Circular No. 13/2018/TT-BTP Abolishes Certain Legal Normative Documents Issued by the Minister of Justice in the Field of Legal Aid

CIRCULAR

Repealing certain regulatory legal documents issued by the Minister of Justice,

jointly issued in the field of legal aid

Pursuant to the Law on Legislative Documents dated June 22, 2015;

Pursuant to the Government's Decree No. 34/2016/NĐ-CP dated May 14, 2016 detailing certain provisions and measures for implementing the Law on Legislative Acts of Regulations;

Decree No. 96/2017/NĐ-CP dated August 16, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director of the Legal Aid Agency;

After reaching consensus with the Minister of Finance, the Minister of Justice issues this Circular to repeal certain regulatory legal documents issued by the Minister of Justice, jointly issued in the field of legal aid.

This Circular takes effect from January 25, 2026.

Repeal all regulatory legal documents issued by the Minister of Justice in the field of legal aid as follows:

1. Decision No. 02/2008/QĐ-BTP dated February 28, 2008 of the Minister of Justice promulgating the Model Regulation on the organization and operation of State Legal Aid Centers;

2. Decision No. 03/2008/QĐ-BTP dated February 28, 2008 of the Minister of Justice promulgating the Model Charter on the organization and operation of Legal Aid Clubs;

3. Decision No. 07/2008/QĐ-BTP dated December 5, 2008 of the Minister of Justice promulgating the Regulation on professional training for legal aid;

4. Decision No. 08/2008/QĐ-BTP dated December 8, 2008 of the Minister of Justice promulgating the Regulation on the organization and operation of the Vietnam Legal Aid Fund;

5. Decision No. 10/2008/QĐ-BTP dated December 10, 2008 of the Minister of Justice approving the Plan for professional training for legal aid for the period 2008-2010, with a view to 2015;

6. Decision No. 08/2006/QĐ-BTP dated November 15, 2006 of the Minister of Justice promulgating the Plan of the Justice Sector to implement Directive No. 35/2006/CT-TTg dated October 13, 2006 of the Prime Minister on the implementation of the Legal Aid Law.

Article 2. Repealing part of legal normative documents

Repeal Article 2 of Joint Circular No. 58/2014/TTLT-BTC-BTP dated May 8, 2014 of the Ministers of Finance and Justice guiding the management and distribution of uniforms for Legal Aid Officers.

Article 3. Implementation Organization

1. This Circular takes effect from November 15, 2018.

2. The Director of the Legal Aid Department, heads of units under the Ministry of Justice, and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.
