Article 1. Position and Functions
The Ministry of Agriculture and Rural Development is a governmental agency responsible for managing state affairs in the following sectors: agriculture, forestry, salt industry, fisheries, irrigation, disaster prevention and mitigation, rural development; managing public services within the scope of its jurisdiction according to the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Agriculture and Rural Development shall perform the tasks and powers as prescribed in Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the specific tasks and powers set forth below:
1. Submit draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees of the Government according to the annual legislative program of the ministry approved; and other mechanisms, policies, projects, programs, regulatory documents under the scope of state management of the ministry as assigned by the Government and the Prime Minister.
5. Issue circulars, decisions, directives, national technical standards, procedures, norms, economic and technical quotas; organize the establishment of national standards on sectoral and field management under the ministry’s state management jurisdiction as prescribed by law; guide, inspect the implementation of these documents.
3. Submit to the Prime Minister draft decisions, directives, and other documents within the Prime Minister's authority to issue.
6. Announce, direct, guide, inspect, audit, evaluate, compile reports, and be responsible for implementing mechanisms, policies, strategies, plans, and programs that have been approved within the scope of the ministry’s state management; promote, disseminate, and educate the law on sectors and fields under the ministry’s state management jurisdiction.
5. Issue circulars, decisions, directives, national technical standards, procedures, norms, economic and technical standards; organize the development of national standards on sectoral management within the scope of state management of the ministry according to the law; guide, inspect the implementation of such documents.
6. Announce, direct, guide, inspect, audit, compile reports, and be responsible for implementing mechanisms, policies, strategies, plans approved within the scope of state management of the ministry; promote, disseminate, and educate the law on sectors and fields within the scope of state management of the ministry.
7. Inspect regulatory documents issued by other ministries, provincial People's Councils, provincial People's Committees directly under the central government related to sectors and fields within the scope of state management of the ministry; if any provisions issued by these authorities are found to be contrary to regulatory documents within the scope of management of the ministry, handle them according to the law.
b) Direct and guide the use of the budget for programs to prevent, control, and mitigate the consequences of plant diseases;
a) Direct the development and inspection of implementation of planning for the development of crop zones, safe agricultural product production; plans for the use, protection, and improvement of agricultural land fertility; soil erosion control, desertification, and landslides.
b) Direct, guide the use of the budget for disease prevention and control programs in plants;
b) Direct and guide the use of the budget for programs to prevent, control, and mitigate the consequences of animal diseases;
c) Direct the implementation of livestock structure; breeding techniques; annual livestock production plan summary and evaluation;
e\. Manage agricultural crop seeds, plant quarantine, plant protection, and plant protection chemicals in accordance with the law.
9\. Regarding animal husbandry and veterinary medicine
d) Direct the inspection of germplasm conservation, storage, and utilization according to the law;
đ) Direct, guide, and inspect the implementation of state management tasks regarding livestock breeding seeds, livestock feed, veterinary drugs, and veterinary activities according to the law.
10. On fisheries:
c) Direct the implementation of livestock structure; animal husbandry techniques; summarize and evaluate the implementation of the annual animal husbandry production plan;
c) Guide and inspect the implementation of fishery resource exploitation, protection, and development planning of provinces and centrally governed cities; regulations on safety of fishing vessels, information to prevent natural disasters for fishermen and fishing vessels at sea; fishery resource exploitation, protection, and development according to the law;
d) Direct, guide, and inspect the implementation of planning for concentrated aquaculture zones; environmental monitoring in aquaculture; aquaculture procedures, techniques, and seasons; disease prevention and control in aquaculture;
đ) Specify the list of aquatic species that need to be conserved, protected, and regenerated; measures to protect aquatic ecosystem environments, conserve genetic funds, and maintain aquatic biodiversity according to the law;
e) Implement state management tasks concerning fishery surveillance according to the law;
g) Direct the implementation of state management tasks regarding aquaculture breeding seeds, feed; chemicals, biological products, and microorganisms used for environmental treatment in aquaculture according to the law;
c) Guide and inspect the implementation of planning for the exploitation, protection, and development of aquatic resources by provinces and centrally-administered cities; regulations on safety for fishing vessels, information for preventing natural disasters for fishermen and fishing vessels at sea; exploitation, protection, and development of aquatic resources according to the law.
d) Direct, guide, and inspect the implementation of planning for concentrated aquaculture zones; environmental monitoring and warning systems in aquaculture; aquaculture procedures, techniques, and seasons; quarantine, prevention, and control of aquatic diseases.
