After consultation with the Central Organization Committee, the Ministry of Finance, and relevant agencies,1/201The Minister of Home Affairs issues this Circular guiding the implementation of the basic salary for certain subjects receiving salaries and allowances in public institutionsJune 2024;, 201212 of Chapter"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."Chính phủ quy định chức năng, nhiệm vụ, quyềnuof the Party, State, and social-political organizations and associations with special characteristics.

1. Civil servants and officials receiving state budget salaries working in central Party, State organs, and social-political organizations; at provincial and centrally-administered city levels; and at district, town, and town-city levels. 1 3. Civil servants, officials, and employees receiving salaries according to the state-prescribed pay scale appointed by competent authorities to work in associations, non-governmental organizations, projects, and international organizations based in Vietnam.14. Civil servants and officials at commune, ward, and town levels, and those non-professional staff members at commune level, village, and residential quarter levels as prescribed in Decree No. 92/2009/NĐ-CP dated October 22, 2009 of the Government on job titles, number, and some policies for civil servants and officials at commune, ward, and town levels, which has been amended and supplemented by Decree No. 29/2013/NĐ-CP dated April 8, 2013 of the Government.15. Kindergarten teachers receiving salaries as prescribed in Decision No. 60/2011/QĐ-TTg dated October 26, 2011 of the Prime Minister.u6. Health workers at commune, ward, and town levels receiving salaries as prescribed in Decisions No. 58/TTg dated February 3, 1994 and No. 131/TTg dated March 4, 1995 of the Prime Minister.No.for civil servants,June 2024;and staff. larmed force;

7. People's Council representatives at all levels receiving activity fees as prescribed in Clause 2 of Article 75 of the Operation Regulations of People's Councils at all levels issued together with Resolution No. 753/2005/NQ-UBTVQH11 dated April 2, 2005 of the Standing Committee of the National Assembly., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP 9. The following subjects also fall within the scope of application of this Circular for calculating contributions and benefits under social insurance laws and resolving other wage-related benefits as prescribed by law:"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."a) Civil servants, officials, and employees studying, interning, working, or undergoing treatment and rehabilitation both domestically and abroad listed on the payroll of Party, State organs, social-political organizations, public institutions, and associations with special characteristics; relatedb) Individuals in their probationary or trial period (including probationary civil servants at commune level) in Party, State organs, social-political organizations, public institutions, and associations with special characteristics;ớd) Subjects working in Party, State organs, social-political organizations, public institutions, and associations with special characteristics who have signed labor contracts according to the pay scale issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on wage regulations for civil servants, officials, employees, and armed forces personnel. l1. Social-political organizations as defined in this Circular are those organizations as defined in Article 1 of Decision No. 128-QĐ/TW dated December 14, 2004 of the Secretariat of the Central Committee of the Communist Party of Vietnam on wage regulations for civil servants, officials, employees, and organizations of the Party, the Front, and mass organizations.n lng, and social-political organizations and associations with special characteristics, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Citing Decree No. 62/2025/NĐ-CP dated October 10 of the organizational structure and operation mechanism of the Ministry of Home Affairs;- - Arc lampsCiting Clause 1 of Article 6 of Decree No. 66/2013/NĐ-CP dated June 27, 2013 of the Government stipulating the basic salary;,

Article 1. Scope of application

2. Associations with special characteristics as defined in this Circular are those associations as defined in Article 33 of Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on organization, operation, and management of associations and Decision No. 68/2010/QĐ-TTg dated November 1, 2010 of the Prime Minister on defining associations with special characteristics.

2. Civil servants in leadership and management positions and public officials receiving salaries from the payroll fund of publicly established state organizations in accordance with the law.

