc hợp đồng thuê mua nhà ở ký với chủ đầu tư dự án xây dựng nhà ở xã hội kèm theo biên bản bàn giao nhà ở và giấy tờ chứng minh đã thanh toán hết tiền mua hoặc tiền thuê mua nhà ở cho chủ đầu tư.
8. Trường hợp thừa kế nhà ở thì phải có giấy tờ theo quy định sau đây:
a) Nếu thừa kế nhà ở thuộc diện được tặng cho thì phải có văn bản hoặc hợp đồng tặng cho được lập hợp pháp kèm theo giấy tờ chứng minh quyền sở hữu nhà ở của bên tặng cho (nếu có);
b) Nếu thừa kế nhà ở thuộc diện mua, thuê mua thì phải có hợp đồng mua bán, thuê mua nhà ở hợp pháp kèm theo giấy tờ chứng minh quyền sở hữu nhà ở hoặc chứng minh việc đầu tư xây dựng nhà ở của bên bán, bên cho thuê mua;
c) Nếu thừa kế nhà ở thuộc diện đầu tư xây dựng mới thì phải có Giấy phép xây dựng (đối với trường hợp phải có Giấy phép xây dựng) và giấy tờ chứng minh có quyền sử dụng đất hợp pháp theo quy định của pháp luật về đất đai của bên để thừa kế;
d) Nếu thừa kế nhà ở theo quyết định của Tòa án nhân dân thì phải có bản án hoặc quyết định đã có hiệu lực pháp luật của Tòa án nhân dân.
9. Trường hợp cho thuê, cho mượn, cho ở nhờ, ủy quyền quản lý nhà ở (trừ trường hợp cho thuê nhà ở cũ thuộc sở hữu nhà nước) thì bên cho thuê, cho mượn, cho ở nhờ, ủy quyền quản lý nhà ở phải có hợp đồng mua bán, thuê mua nhà ở ký với chủ đầu tư dự án xây dựng nhà ở nếu là mua, thuê mua nhà ở của chủ đầu tư hoặc có Giấy phép xây dựng hoặc giấy tờ khác chứng minh quyền sở hữu nhà ở theo quy định của pháp luật dân sự, pháp luật về đất đai nếu là đầu tư xây dựng nhà ở.
Điều 73. Bán nhà ở có thời hạn
1. Bên bán được bán nhà ở gắn với việc chuyển nhượng quyền sử dụng đất hoặc quyền thuê đất ở có nhà ở đó cho bên mua trong một thời hạn nhất định. Trong thời hạn sở hữu nhà ở và sử dụng đất ở, bên bán không được đơn phương chấm dứt hợp đồng, trừ trường hợp hai bên có thỏa thuận khác; việc cấp Giấy chứng nhận cho bên mua nhà ở được thực hiện theo quy định tại Khoản 1 Điều 7 của Nghị định này.
2. Khi hết thời hạn sở hữu nhà ở theo thỏa thuận trong hợp đồng thì thực hiện xử lý nhà ở theo quy định tại Điều 8 của Nghị định này.
3. Trong thời hạn sở hữu nhà ở, nếu các bên vi phạm hợp đồng mua bán thì bị xử lý vi phạm và phải bồi thường thiệt hại theo thỏa thuận trong hợp đồng; nếu các bên có tranh chấp về hợp đồng mua bán nhà ở thì do Tòa án nhân dân giải quyết theo quy định của pháp luật.
Chương VII
SỞ HỮU NHÀ Ở TẠI VIỆT NAM CỦA TỔ CHỨC, CÁ NHÂN
NƯỚC NGOÀI
Điều 74. Giấy tờ chứng minh đối tượng và điều kiện được sở hữu nhà ở tại Việt Nam
1. Đối với cá nhân nước ngoài thì phải có hộ chiếu còn giá trị có đóng dấu kiểm chứng nhập cảnh của cơ quan quản lý xuất, nhập cảnh Việt Nam và không thuộc diện được quyền ưu đãi, miễn trừ ngoại giao theo quy định của Pháp lệnh về quyền ưu đãi, miễn trừ dành cho cơ quan Đại diện ngoại giao, cơ quan Lãnh sự và cơ quan Đại diện của Tổ chức quốc tế tại Việt Nam.
2. Đối với tổ chức nước ngoài thì phải thuộc đối tượng quy định tại Điều 159 của Luật Nhà ở và có Giấy chứng nhận đăng ký đầu tư hoặc giấy tờ do cơ quan có thẩm quyền của Việt Nam cho phép hoạt động tại Việt Nam còn hiệu lực tại thời điểm ký kết các giao dịch về nhà ở (sau đây gọi chung là Giấy chứng nhận đăng ký đầu tư).
Điều 75. Khu vực tổ chức, cá nhân nước ngoài được sở hữu nhà ở
1. Tổ chức, cá nhân nước ngoài chỉ được sở hữu nhà ở (bao gồm căn hộ chung cư và nhà ở riêng lẻ) trong dự án đầu tư xây dựng nhà ở thương mại, trừ khu vực bảo đảm quốc phòng, an ninh theo quy định của pháp luật Việt Nam.
2. Bộ Quốc phòng, Bộ Công an có trách nhiệm xác định cụ thể các khu vực cần bảo đảm an ninh, quốc phòng tại từng địa phương và có văn bản thông báo cho Ủy ban nhân dân cấp tỉnh để làm căn cứ chỉ đạo Sở Xây dựng xác định cụ thể danh mục dự án đầu tư xây dựng nhà ở thương mại trên địa bàn không cho phép tổ chức, cá nhân nước ngoài được quyền sở hữu nhà ở.
Điều 76. Số lượng nhà ở mà tổ chức, cá nhân nước ngoài được sở hữu
1. Căn cứ vào thông báo của Bộ Quốc phòng, Bộ Công an và chỉ đạo của Ủy ban nhân dân cấp tỉnh theo quy định tại Khoản 2 Điều 75 của Nghị định này, Sở Xây dựng có trách nhiệm công bố công khai trên Cổng thông tin điện tử của Sở các nội dung sau đây:
a) Danh mục các dự án đầu tư xây dựng nhà ở trên địa bàn nằm trong khu vực mà tổ chức, cá nhân nước ngoài không được phép sở hữu nhà ở;
b) Số lượng nhà ở (bao gồm cả căn hộ, nhà ở riêng lẻ) mà tổ chức, cá nhân nước ngoài được sở hữu tại mỗi dự án đầu tư xây dựng nhà ở không thuộc diện quy định tại Điểm a Khoản này; số lượng căn hộ chung cư tại mỗi tòa nhà chung cư, số lượng nhà ở riêng lẻ của mỗi dự án mà tổ chức, cá nhân nước ngoài được sở hữu;
c) Số lượng nhà ở mà tổ chức, cá nhân nước ngoài đã mua, thuê mua, đã được cấp Giấy chứng nhận tại mỗi dự án đầu tư xây dựng nhà ở;
d) Số lượng căn hộ chung cư mà tổ chức, cá nhân nước ngoài được sở hữu trong trường hợp trên một địa bàn có số dân tương đương một đơn vị hành chính cấp phường có nhiều tòa nhà chung cư; số lượng nhà ở riêng lẻ mà tổ chức, cá nhân nước ngoài được sở hữu trong trường hợp trên một địa bàn có số dân tương đương một đơn vị hành chính cấp phường mà có một hoặc nhiều dự án nhưng có tổng số lượng nhà ở riêng lẻ ít hơn hoặc tương đương bằng 2.500 căn.
