Amending and supplementing certain articles of Circulars No. 01/2021/TT-BGDĐT,
No. 02/2021/TT-BGDĐT, No. 03/2021/TT-BGDĐT, No. 04/2021/TT-BGDĐT dated February 2, 2021 of the Ministry of Education and Training on job code,
qualification standards for occupational titles and appointment, classification of salary for teaching civil servants in public kindergartens, primary and secondary schools
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, civil servants and armed forces; Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, civil servants and armed forces; Pursuant to Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government stipulating training and capacity building for cadres, civil servants, civil servants; Decree No. 89/2021/NĐ-CP dated October 18, 2021 of the Government amending and supplementing certain articles of Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government stipulating training and capacity building for cadres, civil servants, civil servants;
The Minister of Education and Training promulgates this Circular amending and supplementing certain articles of Circulars No. 01/2021/TT-BGDĐT, No. 02/2021/TT-BGDĐT, No. 03/2021/TT-BGDĐT, No. 04/2021/TT-BGDĐT dated February 2, 2021 of the Ministry of Education and Training on job code, qualification standards for occupational titles and appointment, classification of salary for teaching civil servants in public kindergartens, primary and secondary schools.

Pursuant to the Education Law dated June 14, 2019;
Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;
Article 1. Amending and supplementing certain articles of Circular No. 01/2021/TT-BGDĐT dated February 2, 2021 of the Ministry of Education and Training on job code, qualification standards for occupational titles and appointment, classification of salary for teaching civil servants in public kindergartens
1. Supplementing Clause 2a following Clause 2 as follows:
Based on the proposal of the Director of the Cadre and Civil Servant Department;
Pursuant to Decree No. 86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
At the proposal of the Director of the Department of Teachers and Educational Management Staff;
"Clause 2a. Standards for professional ethics
1. Adhering to the Party's policies, State laws, and regulations of the education sector and localities regarding kindergarten education.
2. Continuously improving professional ethics, demonstrating a sense of responsibility, maintaining personal integrity, honor, and reputation as a teacher; serving as a role model for children.
3. Loving the profession and children; managing emotions effectively; treating children fairly and with respect; protecting their legitimate rights and interests; fostering teamwork and mutual assistance among colleagues.
4. Strictly implementing general responsibilities and obligations of civil servants and the Ministry of Education and Training’s regulations on teacher ethics."
2. Amending Point b Clause 3 Article 3, Point b Clause 3 Article 4, and Point b Clause 3 Article 5 as follows:
"b) Having a certificate of training according to the qualification standards for the occupational title of kindergarten teacher."
3. Amending Point b Clause 4 Article 3 as follows:
"b) Possessing knowledge and skills in organizing nurturing, caring, and educational activities for children; having pedagogical competence suitable for the requirements of implementing the kindergarten education program;"
4. Amending Point d Clause 4 Article 3, Point d Clause 4 Article 4, and Point d Clause 4 Article 5 as follows:
"Having the ability to apply information technology in professional activities; being able to use foreign languages or ethnic minority languages as required by the position;"
5. Amending Point d Clause 4 Article 4 as follows:
"d) Being recognized as a grassroots labor hero or excellent kindergarten teacher at school level or higher, or receiving commendation certificates from district level or higher;"
6. Amending Point e Clause 4 Article 4 as follows:
"e) Civil servants participating in the examination or assessment for promotion to the occupational title of kindergarten teacher grade II (job code V.07.02.25) must have held the occupational title of kindergarten teacher grade III (job code V.07.02.26) or equivalent for at least three years (excluding probation period) up to the deadline for submitting application forms for the examination or assessment for promotion."
7. Amending Point d Clause 4 Article 5 as follows:
"d) Being recognized as a grassroots labor hero or excellent kindergarten teacher at district level or higher, or receiving commendation certificates from provincial level or higher."
8. Amending Point e Clause 4 Article 5 as follows:
"e) Civil servants participating in the examination or assessment for promotion to the occupational title of kindergarten teacher grade I (job code V.07.02.24) must have held the occupational title of kindergarten teacher grade II (job code V.07.02.25) or equivalent for at least nine years up to the deadline for submitting application forms for the examination or assessment for promotion."
