CIRCULAR

Guidelines on certain aspects of managing civil servants, officials, and employees within the enforcement agency system.

 

Circular No. 02/2017/TT-BTP dated March 23, 2017, issued by the Minister of Justice, providing guidelines on certain aspects of managing civil servants, officials, and employees within the enforcement agency system, effective from May 7, 2017, has been amended and supplemented by:

1. Circular No. 18/2018/TT-BTP dated December 28, 2018, issued by the Minister of Justice, amending and supplementing certain articles of Circular No. 02/2017/TT-BTP dated March 23, 2017, issued by the Minister of Justice, providing guidelines on certain aspects of managing civil servants, officials, and employees within the enforcement agency system, effective from February 20, 2019;

2. Circular No. 06/2021/TT-BTP dated October 14, 2021, issued by the Minister of Justice, abolishing certain normative legal documents regarding personnel work in the field of enforcement of civil judgments issued by the Minister of Justice, effective from October 14, 2021;

3. Circular No. 12/2024/TT-BTP dated October 31, 2024, issued by the Minister of Justice, abolishing certain articles and clauses of circulars issued by the Minister of Justice guiding certain aspects of managing civil servants, officials, and employees within the enforcement agency system, effective from October 31, 2024.

Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to the Civil Enforcement Law dated November 14, 2008; the Law Amending and Supplementing Certain Provisions of the Civil Enforcement Law dated November 25, 2014;

Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain articles of the Civil Enforcement Law;

Pursuant to Decree No. 24/2010/NĐ-CP dated March 15, 2010, issued by the Government, stipulating recruitment, utilization, and management of civil servants, and Decree No. 93/2010/NĐ-CP dated August 31, 2010, issued by the Government, amending certain provisions of Decree No. 24/2010/NĐ-CP;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, use, and management of civil servants;

Pursuant to Decision No. 27/2003/QĐ-TTg dated February 19, 2003, issued by the Prime Minister, concerning the issuance of regulations on appointment, reappointment, rotation, resignation, and removal of cadres and civil servants in leadership positions;

Pursuant to Decision No. 61/2014/QĐ-TTg dated October 30, 2014, issued by the Prime Minister, stipulating the functions, tasks, powers, and organizational structure of the Civil Enforcement Agency under the Ministry of Justice;

At the proposal of the Director of the Civil Enforcement Agency and the Head of the Personnel Department of the Ministry of Justice;

The Minister of Justice issues this Circular providing guidelines on certain aspects of managing civil servants, officials, and employees within the enforcement agency system as follows[1]:

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular provides guidelines on certain aspects of managing civil servants, officials, and employees within the enforcement agency system, including the following contents:

Principles, conditions, content, form, and procedures for organizing examinations to enter the position of Junior Enforcement Officer in civil enforcement agencies; application dossier for appointing an Enforcement Officer without examination in certain cases provided for in Clauses 6 and 7 of Article 18 of the Civil Enforcement Law; procedures and formalities for appointing a Civil Enforcement Reviewer.

4. Models, colors, principles of distribution and use of uniforms; principles of distribution and use of badges and insignias of Enforcement Officers, Civil Enforcement Reviewers, Civil Enforcement Secretaries, other civil servants, officials, and employees working under labor contracts as prescribed in Decree No. 68/2000/NĐ-CP dated November 17, 2000, issued by the Government, concerning the implementation of a contract system for certain types of work in administrative state agencies and public institutions (hereinafter referred to collectively as persons engaged in civil enforcement work) currently working at the Civil Enforcement Agency, Provincial Civil Enforcement Agencies, District Civil Enforcement Agencies, and Military Zone Civil Enforcement Departments; models, principles of distribution, replacement, and recovery of Enforcement Officer cards and Civil Enforcement Reviewer cards.

Article 2. Applicability

This Circular applies to:

1. Civil enforcement management agencies include: The Civil Enforcement Agency under the Ministry of Justice, and the Civil Enforcement Agency under the Ministry of National Defense.

2. Civil enforcement agencies include: Provincial Civil Enforcement Agencies, District Civil Enforcement Agencies, and Military Zone Civil Enforcement Departments.

3. Civil servants, officials, and employees belonging to civil enforcement management agencies and civil enforcement agencies.

4. Other related agencies, organizations, and individuals.

Chapter IV. ORGANIZATION OF EXAMINATION FOR ENTRY INTO THE POSITION OF JUNIOR EXECUTION OFFICER, SPECIAL CASES FOR APPOINTMENT OF EXECUTION OFFICERS, TRANSFER, DETACHMENT OF EXECUTION OFFICERS, AND PROCEDURES AND REQUIREMENTS FOR APPOINTMENT OF CIVIL ENFORCEMENT OFFICERS

Section 1. ORGANIZATION OF EXAMINATION FOR ENTRY INTO THE POSITION OF JUNIOR EXECUTION OFFICER

Article 49. Principles for organizing examination for junior execution officers

The organization of examinations for junior execution officers (hereinafter referred to as examinations) shall be conducted on the principles of transparency, fairness, objectivity, and competition. The principle of competition does not apply to examinations for execution officers in the military.

