DECREE
REGULATIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF HEALTH
Pursuant to the Government Organization Law on February 18, 2025;
At the proposal of the Minister of Health;
The Government promulgates this Decree to regulate the functions, tasks, powers and organizational structure of the Ministry of Health.
Article 1. Position and Functions
The Ministry of Health is an agency of the Government, responsible for managing state affairs in the following areas: preventive healthcare; diagnosis, treatment, and rehabilitation; medical, forensic, and forensic psychiatric examination; maternal and child health; population; social evil prevention (excluding drug rehabilitation and post-rehabilitation management); social assistance; traditional medicine; pharmaceuticals and cosmetics; food safety; medical equipment; health insurance; and state management of public services within the scope of the Ministry of Health's jurisdiction.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Health performs tasks and exercises powers as prescribed in the Law on the Organization of the Government, regulations of the Government on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and implements specific tasks and powers as follows:
1. Submitting to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft decrees, and draft resolutions of the Government according to the annual legislative program of the Ministry of Health that has been approved, and programs, projects, and plans assigned by the Government and the Prime Minister; submitting to the Government and the Prime Minister for approval strategies, plans, and important national programs, projects, and works in the fields under the Ministry of Health’s jurisdiction.
2. Submitting to the Prime Minister draft decisions, directives, and other documents concerning the fields under the Ministry of Health’s jurisdiction or as assigned.
3. Issuing circulars, decisions, directives, and other documents regarding state management in the fields under the Ministry of Health’s jurisdiction.
4. Directing, guiding, and organizing the implementation of normative legal documents, strategies, plans, national target programs, important national programs, and projects after their approval; inspecting, reviewing, systematizing, consolidating, codifying the system of normative legal documents, disseminating, popularizing, and educating about the law, and monitoring the enforcement of the law in the fields under the Ministry of Health’s jurisdiction.
5. On preventive healthcare:
a) Establishing and issuing, or submitting to competent authorities for issuance, specialized regulations, national standards, national technical regulations, and economic-technical norms on: surveillance, prevention, and control of infectious diseases, HIV/AIDS, non-communicable diseases, occupational diseases, accidents and injuries; vaccination; biological safety in medical laboratories; border health quarantine; environmental health, occupational health, health of government offices and schools; community nutrition; tobacco harm reduction; alcohol and beer harm reduction; quality of water for domestic use; management of chemicals and insecticides, disinfectants used in household and medical fields;
b) Issuing, amending, and supplementing lists of infectious diseases categorized into groups, lists of infectious diseases requiring mandatory vaccinations, and managing vaccination activities and implementing mandatory vaccination for specified groups as prescribed by law;
c) Leading and coordinating with relevant ministries and sectors to establish and issue health standards for different types of jobs, lists of diseases requiring long-term treatment eligible for sick leave benefits, and lists of occupational diseases eligible for social insurance benefits in Vietnam;
d) Establishing and issuing regulations on medical waste management, environmental protection within healthcare facilities, and sanitation during burial and cremation for cases of death due to dangerous epidemics;
đ) Organizing the supervision of infectious diseases, non-communicable diseases, diseases of unknown origin, risk factors affecting health, and other public health issues; early detection of infectious diseases causing epidemics and organizing the declaration of epidemics and the end of epidemics as prescribed by law; leading and coordinating with related agencies to provide accurate and timely information on infectious diseases;
e) Submitting to competent authorities for decision-making or deciding within its authority on the organization and implementation of special measures to prevent and control epidemics; inspecting, urging, and supporting units and localities in organizing and implementing epidemic prevention and control measures; planning and organizing responses to public health emergencies;
g) Guiding and organizing the implementation of border health quarantine activities at border gates; providing timely information and reporting on serious infectious diseases and public health issues worldwide to proactively prevent and control them;
h) Managing, guiding, and organizing the implementation of workplace environmental monitoring activities at workplaces, directing high-risk industrial zones and clusters for occupational disease monitoring; assessing, controlling, and managing harmful factors in the workplace; building databases on workplace environmental monitoring activities, and announcing organizations qualified to conduct workplace environmental monitoring and those whose activities have been suspended according to the law;
i) Guiding, within its authority, the management of workplace hygiene, health examinations of workers, occupational disease detection, and worker health management in the workplace; leading the management of certification of professional qualifications in occupational health, first aid training, and emergency response in the workplace according to the law;
k) Directing and guiding the implementation of content to monitor the impact of environmental pollution on human health;
l) Direct, guide the organization to implement the assessment of the scope, subjects, and degree of impact of environmental incidents on human health; prevent and respond to environmental incidents caused by dangerous infectious diseases; implement preventive measures to limit the impact of environmental incidents on human health;
