CIRCULAR

Repeals certain regulatory legal documents issued by the Minister of Agriculture and Rural Development, jointly issued

Pursuant to the Law on Legislative Documents dated June 22, 2015;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and implementing mechanisms of the Law on Enacting Legal Normative Documents 2015;

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Technical Standards Law;

At the proposal of the Director of the Legal Department;

After reaching consensus with the Minister of Planning and Investment, the Minister of Finance, and the Minister of Agriculture and Rural Development the Minister of Agriculture and Rural Development issues this Circular to abolish certain legal normative documents issued by the Minister of Agriculture and Rural Development, jointly issued.

Article 1. Abolish all of the following documents:

Repeals all of the following regulatory legal documents issued by the Minister of Agriculture and Rural Development, jointly issued:

1. Decision No. 211/1998/QĐ-BNN-QLN dated December 19, 1998 of the Minister of Agriculture and Rural Development promulgating regulations on the use of repair costs for fixed assets of enterprises operating water conservancy works.

2. Decision No. 113/2000/QĐ-BNN-XDCB dated November 6, 2000 of the Minister of Agriculture and Rural Development promulgating bidding documents for construction and installation projects applicable to single-stage tender projects under the Ministry of Agriculture and Rural Development.

3. Decision No. 11/2001/QĐ-BNN-XDCB dated February 19, 2001 of the Minister of Agriculture and Rural Development promulgating management regulations for investment and construction projects under the management of the Ministry of Agriculture and Rural Development.

4. Circular No. 81/2001/TT-BNN dated August 9, 2001 of the Minister of Agriculture and Rural Development guiding the implementation of final inspection and payment procedures for preparatory costs of water conservancy projects under the Ministry of Agriculture and Rural Development.

5. Decision No. 101/2001/QĐ-BNN dated October 15, 2001 of the Minister of Agriculture and Rural Development promulgating bidding documents for procurement applicable to single-stage tender projects under the Ministry of Agriculture and Rural Development.

6. Decision No. 44/2003/QĐ-BNN dated February 14, 2003 of the Minister of Agriculture and Rural Development amending and supplementing some management document templates for investment and construction projects under the Ministry of Agriculture and Rural Development.

7. Decision No. 55/2003/QĐ-BNN dated April 9, 2003 of the Minister of Agriculture and Rural Development temporarily promulgating capital investment standards for basic construction projects in the agriculture and rural development sector.

8. Decision No. 55/2004/QĐ-BNN dated November 1, 2004 of the Minister of Agriculture and Rural Development stipulating the issuance of permits for activities within the scope of protection of water conservancy works.

9. Decision No. 56/2004/QĐ-BNN dated November 1, 2004 of the Minister of Agriculture and Rural Development stipulating the authority and procedures for issuing discharge permits into the water conservancy works system.

10. Decision No. 11/2005/QĐ-BNN dated March 7, 2005 of the Minister of Agriculture and Rural Development stipulating responsibilities and forms of handling violations in project management under the Ministry of Agriculture and Rural Development.

11. Decision No. 39/2005/QĐ-BNN dated July 7, 2005 of the Minister of Agriculture and Rural Development promulgating unit prices for detailed planning of resettlement areas for the Son La Hydropower Project.

12. Circular No. 18/2006/TT-BNN dated March 20, 2006 of the Minister of Agriculture and Rural Development guiding certain contents of implementing Decree No. 16/2005/NĐ-CP dated February 7, 2005 of the Government on managing construction projects using state budget funds under the Ministry of Agriculture and Rural Development.

13. Decision No. 62/2007/QĐ-BNN dated June 28, 2007 of the Minister of Agriculture and Rural Development amending and supplementing certain provisions of the decision on issuing permits for activities within the scope of protection of water conservancy works issued together with Decision No. 55/2004/QĐ-BNN dated November 1, 2004 of the Ministry of Agriculture and Rural Development.

14. Circular No. 80/2007/TT-BNN dated September 24, 2007 of the Minister of Agriculture and Rural Development guiding agricultural and forestry production planning linked to processing and consumption of agricultural and forest products and procedures for supporting production in resettlement areas of the Son La Hydropower Project.

15. Circular No. 34/2008/TT-BNN dated February 14, 2008 of the Minister of Agriculture and Rural Development amending and supplementing certain provisions of Circular No. 80/2007/TT-BNN dated September 24, 2007 of the Minister of Agriculture and Rural Development guiding agricultural and forestry production planning linked to processing and consumption of agricultural and forest products and procedures for supporting production in resettlement areas of the Son La Hydropower Project.

16. Circular No. 08/2009/TT-BNN dated February 26, 2009 of the Minister of Agriculture and Rural Development guiding the implementation of certain support policies for developing agricultural, forestry, and aquaculture production according to Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government on the Program for Rapid and Sustainable Poverty Reduction in 61 Poor Districts.

17. Circular No. 45/2009/TT-BNNPTNT dated July 24, 2009 of the Minister of Agriculture and Rural Development guiding the preparation and approval of protection plans for water conservancy works.

18. Circular No. 49/2009/TT-BNNPTNT dated August 4, 2009 of the Minister of Agriculture and Rural Development guiding the management and use of foreign aid sources under the Ministry of Agriculture and Rural Development.

19. Circular No. 53/2009/TT-BNNPTNT dated August 21, 2009 of the Minister of Agriculture and Rural Development stipulating the management of alien aquatic species in Vietnam.