1. For civil servants, officials, employees, and workers as defined in Clauses 1, 2, 3, 4, 5, and 6 of Article 1 of this Circular:

Based on the current salary coefficient and allowance stipulated in Resolution No. 730/2004/NQ-UBTVQH11 dated September 30, 2004, Resolution No. 1003/2006/NQ-UBTVQH11 dated March 3, 2006, Resolution No. 794/2009/NQ-UBTVQH12 dated June 22, 2009, Resolution No. 823/2009/UBTVQH12 dated October 3, 2009, Resolution No. 888NQ/2010/UBTVQH12 dated March 5, 2010, and Resolution No. 555/NQ-UBTVQH13 dated December 28, 2012 of the Standing Committee of the National Assembly; Decision No. 128-QĐ/TW dated December 14, 2004 and Decision No. 275-QĐ/TW dated December 4, 2009 of the Secretariat of the Central Committee of the Communist Party of Vietnam; Decree No. 204/2004/NĐ-CP dated December 14, 2004, Decree No. 76/2009/NĐ-CP dated September 15, 2009, Decree No. 92/2009/NĐ-CP dated October 22, 2009, Decree No. 116/2010/NĐ-CP dated December 24, 2010, Decree No. 14/2012/NĐ-CP dated March 7, 2012, Decree No. 17/2013/NĐ-CP dated February 19, 2013, and the basic salary stipulated in Decree No. 66/2013/NĐ-CP dated June 27, 2013 of the Government on basic salary for civil servants, officials, employees, and armed forces personnel (hereinafter referred to as Decree No. 66/2013/NĐ-CP) to calculate the salary, allowance, and amount of the retention coefficient difference (if any) as follows:

The salary implemented from July 1, 2013

The allowance implemented from July 1, 2013

The current allowance from July 1, 2013

8. Persons working in confidential organizations.

The leadership position allowance implemented from July 1, 2013 (if any)

The allowance for years of service exceeding the framework implemented from July 1, 2013 (if any)

The amount of the retention coefficient difference implemented from July 1, 2013

c) Cadres, civil servants, and public officials currently suspended from duty, detained, or imprisoned;

2. For People's Council representatives at all levels as defined in Clause 7 of Article 1 of this Circular:

Article 2. Interpretation of Terms

Based on the activity fee coefficient for People's Council representatives at all levels stipulated in Clause 2 of Article 75 of the Operation Regulations of People's Councils at all levels issued together with Resolution No. 753/2005/NQ-UBTVQH11 dated April 2, 2005 of the Standing Committee of the National Assembly to calculate the activity fee according to the following formula:

The activity fee implemented from July 1, 2013

3. Organizations, units, and associations as defined in this Circular are collectively referred to as organizations and units.

Article 3. Calculation of Salary Levels, Allowances, and Activity Fees

1. For officials, civil servants, public employees, and workers specified in Clauses 1, 2, 3, 4, 5, and 6 of Article 1 of this Circular:

Based on the salary coefficient and current allowances stipulated in Resolution No. 730/2004/NQ-UBTVQH11 dated September 30, 2004, Resolution No. 1003/2006/NQ-UBTVQH11 dated March 3, 2006, Resolution No. 794/2009/NQ-UBTVQH12 dated June 22, 2009, Resolution No. 823/2009/UBTVQH12 dated October 3, 2009, Resolution No. 888NQ/2010/UBTVQH12 dated March 5, 2010, and Resolution No. 555/NQ-UBTVQH13 dated December 28, 2012 of the Standing Committee of the National Assembly; Decision No. 128-QĐ/TW dated December 14, 2004 and Decision No. 275-QĐ/TW dated December 4, 2009 of the Central Committee Secretariat of the Communist Party of Vietnam; Decree No. 204/2004/NĐ-CP dated December 14, 2004, Decree No. 76/2009/NĐ-CP dated September 15, 2009, Decree No. 92/2009/NĐ-CP dated October 22, 2009, Decree No. 116/2010/NĐ-CP dated December 24, 2010, Decree No. 14/2012/NĐ-CP dated March 7, 2012, Decree No. 17/2013/NĐ-CP dated February 19, 2013, and the base salary level prescribed in Decree No. 66/2013/NĐ-CP dated June 27, 2013 of the Government regarding the base salary for officials, civil servants, public employees, and armed forces personnel (hereinafter referred to as Decree No. 66/2013/NĐ-CP), the salary level, allowance level, and amount of the retention differential coefficient (if applicable) shall be calculated as follows:

a) Formula for calculating the salary level:

- For allowances calculated based on the basic wage level:

- For allowances calculated based on the percentage of the current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable):

- For allowances specified in specific monetary amounts, maintain them according to the current regulations.