m) Direct, guide, organize the implementation of legal provisions regarding the classification, collection, storage, management of medical waste, environmental protection within the premises of healthcare facilities, funeral hygiene, and cremation for cases of death due to dangerous infectious diseases as prescribed by law;
n) Direct, guide the organization to implement primary health care activities for the community;
o) Review, issue new, reissue, and revoke certificates of testing facilities meeting biosafety standards level III and level IV, except for testing facilities under the management authority of the Ministry of National Defense;
p) Issue, reissue, supplement, extend, revoke registration numbers for circulation, import permits, free circulation certificates, suspend circulation for chemicals, insecticides, and bactericides used in household and medical fields according to the provisions of the law;
q) Issue new, reissue, adjust, and revoke certificates of qualification for HIV positive confirmatory testing, suspend HIV positive confirmatory testing activities for HIV testing facilities directly under the Ministry of Health, and decide on designation, adjustment, revocation of designated decisions for reference HIV positive confirmatory testing facilities, and suspend reference HIV positive confirmatory testing activities;
designate organizations to certify compliance for tobacco products; issue, suspend, revoke, and reissue certificates of acceptance for declarations of compliance for tobacco products according to the provisions of the law;
manage, guide, organize the implementation of activities to prevent and control HIV/AIDS; provide counseling, HIV testing; treat drug addiction and smoking cessation;
direct, guide, organize the implementation of specialized regulations, national technical standards in the field of preventive medicine throughout the country;
6. On medical examination, treatment, rehabilitation, medical examination, forensic medical examination, forensic psychiatric examination:
a) Develop, promulgate, or submit to competent authorities for promulgation regulations on professional techniques, national standards, national technical standards, economic-technical norms, quality criteria on: medical examination, treatment, emergency care, blood transfusion safety, nursing, rehabilitation, clinical pharmacy, clinical nutrition, infection control; aesthetic surgery; donation, procurement, transplantation of human tissues and organs; medical examination, forensic medical examination, forensic psychiatric examination according to the provisions of the law;
b) Develop, submit to competent authorities for approval planning for the system of medical examination and treatment facilities; specify detailed professional technical levels for medical examination and treatment facilities;
c) Manage, organize the issuance of new, reissue, extend, adjust, suspend, and revoke practice licenses for medical examination and treatment personnel working at medical examination and treatment facilities under its management; issue new, reissue, adjust, suspend operations, and revoke operation licenses for medical examination and treatment facilities under its management; suspend operations for other medical examination and treatment facilities nationwide according to the provisions of the law;
d) Review and approve medical examination and treatment facilities to apply new techniques and methods according to the provisions of the law;
e) Issue certificates confirming the content of advertising for medical examination and treatment activities within its authority according to the provisions of the law;
f) Take the lead, coordinate with relevant ministries and sectors to organize professional medical activities in central cadre health care according to the provisions;
g) Direct, guide, organize the implementation of regulatory legal documents, specialized regulations, national standards, national technical standards in the fields of medical examination, treatment, rehabilitation, aesthetic surgery, medical examination, forensic medical examination, forensic psychiatric examination;
7. On mothers and children:
a) Develop, promulgate, or submit to competent authorities for promulgation legal regulatory documents, strategies, policies, programs, plans, national targets on mothers and children;
b) Develop, promulgate, or submit to competent authorities for promulgation systems of targets and indicators on mothers and children; specialized regulations, national technical standards on reproductive health services, child protection services;
c) Guide, organize the implementation of counseling, reproductive health care; nutritional counseling, health care for mothers and children; counseling, screening, diagnosis, pre-natal and post-natal treatment;
d) Coordinate the implementation of children's rights; take the lead, coordinate with related agencies and organizations to ensure the implementation of children's rights; protect children and their participation in issues concerning them;
e) Guide, organize the implementation of legal regulatory documents, strategies, policies, programs, plans, national targets on children and Children's Action Month; prevention and control of accidents and injuries among children and care and support for children in special circumstances;
f) Review and decide to recognize medical facilities eligible to perform altruistic surrogacy techniques and gender determination procedures according to the provisions of the law;
g) Manage and use the Vietnam Child Welfare Fund according to the law;
h) Manage the National Hotline for Child Protection;
8. On population:
a) Develop, promulgate, or submit to competent authorities for promulgation legal regulatory documents, strategies, policies, programs, plans on population;
b) Develop, promulgate, or submit to competent authorities for promulgation systems of population targets and indicators; specialized regulations, national technical standards on population services;
c) Direct, guide the implementation of legal regulatory documents, strategies, policies, programs, plans, specialized regulations, national technical standards in the field of population.