Article 50. Eligibility to register for examination

1. Civil servants of civil enforcement agencies holding the rank of Enforcement Officer or Clerk of Civil Enforcement or Specialist.

2. Civil servants of other agencies who wish to register for examination, holding the rank of Specialist or equivalent.

3. Active officers in the Vietnam People's Army.

Article 51. Examination plan for junior execution officers

1. By March 31 each year at the latest, the Director of the Civil Enforcement Agency shall submit a report to the National Civil Enforcement Agency on the staffing, number of civil servants currently held by each civil servant rank, and the registration of the need for junior execution officers in their locality to the Minister of Justice for approval of quotas and examination plans.

2. The examination plan for junior execution officers shall be publicly announced on the Ministry of Justice's website and the National Civil Enforcement Agency's website.

Article 52. Examination rules and regulations

The examination rules and regulations for entry into the position of junior execution officer shall be implemented according to the current regulations of the Ministry of Home Affairs regarding the promotion examination for senior specialists.

Article 53. Examination Board for Junior Execution Officers

1. The Minister of Justice decides to establish the Examination Board for Junior Execution Officers and the Supervisory Board of the examination based on the proposal of the Director of the National Civil Enforcement Agency. The Examination Board for Junior Execution Officers consists of five or seven members, including:

a) Chairman of the Board: One leader from the Ministry of Justice;

b) Vice-Chairman of the Board: One leader from the National Civil Enforcement Agency;

c) Members of the Board: One leader from the Personnel Department of the Ministry of Justice and other members are heads of some units under the National Civil Enforcement Agency, some Directors of Civil Enforcement Agencies;

d) Member and Secretary of the Board: One leader from the Personnel Department of the National Civil Enforcement Agency.

2. The Examination Board for Junior Execution Officers establishes working committees, including: Question-setting Committee, Examination Committee, Sealing Committee, Marking Committee, Review Committee; these working committees perform their duties and powers as prescribed by law.

Article 54. Supervision of the Examination

1. The Minister of Justice shall decide to establish the Examination Supervision Board consisting of members who are the Head of the Board and supervisors. The specific tasks of the supervisors shall be assigned by the Head of the Examination Supervision Board.

2. The Supervision Board shall perform its duties and powers as prescribed by the Ministry of Interior for the Supervision Board of the civil service grade promotion examination.

Article 55. Conditions and Application Documents for Registration to Take the Examination

1. The conditions for registration to take the examination include:

a) Meeting the criteria for the初级级执行员级别,如民事诉讼法第十八条所述;

b) Performing well in the last three consecutive years; not being under criminal investigation or serving or having completed serving a criminal judgment or decision of the court without having had the criminal record expunged, or being under disciplinary review or within the disciplinary period;

c) For civil enforcement agency officials from this province or centrally administered municipality registering to take the examination for the primary level enforcement officer position at another provincial or centrally administered municipal civil enforcement agency, or for officials outside civil enforcement agencies registering to take the examination, they must obtain the consent of their current working unit. It is encouraged that officials from civil enforcement agencies in areas with developed economic and social conditions register to take the examination to become primary level enforcement officers at civil enforcement agencies in border, island, or particularly difficult economic and social condition regions.

2. The application documents for registration to take the examination shall be implemented according to Article 59 of Decree No. 62/2015/ND-CP, the recruitment plan for primary level enforcement officers of the Ministry of Justice, and the guidance of the Civil Enforcement General Bureau.

The application form for participating in the examination recruitment follows the model provided.[50] promulgated together with this Circular.

Article 56. Preliminary Selection for the Primary Level Enforcement Officer Position

1. The leadership collective of the Civil Enforcement Service Bureau shall conduct preliminary selection for those individuals proposed or registered to participate in the examination for the primary level enforcement officer position in their locality.

The leadership collective of the Civil Enforcement Service Bureau of the Ministry of National Defense shall conduct preliminary selection for those individuals proposed to participate in the examination for the primary level enforcement officer position in the military area enforcement office.

2. Content of preliminary selection:

a) Verify the validity of the application documents for the examination;

b) Check the eligibility of the examinees to take the examination;

c) Evaluate the political integrity, ethics, and physical fitness of the candidates according to the requirements and tasks of civil enforcement work;

3. After conducting preliminary selection as stipulated in Clause 2 of this Article, the leadership collective of the Civil Enforcement Service Bureau shall evaluate the results of the preliminary selection in the form of pass or fail.

4. Within three working days from the date of conducting preliminary selection, the Director of the Civil Enforcement Service Bureau must notify the results of the preliminary selection to the individual selected and their working unit.