2. Tổ chức, cá nhân nước ngoài thuộc diện được sở hữu nhà ở tại Việt Nam chỉ được mua, thuê mua nhà ở của chủ đầu tư dự án xây dựng nhà ở, mua nhà ở của tổ chức, cá nhân nước ngoài quy định tại Điểm b Khoản 4 Điều 7 của Nghị định này và chỉ được nhận thừa kế, nhận tặng cho nhà ở của hộ gia đình, cá nhân hoặc nhận tặng cho nhà ở của tổ chức trong số lượng nhà ở theo quy định tại Khoản 3, Khoản 4 Điều này tại các dự án đầu tư xây dựng nhà ở được phép sở hữu; trường hợp tổ chức, cá nhân nước ngoài được tặng cho, được thừa kế nhà ở tại Việt Nam nhưng không thuộc diện được sở hữu nhà ở tại Việt Nam thì giải quyết theo quy định tại Điều 78 của Nghị định này.
3. Tổ chức, cá nhân nước ngoài chỉ được sở hữu không quá 30% tổng số căn hộ của một tòa nhà chung cư; trường hợp trên một địa bàn có số dân tương đương một đơn vị hành chính cấp phường mà có nhiều tòa nhà chung cư để bán, cho thuê mua thì tổ chức, cá nhân nước ngoài chỉ được sở hữu không quá 30% số căn hộ của mỗi tòa nhà chung cư và không quá 30% tổng số căn hộ của tất cả các tòa nhà chung cư này.
4. Trường hợp trên một địa bàn có số dân tương đương một đơn vị hành chính cấp phường mà có dự án đầu tư xây dựng nhà ở thương mại, trong đó có nhà ở riêng lẻ để bán, cho thuê mua thì tổ chức, cá nhân nước ngoài được sở hữu số lượng nhà ở riêng lẻ theo quy định sau đây:
a) Trường hợp chỉ có một dự án có số lượng nhà ở riêng lẻ dưới 2.500 căn thì tổ chức, cá nhân nước ngoài chỉ được sở hữu không quá 10% tổng số lượng nhà ở trong dự án đó;
b) Trường hợp chỉ có một dự án có số lượng nhà ở riêng lẻ tương đương 2.500 căn thì tổ chức, cá nhân nước ngoài chỉ được sở hữu không quá 250 căn;
c) Trường hợp có từ hai dự án trở lên mà tổng số nhà ở riêng lẻ trong các dự án này ít hơn hoặc bằng 2.500 căn thì tổ chức, cá nhân nước ngoài chỉ được sở hữu không quá 10% số lượng nhà ở của mỗi dự án.
5. Bộ Xây dựng hướng dẫn cụ thể cách thức xác định số lượng nhà ở mà tổ chức, cá nhân nước ngoài được sở hữu quy định tại Khoản 3 và Khoản 4 Điều này.
Điều 77. Gia hạn thời hạn sở hữu nhà ở tại Việt Nam của tổ chức, cá nhân nước ngoài
1. Trường hợp cá nhân nước ngoài sở hữu nhà ở theo quy định tại Điểm c Khỏan 2 Điều 161 của Luật Nhà ở thì việc gia hạn thời hạn sở hữu nhà ở được quy định như sau:
a) Trước khi hết hạn sở hữu nhà ở 03 tháng, nếu chủ sở hữu có nhu cầu gia hạn thêm thì phải có đơn ghi rõ thời hạn đề nghị gia hạn thêm kèm theo bản sao có chứng thực Giấy chứng nhận đối với nhà ở và gửi cho Ủy ban nhân dân cấp tỉnh nơi có nhà ở đó xem xét, giải quyết;
b) Trong thời hạn 30 ngày, kể từ ngày nhận được đơn đề nghị của chủ sở hữu, Ủy ban nhân dân cấp tỉnh xem xét và có văn bản đồng ý gia hạn một lần thời hạn sở hữu nhà ở theo đề nghị của chủ sở hữu nhưng tối đa không quá 50 năm, kể từ khi hết hạn sở hữu nhà ở lần đầu ghi trên Giấy chứng nhận, trừ trường hợp quy định tại Khoản 3 Điều này;
c) Căn cứ văn bản đồng ý gia hạn của Ủy ban nhân dân cấp tỉnh, cơ quan có thẩm quyền cấp Giấy chứng nhận có trách nhiệm ghi gia hạn trên Giấy chứng nhận; cơ quan cấp Giấy chứng nhận phải sao một bản Giấy chứng nhận và chuyển cho Sở Xây dựng để theo dõi.
2. Trường hợp tổ chức nước ngoài sở hữu nhà ở có thời hạn theo quy định tại Điểm d Khoản 2 Điều 161 của Luật Nhà ở thì việc gia hạn thời hạn sở hữu nhà ở được quy định như sau:
a) Trước khi hết hạn sở hữu nhà ở 03 tháng, nếu chủ sở hữu có nhu cầu gia hạn thêm thì phải có đơn ghi rõ thời hạn đề nghị gia hạn thêm kèm theo bản sao có chứng thực Giấy chứng nhận đối với nhà ở, Giấy chứng nhận đăng ký đầu tư đã được cơ quan có thẩm quyền của Việt Nam gia hạn hoạt động và gửi cho Ủy ban nhân dân cấp tỉnh nơi có nhà ở đó xem xét, giải quyết;
b) Trong thời hạn 30 ngày, kể từ ngày nhận được đơn đề nghị của chủ sở hữu, Ủy ban nhân dân cấp tỉnh xem xét và có văn bản đồng ý gia hạn một lần thời hạn sở hữu nhà ở theo đề nghị của chủ sở hữu nhưng tối đa không quá thời hạn ghi trên Giấy chứng nhận đăng ký đầu tư đã được cơ quan có thẩm quyền của Việt Nam gia hạn hoạt động;
c) Căn cứ văn bản đồng ý gia hạn của Ủy ban nhân dân cấp tỉnh, cơ quan có thẩm quyền cấp Giấy chứng nhận có trách nhiệm ghi gia hạn trên Giấy chứng nhận; cơ quan cấp Giấy chứng nhận phải sao một bản Giấy chứng nhận và chuyển cho Sở Xây dựng để theo dõi.
3. Trường hợp khi hết hạn sở hữu lần đầu mà cá nhân hoặc tổ chức nước ngoài bị cơ quan có thẩm quyền của Việt Nam quyết định buộc xuất cảnh hoặc buộc chấm dứt hoạt động tại Việt Nam thì không được gia hạn thêm thời hạn sở hữu theo quy định tại Khoản 1, Khoản 2 Điều này; nhà ở của đối tượng này được xử lý theo quy định tại Khoản 3 Điều 8 của Nghị định này.