9. On social assistance and prevention of social evils:
a) Establish, issue, or submit to competent authorities for issuance normative legal documents, policies, programs, and plans on social assistance, social old-age pensions, social work, elderly affairs, disability affairs, and other forms of social assistance;
b) Establish, issue, or submit to competent authorities for issuance normative legal documents, policies, programs, and plans on preventing and combating prostitution and supporting victims of trafficking and persons undergoing identification as trafficking victims;
c) Issue or submit to competent authorities for issuance and organize the implementation of normative legal documents on emergency social assistance in addressing the aftermath of natural disasters, calamities, epidemics, or other force majeure events;
d) Direct, guide, and organize the implementation of policies and laws on social assistance, social old-age pensions, funeral cost support, care, and maintenance for the elderly and persons with disabilities in elderly care facilities and disability care facilities;
đ) Direct, guide, and organize the implementation of regulations on conditions, procedures for establishment and registration, and issuance of operating licenses for social assistance facilities and disability care facilities;
e) Guide and organize the implementation of normative legal documents, policies, programs, and plans on social work, elderly affairs, disability affairs, promoting the role of the elderly, health care for the elderly, health care, and functional recovery for persons with disabilities;
g) Direct, guide, and organize the implementation of legal provisions on preventing and combating prostitution;
h) Guide the screening of signs of trafficking among workers; guide and organize the implementation of medical and psychological support measures for victims and persons undergoing identification as trafficking victims, and support victims of trafficking to integrate into the community;
i) Direct, guide the integration of anti-trafficking content into programs on preventing and combating social evils, protecting children, advancing women's progress, and other economic and social development programs;
10. On traditional medicine:
a) Establish, issue, or submit to competent authorities for issuance specialized regulations, national standards, and national technical standards on traditional medicine;
b) Establish and submit to competent authorities for issuance mechanisms and policies to implement the inheritance, preservation, development, and modernization of traditional medicine; develop medicinal plant cultivation areas and combine traditional medicine with modern medicine;
c) Establish and issue lists of rare, precious, and endemic medicinal plant species that require control; organize the implementation of measures for conservation, rational exploitation, and sustainable use of medicinal plants;
d) Issue new, reissue, extend, adjust, revoke licenses for practicing traditional medicine under its management authority; issue new, reissue, adjust, and revoke operating licenses for traditional medicine clinics and hospitals under its management authority according to the law;
đ) Issue, extend, change, supplement, and revoke registration certificates for circulation of medicinal plants and traditional medicines according to the law; issue, reissue, adjust contents, and revoke: certificates of qualification for drug business for medicinal plant and traditional medicine trading establishments; certificates of good agricultural and collection practices (GACP) for medicinal plants under its management authority according to the law;
e) Issue, reissue certificates confirming advertising content for traditional medicine services and traditional medicines, and adjust advertising content for traditional medicines under its management authority according to the law;
g) Direct, guide, and organize the implementation of mechanisms, policies, normative legal documents, specialized regulations, and national technical standards on traditional medicine, combining traditional medicine with modern medicine;
11. On pharmaceuticals and cosmetics:
a) Establish, issue, or submit to competent authorities for issuance specialized regulations, national technical standards on drugs and cosmetics; national standards on medicines; issue and update the Vietnamese Pharmacopoeia and National Drug Formulary;
b) Establish, issue, or submit to competent authorities for issuance lists of special controlled drugs, rare drugs, essential drugs, tendered drugs, centralized tendered drugs, drugs subject to price negotiation, and over-the-counter drug lists;
c) Issue, extend, change, adjust, change, supplement, and revoke: drug registration certificates, raw material registration certificates; issue product certificates for drugs; export and import permits for drugs, raw materials, and direct contact drug packaging according to the law and international practices;
d) Issue, extend, adjust, change, supplement, and revoke: pharmaceutical practice certificates through examinations, certificates of qualification for drug business, good manufacturing practice certificates for drug and raw material production and trading establishments according to the law and international practices. Announce lists of drug and raw material production and trading establishments; foreign drug and raw material trading service storage establishments registered to supply drugs and raw materials to Vietnam; evaluate compliance with good manufacturing practices for foreign drug and raw material production establishments when registering for circulation in Vietnam according to the law;
đ) Issue, revoke acceptance numbers for imported cosmetic product declaration forms; approve changes to declared contents on cosmetic product declaration forms; issue, reissue, adjust, and revoke certificates of compliance with good manufacturing practices for cosmetic production (CGMP) according to the law;