5. Based on the proposal document from the Director of the Civil Enforcement Service Bureau to the civil enforcement agency or the Director of the Civil Enforcement Service Bureau of the Ministry of National Defense to the military area enforcement office, the Civil Enforcement General Bureau shall review the application documents for the examination, report to the General Bureau Director for consideration and approval of the list of qualified candidates for the examination.

Article 57. Examination Form and Time

Candidates registering for the recruitment examination for the position of Junior Enforcement Officer must participate in the following subjects:

1. A multiple-choice law test on civil enforcement proceedings, lasting 45 minutes.

2. A writing test on civil enforcement skills, lasting 180 minutes.

Article 58. Calculation of Points for Each Subject

1. Each subject is scored out of 100 points.

2. The points for each subject are calculated as follows:

a) The writing test on civil enforcement skills is weighted by a factor of 2;

b) The multiple-choice law test on civil enforcement proceedings is weighted by a factor of 1.

Article 59. Determination of Successful Candidates in the Recruitment Examination for Junior Enforcement Officers

Successful candidates in the recruitment examination for Junior Enforcement Officers must meet the following conditions:

1. Having participated in all subjects as prescribed in Article 57 of this Circular;

2. Obtaining at least 50 points in each subject (before applying the weighting factor);

3. Having a total score higher than the cut-off score determined in descending order within the quota for Junior Enforcement Officers of each province and centrally governed city.

Total Score = (Score of the writing test on civil enforcement skills) x 2 + Score of the multiple-choice law test on civil enforcement proceedings.

Civil servants from local civil enforcement agencies with developed economic and social conditions who register to take the recruitment examination for Junior Enforcement Officers at border, island, or particularly difficult economic and social condition areas shall be granted an additional 10 points to their total score for determining successful candidates.

4. In case two or more candidates have the same total score at the last quota, the candidate with a higher score in the writing test on civil enforcement skills will be considered successful. If it is still not possible to determine a successful candidate, the Director of the Civil Enforcement Agency shall issue a report to the General Director of the Civil Enforcement Service for submission to the Minister of Justice for decision on the successful candidate.

5. The determination of successful candidates for Junior Enforcement Officers in the military does not follow the provisions of paragraphs 3 and 4 of this Article.

Article 60. Announcement and Recognition of Examination Results

1. The examination board for the recruitment of Junior Enforcement Officers shall publicly announce the examination results on the Ministry of Justice's electronic portal, the Civil Enforcement Service's electronic portal, and notify in writing the Provincial Civil Enforcement Agencies and the Civil Enforcement Agency of the Ministry of National Defense to inform the candidates.

2. Within 15 days from the completion of the review procedures, the examination board for the recruitment of Junior Enforcement Officers must report to the Minister of Justice for recognition of the examination results.

Article 61. Appointment of Junior Enforcement Officers

1. Based on the Decision recognizing the examination results and the quota of Junior Enforcement Officers allocated to units, the Provincial Civil Enforcement Agencies and the Civil Enforcement Agency of the Ministry of National Defense shall request successful candidates to complete the appointment dossier for Junior Enforcement Officers.

2. The appointment dossier for Junior Enforcement Officers includes:

a) A proposal for the appointment of Junior Enforcement Officers;

b) A resume according to the model issued by the Ministry of Home Affairs, confirmed by the personnel management agency or according to the regulations of the Ministry of National Defense for the appointment of Junior Enforcement Officers in the military;

c) A health certificate issued by a district-level general hospital or higher, valid within the specified period;

d) A declaration of assets;

đ) Certified copies of diplomas and certificates;

3. On the basis of the proposal of the Directors of the Provincial Civil Enforcement Agencies and the Civil Enforcement Agency of the Ministry of National Defense, the General Director of the Civil Enforcement Service shall submit to the Minister of Justice for the appointment of Junior Enforcement Officers for those who have been successful.

In the case where a civil servant from a provincial or centrally governed city's civil enforcement agency is determined to be successful at another provincial or centrally governed city's civil enforcement agency, the General Director of the Civil Enforcement Service shall submit to the Minister of Justice for a decision to transfer and appoint Junior Enforcement Officers simultaneously.

In the case where a civil servant not belonging to any civil enforcement agency is successful, the General Director of the Civil Enforcement Service shall submit to the Minister of Justice for a decision to accept and appoint Junior Enforcement Officers simultaneously.