Điều 78. Các trường hợp không được công nhận quyền sở hữu nhà ở tại Việt Nam
1. Tổ chức, cá nhân nước ngoài thuộc trường hợp quy định sau đây thì không được cấp Giấy chứng nhận đối với nhà ở mà chỉ được bán hoặc tặng cho nhà ở này cho các đối tượng được sở hữu nhà ở tại Việt Nam:
a) Tổ chức, cá nhân nước ngoài được tặng cho hoặc được thừa kế nhà ở nằm trong khu vực không thuộc diện được sở hữu theo quy định tại Điều 75 của Nghị định này hoặc vượt quá số lượng nhà ở được phép sở hữu theo quy định tại Khoản 3, Khoản 4 Điều 76 của Nghị định này;
b) Tổ chức nước ngoài không hoạt động tại Việt Nam, cá nhân nước ngoài không được phép nhập cảnh vào Việt Nam nhưng được tặng cho, được thừa kế nhà ở tại Việt Nam.
2. Đối tượng quy định tại Điểm a Khoản 1 Điều này được trực tiếp hoặc ủy quyền cho người khác bán hoặc tặng cho nhà ở; đối tượng quy định tại Điểm b Khoản 1 Điều này được ủy quyền cho cá nhân, tổ chức khác đang cư trú, hoạt động tại Việt Nam bán hoặc tặng cho nhà ở.
3. Việc bán, tặng cho nhà ở của các đối tượng quy định tại Khoản 2 Điều này được thực hiện khi có các giấy tờ theo quy định sau đây:
a) Có hợp đồng tặng cho, giấy tờ về thừa kế nhà ở được lập theo quy định của pháp luật về nhà ở và pháp luật dân sự của Việt Nam;
b) Có giấy tờ chứng minh quyền sở hữu nhà ở của bên tặng cho, bên để thừa kế theo quy định của Luật Nhà ở và Điều 72 của Nghị định này;
c) Có văn bản ủy quyền bán hoặc tặng cho nhà ở được lập theo quy định của pháp luật dân sự nếu ủy quyền cho người khác bán, tặng cho nhà ở.
4. Trình tự, thủ tục mua bán, tặng cho nhà ở của các đối tượng quy định tại Khoản 2 Điều này được thực hiện theo quy định của Luật Nhà ở và Nghị định này.
5. Trường hợp trong số đối tượng được thừa kế nhà ở có cả người thuộc diện được sở hữu nhà ở tại Việt Nam và người không thuộc diện được sở hữu nhà ở tại Việt Nam thì các bên được thừa kế phải thống nhất phân chia tài sản nhà ở này theo một trong các trường hợp sau đây:
a) Các bên thống nhất đề nghị cơ quan có thẩm quyền cấp Giấy chứng nhận đối với nhà ở đó cho người thuộc diện được sở hữu nhà ở tại Việt Nam;
b) Các bên thống nhất thực hiện tặng cho hoặc bán nhà ở này cho đối tượng thuộc diện được sở hữu nhà ở tại Việt Nam theo quy định tại Khoản 2, Khoản 3 Điều này để hưởng giá trị.
Điều 79. Quản lý nhà ở của tổ chức, cá nhân nước ngoài tại Việt Nam
1. Sở Xây dựng có trách nhiệm lập một mục riêng trên Cổng thông tin điện tử của Sở để đăng tải và quản lý các thông tin quy định tại Khoản 1 Điều 76 của Nghị định này.
2. Trước khi ký hợp đồng mua bán, thuê mua, tặng cho nhà ở, chủ đầu tư, bên tặng cho phải kiểm tra thông tin trên Cổng thông tin điện tử của Sở Xây dựng hoặc đề nghị Sở Xây dựng cung cấp thông tin để xác định số lượng nhà ở được bán, cho thuê mua, được tặng cho, Sở Xây dựng có trách nhiệm cung cấp thông tin trong ngày. Chủ đầu tư dự án xây dựng nhà ở chỉ được bán, cho thuê mua nhà ở, bên tặng cho chỉ được tặng cho nhà ở cho tổ chức, cá nhân nước ngoài theo đúng số lượng quy định tại Điều 76 của Nghị định này.
3. Sau khi ký hợp đồng mua bán, cho thuê mua, tặng cho nhà ở, chủ đầu tư, bên tặng cho có trách nhiệm thông báo ngay thông tin trong ngày (bằng thư điện tử và bằng văn bản) về địa chỉ nhà ở đã bán, cho thuê mua, đã tặng cho đến Sở Xây dựng nơi có nhà ở để đăng tải trên Cổng thông tin điện tử của Sở; sau khi nhận được thông tin, Sở Xây dựng phải kiểm tra và đăng tải ngay trên Cổng thông tin điện tử của Sở.
4. Trước khi cấp Giấy chứng nhận cho tổ chức, cá nhân nước ngoài, cơ quan có thẩm quyền cấp Giấy chứng nhận phải kiểm tra thông tin do Sở Xây dựng quản lý. Sau khi thực hiện cấp Giấy chứng nhận cho tổ chức, cá nhân nước ngoài, cơ quan có thẩm quyền cấp Giấy chứng nhận phải thông báo ngay trong ngày thông tin về nhà ở đã được cấp Giấy chứng nhận cho Sở Xây dựng để đăng tải trên Cổng thông tin điện tử của Sở Xây dựng.
5. Mọi giao dịch mua bán, cho thuê mua, tặng cho nhà ở của tổ chức, cá nhân nước ngoài vượt quá số lượng mà tổ chức, cá nhân nước ngoài được sở hữu theo quy định tại Điều 76 của Nghị định này hoặc giao dịch mua, thuê mua, tặng cho nhà ở tại dự án đầu tư xây dựng nhà ở mà tổ chức, cá nhân nước ngoài không thuộc diện được sở hữu thì đều không có giá trị pháp lý và không được cơ quan có thẩm quyền cấp Giấy chứng nhận; bên bán, cho thuê mua nhà ở phải bồi thường thiệt hại cho bên mua, thuê mua nhà ở.
6. Sở Xây dựng, chủ đầu tư, bên tặng cho nhà ở, cơ quan có thẩm quyền cấp Giấy chứng nhận nếu không kịp thời thông báo, đăng tải các thông tin theo quy định tại các Khoản 2, 3 và 4 Điều này thì phải chịu trách nhiệm trước pháp luật; nếu do chậm thông báo, đăng tải các thông tin mà gây thiệt hại thì phải bồi thường cho bên bị thiệt hại.
7. Cơ quan có thẩm quyền cấp Giấy chứng nhận cho tổ chức, cá nhân nước ngoài có trách nhiệm gửi văn bản thông báo kèm bản sao Giấy chứng nhận đã cấp (bao gồm cả trường hợp được gia hạn thêm) cho Sở Xây dựng nơi có nhà ở, Bộ Xây dựng và Bộ Tài nguyên và Môi trường để theo dõi, quản lý.
8. Nghiêm cấm tổ chức, cá nhân nước ngoài mua nhà ở để bán lại nhằm mục đích kinh doanh kiếm lời.
9. Bộ Xây dựng hướng dẫn biểu mẫu báo cáo tình hình mua bán, thuê mua, việc sở hữu nhà ở của tổ chức, cá nhân nước ngoài tại Việt Nam.
