RESOLUTION
On land use planning until 2010 and land use plan until 2005 for the whole country

NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM
Based on Article 84 of the Constitution of the Socialist Republic of Vietnam in 1992 amended and supplemented by Resolution No. 51/2001/QH10 dated October 25, 2001 of the National Assembly, tenth session;
Based on the Land Law;
After considering Proposal No. 576/CP - NN dated May 4, 2004 of the Government on land use planning until 2010 and land use plan until 2005 for the whole country, Report No. 824/UBKTNS dated May 10, 2004 of the Economic and Budget Committee of the National Assembly, and opinions of National Assembly deputies;
RESOLUTION:
I. APPROVE THE LAND USE PLANNING UNTIL 2010 FOR THE WHOLE COUNTRY WITH THE FOLLOWING MAIN INDICATORS:
1. Agricultural land group: 25,627,400 hectares
a) Agricultural production land: 9,363,000 hectares
Of which: Paddy field land: 3,861,400 hectares
- Double-crop paddy field land: 3,300,000 hectares
b) Forestry land with forest: 16,243,700 hectares
Of which: Newly planted forests and protected regrowth areas: 4,922,300 hectares, including:
- Newly planted forests: 3,358,800 hectares
- Protected regrowth areas: 1,563,500 hectares
The proportion of concentrated forest coverage reaches 43.2% of natural land area and accounts for 92% of forestry land.
c) Salt production land: 20,700 hectares
2. Non-agricultural land group: 3,925,300 hectares
a) Residential land: 1,035,300 hectares
Of which: - Rural residential land: 936,000 hectares
- Urban residential land: 99,300 hectares
b) Special-purpose land: 2,145,400 hectares
3. Land with potential for use but not yet used: 3,371,400 hectares.
II. APPROVE THE LAND USE PLAN UNTIL 2005 FOR THE WHOLE COUNTRY WITH THE FOLLOWING MAIN INDICATORS:
1. Agricultural land group: 22,948,700 hectares
a) Agricultural production land: 9,037,800 hectares
Of which: Paddy field land: 4,039,400 hectares
b) Forestry land with forest: 13,889,500 hectares
Of which: Newly planted forests and protected regrowth areas: 2,427,300 hectares, including:
- Newly planted forests: 1,356,400 hectares
- Protected regrowth areas: 1,070,900 hectares
The proportion of concentrated forest coverage reaches 36.8% of natural land area and accounts for 77.2% of forestry land.
c) Salt production land: 21,400 hectares
2. Non-agricultural land group: 3,606,000 hectares
a) Residential land: 1,014,900 hectares
Of which: - Rural residential land: 931,200 hectares
- Urban residential land: 83,700 hectares
b) Special-purpose land: 1,846,500 hectares
3. Land with potential for use but not yet used: 6,369,400 hectares.
III. BASED ON THIS RESOLUTION, THE GOVERNMENT GUIDES MINISTRIES, GOVERNMENT-LEVEL ORGANIZATIONS, PROVINCE AND CITY PEOPLE'S COMMITTEES UNDER THE DIRECT CONTROL OF THE CENTRAL GOVERNMENT TO ADJUST THE LAND USE PLANNING UNTIL 2010 AND THE LAND USE PLAN UNTIL 2005 WITHIN THEIR SCOPE OF DUTIES AND AUTHORITY, SUBMIT THEM TO THE GOVERNMENT FOR REVIEW AND IMPLEMENTATION.
During the implementation process, it is necessary to implement well the measures stated in the Government's proposal and pay attention to the following issues:
1. The Government directs regular inspections and audits of land use situations, promptly handle violations of land laws, thoroughly resolve and stop arbitrary changes in land use purposes, encroachments on land, illegal transfers of land use rights, ensuring that land is used according to the planning and plans.
2. In guidance, clearly define responsibilities and specific sanctions for sectors, levels, organizations, and individuals in implementing land use planning and plans. Identify, prevent, and strictly deal with cases where projects are approved without following the planning and plans; land allocation and leasing without proper authority; lax management allowing users to change land use purposes illegally. At the same time, commend sectors and levels that implement the planning and plans well, encourage users to use land for its intended purpose, improve land utilization rates, increase land productivity, and achieve high efficiency in land use.
3. Strengthen basic investigations of land. The State has financial policies to ensure timely implementation of projects according to the planning and plans approved by competent authorities; specific policies for rice cultivation areas to create favorable conditions for farmers to produce rice as profitable as short-term crop growers.
4. Have appropriate mechanisms and policies and more focused guidance for ethnic minorities in mountainous areas to have farming land, live stably, and become wealthy through forestry.
5. Consolidate organizational structures, strengthen and enhance the capacity of cadres working on land use planning. Pay attention to training and improving the professional skills, service awareness, and responsibility of cadres managing land, especially at county, district, town, city under province, commune, ward, township levels. Apply comprehensive measures to enhance the ability of state agencies to control land according to the law and strictly deal with organizations and individuals who neglect management, extort, engage in corruption, and cause inconvenience to the people.
6. Strengthen the supervision of the National Assembly and People's Councils in the work of establishing, reviewing, and implementing land use planning and plans. Publicize land use planning and plans according to the provisions of the Land Law in 2003.
7. In case adjustments are needed to the main indicators stipulated in Sections I and II of this Resolution, the Government shall promptly submit them to the National Assembly for consideration and decision.
8. The Government shall urgently prepare the five-year land use plan from 2006 to 2010 to be submitted to the National Assembly for consideration and approval during the final session in 2005 along with the five-year socio-economic development plan from 2006 to 2010; report annually to the National Assembly on the implementation of this Resolution.
IV. THE NATIONAL ASSEMBLY STANDING COMMITTEE, ETHNIC COMMITTEE, NATIONAL ASSEMBLY COMMITTEES, DELEGATIONS OF NATIONAL ASSEMBLY DEPUTIES, AND NATIONAL ASSEMBLY DEPUTIES MONITOR THE IMPLEMENTATION OF THIS RESOLUTION.
People's Councils at all levels monitor the implementation of this Resolution in their localities.
V. THE VIETNAMESE FRONT FOR UNITY, MEMBER ORGANIZATIONS OF THE FRONT, WITHIN THEIR SCOPE OF DUTIES AND AUTHORITY, COOPERATE WITH RELEVANT STATE AGENCIES RESPONSIBLE FOR SPREADING INFORMATION, MOBILIZING THE PUBLIC TO IMPLEMENT THIS RESOLUTION AND PARTICIPATING IN MONITORING ITS IMPLEMENTATION.
This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, eleventh session, fifth meeting, on June 15, 2004.
