Repeals consolidated legal documents issued by the Minister of Construction or jointly issued

Pursuant to the Law on Legal Documents legal documents dated June 22, 2015;

Pursuant to the Law Amending Law No. 42/2024/QH15 Supplementing Certain Provisions of the Law on Legal Documents dated dated 18/6/2020;

WHEREAS Pursuant to Decree No. 81/2017/NĐ-CP dated July 17, 2017 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Construction; enterprises, organization of the Ministry of Construction;

At the proposal of the Director of the Department of Legislation ON;

The Minister of Construction issues this Circular certain legal normative documents issued by the Minister of Education and Training repeals consolidated legal documents issued by the Director Ministry of Construction or jointly issued.

Repeal all legislative regulatory documents as follows:

1. Circular No. 05/2000/TT-BXD dated June 27, 2000 of the Minister of Construction guiding the implementation of support for people participating in revolutionary activities before the August Revolution of 1945 to improve housing pursuant to Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Prime Minister.

1. Circular No. 07/2006/TT-BXD dated November 10, 2006 of the Minister of Construction guiding adjustments to construction project budgets.

2. Joint Circular No. 01/2007/TTLT-BTTTT-BXD dated December 10, 2007 of the Minister of Information and Communications and the Minister of Construction guiding the installation, management, and use of mailboxes, fixed telephone cable systems, and television cable systems in multi-story buildings with multiple users.

3. Joint Circular No. 04/2007/TTLT-BXD-BCA dated July 7, 2007 of the Minister of Public Security and the Minister of Construction guiding coordination in handling violations in construction activities.

4. Circular No. 02/2008/TT-BXD dated January 2, 2008 of the Minister of Construction guiding the establishment and management of investment costs for infrastructure projects under the Socio-Economic Development Program for Particularly Difficult Communes in Ethnic Minority and Mountainous Areas for the period 2006-2010.

5. Circular No. 03/2008/TT-BXD dated January 25, 2008 of the Minister of Construction guiding adjustments to construction project budgets.

6. Circular No. 09/2008/TT-BXD dated April 17, 2008 of the Minister of Construction guiding adjustments to prices and construction contracts due to fluctuations in raw material, fuel, and building material prices.

29. Decision No. 18/2002/QĐ-BXD dated July 2, 2002 of the Minister of Construction on issuing standard budget rates for basic construction projects on islands and at sea for Electrical, Water, and Communication sections.

30. Decision No. 33/2002/QD-BXD dated November 28, 2002, issued by the Minister of Construction, temporarily promulgating regulations on "Awarding annual commendations to units within the Construction Industry through scoring methods."

31. Decision No. 13/2003/QD-BXD dated May 30, 2003, issued by the Minister of Construction, promulgating the "Comprehensive unit price for construction projects of the new Hai Phong Cement Plant."

32. Decision No. 22/2003/QD-BXD dated September 11, 2003, issued by the Minister of Construction, promulgating the Regulation on management, collection, submission, and utilization of fees for investment appraisal conducted by the Ministry of Construction.

33. Decision No. 25/2003/QD-BXD dated September 24, 2003, issued by the Minister of Construction, promulgating detailed regulations on authority to sign official documents.

34. Decision No. 19/2005/QD-BXD dated June 29, 2005, issued by the Minister of Construction, promulgating the Regulation on management, preparation, and utilization of state secrets documents.

35. Decision No. 38/2005/QD-BXD dated November 2, 2005, issued by the Minister of Construction, promulgating the "Standard cost estimate for maintaining public lighting systems."

36. Decision No. 22/2006/QD-BXD dated August 8, 2006, issued by the Minister of Construction, promulgating the Regulation on sending, receiving, managing, operating, and utilizing administrative documents and papers via the information network of the Ministry of Construction.

37. Directive No. 07/2007/CT-BXD dated November 5, 2007, issued by the Minister of Construction, enhancing management of construction works for high-rise buildings.

Article 2. Repealing part of certain regulatory legal documents

Repealing part of the following legislative regulatory documents:

1. Repeal Section V Part I and Section I, Section IV Part II of Circular No. 20/2005/TT-BXD dated December 20, 2005, issued by the Minister of Construction, guiding urban greenery management.

2. Repeal Article 2 and Article 3 of Circular No. 20/2009/TT-BXD dated June 30, 2009, issued by the Minister of Construction, amending and supplementing Circular No. 20/2005/TT-BXD dated December 20, 2005, issued by the Minister of Construction, guiding urban greenery management.

3. Repeal Chapter III, Clause 2 of Article 28, Appendix IV, Appendix V, and Appendix VI attached to Joint Circular No. 20/2013/TTLT-BXD-BNV dated November 21, 2013, issued by the Ministers of Construction and Home Affairs, guiding certain contents of Decree No. 11/2013/NĐ-CP dated January 14, 2013, of the Government on urban development investment management.

4. Repeal Article 1 of Circular No. 28/2016/TT-BXD dated December 15, 2016, issued by the Minister of Construction, amending and supplementing certain provisions of Circular No. 10/2015/TT-BXD dated December 30, 2015, on training and professional knowledge enhancement for management and operation of apartment buildings, Circular No. 11/2015/TT-BXD dated December 30, 2015, on issuance of real estate brokerage practice certificates; guiding training and professional knowledge enhancement for real estate brokerage practice and property trading floor management; establishment and organization of activities of property trading floors and certain provisions of the Regulation on management and use of apartment buildings issued together with Circular No. 02/2016/TT-BXD dated February 15, 2016, of the Minister of Construction.

5. Repeal Article 1, Clause 3 of Article 2, and the attached Appendix of Circular No. 10/2018/TT-BXD dated December 26, 2018, issued by the Minister of Construction, amending and supplementing certain articles of Circular No. 10/2015/TT-BXD dated December 30, 2015, on training and professional knowledge enhancement for management and operation of apartment buildings, and Circular No. 28/2016/TT-BXD dated December 15, 2016, on amending and supplementing certain provisions of Circular No. 10/2015/TT-BXD dated December 30, 2015, on training and professional knowledge enhancement for management and operation of apartment buildings, Circular No. 11/2015/TT-BXD dated December 30, 2015, on issuance of real estate brokerage practice certificates; guiding training and professional knowledge enhancement for real estate brokerage practice and property trading floor management; establishment and organization of activities of property trading floors and certain provisions of the Regulation on management and use of apartment buildings issued together with Circular No. 02/2016/TT-BXD dated February 15, 2016, of the Minister of Construction.

Article 3. Implementation Provisions

This Circular takes effect from August 15, 2021.