Chương VIII
XỬ LÝ CHUYỂN TIẾP
Điều 80. Xử lý chuyển tiếp đối với việc phát triển và quản lý nhà ở
1. Kể từ ngày Nghị định này có hiệu lực thi hành, các dự án đầu tư xây dựng nhà ở thuộc diện quy định tại Khoản 2 Điều 17 của Luật Nhà ở phải có tên gọi thống nhất là dự án đầu tư xây dựng nhà ở, việc triển khai thực hiện phải tuân thủ các quy định của Luật Nhà ở, Nghị định này, pháp luật về xây dựng và pháp luật có liên quan.
2. Trường hợp đã nộp hồ sơ đề nghị chấp thuận chủ trương đầu tư hoặc quyết định chủ trương đầu tư dự án xây dựng nhà ở trước ngày Nghị định này có hiệu lực thi hành nhưng cơ quan có thẩm quyền chưa ban hành văn bản chấp thuận hoặc quyết định chủ trương đầu tư theo thẩm quyền quy định của Luật Nhà ở và Nghị định này thì cơ quan, đơn vị đề nghị quyết định hoặc chấp thuận chủ trương đầu tư chỉ phải nộp bổ sung các giấy tờ còn thiếu (nếu có) theo quy định của Nghị định này hoặc điều chỉnh bổ sung các nội dung nêu trong hồ sơ đã nộp cho phù hợp với Luật Nhà ở và Nghị định này.
3. Trường hợp cơ quan có thẩm quyền đã tiến hành các bước lựa chọn chủ đầu tư dự án xây dựng nhà ở trước ngày Nghị định này có hiệu lực thi hành nhưng đến ngày Nghị định này có hiệu lực thi hành mà chưa ban hành văn bản lựa chọn chủ đầu tư thì tiếp tục thực hiện các bước lựa chọn chủ đầu tư dự án xây dựng nhà ở theo quy định của Nghị định này.
4. Trường hợp dự án xây dựng nhà ở đã được phê duyệt trước ngày Nghị định này có hiệu lực thi hành mà thuộc diện phải điều chỉnh lại nội dung dự án theo quy định tại Khoản 1 Điều 182 của Luật Nhà ở thì chủ đầu tư phải điều chỉnh lại nội dung dự án; trường hợp nội dung điều chỉnh phải được cơ quan có thẩm quyền chấp thuận hoặc quyết định chủ trương đầu tư thì chủ đầu tư phải có văn bản đề nghị cơ quan có thẩm quyền điều chỉnh lại quyết định hoặc văn bản chấp thuận chủ trương đầu tư theo quy định của Nghị định này trước khi phê duyệt điều chỉnh bổ sung dự án và triển khai thực hiện.
5. Việc xác định nhà ở có sẵn, nhà ở hình thành trong tương lai được quy định như sau:
a) Nhà ở có sẵn là nhà ở đã có biên bản nghiệm thu hoàn thành việc xây dựng đưa vào sử dụng theo quy định của pháp luật về xây dựng; trường hợp nhà ở do chủ đầu tư tự thực hiện xây dựng theo quy định của pháp luật về xây dựng (nhà ở không bắt buộc phải do đơn vị có năng lực thực hiện xây dựng) thì phải đáp ứng điều kiện đã có hệ thống điện, nước phục vụ cho sinh hoạt, có hệ thống phòng cháy, chữa cháy (nếu nhà ở thuộc diện bắt buộc phải có hệ thống phòng cháy, chữa cháy);
b) Nhà ở hình thành trong tương lai là nhà ở không đáp ứng điều kiện quy định tại Điểm a Khoản này.
6. Kể từ ngày Luật Nhà ở có hiệu lực thi hành, việc đặt tên dự án, tên khu vực trong các dự án đầu tư xây dựng nhà ở thuộc diện quy định tại Khoản 2 Điều 17 của Luật Nhà ở phải tuân thủ quy định tại Khoản 3 Điều 19 của Luật Nhà ở và quy định của Nghị định này; các trường hợp đặt tên và sử dụng tên của dự án các khu vực trong dự án đầu tư xây dựng nhà ở không đúng quy định tại Khoản này thì không được pháp luật công nhận. Mọi giao dịch có liên quan đến dự án đầu tư xây dựng nhà ở phải sử dụng đúng tên gọi đã được cơ quan có thẩm quyền chấp thuận.
Đối với dự án đầu tư xây dựng nhà ở thương mại mà chủ đầu tư có sử dụng tên dự án, các khu vực trong dự án bằng tiếng nước ngoài và đã được phê duyệt trước ngày Luật Nhà ở có hiệu lực mà chủ đầu tư có văn bản đề xuất đổi lại tên gọi của dự án, các khu vực trong dự án này theo quy định tại Khoản 3 Điều 19 của Luật Nhà ở thì Ủy ban nhân dân cấp tỉnh nơi có dự án có trách nhiệm xem xét ban hành văn bản chấp thuận việc đổi tên gọi. Mọi giao dịch có liên quan đến dự án đầu tư xây dựng nhà ở phải sử dụng đúng tên gọi đã được cơ quan có thẩm quyền chấp thuận.
7. Trường hợp trong giấy tờ đăng ký kinh doanh do cơ quan có thẩm quyền cấp có ghi sử dụng căn hộ chung cư làm địa điểm kinh doanh trước ngày Luật Nhà ở có hiệu lực thi hành thì tổ chức, hộ gia đình, cá nhân được cấp giấy tờ đăng ký kinh doanh này phải chuyển hoạt động kinh doanh sang địa điểm khác không phải là căn hộ chung cư trong thời hạn sáu tháng, kể từ ngày Nghị định này có hiệu lực thi hành; cơ quan có thẩm quyền cấp giấy tờ đăng ký kinh doanh phải làm thủ tục điều chỉnh lại địa điểm kinh doanh ghi trong giấy tờ đăng ký kinh doanh đã cấp cho tổ chức, hộ gia đình, cá nhân sang địa điểm khác trong thời hạn quy định tại Khoản này; quá thời hạn quy định tại Khoản này thì tổ chức, hộ gia đình, cá nhân không được kinh doanh tại căn hộ chung cư.
8. Trường hợp nhà chung cư đã thành lập Ban quản trị trước ngày Luật Nhà ở có hiệu lực thi hành mà Ban quản trị có nhu cầu tổ chức lại mô hình hoạt động theo quy định của Luật Nhà ở thì phải tổ chức họp Hội nghị nhà chung cư để thành lập lại Ban quản trị theo Quy chế quản lý, sử dụng nhà chung cư do Bộ Xây dựng ban hành.
9. Kể từ ngày Luật Nhà ở có hiệu lực thi hành, việc bảo hành nhà ở được thực hiện theo thời hạn quy định tại Khoản 2 Điều 85 của Luật Nhà ở; thời hạn bảo hành được tính từ khi hoàn thành việc xây dựng và nghiệm thu bàn giao đưa nhà ở vào sử dụng.
10. Kể từ ngày Luật Nhà ở có hiệu lực thi hành, các nhà chung cư (bao gồm cả nhà chung cư có mục đích sử dụng hỗn hợp để ở và sử dụng vào các mục đích khác) được xây dựng phải bố trí nhà sinh hoạt cộng đồng theo tiêu chuẩn, quy chuẩn quy định.