e) Manage the quality of medicines, raw materials for medicines, and cosmetics; decide on suspending circulation, recalling medicines, raw materials for medicines, and cosmetics in accordance with the provisions of the law; coordinate with relevant agencies to prevent and combat acts of producing, circulating counterfeit, substandard, and untraceable origin medicines, raw materials for medicines, and cosmetics, and to prevent and combat smuggling of medicines, raw materials for medicines, and cosmetics in accordance with the provisions of the law;
g) Organize the drug information system and pharmacovigilance; manage and implement drug information and advertising in accordance with the provisions of the law;
h) Guide the implementation of bidding for medicines serving disease prevention, diagnosis, and treatment from state budget sources, health insurance funds, and other lawful revenue sources in healthcare facilities; organize centralized procurement of medicines at the national level and lead negotiations on medicine prices in accordance with the provisions of the law;
i) Direct, guide, and organize the implementation of legal regulations in the field of pharmaceuticals and cosmetics and the rational, safe, and effective use of medicines;
12. Regarding medical equipment and healthcare works:
a) Develop and issue or submit to competent authorities for issuance national standards, technical regulations, strategies, policies, and plans on medical equipment;
b) Issue detailed guidelines on standards and usage norms for specialized machinery and equipment serving public health activities; issue a list of medical equipment that must be inspected and inspection procedures for each type of medical equipment in the list;
c) Issue new, suspend, or recall circulation numbers of medical equipment; issue new or recall certificates of free circulation for medical equipment; issue and publicly announce recall documents and results of medical equipment classification; issue import permits for medical equipment; publicly announce information and declaration files for raw materials for manufacturing medical equipment containing controlled substances and precursors; publicly announce lists of recalled medical equipment;
d) Issue new, reissue, supplement, or recall certificates of registration for medical equipment testing activities within the scope of management according to the provisions of the law; publicly announce information and declaration files for technical consulting services for medical equipment;
đ) Lead and coordinate with relevant agencies to direct, guide, and organize the implementation of regulatory legal documents, national standards, and technical regulations in the field of medical equipment;
e) Lead and coordinate with relevant agencies to develop and issue technical regulations and specific standards and usage norms for works belonging to public health facilities according to the provisions of the law and assigned authority;
13. Regarding food safety:
a) Lead and develop and issue national technical regulations for food and food products under its management; issue national technical regulations or limits on safety levels for groups of products upon proposals from specialized ministries; issue a list of food additives and processing aids allowed for use in food;
b) Develop and submit to competent authorities for issuance regulations on ensuring food safety for food production and business establishments, food products under its management, catering service businesses, and street food vendors;
c) Lead the implementation of information dissemination, communication, knowledge dissemination, and legal education on food safety within its management scope;
d) Lead and coordinate with related ministries and sectors to build a food safety incident warning system; specify the reporting of food safety incidents; implement monitoring, risk analysis, prevention, investigation, and coordinated action to prevent food poisoning and address food safety incidents within the Ministry of Health's jurisdiction;
đ) Manage food safety throughout the production, preliminary processing, processing, storage, transportation, export, import, and sale of food and food products under its management;
e) Organize the acceptance, management of files, issuance, and recall of registration receipt certificates for food and food products under its management; issue confirmation certificates for advertisement content and certificates of free circulation for food products within its management area; issue health certificates and other certificates for exported food products when organizations or individuals request them according to the provisions of the law;
g) Issue and recall certificates of food safety compliance for food production and business establishments and food products under its management; issue and recall certificates of food safety compliance meeting Good Manufacturing Practice (GMP) requirements for health supplements according to the provisions of the law;
h) Designate, redesignate, suspend, or recall decisions on designating food testing laboratories for state management, and verification laboratories within the designated management scope;
i) Designate or assign tasks, suspend, or recall decisions on designating or assigning tasks to state food safety inspection agencies for imported products within the Ministry of Health's management scope;
k) Direct and guide the organization of implementing regulatory legal documents, national standards, and technical regulations on food safety within the Ministry of Health's state management scope;
l) Aggregate, statistically analyze, and report periodically and urgently on food safety management based on supervision and aggregation of reports from sectoral and local management agencies;
14. Regarding health insurance:
a) Develop and issue or submit to competent authorities for issuance policies and laws on health insurance; overall strategies and plans for developing health insurance;
b) Chair and coordinate with relevant ministries and sectors to develop and issue principles and criteria for compiling lists of medicines, medical devices, and medical technical services within the scope of benefits for health insurance participants; lists and ratios, levels, and conditions for payment for medicines, chemicals, medical devices, and medical technical services within the scope of benefits for health insurance participants;