9. Amending Article 7 as follows:
"Article 7. Cases of appointment to the occupational title of kindergarten teacher
1. Civil servants who have been appointed to the grades of the occupational title of kindergarten teacher according to Circular Joint Circular No. 20/2015/TTLT-BGDĐT-BNV shall be appointed to the occupational title of kindergarten teacher stipulated in this Circular as follows:
a) Appointment to the occupational title of kindergarten teacher grade III (job code V.07.02.26) for kindergarten teachers grade IV (job code V.07.02.06) meeting the training qualification standards for kindergarten teacher grade III (job code V.07.02.26);
b) Appointment to the occupational title of kindergarten teacher grade III (job code V.07.02.26) for kindergarten teachers grade III (job code V.07.02.05);
c) Appointment to the occupational title of kindergarten teacher grade II (job code V.07.02.25) for kindergarten teachers grade II (job code V.07.02.04).
2. Kindergarten teachers grade II (job code V.07.02.25) may be appointed to the occupational title of kindergarten teacher grade I (job code V.07.02.24) when determined as successful candidates in the examination or assessment for promotion from grade II to grade I."
10. Amending Article 9 as follows:
"Article 9. Transitional Provisions
1. In cases where kindergarten teachers do not meet the conditions for appointment to the occupational title of kindergarten teacher stipulated in this Circular, they will continue to hold their current grade, job code, and salary coefficient according to Circular Joint Circular No. 20/2015/TTLT-BGDĐT-BNV. When they meet the conditions stipulated in Article 7 of this Circular, they will be appointed to the corresponding occupational title of kindergarten teacher without having to go through an examination or assessment for promotion."
10. Amend Article 9 as follows:
"Article 9. Transitional Provisions
1. In cases where kindergarten teachers have not yet met the conditions to be appointed to the position title of kindergarten teacher as stipulated in this Circular, they shall continue to hold their current rank, code number, and salary coefficient according to the position title of kindergarten teacher classified under Joint Circular No. 20/2015/TTLT-BGDĐT-BNV. Once they meet the conditions as prescribed in Article 7 of this Circular, they shall be appointed to the corresponding position title of kindergarten teacher without having to go through examination or promotion of position title grade."
2. In cases where kindergarten teachers have not yet met the required training standards as stipulated in Article 72 of the Education Law 2019 but do not fall under the category of those required to upgrade their training standards according to Decree No. 71/2020/NĐ-CP dated June 30, 2020 of the Government on the roadmap for implementing the upgrading of training standards for kindergarten, primary, and lower secondary school teachers, they shall continue to hold their current rank, code, and salary coefficient until retirement.
11. Amend Article 10 as follows:
"Article 10. Application Provisions
1. The period during which a kindergarten teacher holds the profession title of Kindergarten Teacher Rank II (code V.07.02.04) or the position of Senior Kindergarten Teacher (code 15a.205) shall be deemed equivalent to the period during which they hold the profession title of Kindergarten Teacher Rank II (code V.07.02.25).
2. The period during which a kindergarten teacher holds the profession title of Kindergarten Teacher Rank III (code V.07.02.05) or the position of Principal Kindergarten Teacher (code 15a.206) shall be deemed equivalent to the period during which they hold the profession title of Kindergarten Teacher Rank III (code V.07.02.26).
3. The period during which a kindergarten teacher holds the profession title of Kindergarten Teacher Rank IV (code V.07.02.06) or the position of Kindergarten Teacher (code 15.115) shall be deemed equivalent to the period during which they hold the profession title of Kindergarten Teacher Rank III (code V.07.02.26) from the date the teacher meets the training standard for kindergarten teachers as stipulated in the Education Law 2019.