Đối với nhà chung cư đã được xây dựng từ trước ngày Luật Nhà ở có hiệu lực thi hành mà có thiết kế diện tích làm nhà sinh hoạt cộng đồng thì chủ đầu tư phải bố trí diện tích để làm nhà sinh hoạt cộng đồng theo thiết kế đã được phê duyệt; trường hợp không có thiết kế diện tích nhà sinh hoạt cộng đồng mà có diện tích nhà dành để kinh doanh thì chủ đầu tư và các chủ sở hữu nhà chung cư có thể thỏa thuận để các chủ sở hữu mua hoặc thuê lại một phần diện tích nhà này để làm nhà sinh hoạt cộng đồng.
Nhà sinh hoạt cộng đồng do Hội nghị nhà chung cư quyết định giao cho Ban quản trị nhà chung cư hoặc đơn vị quản lý vận hành nhà chung cư quản lý; nhà sinh hoạt cộng đồng phải được sử dụng đúng mục đích vào sinh hoạt của cả cộng đồng các chủ sở hữu, người sử dụng nhà chung cư; nghiêm cấm sử dụng nhà này vào mục đích riêng của các chủ sở hữu, người sử dụng nhà chung cư, cho thuê, cho mượn, sử dụng vào các mục đích khác không phải phục vụ cho sinh hoạt chung của các chủ sở hữu, người sử dụng nhà chung cư.
Điều 81. Xử lý chuyển tiếp đối với các quy định về giao dịch về nhà ở
1. Trường hợp cơ quan có thẩm quyền đã tổ chức thẩm định giá cho thuê, cho thuê mua nhà ở xã hội thuộc sở hữu nhà nước trước ngày Nghị định này có hiệu lực thi hành nhưng đến ngày Nghị định này có hiệu lực thi hành mà chưa ban hành giá cho thuê, cho thuê mua nhà ở thì thực hiện thẩm định và ban hành giá cho thuê, cho thuê mua nhà ở theo quy định của Nghị định này.
2. Trường hợp người đang sử dụng nhà ở thuộc sở hữu nhà nước là người đứng tên trong hợp đồng thuê nhà ở và đến ngày Nghị định này có hiệu lực thi hành mà thời hạn thuê nhà vẫn còn thì các bên không phải ký lại hợp đồng thuê. Khi hết thời hạn thuê theo hợp đồng, đơn vị quản lý vận hành nhà ở có trách nhiệm kiểm tra, nếu bên thuê vẫn đủ điều kiện được thuê và có nhu cầu tiếp tục thuê thì các bên ký gia hạn hợp đồng thuê nhà ở; nếu bên thuê không có nhu cầu thuê tiếp hoặc không đủ điều kiện được tiếp tục thuê nhà ở theo quy định của Luật Nhà ở và Nghị định này thì đơn vị quản lý vận hành nhà ở có văn bản thông báo cho bên thuê biết để chấm dứt hợp đồng thuê và bàn giao lại nhà ở cho bên cho thuê để quản lý, cho thuê theo quy định của Nghị định này; trường hợp không bàn giao lại nhà ở thì thực hiện thu hồi theo quy định của Nghị định này.
3. Xử lý chuyển tiếp đối với các trường hợp bán nhà ở cũ thuộc sở hữu nhà nước như sau:
a) Trường hợp đã nộp đơn đề nghị mua nhà ở trước ngày 06 tháng 6 năm 2013 mà nhà ở đó có đủ điều kiện được bán theo quy định tại thời điểm nộp đơn và đủ điều kiện bán theo quy định của Nghị định này thì tiếp tục thực hiện bán theo giá bán và cơ chế miễn, giảm tiền mua nhà ở theo chính sách của Nghị định số 61/CP; trường hợp đã nộp đơn trước ngày 06 tháng 6 năm 2013 mà nhà ở đó không đủ điều kiện được bán theo quy định tại thời điểm nộp đơn nhưng đủ điều kiện được bán theo quy định của Nghị định này thì thực hiện bán theo quy định của Nghị định này;
b) Trường hợp đã nộp đơn đề nghị mua nhà ở từ ngày 06 tháng 6 năm 2013 đến trước ngày Nghị đinh này có hiệu lực thi hành mà nhà ở đó có đủ điều kiện được bán theo quy định của Nghị định này thì tiếp tục thực hiện bán theo quy định của Nghị định số 34/2013/NĐ-CP;
c) Trường hợp nhà ở thuộc diện quy định tại Điểm d Khoản 2 Điều 65 của Nghị định này mà cơ quan có thẩm quyền đã phê duyệt giá bán trước ngày Nghị định này có hiệu lực thi hành thì tiếp tục thực hiện bán theo giá đã được phê duyệt, trừ trường hợp thuộc diện quy định tại Điểm e Khoản 2 Điều 69 của Nghị định này; trường hợp đến ngày Nghị định này có hiệu lực thi hành mà cơ quan đại diện chủ sở hữu chưa phê duyệt giá bán nhà ở thì thực hiện phê duyệt và bán theo giá quy định của Nghị định này.
4. Trường hợp người mua nhà ở thương mại (bao gồm cả trường hợp hộ gia đình, cá nhân mua nhà ở thương mại làm nhà ở phục vụ tái định cư) nếu đã nhận bàn giao nhà ở từ chủ đầu tư nhưng chưa nộp hồ sơ đề nghị cấp Giấy chứng nhận cho cơ quan có thẩm quyền thì người mua nhà ở đó được chuyển nhượng hợp đồng mua bán nhà ở theo hướng dẫn của Bộ Xây dựng.
5. Đối với nhà ở mà tổ chức, cá nhân nước ngoài đã mua trước ngày Luật Nhà ở có hiệu lực thi hành thì thời hạn sở hữu nhà ở được xác định kể từ khi được cấp Giấy chứng nhận; chủ sở hữu được gia hạn sở hữu nhà ở theo quy định của Nghị định này; trong thời hạn sở hữu hoặc trước khi hết hạn sở hữu nhà ở, chủ sở hữu được thực hiện các quyền và nghĩa vụ đối với nhà ở đó theo quy định của Luật Nhà ở và Nghị định này.
6. Trường hợp đã ký hợp đồng về nhà ở trước ngày Luật Nhà ở có hiệu lực thi hành mà nội dung của hợp đồng phù hợp với các quy định của pháp luật có liên quan tại thời điểm ký kết hợp đồng nhưng có các thỏa thuận khác với quy định của Luật Nhà ở, Nghị định này thì các bên tiếp tục thực hiện theo nội dung hợp đồng đã ký kết, trừ trường hợp các bên nhất trí sửa đổi, bổ sung lại nội dung của hợp đồng này cho phù hợp với quy định của Luật Nhà ở và Nghị định này.
Kể từ ngày Nghị định này có hiệu lực thi hành, mọi giao dịch về nhà ở phải tuân thủ các quy định về hình thức giao dịch, điều kiện tham gia giao dịch, trình tự, thủ tục giao dịch, nội dung và mẫu của hợp đồng về nhà ở quy định tại Luật Nhà ở, Nghị định này và hướng dẫn của Bộ Xây dựng; trường hợp thực hiện không đúng quy định thì các giao dịch này không có giá trị pháp lý. Đối với các giao dịch mua bán, cho thuê, cho thuê mua nhà ở (bao gồm nhà ở biệt thự, nhà ở liền kề, căn hộ chung cư) thuộc sở hữu nhà nước, nhà ở phục vụ tái định cư, giao dịch mua bán nhà ở thương mại để làm nhà ở công vụ hoặc làm nhà ở tái định cư thì phải tuân thủ theo mẫu và nội dung của hợp đồng do Bộ Xây dựng ban hành.