Article 62. Supplemental Appointment of Junior Enforcement Officers

1. Upon the proposal of the Director General of the Civil Execution General Department, the Minister of Justice shall make supplemental appointments of Junior Enforcement Officers in the following cases:

a) In the case where a person has been determined to be successful but fails to complete the required documentation for appointment or does not report for duty as prescribed, their examination results will be nullified, and another person with the next lowest score from the same registration unit who meets the conditions stipulated in Clause 1 and 2, Article 59 of this Circular will be determined as a supplementary successful candidate for the appointment of a Junior Enforcement Officer.

b) In the case where those who have taken the examination meet the conditions stipulated in Clause 1 and 2, Article 59 of this Circular but fall outside the quota of Junior Enforcement Officers allocated to the registration unit, if they express a willingness, they may be considered and determined as supplementary successful candidates for other units that do not have enough successful candidates within the allocated quota for the appointment of Junior Enforcement Officers. In the event of multiple persons expressing the same willingness, the order of determination shall be carried out according to the provisions of Clause 3 and 4, Article 59 of this Circular.

2. The application dossier for the supplemental appointment of Junior Enforcement Officers in the case provided for in point b, Clause 1 of this Article shall be implemented in accordance with the provisions of Article 61 of this Circular and supplemented with the following documents:

a) A letter expressing the willingness to be transferred to a unit with remaining quotas and a commitment to serve voluntarily for at least three years at the registered examination unit;

Section 2. DOCUMENTS FOR APPOINTING ENFORCEMENT OFFICERS IN CASES WITHOUT COMPETITIVE SELECTION

Article 63. Documents for appointing Enforcement Officers in cases provided for in Clauses 6 and 7 of Article 18 of the Civil Execution Law

1. The documents for appointing Enforcement Officers in cases provided for in Clause 6 of Article 18 of the Civil Execution Law include:

a) A proposal for appointing an Enforcement Officer;

b) A curriculum vitae according to the model issued by the Ministry of Home Affairs, confirmed by the competent authority managing civil servants, or in accordance with the regulations of the Ministry of National Defense for the appointment of Enforcement Officers in the military;

c) A copy of the Decision of the competent authority appointing Judges, Prosecutors, Investigators, Enforcement Officers (for those who have previously been Enforcement Officers);

d) A health certificate issued by a general hospital at district level or higher within the validity period;

đ) A declaration of assets;

e) Certified copies of diplomas and certificates;

g) An evaluation and recommendation for transfer of work from the head of the unit where the civil servant is working;

h)|||[51] Certificate of civil enforcement proceedings vocational training for civil servants working in civil execution agencies.

2. The application dossier for the appointment of a Junior Enforcement Officer in the case provided for in Clause 7, Article 18 of the Civil Execution Law includes:

a) The documents specified in points a, b, d, đ, e of Clause 1 of this Article;

b) Documents and papers confirming the time spent on legal work;

c) A document unifying the policy on the appointment of Heads and Deputy Heads of civil execution agencies by the local party committee or government at the appropriate level according to the cadre management hierarchy.

Article 64. Documents for appointing Enforcement Officers as prescribed in Article 63 of Decree No. 62/2015/NĐ-CP.

1. The proposal of the Selection Board for Enforcement Officers;

2. Minutes of the Selection Board's meeting for Enforcement Officers;

3. The application for appointment of Enforcement Officers by civil servants according to the model at; APPLICATION FORMS AND REGISTRATION TABLES FOR REQUESTING ISSUANCE OF CERTIFICATES AND LICENSES AND SAMPLES OF CERTIFICATES AND LICENSES attached hereto;

4. Documents specified in points b, d, đ, e Clause 1 Article 63 of this Circular; Section 3. REASSIGNMENT AND DETACHMENT OF ENFORCEMENT OFFICERS.

Section 4. PROCEDURES FOR APPOINTING CIVIL EXECUTION INSPECTORS (Repealed)

Article 66. Objectives and principles of appointment

1. Civil servants in the civil execution system holding the rank of specialist or higher at positions requiring a Bachelor’s degree in Law.

2. Civil servants from other agencies transferred to the civil execution system holding the rank of specialist or higher at positions requiring a Bachelor’s degree in Law.

3. Civil servants holding ranks lower than specialist shall not be appointed to the rank of Civil Execution Inspector.

Article 67. Examination and Assessment Board and contents of examination and assessment

1. The agency managing civil servants decides to establish an Examination and Assessment Board for civil servants proposed for appointment to the ranks of Civil Execution Inspector, including:

a) The Examination and Assessment Board for transferring to the ranks of Civil Execution Inspector, Senior Civil Execution Inspector, and Senior Civil Execution Inspector of the Civil Execution Agency includes five members: The Chairman of the Board is one Deputy Director of the Civil Execution Agency, the members include three leaders representing specialized units under the Civil Execution Agency, one leader of the Personnel Organization Department (serving as Secretary of the Board);

b) The Examination and Assessment Board for transferring to the ranks of Civil Execution Inspector, Senior Civil Execution Inspector, and Senior Civil Execution Inspector of local civil execution agencies includes five members: The Chairman of the Board is the Director of the Civil Execution Agency, the members include one leader of the Civil Execution Operations and Organization Department, one leader of the Inspection and Grievance Resolution Department, one Chief of the Civil Execution Branch, one leader of the Personnel Organization Department (serving as Secretary of the Board).