4. In cases where a kindergarten teacher participates in a promotion examination or review for the profession title of Kindergarten Teacher Rank I (code V.07.02.24) and already possesses a master's degree or higher that meets the training standard for Kindergarten Teacher Rank I and has held the profession title of Kindergarten Teacher Rank II (code V.07.02.25) or an equivalent position for at least six years up to the deadline for submitting application documents for the examination or review, such time shall be considered sufficient to meet the requirements for holding the rank as stipulated in point e, Clause 4, Article 5 of this Circular."
12. Amend Clause 1 of Article 11 as follows:
"1. This Circular serves as the basis for the recruitment, utilization, and management of kindergarten teachers in public kindergartens within the national education system."
13. Amend point a of Clause 2 of Article 11 as follows:
"a) Develop a plan for appointing profession titles and determining salaries for kindergarten teachers in public kindergartens under their jurisdiction, submit it for consideration and decision by the competent authority or decide according to the delegated authority;"
14. Repeal point b of Clause 1 of Article 3, Clause 2 of Article 3, Clause 2 of Article 4, and Clause 2 of Article 5.
Article 2. Amend and supplement certain provisions of Circular No. 02/2021/TT-BGDĐT dated February 2, 2021 of the Ministry of Education and Training on job code, qualification criteria, and appointment and determination of salary for teaching staff in public primary schools.
2. Continuously improving professional ethics, demonstrating a sense of responsibility, maintaining personal integrity, honor, and reputation as a teacher; serving as a role model for children.
3. Loving the profession and children; managing emotions effectively; treating children fairly and with respect; protecting their legitimate rights and interests; fostering teamwork and mutual assistance among colleagues.
1. Adhere to the Party’s policies and guidelines, state laws, and regulations of the education sector and localities regarding primary education.
2. Continuously improving ethics, demonstrating a high sense of responsibility, maintaining the integrity, honor, and reputation of educators; setting a good example for students.

3. Amending Point b Clause 4 Article 3 as follows:
"b) Possessing knowledge and skills in organizing nurturing, caring, and educational activities for children; having pedagogical competence suitable for the requirements of implementing the kindergarten education program;"
"b) Hold a certificate of professional development meeting the qualification criteria for primary school teachers."
3. Amend point g of Clause 4 of Article 3, point g of Clause 4 of Article 4, and point d of Clause 4 of Article 5 as follows:

4. Amend point i of Clause 4 of Article 4 as follows:
"i) Staff participating in an examination or review for promotion to the profession title of Primary School Teacher Rank II (code V.07.03.28) must have held the profession title of Primary School Teacher Rank III (code V.07.03.29) or an equivalent position for at least nine years (excluding probationary period) up to the deadline for submitting application documents for the examination or review."
5. Amend point a of Clause 3 of Article 5 as follows:
"a) Hold a bachelor's degree or higher in a teacher training program for primary school teachers.
In cases where there is a shortage of teachers with a bachelor's degree in a teacher training program, they must hold a bachelor's degree in a relevant field and possess a certificate of professional development for primary school teachers according to a program issued by the Minister of Education and Training;"
6. Amend point g of Clause 4 of Article 5 as follows:
"g) Staff participating in an examination or review for promotion to the profession title of Primary School Teacher Rank I (code V.07.03.27) must have held the profession title of Primary School Teacher Rank II (code V.07.03.28) or an equivalent position for at least six years up to the deadline for submitting application documents for the examination or review."
7. Amend Article 7 as follows:
"Article 7. Cases of Appointment to the Profession Title of Primary School Teacher
1. Staff who have been appointed to various ranks of the profession title of Primary School Teacher according to Joint Circular No. 21/2015/TTLT-BGDĐT-BNV shall be appointed to the profession title of Primary School Teacher as stipulated in this Circular as follows:
a) Appoint to the profession title of Primary School Teacher Rank III (code V.07.03.29) for Primary School Teacher Rank IV (code V.07.03.09) who meets the training standard for Primary School Teacher Rank III (code V.07.03.29);
b) Appoint to the profession title of Primary School Teacher Rank III (code V.07.03.29) for Primary School Teacher Rank III (code V.07.03.08) who meets the training standard for Primary School Teacher Rank III (code V.07.03.29);
c) Appoint to the profession title of Primary School Teacher Rank II (code V.07.03.28) for Primary School Teacher Rank II (code V.07.03.07) who has accumulated at least nine years (excluding probationary period) in holding the profession title of Primary School Teacher Rank III (code V.07.03.08) and Rank II (code V.07.03.07) or an equivalent position.