c) Formula for calculating the amount of the retention differential coefficient (if applicable):

2. For representatives of People's Councils at all levels specified in Clause 7 of Article 1 of this Circular:

Based on the activity fee coefficient for representatives of People's Councils at all levels stipulated in Clause 2 of Article 75 of the Operation Regulations of People's Councils at all levels issued together with Resolution No. 753/2005/NQ-UBTVQH11 dated April 2, 2005 of the Standing Committee of the National Assembly, the activity fee level shall be calculated according to the following formula:

3. For those engaged in non-professional activities at commune level, village-level, and neighborhood-level organizations specified in Clause 4 of Article 1 of this Circular:

As of July 1, 2013, the subsidy fund allocated by the central budget for each commune, each village, and each neighborhood association as stipulated in Clause 3 and Clause 4, Article 1 of Decree No. 29/2013/NĐ-CP dated April 8, 2013 of the Government shall be calculated based on the minimum wage level of 1,150,000 VND/month. The specific amount of subsidies for these subjects shall be implemented according to the provisions set out in Clause 5, Article 1 of Decree No. 29/2013/NĐ-CP.

4. For individuals working in confidential organizations as defined in Clause 8, Article 1 of this Circular:

a) Personnel working in confidential organizations under the management of the Ministry of National Defense and the Ministry of Public Security shall follow the guidance of the Minister of National Defense and the Minister of Public Security;

b) Individuals working in confidential organizations within Party agencies, state agencies, political-social organizations (excluding those under the management of the Ministry of National Defense and the Ministry of Public Security) shall implement the calculation of salary levels, subsidies, and retention differential coefficients (if any) according to the calculation method prescribed in Clause 1, Article 3 of this Circular.

Article 4. Effectivenessi ADJUSTMENT

1. This Circular takes effect from September 15, 2013.

2. The salary levels, subsidies (including retention differential coefficients, if any) and activity fees for the subjects specified in Article 1 of this Circular shall be calculated based on the minimum wage level of 1,150,000 VND/month from July 1, 2013, replacing the general minimum wage level stipulated in Joint Circular No. 01/2012/TTLT-BNV-BTC dated May 16, 2012 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the general minimum wage level from May 1, 2012 for state agencies, political organizations, political-social organizations, and public service units.

3. Deductions and benefit entitlements calculated based on the general minimum wage level shall be recalculated based on the minimum wage level from July 1, 2013.

Article 5. Responsibilities for enforcement ADJUSTMENT

1. The heads of agencies and units directly managing individuals receiving salaries, subsidies, and activity fees as stipulated in Article 1 of this Circular shall base their calculations of salary levels, subsidies, amounts of retention differential coefficients (if any), and activity fees on the number of individuals as of July 1, 2013, following the guidance provided in this Circular.

2. The determination of needs, sources, and methods of expenditure for implementing the minimum wage level according to Decree No. 66/2013/NĐ-CP shall be carried out in accordance with the guidance of the Minister of Finance.

During the implementation process, if there are any difficulties, please report them to the Ministry of Home Affairs for study and resolution./.

b) The Department of Home Affairs assists the People's Committee of the province in reviewing job position plans or adjusted job position plans within provincial agencies, organizations, and units; compiles and builds job position plans or adjusted job position plans for provincial agencies, organizations, and units, and submits them to the leadership of the People's Committee of the province for submission to the Ministry of Home Affairs in accordance with regulations.

Article 12. Conditions for Review

Job position plans or adjusted job position plans within agencies, organizations, and units can only be reviewed when they have complete documentation as required by Clause 1, Article 11 of Decree No. 36/2013/NĐ-CP of the Government, and the agencies, organizations, and units included in the plan must be established in accordance with their authority and the law.

Chapter III

IMPLEMENTING PROVISIONS

Article 13. Effective Date

This Circular takes effect from August 10, 2013.

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.

1. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, heads of organizations established by the Government or the Prime Minister that are not public service organizations, Chairmen of Provincial People's Councils, Chairmen of Provincial People's Committees, and relevant agencies, organizations, and individuals are responsible for enforcing this Circular.

2. In case of difficulties during implementation, please report to the Ministry of Home Affairs for guidance, consideration, and resolution./.