2. The Examination and Assessment Board conducts examinations and assessments on the qualifications and capabilities of civil servants proposed for appointment to the ranks of Civil Execution Inspector to advise the head of the agency managing civil servants to report to the competent authority to decide on the appointment to the ranks of Civil Execution Inspector, Senior Civil Execution Inspector, and Senior Civil Execution Inspector.

3. Civil servants currently holding one of the ranks of Junior Enforcement Officer, Intermediate Enforcement Officer, or Senior Enforcement Officer who are appointed to equivalent ranks of Civil Execution Inspector do not need to undergo examination and assessment.

BADGES OF ENFORCEMENT OFFICERS AND CIVIL EXECUTION INSPECTORS AND UNIFORMS, BADGES, RANK BADGES

Chapter V. Article 68. Principles of management and use

1. Persons engaged in civil execution work must wear uniforms with name plates, badges, and rank badges for civil execution while working at the office and during official duties according to their current position and title.

2. The issuance, management, and use of uniforms, badges, rank badges, Enforcement Officer Cards, and Civil Execution Inspector Cards must be in accordance with the purpose, target group, and regulations stipulated by law.

3. Strictly prohibit the use of uniforms, badges, rank badges, Enforcement Officer Cards, and Civil Execution Inspector Cards to commit acts contrary to the law.

3. It is strictly prohibited to use uniforms, insignia, badges, Enforcement Officer Cards, Execution Reviewer Cards to commit acts contrary to the law.

Article 69. Sample and Content of the Enforcement Officer Card

1.[53] The Enforcement Officer Card has a length of 86 mm and a width of 54 mm, produced from plastic material.

The style is a four-pocket coat with four buttons; the collar is square, with a large lapel, and a badge clip on the upper lapel; the buttons are metal-plated gold with the insignia of the civil enforcement agency embossed; the upper and lower pockets are outside with flaps, slightly curved, with angled bottoms, and a recessed welt; there are two clips on the left pocket flap for name plates; the shoulders have two shoulder straps; the hem is square; the sleeves are straight, with wide cuffs measuring 9 cm; the back has a slit; the chest and body have a pressed lining, with two hair combs on the shoulders; the coat is fully lined on the front, back, and sleeves; the lining matches the coat color; the entire collar, lapel, pockets, and cuffs are sewn with two parallel seams.

b) The winter formal shirt has a color of white fabric. The style is a two-pocket, four-button jacket with a seven-piece body; the collar is slightly turned up, the upper collar has a badge attachment notch; the buttons are metal-plated gold with the civil enforcement agency emblem embossed; there are two notches on the left chest for name badges; the two lower pockets have lids that curve slightly, the pocket bodies are inset; the shoulders have shoulder straps; the hem is square; the sleeves are straight with a 7 cm cuff, the back has a slit; the jacket body has a pressed seam; the jacket is fully lined on the front, back, and sleeves; the lining color matches the jacket; the entire collar, lapel, pocket, and cuff are sewn with double stitching.

b) The winter women's ceremonial shirt has a color of white fabric. The style is a button-down shirt with a placket; the buttons are plastic with the civil enforcement agency initials embossed, matching the shirt color; the body has four darts, including two side chest darts; the hem is curved 5 cm; the cuffs are 7 cm wide, fastened with two buttons, and have a pleat; the entire collar, placket, and cuff are sewn with single stitching, the hem is rolled 0.5 cm.

2. The summer women's ceremonial jacket has a color of ivory white fabric. Article 75. Kepi Hat

1. Colors include two types based on the autumn-winter outerwear color and the winter ceremonial attire color.

2. The style is a curved-brim hat made from the same fabric for the crown and visor, with a black plastic visor that slopes downward; the hat has a yellow chin strap with gold metal buttons at both ends, each with a raised five-pointed star; the center of the crown has a punched-out oval; the sides of the crown have four punched-out ovals; the front of the crown is reinforced with thin plastic; the crown lining is made of plastic-coated fabric, with foam padding attached inside.

3. Details of the Kepi Hat model at Appendix No. 6 promulgated together with this Circular.

Article 76. Cravat

1. Color is dark heather gray.

2. The cravat has moderate length and width; it is pre-tied with a zipper closure and an automatic lock.

Article 77. Name Badge on the Chest

1. The rectangular name badge on the chest measures 81 mm long and 23 mm wide, made of 0.6 mm thick brass plate, with a rust-resistant alloy pin, blue painted background, and a golden border. To the left of the badge is the emblem of the Civil Enforcement Agency. To the right is the text "LAST NAME AND FIRST NAME".