7. Đối với hợp đồng góp vốn, hợp đồng hợp tác đầu tư, hợp đồng hợp tác kinh doanh mà các bên đã ký từ trước ngày Nghị định này có hiệu lực thi hành và có thỏa thuận phân chia 20% sản phẩm nhà ở theo quy định của Nghị định số 71/2010/NĐ-CP ngày 23 tháng 6 năm 2010 của Chính phủ quy định chi tiết và hướng dẫn thi hành Luật Nhà ở thì tiếp tục được phân chia số lượng nhà ở theo thỏa thuận trong hợp đồng; các bên thực hiện thanh lý hợp đồng này và ký hợp đồng mua bán nhà ở khi có đủ điều kiện được bán nhà ở này theo quy định của pháp luật kinh doanh bất động sản và Nghị định này.
8. Kể từ ngày Nghị định này có hiệu lực thi hành, việc thế chấp dự án đầu tư xây dựng nhà ở, nhà ở hình thành trong tương lai, thế chấp quyền tài sản phát sinh từ hợp đồng mua bán, thuê mua nhà ở, hợp đồng chuyển nhượng dự án và các quyền tài sản khác liên quan đến nhà ở, dự án đầu tư xây dựng nhà ở thuộc diện được thế chấp theo quy định của pháp luật phải thực hiện theo quy định của Luật Nhà ở và Nghị định này; các trường hợp thế chấp dự án đầu tư xây dựng nhà ở, nhà ở hình thành trong tương lai và các quyền tài sản liên quan đến nhà ở, dự án đầu tư xây dựng nhà ở quy định tại Khoản này không đúng với quy định của Luật Nhà ở và Nghị định này thì không có giá trị pháp lý và không được pháp luật công nhận.
Việc đăng ký thế chấp dự án đầu tư xây dựng nhà ở, nhà ở hình thành trong tương lai và các quyền tài sản liên quan đến nhà ở, dự án đầu tư xây dựng nhà ở quy định tại Khoản này được thực hiện theo quy định của pháp luật về đăng ký giao dịch bảo đảm; việc xử lý các tài sản thế chấp quy định tại Khoản này được thực hiện theo quy định của pháp luật về dân sự và pháp luật có liên quan.
Điều 82. Xử lý chuyển tiếp đối với việc phát triển và quản lý nhà ở phục vụ tái định cư
1. Trường hợp đến ngày Nghị định này có hiệu lực thi hành mà chủ đầu tư đã làm thủ tục phê duyệt dự án đầu tư xây dựng nhà ở để phục vụ tái định cư nhưng cơ quan có thẩm quyền chưa phê duyệt dự án thì thực hiện phê duyệt dự án theo quy định của Luật Nhà ở và Nghị định này; chủ đầu tư không phải làm lại thủ tục thẩm định, phê duyệt dự án mà chỉ phải bổ sung giấy tờ còn thiếu (nếu có) và điều chỉnh bổ sung các nội dung nêu trong hồ sơ dự án cho phù hợp với quy định của Luật Nhà ở và Nghị định này.
Trường hợp cơ quan có thẩm quyền đã phê duyệt phương án bồi thường, hỗ trợ, tái định cư trước ngày Nghị định này có hiệu lực thi hành thì tiếp tục thực hiện theo phương án đã được phê duyệt.
2. Đối với nhà chung cư phục vụ tái định cư được xây dựng bằng nguồn vốn quy định tại Khoản 3 Điều 36 của Luật Nhà ở thì người mua, người thuê mua nhà ở phải đóng kinh phí bảo trì phần sở hữu chung theo quy định tại Điều 108 của Luật Nhà ở.
Trong trường hợp nhà chung cư phục vụ tái định cư mà có dành diện tích để kinh doanh theo dự án đã được phê duyệt thì sau khi trừ các chi phí kinh doanh hợp lý, Ủy ban nhân dân cấp tỉnh được sử dụng khoản tiền thu được từ hoạt động kinh doanh này để hỗ trợ cho kinh phí bảo trì phần diện tích, thiết bị thuộc sở hữu chung của nhà chung cư phục vụ tái định cư trên địa bàn (bao gồm bảo trì thang máy, hệ thống phòng cháy, chữa cháy, máy bơm nước, máy phát điện, hệ thống chống sét, mặt ngoài của nhà chung cư) và hỗ trợ một phần kinh phí cho công tác quản lý vận hành nhà ở này.
Điều 83. Xử lý chuyển tiếp đối với Quỹ phát triển nhà ở
1. Đối với các tỉnh, thành phố trực thuộc Trung ương đã thành lập Quỹ phát triển nhà ở trước ngày Nghị định này có hiệu lực thi hành thì Quỹ phát triển nhà ở này tiếp tục được hoạt động theo Điều lệ hoạt động đã được Ủy ban nhân dân cấp tỉnh phê duyệt. Căn cứ vào điều kiện cụ thể của từng địa phương, Ủy ban nhân dân cấp tỉnh báo cáo Hội đồng nhân dân cùng cấp quyết định cấp kinh phí từ ngân sách địa phương cho Quỹ phát triển nhà ở để thực hiện cho vay phát triển nhà ở xã hội trên địa bàn.
2. Đối với các tỉnh, thành phố trực thuộc Trung ương chưa thành lập Quỹ phát triển nhà ở, nếu có nhu cầu thành lập Quỹ phát triển nhà ở thì báo cáo Thủ tướng Chính phủ xem xét, quyết định thành lập Quỹ phát triển nhà ở riêng hoặc ủy thác cho Quỹ đầu tư phát triển của địa phương quản lý Quỹ phát triển nhà ở.
Chương IX
ĐIỀU KHOẢN THI HÀNH
Điều 84. Trách nhiệm của các Bộ, ngành liên quan
1. Bộ Xây dựng có các quyền hạn và trách nhiệm sau đây:
a) Thực hiện các nhiệm vụ được giao quy định tại Điều 175 của Luật Nhà ở và quy định tại Nghị định này;
b) Hướng dẫn, đôn đốc việc thực hiện Luật Nhà ở và Nghị định này; tổ chức tuyên truyền, phổ biến các cơ chế, chính sách pháp luật về nhà ở;
c) Quyết định cho phép điều chỉnh dự án đầu tư xây dựng nhà ở thương mại sang làm nhà ở xã hội hoặc sang làm nhà ở phục vụ tái định cư hoặc quyết định điều chỉnh cơ cấu diện tích sàn xây dựng nhà ở thương mại, nhà ở xã hội đối với các dự án đầu tư xây dựng nhà ở có từ 500 căn trở lên (bao gồm cả nhà ở riêng lẻ và căn hộ chung cư) để thực hiện chính sách điều tiết thị trường bất động sản theo chủ trương của Chính phủ, yêu cầu của Thủ tướng Chính phủ hoặc khi có đề nghị của Ủy ban nhân dân cấp tỉnh; xem xét, quyết định việc điều chỉnh nhà ở phục vụ tái định cư hoặc điều chỉnh dự án đầu tư xây dựng nhà ở phục vụ tái định cư sang làm nhà ở xã hội hoặc sang làm nhà ở thương mại theo đề nghị của Ủy ban nhân dân cấp tỉnh;
d) Đình chỉ thực hiện dự án đối với trường hợp đã được Ủy ban nhân dân cấp tỉnh quyết định hoặc chấp thuận chủ trương đầu tư hoặc đã được cơ quan có thẩm quyền phê duyệt mà không có trong chương trình, kế hoạch phát triển nhà ở của địa phương hoặc khi chưa có quy hoạch chi tiết xây dựng được cơ quan có thẩm quyền phê duyệt; đình chỉ việc thực hiện đối với dự án không bảo đảm đúng các yêu cầu đã được nêu trong quyết định hoặc văn bản chấp thuận chủ trương đầu tư của cơ quan nhà nước có thẩm quyền hoặc dự án vi phạm các quy định về huy động vốn, về điều kiện mua bán, cho thuê mua nhà ở.