đ) Specify the list of aquatic species that need conservation, protection, and regeneration; measures to protect the environment of aquatic ecosystems, conserve genetic funds, and biodiversity of aquatic species according to the law.
e) Implement state management tasks regarding fisheries surveillance as prescribed by law;
g) Direct the implementation of state management tasks regarding aquaculture seedlings, feed; chemicals, biological preparations, microorganisms used to treat and improve aquaculture environments according to the law.
h) Manage state infrastructure and post-harvest services for the fishing industry.
11. Regarding salt production:
a) Direct, guide, and inspect technical production and harvesting; summarize and evaluate the implementation of the annual salt production plan;
b) Issue and inspect the implementation of national technical standards and procedures for salt production, processing, and preservation, and salt products (excluding salt used in the medical field).
12. Regarding forestry:
a) Direct, guide, and inspect the implementation of government and prime minister regulations on mechanisms and policies for forestry development, forest management rules, management and protection of endangered and precious forest plants and animals, and lists of endangered and precious forest plants and animals according to the law.
Take the lead and coordinate with relevant ministries and sectors to manage special-use forests, protect forest ecosystems, forest species, and natural conservation according to the law.
Submit to the Prime Minister for approval the establishment of planning for the system and change of purpose of use of protective forests and special-use forests of national importance or spanning multiple provinces.
b) Direct, guide, and inspect the implementation of regulations on combined agricultural, forestry, and fishery production and afforestation according to the law.
c) Direct the implementation of policies for compensating for forest environmental services as prescribed by law;
d) Direct the implementation of state management tasks regarding forest development, protection, and utilization; timber harvesting; organization of forestry production linked to processing and consumption of forest products; forestry plant seeds according to the law.
13. Regarding water resources:
a) Carry out state management tasks related to the exploitation and protection of irrigation works as prescribed by law;
b) Direct, guide, and inspect basic surveys, strategies, planning, programs, projects, policies, and laws on irrigation, rural water supply; investment in construction, repair, and upgrading of irrigation works and rural water supply facilities; operation of reservoirs and irrigation works according to the law.
c) Direct, guide, and inspect the establishment, approval, and implementation of irrigation planning serving agriculture and multi-purpose objectives linked to economic and social sectors as prescribed by law;
d) Approve irrigation planning, rural water supply planning involving two or more provinces, complex irrigation systems and large-scale irrigation works within a province serving water supply and drainage; drought prevention, saline intrusion prevention; land improvement, desertification prevention; rural water supply and drainage according to the law.
đ) Direct, guide, and inspect technical procedures, irrigation and drainage policies; management of irrigation and drainage, management of irrigation works exploitation; guide and inspect the implementation of regulations on discharging wastewater into irrigation works.
e) Direct, guide, and inspect the approval of irrigation plans, irrigation works systems, clean water, and rural environmental sanitation plans at the provincial level as prescribed by law;
g) Direct, guide, and inspect the implementation of drought, saline intrusion, flooding, desertification prevention and mitigation; organize monitoring, forecasting, and warning about drought, saline intrusion, flooding, water quantity and quality in irrigation systems according to the law.
h) Direct, guide, and inspect plans for protecting hydraulic works and their protection zones;
i) Direct, guide, and inspect the establishment of plans for constructing, managing, using, and protecting rural water supply and drainage facilities;
k) Implement state management tasks regarding dam safety and water reservoirs for irrigation in accordance with the provisions of the law; implement state management tasks within the scope assigned to the ministry under the Law on Water Resources and other relevant laws.
14. Regarding disaster prevention and control:
a) Direct, guide, and inspect the implementation of strategies, plans, programs, projects, policies, and laws related to disaster prevention and response.
b) Direct, guide, and inspect the implementation of legal provisions concerning mechanisms, policies, human resources, materials, equipment, information systems, emergency supplies, and resources for disaster prevention and response.
c) Guide and inspect the development, approval, and organization of implementation of disaster response plans; inspect disaster prevention and response plans in economic and social development plans and projects of localities, ministries, and sectors.
d) Aggregate, evaluate, statistically analyze, and publish data on losses caused by disasters; guide and inspect the implementation of monitoring and supervision activities related to construction works and disaster prevention and response measures as prescribed by law.
d) Guide, compile, evaluate, and publish statistics on losses caused by disasters; guide and inspect the implementation of monitoring and supervision of activities related to works and disaster prevention and control measures as prescribed by law;
e) Implement state management tasks regarding flood prevention planning for river embankments, dike regulation planning; investment in construction, repair, upgrading, and reinforcement of dikes; manage and protect dikes, dike protection zones, and dike usage according to the Law on Dikes and other relevant laws; approve plans for flood and storm prevention, coastal erosion prevention, and other relevant plans as prescribed by law.
f) Manage the investment in the construction, repair, and protection of disaster prevention and control works as prescribed by law;
g) Perform state management tasks regarding disaster prevention and control as stipulated in the Law on Dikes, the Law on Disaster Prevention and Control, the Law on Water Resources, and other legal provisions.