c) Issue regulations on data sharing in the field of health insurance, interconnection and utilization of cross-clinical test results between healthcare facilities under health insurance;
d) Issue or submit to competent authorities for issuance solutions to ensure balance in the health insurance fund;
đ) Direct and guide healthcare facilities, organizations, and individuals in implementing laws on health insurance;
15. Regarding management of civil servants in the healthcare, pharmaceuticals, population, and social work sectors:
a) Develop, amend, supplement, and issue specific regulations on job code, occupational standards, and salary grading for specialized civil servants in fields under the Ministry of Health's administrative management;
b) Guide positions for leadership and management roles and positions for occupational titles of specialized civil servants in healthcare, pharmaceuticals, population, and social work; organizational structure of civil servants according to occupational titles and staffing norms in public health sector units;
c) Develop and issue specific regulations on standards and conditions for promotion of occupational titles of specialized civil servants in healthcare, pharmaceuticals, population, and social work to Grade II and Grade I as prescribed by law; organize promotions of occupational titles of specialized civil servants in healthcare, pharmaceuticals, population, and social work as prescribed by law;
d) Chair and coordinate with related agencies to develop and submit to competent authorities for issuance, amendment, and supplementation of policies for civil servants and workers in the healthcare sector;
đ) Specify details on content, programs, forms, and timeframes for training specialized civil servants in healthcare, pharmaceuticals, population, and social work according to occupational standards and guide and organize implementation;
16. Regarding human resource training in the health sector:
a) Develop and issue, or submit to competent authorities for issuance, strategies, plans for human resource training in the health sector and special mechanisms and policies in human resource training in the health sector and guide organization and implementation;
b) Develop and issue occupational competency standards as a basis for developing and improving training program standards and graduation standards for various levels of human resource training in the health sector; coordinate with the Ministry of Education and Training to implement development of training program standards and graduation standards for each training field and level in the health sector;
c) Develop and issue conditions for ensuring quality and graduation standards for specialized postgraduate training and continuous human resource training in the health sector;
d) Manage specialized postgraduate training and continuous human resource training in the health sector according to laws;
đ) Guide, inspect, and evaluate according to authority the implementation of laws in human resource training in the health sector; inspect and review compliance with requirements in practical training organization for educational institutions' practice bases in human resource training in the health sector;
e) Specify, guide, and organize implementation of inspection and evaluation to issue practice licenses for human resources in the health sector according to laws;
17. Regarding science, technology, innovation in the healthcare sector:
a) Develop and submit to competent authorities for issuance mechanisms, policies, strategies, and plans for scientific research, technological development, and innovation in fields under the Ministry of Health's administrative management;
b) Manage, guide, and organize implementation of biomedical research on humans, new method and technique development, new technology and product development in fields under the Ministry of Health's administrative management;
c) Guide and inspect implementation of laws in organizing scientific and technological tasks; technology transfer and popularization and application of scientific research and technological development outcomes in fields under the Ministry of Health's administrative management; manage and utilize scientific and technological resources in assigned areas;
d) Implement laws on intellectual property rights and innovative activities under the Ministry of Health's administrative management;
đ) Manage construction and issuance of national technical standards in fields under the Ministry of Health's administrative management according to laws; guide, monitor, and manage national standard and national technical standard popularization and application in fields under the Ministry of Health's administrative management;
e) Implement agreements on technical barriers to trade (TBT) in fields under the Ministry of Health's administrative management;
18. Regarding information technology application and digital transformation in the healthcare sector:
a) Develop and issue, or submit to competent authorities for issuance, strategies and plans for information technology application, development, electronic transactions, information security, and digital transformation in the healthcare sector;
b) Develop and issue, or submit to competent authorities for issuance, professional regulations, technical procedures, national standards, and national technical standards for information technology application, development, digital transformation in fields under the Ministry of Health's administrative management and ensure healthcare information security on networks;
c) Develop, maintain, update, and implement the Ministry of Health's Electronic Government Architecture towards a Digital Government; develop, manage, maintain, update, and ensure security of healthcare information systems and national healthcare databases; manage, connect, and share digital healthcare data according to laws.
d) Direct, guide, organize the implementation of strategies, plans, regulations, technical procedures for the application, development of information technology, artificial intelligence, digital transformation, electronic transactions in fields under the Ministry of Health's administrative management, ensuring cybersecurity and the safety of healthcare information systems nationwide in accordance with the provisions of the law.