2. Bộ Tài chính có các quyền hạn và trách nhiệm sau đây:
a) Chủ trì, phối hợp với Bộ Xây dựng hướng dẫn cụ thể việc thu, chi tiền cho thuê, cho thuê mua, bán nhà ở thuộc sở hữu nhà nước theo quy định tại Điều 44 của Nghị định này;
b) Hướng dẫn việc thu thuế, các nghĩa vụ tài chính khác khi chủ sở hữu bán, chuyển nhượng hợp đồng mua bán, cho thuê mua, tặng cho, đổi, góp vốn bằng nhà ở;
c) Hướng dẫn thủ tục thanh toán tiền chênh lệch thuê nhà ở công vụ quy định tại Khoản 2 Điều 51 của Nghị định này và thực hiện các nhiệm vụ khác theo quy định của Nghị định này.
3. Bộ Tài nguyên và Môi trường có trách nhiệm chủ trì, phối hợp với Bộ Xây dựng hướng dẫn việc thực hiện quy định tại Khoản 3, Khoản 4 Điều 6, việc cấp Giấy chứng nhận quy định tại Điều 7, việc xử lý Giấy chứng nhận khi hết hạn sở hữu nhà ở quy định tại Điều 8, việc ghi gia hạn Giấy chứng nhận quy định tại Khoản 1, Khoản 2 Điều 77 của Nghị định này và việc xử lý bồi thường, hỗ trợ, tái định cư khi nhà nước thu hồi đất đối với trường hợp mua bán nhà ở có thời hạn.
4. Ngân hàng Nhà nước Việt Nam có các quyền hạn và trách nhiệm sau đây:
a) Chủ trì, phối hợp với Bộ Xây dựng, Bộ Tư pháp, Bộ Tài nguyên và Môi trường quy định và hướng dẫn cụ thể trình tự, thủ tục thế chấp và giải chấp tài sản là dự án đầu tư xây dựng nhà ở, nhà ở hình thành trong tương lai và các quyền tài sản có liên quan đến dự án đầu tư xây dựng nhà ở, nhà ở hình thành trong tương lai theo quy định của Luật Nhà ở và Khoản 8 Điều 81 của Nghị định này;
b) Hướng dẫn cụ thể việc thanh toán tiền mua bán, thuê mua nhà ở qua tổ chức tín dụng của tổ chức, cá nhân nước ngoài, người Việt Nam định cư ở nước ngoài khi mua, thuê mua nhà ở tại Việt Nam và việc chuyển tiền bán, cho thuê mua nhà ở ra nước ngoài của tổ chức, cá nhân nước ngoài, người Việt Nam định cư ở nước ngoài khi bán, cho thuê mua nhà ở tại Việt Nam.
5. Các Bộ ngành có liên quan trong phạm vi chức năng nhiệm vụ được giao có trách nhiệm ban hành mới hoặc sửa đổi, bổ sung các quy định thuộc thẩm quyền được giao có liên quan đến nhà ở cho phù hợp với quy định của Luật Nhà ở, Nghị định này và phối hợp với Bộ Xây dựng để thực hiện các quy định của Luật Nhà ở và Nghị định này.
Đối với các Bộ, ngành có quỹ nhà ở cũ tự quản thì phải chuyển giao quỹ nhà ở này sang Ủy ban nhân dân cấp tỉnh nơi có nhà ở để tiếp nhận, quản lý, cho thuê và bán theo quy định của Nghị định này; trường hợp nhà ở cũ do Bộ Quốc phòng đang quản lý thì Bộ Quốc phòng có trách nhiệm chỉ đạo quản lý, cho thuê và bán theo quy định của Nghị định này, trừ trường hợp quy định tại Khoản 2 Điều 64 của Nghị định này.
Điều 85. Trách nhiệm quản lý nhà nước về nhà ở của địa phương
1. Ủy ban nhân dân cấp tỉnh có các quyền hạn và trách nhiệm sau đây:
a) Thực hiện chức năng quản lý nhà nước về nhà ở trên địa bàn;
b) Bố trí kinh phí để xây dựng chương trình, kế hoạch phát triển nhà ở của địa phương theo quy định của Nghị định này và hướng dẫn của Bộ Xây dựng; chỉ đạo xây dựng và triển khai thực hiện chương trình, kế hoạch này sau khi được phê duyệt;
c) Quy hoạch, bố trí diện tích đất để phát triển đối với từng loại nhà ở theo quy định của Luật Nhà ở và chương trình, kế hoạch phát triển nhà ở của địa phương đã được phê duyệt, trong đó phải xác định rõ các khu vực để xây dựng nhà ở xã hội cho thuê; quyết định hệ số k điều chỉnh giá đất trong trường hợp bán nhà ở cũ thuộc sở hữu nhà nước quy định tại Điểm d Khoản 2 Điều 65 của Nghị định này;
d) Chỉ đạo công bố công khai trên Cổng thông tin điện tử của Ủy ban nhân dân cấp tỉnh và của Sở Xây dựng các dự án đầu tư xây dựng nhà ở trên địa bàn theo quy định tại Khoản 5 Điều 19 của Luật Nhà ở, chương trình, kế hoạch phát triển nhà ở của địa phương đã được phê duyệt; chỉ đạo Sở Xây dựng công khai trên Cổng thông tin điện tử của Sở các thông tin về nhà ở đủ điều kiện được bán, cho thuê mua, được huy động vốn quy định tại Điều 19 của Nghị định này, danh mục các dự án đầu tư xây dựng nhà ở thương mại trên địa bàn không cho phép tổ chức, cá nhân nước ngoài được quyền sở hữu quy định tại Khoản 1 Điều 76 và các thông tin quy định tại Điều 79 của Nghị định này;
đ) Ban hành quy định cụ thể việc quản lý, sử dụng, nhà biệt thự, nhà chung cư; hướng dẫn việc bán, cho thuê, cho thuê mua nhà ở thuộc sở hữu nhà nước, nhà ở phục vụ tái định cư được giao quản lý cho phù hợp với tình hình thực tế của địa phương; tổ chức cưỡng chế thu hồi nhà ở thuộc sở hữu nhà nước theo quy định tại Điều 84 của Luật Nhà ở, quy định của Nghị định này; tổ chức cưỡng chế bàn giao kinh phí bảo trì phần sở hữu chung của nhà chung cư theo quy định của Nghị định này;
e) Quy định tiêu chí, thủ tục và xác định danh mục nhà ở có giá trị nghệ thuật, văn hóa, lịch sử (bao gồm cả nhà biệt thự, nhà ở cổ); quyết định thành lập Hội đồng xác định danh mục và ban hành quyết định phê duyệt danh mục nhà ở này để thực hiện quản lý theo quy định của Luật Nhà ở, Nghị định này và pháp luật có liên quan;
g) Sắp xếp tổ chức, bố trí đủ cán bộ, công chức và phân giao lại chức năng, nhiệm vụ của các cơ quan có liên quan của địa phương để thực hiện việc phát triển và quản lý nhà ở theo đúng quy định của Luật Nhà ở và Nghị định này; chỉ đạo thực hiện, hướng dẫn, kiểm tra, thanh tra công tác phát triển và quản lý nhà ở trên địa bàn; xử lý các hành vi vi phạm, giải quyết các tranh chấp, khiếu nại, tố cáo về nhà ở theo thẩm quyền hoặc đề nghị cơ quan có thẩm quyền xử lý, giải quyết theo quy định của pháp luật;
h) Sửa đổi, bổ sung các văn bản quy phạm pháp luật nhà ở thuộc thẩm quyền ban hành cho phù hợp với Luật Nhà ở và Nghị định này; tổ chức tập huấn, phổ biến, tuyên truyền các văn bản pháp luật về nhà ở và vận động các tổ chức, cá nhân trên địa bàn chấp hành các quy định của pháp luật về nhà ở;
i) Chủ trì hoặc phối hợp với các Bộ, ngành có liên quan thực hiện các nhiệm vụ được giao theo quy định của Luật Nhà ở, Nghị định này và pháp luật có liên quan;
k) Định kỳ hàng năm hoặc theo yêu cầu đột xuất báo cáo cơ quan có thẩm quyền về tình hình triển khai Luật Nhà ở và Nghị định này trên địa bàn;
l) Thực hiện các nhiệm vụ khác theo quy định của Luật Nhà ở, Nghị định này và quy định của pháp luật.