2. Details of the Name Badge on the Chest model at Appendix No. 7 promulgated together with this Circular.

Article 78. Leather Shoes, Leather Belts, Civil Enforcement Helmets

1. Leather belts shall be made of leather and black in color.

2. Leather shoes shall be made of leather and black in color, with laces.

3. The civil enforcement helmet shall be a dark heather gray colored helmet, with the phrase "CIVIL ENFORCEMENT" printed on the right side of the helmet exterior.

Article 79. Other Types of Uniforms

Other types of uniforms include leather sandals, socks, raincoats, and leather document cases, which shall be decided by the Director of the Civil Enforcement General Department (for civil servants of the Civil Enforcement General Department) and the Director of the Provincial Civil Enforcement Department (for civil servants of local enforcement agencies) in accordance with the characteristics of each locality within the price range specified by the Minister of Justice.

Article 80. Civil Enforcement Badges and Rank Insignias

1. The model of civil enforcement badges and rank insignias, the subjects eligible for badges and rank insignias, shall be implemented according to Articles 79, 80, and 81 of Decree No. 62/2015/NĐ-CP and Clause 4 of Article 1 of this Circular. 2. Details of the models of civil enforcement badges and rank insignias are set out in Appendix 8..

Article 81. Management of Funds for Printing, Issuing, and Retrieving Enforcement Officer Cards and Enforcement Audit Officer Cards 1. The Director of the Civil Enforcement General Department assists the Minister of Justice in uniformly managing Enforcement Officer Cards and Enforcement Audit Officer Cards and has the following responsibilities and authorities: promulgated together with this Circular.

a) Printing and managing card blanks for Enforcement Officer Cards and Enforcement Audit Officer Cards;

b) Implementing the printing of information of those who are issued cards onto the cards, maintaining registers to manage card serial numbers, coordinating with the Ministry of Justice's Office to stamp the Enforcement Officer Cards and Enforcement Audit Officer Cards.

2. The Ministry of Justice's Office is responsible for stamping the Enforcement Officer Cards and Enforcement Audit Officer Cards after verifying all relevant information provided by the Civil Enforcement General Department regarding the issuance of cards.

3. The funds for printing and purchasing card blanks for Enforcement Officer Cards and Enforcement Audit Officer Cards shall be allocated by the competent authority within the annual budget estimate of the Civil Enforcement General Department.

4. The issuance, replacement, reissuance, and retrieval of Enforcement Officer Cards and Enforcement Audit Officer Cards shall be carried out in the following situations:

a) Enforcement officers and audit officers when appointed to their positions shall be issued cards to serve their work;

b) Enforcement officers and audit officers who have been issued cards, when there is a change in position or workplace, or when the card is damaged, shall be issued new cards;

c) Enforcement officers and audit officers who have been issued cards but lost them must immediately report to the head of the agency directly managing such civil servants and proceed with the procedures for reissuing the cards.

5. The procedures for issuing, replacing, and reissuing Enforcement Officer Cards and Enforcement Audit Officer Cards are as follows:

a) For the situations mentioned in points a and b of Clause 4 of this Article, the Directors of the Civil Enforcement Departments and the Civil Enforcement Departments of the Ministry of National Defense are responsible for compiling lists accompanied by two photos wearing the uniform, badges, and rank insignias of the newly appointed positions, photo size 2x3 cm, and sending them to the Civil Enforcement General Department for issuance, replacement of cards according to regulations.

For the situation of replacing cards, after receiving the new card, the person being replaced must return the old card to the head of the agency where they work for destruction;

b) For the situation mentioned in point c of Clause 4 of this Article, the Directors of the Civil Enforcement Departments and the Civil Enforcement Departments of the Ministry of National Defense are responsible for compiling lists and confirmation letters from the heads of agencies and units where the Enforcement Officers and Audit Officers work, accompanied by two photos wearing the uniform, badges, and rank insignias of the newly appointed positions, photo size 2x3 cm, and sending them to the Civil Enforcement General Department for reissuance of cards according to regulations.

6. In the case where Enforcement Officers and Audit Officers transfer to other agencies, are disciplined, or for other reasons are no longer Enforcement Officers or Audit Officers, they are responsible for returning the cards to the head of the agency where they work; if they are the head of a Civil Enforcement Agency, they must return the cards to the head of the superior agency directly managing them.

b) For the case mentioned in point c of Clause 4 hereof, the Director of the Civil Execution Office, the Director of the Civil Execution Office of the Ministry of National Defense shall be responsible for compiling a list, attaching a confirmation letter from the head of the agency or unit where the Enforcement Officer or Execution Reviewer works, along with two photographs wearing the uniform, insignia, badge of the appointed rank, size 2x3 cm, to be sent to the General Department of Civil Execution to issue the Card as prescribed.