19. Develop programs, plans, and direct, guide, organize and inspect the implementation of health communication, health education work, and the provision of information on the activities of the healthcare sector.
20. Administer public services in fields under the Ministry of Health's administrative management in accordance with the law; develop, issue, or submit to competent authorities for issuance mechanisms and policies regarding the supply of public services in fields under the Ministry of Health's administrative management; issue economic and technical standards applicable in public service sectors managed by the State; set quality criteria and standards for public services; establish monitoring, evaluation, and certification mechanisms for the quality of public services and the effectiveness of operations of public service units in fields under the Ministry of Health's administrative management.
21. Guide and implement legal provisions on price management for goods and services in fields under the Ministry of Health's administrative management in accordance with the law.
22. Take the lead and coordinate with relevant agencies in preventing, rescuing, and treating victims during natural disasters and catastrophes.
23. Develop and organize the implementation of national reserves of medicines, chemicals, medical equipment, and epidemic prevention and disaster relief supplies according to the list of national reserves decided by the Government and in accordance with the law.
24. Administer associations and non-governmental organizations operating in fields under the Ministry's administrative management in accordance with the law.
25. Develop and direct the implementation of the Ministry of Health's administrative reform plan in accordance with the objectives and content of the Government's overall administrative reform program.
26. Implement international cooperation and integration in fields under the Ministry of Health's administrative management in accordance with the law. Organize negotiations and sign international treaties in accordance with the law and authorization from competent state agencies; take the lead and coordinate in signing international agreements on behalf of the Ministry of Health in accordance with the law; participate in international organizations as assigned by the Government.
27. Manage organizational structure, civil servant staffing, number of employees, job positions, civil servant grade structure, and career-based staff structure; decide on rotation, transfer, appointment, dismissal, resignation, removal, assignment, commendation, disciplinary action, termination, retirement; implement salary systems and incentive policies; organize training and capacity building for cadres, civil servants, staff, and workers under the Ministry of Health's administrative management in accordance with the law.
28. Manage finances, assets allocated, and implement the budget allocated in accordance with the law; manage the Tobacco Control Fund in accordance with the law.
29. Inspect and check the performance of functions, tasks, powers, and compliance with policies and laws by agencies, organizations, and individuals; perform administrative inspection tasks for agencies, organizations, and individuals under the Ministry of Health's administrative management; perform specialized inspection tasks in fields under the Ministry of Health's administrative management in accordance with the law. Organize anti-corruption and anti-waste activities; implement thrift and waste reduction measures; receive citizens, handle complaints, reports, and proposals related to fields under the Ministry of Health's administrative management; handle violations of the law or report to competent authorities for handling violations of the law in fields under the Ministry of Health's administrative management in accordance with the law.
30. Develop and issue statistical indicators and reporting systems for the healthcare sector in accordance with the law; organize the collection, synthesis, analysis, management, and storage of healthcare statistics information; build a national healthcare database.
31. Perform other tasks and powers delegated by the Government and Prime Minister and as prescribed by the law.

20. The Health and Life Newspaper.
Organizations specified from Clause 1 to Clause 17 of this Article assist the Minister in performing state administrative management functions; organizations specified from Clause 18 to Clause 20 of this Article are public service units serving the state administrative management functions of the Ministry of Health.
The Planning and Finance Department has five divisions.
The Minister of Health shall submit to the Prime Minister for approval the list of other public service units directly subordinate to the Ministry of Health in accordance with the law.
The Minister of Health shall issue a decision specifying the functions, tasks, powers, and organizational structures of organizations and units under the Ministry of Health.
Article 4. Effective date
This Decree takes effect from March 1, 2025.
Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government prescribing the functions, tasks, powers, and organizational structure of the Ministry of Health ceases to be effective from the date this Decree takes effect.
Article 5. Responsibilities for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree.