15. Regarding rural development:
a) Direct and implement the national target program for new rural development and the action program to eliminate hunger in Vietnam as assigned by the Government;
b) Aggregate and submit to the Prime Minister for approval comprehensive plans and programs for rural development; strategies for developing rural industries and crafts linked to households and cooperatives at the commune level.
c) Organize and inspect the implementation of planning, programs, mechanisms, and policies for the development of agricultural machinery and rural industries and crafts linked to households and cooperatives after they have been approved by competent authorities.
d) Lead, guide, and inspect the implementation of resettlement plans for residents affected by water conservancy and hydropower projects; stabilize resident populations in disaster-prone areas, particularly difficult regions, border islands, coastal areas affected by climate change, free migration areas, weakly protected forest areas, and special-use forests; direct, guide, and inspect the implementation of permanent settlement plans for rural areas and ethnic minority and mountainous regions according to national socio-economic development plans; guide and inspect the implementation of permanent settlement plans for rural areas and ethnic minority and mountainous regions according to national socio-economic development plans.
đ) Direct, guide, and inspect the organization of vocational training for rural laborers as prescribed by law;
e) Direct, guide, and inspect rural technical infrastructure construction programs according to specialized legal provisions;
16. Regarding food safety for agriculture, forestry, aquaculture, and salt:
a) Direct, organize, guide, inspect, and supervise the implementation of legal provisions on food safety for primary production of agricultural, forestry, aquatic products, and salt within the scope of the ministry's state management.
b) Direct, organize, guide, inspect, and supervise the implementation of legal provisions on food safety throughout the production process, collection, slaughter, preliminary processing, manufacturing, storage, transportation, export, import, and trade of cereals; meat and meat products; aquatic products and aquatic product products; vegetables, fruits, and vegetable and fruit products; eggs and egg products; raw milk; honey and honey products; genetically modified foods; salt; spices; sugar; tea; coffee; cocoa; pepper; cashew nuts; and other agricultural food products; manage food safety for wholesale markets and agricultural auctions.
c) Take the lead in managing food safety for production facilities producing multiple types of food products under the management authority of the Ministry of Agriculture and Rural Development and the Ministry of Industry and Trade.
d) Organize monitoring, assess risks, issue warnings, prevent, stop, and rectify food safety incidents for food products within the scope of the ministry's management; inspect and supervise the implementation of traceability, recall, and handling of unsafe food products within the scope of the ministry's management.
đ) Issue, revoke confirmation of genetically modified organisms meeting conditions for use as food; confirm advertising content for food products within the scope of the ministry's management.
e) Designate testing units, verification testing units; announce testing results for food products within the scope of the ministry's management.
17. Regarding quality management for seeds, materials, agricultural, forestry, salt industry, aquatic products, and water conservancy projects, dyke systems:
a) Implement and inspect the execution of mechanisms, policies, strategies, planning, programs to develop and improve the quality of products and goods within the scope of the ministry's management.
b) Enact a list of products and goods that have the potential to cause safety hazards (products and goods group 2) within the scope of the ministry's management.
c) Designate and manage the activities of organizations assessing conformity with quality standards for products and goods within the scope of the ministry's management.
18. Regarding storage, processing, transportation of agricultural, forestry, aquatic products, and salt:
a) Direct, guide, and inspect the implementation of planning, programs, mechanisms, and policies for the development of processing industries linked to production and markets; support post-harvest loss reduction for industries under the ministry's state management.
b) Guide, inspect the implementation of regulations concerning conditions ensuring safety for preliminary processing, storage, and processing facilities within the scope of the ministry's management.
c) Guide the transportation of goods under specialized agricultural, forestry, aquatic product, and salt management.