6. In the event that an Enforcement Officer or Execution Reviewer transfers to another agency, is disciplined, or for other reasons is no longer an Enforcement Officer or Execution Reviewer, they are responsible for returning the Card to the head of their agency; if they are the head of a civil execution agency, they must return the Card to the head of the superior managing agency.

Article 82. Management, Allocation, and Use of Uniforms, Badges, and Insignia

1. The Director of the Civil Enforcement General Department assists the Minister of Justice in uniformly managing uniforms, badges, and insignia for civil enforcement officers.

If uniforms, badges, or insignia of civil enforcement officers are damaged or lost due to objective reasons, they will be replenished by the issuing authority. In cases of damage or loss due to other reasons, the issuing authority will provide them but the civil enforcement officer must bear the entire cost of purchasing and equipping.

2. Civil enforcement officers who lose their uniforms, badges, or insignia must promptly report to the leadership of their agency or unit. When resigning, being disciplined with compulsory resignation, or transferring to another position, they must return their badges and insignia to the head of the civil enforcement agency before transferring positions.

3. The price range for purchasing each type of uniform, badge, and insignia, as well as Enforcement Officer Cards and Review Officer Cards for civil enforcement, shall be stipulated by the Minister of Justice. The budget for making and allocating uniforms, badges, and insignia for civil enforcement officers shall be provided by the state budget. The work of preparing budgets, making, and allocating uniforms, badges, and insignia for civil enforcement officers shall be carried out in accordance with the State Budget Law and the regulations on decentralization issued by the Minister of Justice.

4. The term of use, allocation, and utilization of uniforms, badges, and insignia for civil enforcement officers shall be implemented according to the provisions of Article 83 of Decree No. 62/2015/NĐ-CP.

The term of use for name plates on the chest of uniforms is three years per piece, with the initial issuance of three pieces.

5. Uniforms, badges, and insignia for civil enforcement officers shall be allocated as follows:

a) The Civil Enforcement General Department shall uniformly allocate badges and insignia for civil enforcement throughout the civil enforcement system;

b) Leather shoes, leather belts, leather sandals, socks, raincoats, and leather folders for civil enforcement officers under the Civil Enforcement General Department shall be allocated by the Director of the Civil Enforcement General Department, while those under local civil enforcement agencies shall be allocated by the Director of the Civil Enforcement Agency. Allocation shall be made in cash so that civil enforcement officers can purchase items based on the price range, standards, and models prescribed by the Minister of Justice.

c) The Director of the Civil Enforcement General Department and the Director of the Civil Enforcement Agency shall be responsible for purchasing and allocating remaining uniforms for subordinate civil enforcement officers. In necessary cases, the Director of the Civil Enforcement General Department may decide to allocate funds in cash for civil enforcement officers at the Civil Enforcement General Department and local civil enforcement agencies to purchase items based on the price range, standards, and models prescribed by the Minister of Justice.

6. Payment and settlement of costs for purchasing uniforms, badges, and insignia for civil enforcement officers shall be carried out in accordance with the State Budget Law and related implementing documents.

7. The Director of the Civil Enforcement General Department and the Director of the Civil Enforcement Agency shall ensure the allocation of uniforms, badges, and insignia in accordance with established principles and regulations; maintain records for monitoring and management as prescribed.

1. This Circular shall take effect from May 7, 2017. The Circular No. 01/2011/TT-BTP dated January 10, 2011 of the Minister of Justice on the model, principles for issuing and using Enforcement Officer Cards, Audit Officer Cards in enforcement proceedings, uniforms, insignia, and badges for civil enforcement officers; the Circular No. 09/2012/TT-BTP dated September 1, 2012 of the Minister of Justice on the procedures and formalities for appointing, reappointing, resigning, dismissing, demoting civil enforcement officers at the Department level under the General Office of Civil Enforcement; leaders of the Bureau, specialized departments, and equivalent units under the Bureau of Civil Enforcement; leaders of the Enforcement Branches; and the Circular No. 10/2012/TT-BTP dated October 15, 2012 of the Minister of Justice on organizing recruitment for the position of Junior Enforcement Officer; and the Circular No. 13/2013/TT-BTP dated September 13, 2013 of the Minister of Justice on the criteria for positions of leadership and management within the Bureau of Civil Enforcement and Enforcement Branches are hereby abolished.

2. Heads of units under the Ministry of Justice, heads of local enforcement agencies, and the Director of the Civil Enforcement Bureau under the Ministry of National Defense shall be responsible for implementing this Circular within their respective duties and authorities./.

Pursuant to Decree No. 96/2017/NĐ-CP dated August 16, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain articles of the Civil Enforcement Law;

On the basis of Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government stipulating recruitment, utilization, and management of civil servants; Decree No. 93/2010/NĐ-CP dated August 31, 2010 of the Government amending certain articles of Decree No. 24/2010/NĐ-CP;

At the proposal of the Director General of the Civil Enforcement Agency and the Head of the Cadre and Civil Service Department of the Ministry of Justice;

The Minister of Justice issues this Circular amending and supplementing certain articles of Circular No. 02/2017/TT-BTP dated March 23, 2017, guiding certain management contents for civil servants, officials, and employees belonging to the civil enforcement organization system."

