DECISION
On "Cultural Enjoyment Preferential Policies"
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
To implement Resolution No. 5 of the Central Committee of the Communist Party of Vietnam, Session VIII on "Building and Developing a Modern and Distinctly National Cultural Foundation";
Considering the proposal of the Minister of Culture and Information,
DECISION:
Article 1. Issuing "Cultural Enjoyment Preferential Policies" for certain preferential policy beneficiaries.
1. Citizens residing in particularly difficult mountainous and remote areas as defined in Program 135 of the Government.
2. Persons with meritorious service to the revolution:
a) Elder revolutionary cadres; pre-revolutionary cadres.
b) Relatives of martyrs.
c) Heroes of the Armed Forces, Labor Heroes, Mothers of Vietnam's Heroes.
d) War invalids, persons receiving benefits equivalent to war invalids, and veterans.
đ) Subjects being cared for at facilities for invalids, veterans, and persons with meritorious service.
3. Social welfare beneficiaries:
a) Disabled persons, elderly individuals living alone.
b) Subjects being cared for at social welfare institutions.
c) Students of boarding schools for ethnic minorities.
Article 3. Cultural activities to implement cultural enjoyment preferential policies include:
- Art performances, film screenings, or video showings.
- Libraries.
- Mobile information services; exhibitions.
- Museums, historical sites.
Article 4. The subjects specified in Article 2 shall be granted state preferential treatment at a minimum level as follows:
1. For the subjects specified in Clause 1 of Article 2 of this Decision, within one year they are entitled to free viewing:
a) Film screenings or video showings four times and art performances twice.
b) Mobile information teams performing four times and exhibitions organized by provincial or city authorities two times.
2. For the subjects specified in Clause 2 of Article 2 of this Decision:
a) For the subjects listed in Points a, b, c, and d of Clause 2 of Article 2 of this Decision, within one year:
- They are invited by the Department of Culture and Information (or authorized units) to view films or videos, attend art performances four times; visit museums, historical sites, and cultural works implemented by state agencies or social organizations in their locality two times.
- They are entitled to a 50% discount on current ticket prices when participating in group activities such as watching films, attending art performances, visiting museums, and historical sites organized by state agencies or social organizations in their locality.
b) For the subjects specified in Point đ of Clause 2 of Article 2 of this Decision, they are organized to watch films or videos, attend art performances four times; view mobile exhibitions of museums organized by state agencies or social organizations in their locality two times.
3. For the subjects specified in Clause 3 of Article 2 of this Decision, state preferential treatment is provided based on voluntary participation:
a) Disabled persons and elderly individuals living alone are invited by the Department of Culture and Information (or authorized units) to watch films or videos, attend art performances four times per year.
They are entitled to a 50% discount on current ticket prices when participating in group activities such as watching films or videos, attending art performances, visiting museums, and historical sites organized by state agencies or social organizations in their locality.
b) For the subjects being cared for at social welfare institutions and students of boarding schools for ethnic minorities, they are organized to watch films or videos, attend art performances four times per year; visit museums, historical sites, cultural works, or mobile exhibitions in a group two times per year.
4. For mountainous, remote, and deep regions until the end of 2005:
a) Ensuring the circulation of books and newspapers from higher-level library systems to lower-level library systems, ensuring that 35% of communes have functioning commune libraries funded by the state budget and 65% of remaining communes have basic book cabinets or reading points.
b) For particularly difficult communes, ensuring the provision of ten legal books, ten general knowledge books promoting scientific and technological development in rural areas, and at least ten types of newspapers and magazines annually.
Article 5. The funds to implement these policies will be balanced from the annual cultural and information public expenditure budget and the funds of local target programs according to current regulations.
The State encourages and creates favorable conditions for domestic and foreign organizations and individuals to sponsor funds or materials and participate in organizing cultural activities appropriate to the customs, age, physical condition, and spirit of the subjects benefiting from preferential cultural enjoyment policies.
Article 6. Implementation organization:
1. The Ministry of Culture, Sports and Tourism:
a) Taking the lead in coordinating with the Ministry of Finance to guide ministries, sectors, and localities in implementing this Decision, with particular emphasis on honoring and providing preferential treatment in the implementation of policies for the subjects specified in Clause 2 of Article 2 of this Decision.
b) Coordinating with ministries, sectors, and localities to continue implementing Decision No. 1637/QĐ-TTg dated December 31, 2001 of the Prime Minister regarding the provision of certain types of newspapers and magazines to ethnic minority and mountainous regions.
c) Coordinating with ministries, sectors, and localities to integrate the implementation of preferential cultural enjoyment policies into relevant target programs and socio-economic development programs in the locality.
Coordinating with the Ministry of Defense to implement these policies in areas where cultural forces cannot organize them.
d) Coordinating with the Ministries of Labor, Invalids and Social Affairs, Defense, the Ethnic Minority Commission, and People's Committees of provinces and centrally-administered cities to inspect the implementation of these policies, promptly address arising difficulties and obstacles during implementation, and compile reports to the Prime Minister annually.
2. Ministries, ministerial-level agencies, government agencies, and People's Committees of provinces and centrally-administered cities within their respective functions and responsibilities shall cooperate with the Ministry of Culture and Information in organizing the implementation of this Decision.
Article 7. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
The Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, and Chairmen of Provincial and Central City People's Committees are responsible for implementing this Decision./.