19. Regarding agricultural product trade:
a) Coordinate with the Ministry of Industry and Trade to develop mechanisms and policies for promoting agricultural trade and markets; plans and programs for trade promotion; national brand programs for agricultural, forestry, aquatic products, and salt.
b) Direct, guide, and organize the implementation of market analysis, forecasting, trade promotion, and related activities for national brand programs for agricultural, forestry, aquatic products, and salt within the scope of the ministry's management.
c) Enact specific lists of prohibited imports and exports; lists of exported and imported goods under specialized management of the ministry according to the provisions of the law.
d) Coordinate with the Ministry of Industry and Trade to implement anti-dumping and self-defense measures for Vietnamese agricultural exports to foreign countries and agricultural imports from foreign countries into Vietnam.
20. Regarding investment and construction management:
a) Direct, guide, inspect, supervise activities on investment, construction investment; construction activities in accordance with the provisions of the law;
b) Carry out state management tasks over construction investment and quality management of specialized works and fields under the Ministry's management scope according to the provisions of the law;
c) Review the contents of pre-feasibility study reports and feasibility study reports of programs, projects, plans within the scope of the ministry's management;
Approve investment orientation; decide on investment; approve design, budget estimate, final account, and manage bidding for programs and projects under the Ministry's authority according to the provisions of the law;
d) Guide, monitor, assess, inspect, audit programs and projects on investment and construction under the Ministry's decision-making authority according to the provisions of the law;
đ) Organize overall supervision and evaluation of investment; supervise and evaluate construction investment and specialized investment projects within the industry and field management scope of the Ministry according to the provisions of the law;
21. Regarding enterprises, cooperatives, and other forms of collective and private economies:
a) Submit to the Government for issuance of mechanisms and policies to encourage and support household economies, farms, cooperative groups, cooperatives, cooperative unions, and production linkages in industries and fields under the ministry's state management.
d) Exercise rights and responsibilities of the state agency representing state ownership at enterprises according to the division of labor by the Government and according to the Law on Management and Use of State Capital Invested in Production and Business at Enterprises, the Enterprise Law, and other legal provisions.
b) Guide and inspect compliance with business and service regulations with conditions according to the list prescribed by the Government and handle violations within authority.
22. Manage national reserves of crop seeds, plant protection chemicals, veterinary drugs, and other goods according to the division of labor by the Government.
d) Exercise rights and responsibilities of the state-owned enterprise representative body at enterprises according to the division of labor by the Government and the provisions of the Law on State Capital Management and Usage in Production and Business Enterprises, the Enterprise Law, and other relevant laws.
22. Manage the national strategic reserve of crop seeds, plant protection chemicals, veterinary drugs, and other goods as assigned by the Government.
24. Regarding agricultural extension services:
a) Direct scientific and technological activities within the sectors and fields under the Ministry's management.
a) Submit to competent authorities for issuance or issue within its authority mechanisms, policies, strategies for agricultural extension services; socialization of agricultural extension activities.
c) Direct the implementation of state management tasks regarding high technology in agriculture as prescribed by the High Technology Law.
c) Develop plans, organize the implementation of central-level agricultural extension activities; manage central-level agricultural extension funds according to legal provisions.
25. Regarding environmental protection, climate change, and biodiversity:
b) Guide and inspect the implementation of regulations concerning agricultural extension activities.
27. Technically inspect safety for machines, equipment, materials, substances requiring strict occupational safety in activities under the ministry's management according to legal provisions.

c) Direct and implement tasks to respond to climate change and rising sea levels within the scope of the ministry's state management as assigned by the Government.
26. Direct, guide, and organize the implementation of investment promotion activities in sectors and fields under the ministry's state management;
27. Conduct technical safety inspections for machines, equipment, materials, and substances requiring strict labor safety in activities within the sectors and fields managed by the ministry as prescribed by law;
28. Implement international cooperation and economic integration in industries and fields under the ministry's state management as prescribed by law.
29. To decide and direct the implementation of the Ministry's administrative reform program according to the goals and content of the State administrative reform program approved by the Prime Minister; propose or decide within their authority on the delegation of state management over sectors and fields to local authorities.
30. Regarding organization management and public service activities:
a) Presents to the Government for issuance of mechanisms and policies on the provision of public services; implements socialization of activities providing public services under the Ministry's management;
b) Presents to the Prime Minister for approval the planning of the network of public institutions and public services; the list of public services funded by the state budget under the Ministry's management;
c) To promulgate economic and technical norms applicable in public service fields managed by the State; regulations on bidding, ordering, and assigning tasks for providing public services; criteria, quality standards, monitoring mechanisms, evaluation, and quality certification of public services; the effectiveness of operations of public service units under the management of the ministry;
31. Performs management functions towards associations and non-governmental organizations operating in sectors and fields under the State management of the Ministry according to the provisions of the law.