Circular No. 06/2021/TT-BTP abolishing certain normative legal documents regarding cadre work in the field of civil enforcement issued by the Minister of Justice is based on the following grounds:

"On the basis of the Law on Issuing Normative Legal Documents dated June 22, 2015; the Law Amending and Supplementing Certain Articles of the Law on Issuing Normative Legal Documents dated June 18, 2020;

On the basis of Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain provisions of the Civil Enforcement Law; Decree No. 33/2020/NĐ-CP dated March 17, 2020 of the Government amending and supplementing certain articles of Decree No. 62/2015/NĐ-CP;

On the basis of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Issuing Normative Legal Documents; Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain articles of Decree No. 34/2016/NĐ-CP;

On the basis of Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies; Decree No. 101/2020/NĐ-CP dated August 28, 2020 of the Government amending and supplementing certain articles of Decree No. 123/2016/NĐ-CP;

Pursuant to Decree No. 96/2017/NĐ-CP dated August 16, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 138/2020/NĐ-CP dated November 27, 2020 of the Government on recruitment, use, and management of civil servants;

At the proposal of the Director of the Civil Enforcement General Department;

The Minister of Justice issues this Circular abolishing certain normative legal documents regarding cadre work in the field of civil enforcement issued by the Minister of Justice."

Circular No. 12/2024/TT-BTP abolishing certain articles and clauses of Circulars issued by the Minister of Justice guiding certain management contents for civil servants, officials, and employees belonging to the civil enforcement organization system is based on the following grounds:

"On the basis of the Law on Issuing Normative Legal Documents dated June 22, 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

Pursuant to the Civil Enforcement Law on November 14, 2008;

Based on the Law Amending and Supplementing Certain Provisions of the Civil Enforcement Law dated November 25, 2014;

Pursuant to Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain articles of the Civil Enforcement Law;

Pursuant to Decree No. 138/2020/NĐ-CP dated November 27, 2020 of the Government on recruitment, use, and management of civil servants;

On the basis of Decree No. 116/2024/NĐ-CP dated September 17, 2024 of the Government amending and supplementing certain articles of Decree No. 138/2020/NĐ-CP dated November 27, 2020 stipulating recruitment, utilization, and management of civil servants and Decree No. 06/2023/NĐ-CP dated February 21, 2023 stipulating quality control of civil servant intake;

On the basis of Decree No. 29/2024/NĐ-CP dated March 6, 2024 of the Government stipulating standards and positions of leadership and management civil servants in administrative state agencies;

Pursuant to Decree No. 98/2022/NĐ-CP dated November 29, 2022, issued by the Government, concerning the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director of the Civil Enforcement General Department;

The Minister of Justice issues this Circular abolishing certain articles and clauses of Circulars issued by the Minister of Justice guiding certain management contents for civil servants, officials, and employees belonging to the civil enforcement organization system."

[2] This clause is abolished according to point a, Clause 1, Article 1 of Circular No. 12/2024/TT-BTP abolishing certain articles and clauses of Circulars issued by the Minister of Justice guiding certain management contents for civil servants, officials, and employees belonging to the civil enforcement organization system, effective from October 31, 2024.

[3] This clause is abolished according to point a, Clause 1, Article 2 of Circular No. 06/2021/TT-BTP abolishing certain normative legal documents regarding cadre work in the field of civil enforcement issued by the Minister of Justice, effective from October 14, 2021.

[4] This provision is repealed pursuant to point a, Clause 1, Article 2 of Circular No. 06/2021/TT-BTP abolishing certain regulatory legal documents on cadre work in the field of civil enforcement issued by the Minister of Justice, effective from October 14, 2021.

[5] This provision is amended pursuant to Clause 1, Article 1 of Circular No. 18/2018/TT-BTP amending and supplementing certain provisions of Circular No. 02/2017/TT-BTP dated March 23, 2017 issued by the Minister of Justice guiding certain contents of management of civil servants, officials, and employees under the civil enforcement organization system, effective from February 20, 2019, and is repealed pursuant to Clause 2, Article 1 of Circular No. 12/2024/TT-BTP abolishing certain articles and clauses of circulars issued by the Minister of Justice guiding certain contents of management of civil servants, officials, and employees under the civil enforcement organization system, effective from October 31, 2024.

[6] This provision is repealed pursuant to point a, Clause 1 and Clause 2, Article 1 of Circular No. 12/2024/TT-BTP abolishing certain articles and clauses of circulars issued by the Minister of Justice guiding certain contents of management of civil servants, officials, and employees under the civil enforcement organization system, effective from October 31, 2024.
