Repealing certain consolidated legal document issued by the Minister of Industry and Trade, jointly issued

Pursuant toDecree No. 98/2017/NĐ-CPDecision No. 18/2017/QĐ-TTg dated August 18, 2017, promulgated by the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

At the proposal of the Director of the Legal Department;

The Minister of Industry and Trade issues this Circular to abolish certain legal documents issued by the Minister of Industry and Trade, jointly issued.

Article 1. Abolish certain legal documents

Abolish the following legal documents issued by the Minister of Industry and Trade, jointly issued:

1. Field of Market Management

a) Decision No. 1070QĐ/TM-QLTT dated September 15, 1999 of the Minister of Trade promulgating the Inspection Activity Monitoring Logbook of the Market Management Force;

b) Decision No. 441/2002/QĐ-BTM dated April 16, 2002 of the Minister of Trade promulgating Regulations on the Use of Market Management Force Flags and Signs for Stopping Vehicles Carrying Smuggled Goods in Border Towns and Districts;

c) Decision No. 50/2008/QĐ-BCT dated December 30, 2008 of the Minister of Industry and Trade promulgating Standards for Market Management Branch Chiefs and Team Leaders;

d) Circular No. 34/2014/TT-BCT dated October 15, 2014 of the Minister of Industry and Trade stipulating cooperation among market management agencies at various levels in inspection activities and administrative violation handling;

đ) Joint Circular No. 34/2015/TTLT-BCT-BNV dated October 27, 2015 of the Minister of Industry and Trade and the Minister of Home Affairs guiding functions, tasks, powers, and organizational structure of Market Management Branches and Teams at localities;

2. Field of Local Industry and Trade

a) Joint Circular No. 31/2012/TTLT-BCT-BKHĐT dated October 10, 2012 of the Ministry of Industry and Trade and the Ministry of Science and Technology guiding the handling of industrial clusters formed before the issuance of the Industrial Cluster Management Regulation pursuant to Decision No. 105/2009/QĐ-TTg dated August 19, 2009 of the Prime Minister taking effect

b) Circular No. 17/2016/TT-BCT dated August 30, 2016 of the Minister of Industry and Trade amending and supplementing Clause 10 of Joint Circular No. 31/2012/TTLT-BCT-BKHĐT dated October 10, 2012 guiding the handling of industrial clusters formed before the issuance of the Industrial Cluster Management Regulation pursuant to Decision No. 105/2009/QĐ-TTg dated August 19, 2009 of the Prime Minister taking effect.

3. Field of Trade Promotion

Joint Circular No. 07/2007/TTLT-BTM-BTC dated July 6, 2007 of the Ministry of Trade and the Ministry of Finance guiding the implementation of certain provisions on promotions and trade fairs and exhibitions stipulated in Decree No. 37/2006/NĐ-CP dated April 4, 2006 of the Government detailing the Law on Trade regarding trade promotion activities.

4. Field of Electricity

Decision No. 02/2007/QĐ-BCN dated January 9, 2007 of the Minister of Industry promulgating technical requirements for electrical measuring equipment for power plants.

5. Field of Commodity Trading Exchanges

Circular No. 03/2009/TT-BCT dated February 10, 2009 of the Minister of Industry and Trade guiding the application procedures, reporting systems, and licensing for commodity trading exchanges according to Decree No. 158/2006/NĐ-CP dated December 28, 2006 of the Government detailing the Law on Trade regarding commodity trading exchange activities.

6. Field of Gas Business

a) Circular No. 11/2010/TT-BCT dated March 29, 2010 of the Minister of Industry and Trade promulgating the Provisions on Liquefied Petroleum Gas Dealership;

b) Circular No. 03/2016/TT-BCT dated May 10, 2016 of the Minister of Industry and Trade detailing certain provisions of Decree No. 19/2016/NĐ-CP dated March 22, 2016 of the Government on gas business.

7. Field of Import and Export

a) Joint Circular No. 03/2006/TTLT-BTM-BGTVT-BTC dated March 31, 2016 of the Ministers of Trade, Transport, and Finance guiding the importation of second-hand passenger cars with less than 16 seats according to Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government;

b) Joint Circular No. 25/2010/TTLT-BCT-BGTVT-BTC dated June 14, 2010 of the Ministers of Industry and Trade, Transport, and Finance stipulating the importation of new passenger cars with less than 16 seats (unused).

8. Field of Motor Vehicle Production and Business

a) Decision No. 24/2002/QĐ-BCN dated June 17, 2002 of the Minister of Industry promulgating standards for motorcycle manufacturing and assembly enterprises;

b) Decision No. 115/2004/QĐ-BCN dated October 27, 2004 of the Minister of Industry promulgating standards for automobile manufacturing and assembly enterprises;

c) Circular No. 12/2011/TT-BCT dated March 30, 2011 of the Minister of Industry and Trade amending, supplementing, and abolishing certain provisions of Decision No. 24/2002/QĐ-BCN dated June 17, 2002 of the Minister of Industry regarding standards for motorcycle manufacturing and assembly enterprises.

9. Field of Technical Standards and Regulations

a) Circular No. 06/2008/TT-BCT dated May 19, 2008 of the Minister of Industry and Trade guiding procedures and formalities for declaring products compliant with standards, state inspections, and managing the quality of industrial explosives;

b) Decision No. 36/2006/QĐ-BCN dated October 16, 2006 of the Minister of Industry promulgating Regulations on the Management of Safety Techniques for Refilling Liquefied Petroleum Gas Cylinders;

c) Decision No. 28/2006/QĐ-BCN dated August 16, 2006 of the Minister of Industry promulgating Regulations on the Management of Safety Techniques for Receiving, Transporting Liquefied Petroleum Gas by Tankers;

d) Decision No. 136/2004/QĐ-BCN dated November 19, 2004 of the Minister of Industry promulgating a list of machines, equipment, chemicals with special safety requirements in the industry and regulations on the management of safety techniques for such machines, equipment, and chemicals.

10. Field of Food Safety

Circular No. 57/2015/TT-BCT dated December 31, 2015 of the Minister of Industry and Trade stipulating conditions to ensure food safety in small-scale food production under the Ministry of Industry and Trade's regulatory responsibility.

11. Field of alcohol production and business

Circular No. 60/2014/TT-BCT dated December 27, 2014, issued by the Minister of Industry and Trade, detailing certain provisions of Decree No. 94/2012/NĐ-CP dated November 12, 2012 on alcohol production and business.

Article 2. Effective Date

This Circular takes effect from November 5, 2019.

Article 3. Implementation Organization

The Head of the Legal Department, the Director of the Ministry's Office, the Heads of units under the Ministry of Industry and Trade, and related agencies, organizations, and individuals are responsible for implementing this Circular./.