32. Performs management functions regarding organizational structure, civil servant staffing, job positions, and the number of employees; recruitment, training, development, management, utilization, salary systems, commendation, rewards, disciplinary actions, and other systems and policies for cadres, civil servants, employees, and workers under the Ministry's management and within the scope of State management of the Ministry according to the provisions of the law.
32. To perform duties related to organizational structure management, civil servant staffing, job positions, number of civil servants; recruitment, training, retraining, management, utilization, salary systems, commendation, rewards, disciplinary actions, and other policies for cadres, civil servants, civil employees, and workers under the management of the ministry and within the scope of the ministry's state management as prescribed by law.
33. To conduct inspections and audits; receive citizens; resolve complaints and denunciations; prevent and combat corruption and malpractice and handle violations of laws related to the sector and field as prescribed by law.
34. To implement duties related to the development and application of information technology, remote sensing, statistics within the scope of the ministry's state management as prescribed by the Law on Information Technology, the Law on Statistics, and other relevant laws.
35. To manage finances, assets, and other resources assigned, and organize the implementation of allocated budgets as prescribed by law.
To serve as the national focal point for disaster prevention and control work; plans for forest protection and development; new rural construction; desertification control; international trade management of endangered wild animal and plant species; prevention and control of livestock and poultry diseases as prescribed by law.
11. Plant Protection Bureau.The Minister of Science and Technology issues this Circular on the issuance of "National Technical Regulations on Gasoline, Diesel Fuel and Biofuel"12. Livestock Breeding Bureau.

In this Article, units from Clause 1 to Clause 21 are organizations assisting the Minister in performing State management functions; units from Clause 22 to Clause 27 are public service organizations serving the State management functions of the Ministry.
The Minister of Agriculture and Rural Development presents to the Prime Minister for approval: Regulations on functions, tasks, powers, and organizational structures of the Water Resources Service, Forest Service, Fisheries Service, and Disaster Prevention and Control Service; issues a list of other public service organizations under the Ministry.
22. Institute of Agricultural and Rural Development Policy and Strategy.
The Minister of Agriculture and Rural Development regulates functions, tasks, powers, and organizational structures of subordinate units of the Ministry, excluding units specified in Clauses 18, 19, 20, and 21 of this Article.
The Organization and Cadre Affairs Department is organized into six divisions; the Science, Technology, and Environment Department is organized into five divisions; the International Cooperation Department is organized into four divisions; the Legal Affairs Department is organized into a division for administrative procedure control; the Ministry Inspectorate is organized into seven divisions; the Ministry Office is organized into ten divisions;
The Crop Production Bureau is organized into an office and eight divisions;
The Plant Protection Bureau is organized into an office, nine divisions, and nine branches;
The Livestock Breeding Bureau is organized into an office and seven divisions;
In this Article, units specified from Clause 1 to Clause 21 are organizations assisting the Minister in performing state management functions; units specified from Clause 22 to Clause 27 are public service organizations serving the state management functions of the ministry.
The Minister of Agriculture and Rural Development submits to the Prime Minister: To prescribe the functions, tasks, powers, and organizational structure of the Water Resources General Department, Forestry General Department, Fisheries General Department, Disaster Prevention and Control General Department; to issue a list of other public service organizations under the ministry.
The Minister of Agriculture and Rural Development prescribes the functions, tasks, powers, and organizational structure of subordinate units of the ministry, excluding the units specified in Clauses 18, 19, 20, and 21 of this Article.
The Cadre and Civil Service Affairs Department shall be organized into six divisions; the Science, Technology, and Environment Department shall be organized into five divisions; the International Cooperation Department shall be organized into four divisions; the Legal Affairs Department shall be organized into a division for administrative procedure supervision; the Inspectorate shall be organized into seven divisions; the Ministry Office shall be organized into ten divisions;

The Quality Control Bureau for Agricultural, Forestry, and Aquatic Products is organized into an office, 06 departments, and 02 branches;
The Processing and Market Development Bureau for Agricultural Products is organized into an office, 07 departments, and 06 branches.
Article 4. Effective date
1. This Decree takes effect from the date of issuance.
2. This Decree replaces Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government prescribing the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; abolishes previous provisions that conflict with this Decree.
Article 5. Transitional Provisions
The Water Resources General Department, Forestry General Department, and Fisheries General Department shall continue to operate in accordance with current laws until the Prime Minister decides on their functions, tasks, powers, and organizational structures.
Article 6. Responsibility for Implementation
The Minister of Agriculture and Rural Development, ministers, heads of ministerial-level agencies, heads of government agencies, chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