2. Giúp Ủy ban nhân dân cấp tỉnh làm đầu mối thực hiện chức năng quản lý nhà nước về nhà ở trên địa bàn là Sở Xây dựng.
3. Ủy ban nhân dân cấp huyện có trách nhiệm thực hiện việc quản lý nhà nước về nhà ở trên địa bàn theo chức năng, nhiệm vụ được giao, theo chỉ đạo của Ủy ban nhân dân cấp tỉnh và theo quy định của pháp luật về nhà ở.
4. Chủ tịch Ủy ban nhân dân cấp tỉnh, Chủ tịch Ủy ban nhân dân cấp huyện và thủ trưởng các cơ quan có liên quan của địa phương chịu trách nhiệm trước pháp luật nếu chậm trễ thực hiện hoặc không thực hiện hoặc thực hiện không đúng các quy định của Luật Nhà ở, Nghị định này và các văn bản pháp luật về nhà ở.
Điều 86. Ban Chỉ đạo Trung ương về chính sách nhà ở và thị trường bất động sản
1. Thủ tướng Chính phủ quyết định thành lập Ban Chỉ đạo Trung ương về chính sách nhà ở và thị trường bất động sản để giúp Thủ tướng Chính phủ nghiên cứu, chỉ đạo và phối hợp giải quyết những vấn đề quan trọng, liên ngành có liên quan đến chính sách quản lý, phát triển nhà ở và thị trường bất động sản trên phạm vi toàn quốc.
2. Ban Chỉ đạo Trung ương về chính sách nhà ở và thị trường bất động sản có các nhiệm vụ, quyền hạn sau đây:
a) Chỉ đạo, đôn đốc, hướng dẫn và kiểm tra việc thực hiện các chương trình phát triển nhà ở, các chủ trương, chính sách về nhà ở và thị trường bất động sản tại các Bộ, ngành và các địa phương;
b) Tham gia góp ý các chính sách lớn, quan trọng liên quan đến nhà ở và thị trường bất động sản;
c) Kiến nghị Thủ tướng Chính phủ và các cơ quan có thẩm quyền xem xét, sửa đổi, bổ sung hoặc đình chỉ việc thi hành các văn bản có liên quan đến nhà ở và thị trường bất động sản do các Bộ, ngành và Ủy ban nhân dân cấp tỉnh ban hành trái với quy định của pháp luật về nhà ở và thị trường bất động sản;
d) Chủ tịch Ủy ban nhân dân cấp tỉnh quyết định thành lập Ban Chỉ đạo về chính sách nhà ở và thị trường bất động sản cấp tỉnh để giúp Chủ tịch Ủy ban nhân dân cấp tỉnh chỉ đạo triển khai thực hiện các chính sách liên quan đến lĩnh vực nhà ở và thị trường bất động sản tại địa phương;
đ) Chức năng, nhiệm vụ, quyền hạn, quy chế hoạt động của Ban Chỉ đạo và các tổ chức giúp việc Ban Chỉ đạo ở Trung ương do Thủ tướng Chính phủ quy định, ở địa phương do Chủ tịch Ủy ban nhân dân cấp tỉnh quy định. Kinh phí hoạt động của Ban Chỉ đạo do ngân sách nhà nước cùng cấp cấp.
Điều 87. Hiệu lực thi hành
1. Nghị định này có hiệu lực thi hành kể từ ngày 10 tháng 12 năm 2015.
2. Các Nghị định sau đây hết hiệu lực kể từ ngày Nghị định này có hiệu lực thi hành:
a) Nghị định số 51/2009/NĐ-CP ngày 03 tháng 6 năm 2009 của Chính phủ hướng dẫn thi hành một số điều của Nghị quyết số 19/2008/QH12 ngày 03 tháng 6 năm 2008 của Quốc hội về việc thí điểm cho tổ chức, cá nhân nước ngoài mua và sở hữu nhà ở tại Việt Nam;
b) Nghi định số 71/2010/NĐ-CP ngày 23 tháng 6 năm 2010 của Chính phủ quy định chi tiết và hướng dẫn thi hành Luật Nhà ở;
c) Nghị định số 34/2013/NĐ-CP ngày 22 tháng 4 năm 2013 của Chính phủ về quản lý sử dụng nhà ở thuộc sở hữu nhà nước;
d) Nghị định số 84/2013/NĐ-CP ngày 25 tháng 7 năm 2013 của Chính phủ quy định về phát triển và quản lý nhà ở tái định cư.
3. Các nội dung liên quan đến phát triển nhà ở (bao gồm cả việc quyết định, chấp thuận chủ trương đầu tư dự án xây dựng nhà ở), sở hữu nhà ở, quản lý, sử dụng nhà ở, giao dịch về nhà ở, quản lý nhà nước về nhà ở được quy định trong các Nghị định của Chính phủ, Quyết định của Thủ tướng Chính phủ, các văn bản quy phạm pháp luật do các Bộ, ngành và Ủy ban nhân dân cấp tỉnh ban hành trước ngày Nghị định này có hiệu lực thi hành mà khác với các quy định thuộc phạm vi điều chỉnh của Nghị định này thì thực hiện theo quy định của Nghị định này.
Điều 88. Trách nhiệm thi hành
Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Nghị định này./.