20. Circular No. 54/2009/TT-BNNPTNT dated August 21, 2009 of the Minister of Agriculture and Rural Development guiding the implementation of national criteria for new rural areas according to Decision No. 491/QĐ-TTg dated April 16, 2009 of the Prime Minister on issuing national criteria for new rural areas.

21. Circular No. 69/2009/TT-BNNPTNT dated October 27, 2009 of the Minister of Agriculture and Rural Development stipulating risk assessment procedures for biodiversity and the environment of genetically modified crop varieties.

25. Circular No. 58/2010/TT-BNNPTNT dated October 5, 2010, issued by the Minister of Agriculture and Rural Development prescribing measures to prevent and control rice stripe dwarf disease.

26. Circular No. 16/2011/TT-BNNPTNT dated April 1, 2011, issued by the Minister of Agriculture and Rural Development stipulating the evaluation, designation, and management of agricultural and rural development laboratories.

27. Circular No. 21/2011/TT-BNNPTNT dated April 6, 2011, issued by the Minister of Agriculture and Rural Development amending and supplementing certain provisions on administrative procedures in the field of irrigation pursuant to Resolution No. 57/NQ-CP dated December 15, 2010 of the Government regarding the simplification of administrative procedures within the scope of the Ministry of Agriculture and Rural Development's management functions.

28. Joint Circular No. 26/2011/TTLT-BNNPTNT-BKHĐT-BTC dated April 13, 2011, issued by the Minister of Agriculture and Rural Development, the Minister of Planning and Investment, and the Minister of Finance guiding certain contents for implementing Decision No. 800/QD-TTg dated June 4, 2010 of the Prime Minister approving the national target program for new rural areas construction during the period 2010-2020.

29. Circular No. 34/2011/TT-BNNPTNT dated May 17, 2011, issued by the Minister of Agriculture and Rural Development guiding the preparation, review, and approval of detailed planning for resettlement zones and points of the Lai Chau Hydropower Project.

33. Circular No. 75/2011/TT-BNNPTNT dated October 31, 2011, issued by the Minister of Agriculture and Rural Development guiding the confirmation of food advertisement content.

Circular No. 84/2011/TT-BNNPTNT dated December 12, 2011, issued by the Minister of Agriculture and Rural Development stipulating certain contents regarding the management of investment projects for construction works funded by state budget under the management of the Ministry of Agriculture and Rural Development.

Circular No. 41/2013/TT-BNNPTNT dated October 4, 2013, issued by the Minister of Agriculture and Rural Development guiding the implementation of the National Criteria for New Rural Areas pursuant to Decision No. 342/QĐ-TTg dated February 20, 2013 of

the Prime Minister regarding the amendment and supplementation of certain criteria of the National Criteria for New Rural Areas.

39. Joint Circular No. 51/2013/TTLT-BNNPTNT-BKHĐT-BTC dated December 2, 2013, issued by the Minister of Agriculture and Rural Development, the Minister of Planning and Investment, and the Minister of Finance amending and supplementing certain articles of Joint Circular No. 26/2011/TTLT-BNNPTNT-BKHĐT-BTC dated April 13, 2011. 40. Circular No. 40/2014/TT-BNNPTNT dated November 13, 2014, issued by the Minister of Agriculture and Rural Development guiding the procedures, documents for recognizing and announcing communes, districts, provinces reaching the new rural area standard pursuant to Decision No. 372/QĐ-TTg dated March 14, 2014 of

the Prime Minister regarding the recognition and announcement of localities reaching the new rural area standard.

41. Circular No. 43/2014/TT-BNNPTNT dated November 18, 2014, issued by the Minister of Agriculture and Rural Development promulgating the list of agricultural, forestry, and aquatic products, auxiliary products, and mechanical products for preserving and processing agricultural, forestry, and aquatic products eligible for support under Decree No. 210/2013/NĐ-CP dated December 19, 2013 of the Government on policies encouraging enterprises to invest in agriculture and rural areas.

42. Circular No. 12/2015/TT-BNNPTNT dated March 16, 2015, issued by the Minister of Agriculture and Rural Development guiding the inspection of food safety for imported goods of plant origin.

Article 2. Repeal part of the following documents:

the Prime Minister promulgating Special Policies on Resettlement for Water Resources and Hydropower Projects.

1. Repeal Article 3, Article 5, Article 9, and Article 16 of Circular No. 11/2017/TT-BNNPTNT dated May 29, 2017, issued by the Minister of Agriculture and Rural Development to amend and supplement certain provisions of related legal normative documents concerning the functions and tasks of units under the Ministry of Agriculture and Rural Development.

2. Repeal Point c Clause 2, Article 5 of Circular No. 03/2014/TT-BNNPTNT dated January 25, 2014, issued by the Minister of Agriculture and Rural Development guiding the implementation of Decision No. 1776/QĐ-TTg dated November 21, 2012, of the Prime Minister approving the Program for resettling residents in disaster-prone, extremely difficult, border, island, spontaneous migration, special-use forest areas for the period 2013-2015 and orientations until 2020.

Article 3. Effectiveness

This Circular takes effect from September 27, 2018.

Article 4. Responsibilities for Implementation

The Head of the Office, the Director of the Legal Department, the Heads of units under the Ministry of Agriculture and Rural Development, and relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