2. A Primary School Teacher Rank II (code V.07.03.28) may be appointed to the profession title of Primary School Teacher Rank I (code V.07.03.27) if they are determined to be successful in the examination or review for promotion from Rank II to Rank I."
8. Amend Article 9 as follows:
"Article 9. Transitional Provisions
1. In case primary school teachers have not yet met the conditions for appointment to the primary school teacher occupational title as stipulated in this Circular, they shall continue to hold their current rank, code, and salary coefficient according to the occupational title of primary school teacher under Circular Jointly Issued No. 21/2015/TTLT-BGDĐT-BNV. Once they meet the conditions specified in Article 7 of this Circular, they will be appointed to the corresponding primary school teacher occupational title without having to go through an examination or promotion examination.
2. In cases where primary school teachers have not yet met the training standard as prescribed in Article 72 of the 2019 Education Law but do not fall within the category required to upgrade their training standard as stipulated in Decree No. 71/2020/NĐ-CP dated June 30, 2020 of the Government on the roadmap for upgrading the training standard of kindergarten, primary, and lower secondary school teachers, they shall continue to hold their current rank, code, and salary coefficient of the primary school teacher occupational title until retirement.
9. Amend Article 10 as follows:
“Article 10. Provisions on Application
1. The period during which a primary school teacher holds the primary school teacher occupational title of Grade II (code V.07.03.07) or holds the senior primary school teacher rank (code 15a.203) is deemed equivalent to the period during which they hold the primary school teacher occupational title of Grade II (code V.07.03.28).
2. The period during which a primary school teacher holds the primary school teacher occupational title of Grade IV (code V.07.03.09) or holds the primary school teacher rank (code 15.114) or holds the primary school teacher occupational title of Grade III (code V.07.03.08) or holds the principal primary school teacher rank (code 15a.204) is deemed equivalent to the period during which they hold the primary school teacher occupational title of Grade III (code V.07.03.29) from the date when the teacher meets the training standard for primary school teachers as stipulated in the 2019 Education Law.
3. In cases where a primary school teacher participates in an examination or assessment for promotion to the primary school teacher occupational title of Grade II (code V.07.03.28), if they already possess a master's degree or higher that meets the training standard for the primary school teacher occupational title of Grade II and have held the primary school teacher occupational title of Grade III (code V.07.03.29) or an equivalent position for at least six years (excluding the probationary period) up to the deadline for submitting application forms for the examination or assessment, they will be considered to have met the requirements regarding the period of holding the grade as stipulated in point i, Clause 4, Article 4 of this Circular.
4. Some cases of teachers currently teaching who are determined to meet the training standard for primary school teachers include:
a) Teachers assigned to teach Information Technology and Technology subjects who have a bachelor's degree or higher in education majors related to Information Technology, Technology, Industrial Engineering, Agricultural Engineering, or a bachelor's degree or higher in a relevant major such as Information Technology, Technology, Agricultural Engineering, Industrial Engineering. In cases where they have a bachelor's degree or higher in a relevant major, they must also have a pedagogical training certificate for primary school teachers issued according to the program promulgated by the Minister of Education and Training;
b) Teachers assigned to teach Art (Music, Fine Arts) subjects who have a bachelor's degree or higher in education majors related to Art, Music, Fine Arts, or a bachelor's degree or higher in a relevant major such as Art, Music, Fine Arts. In cases where they have a bachelor's degree or higher in a relevant major, they must also have a pedagogical training certificate for primary school teachers issued according to the program promulgated by the Minister of Education and Training."
10. Amend Clause 1 of Article 11 as follows:
"1. This Circular serves as the basis for the recruitment, utilization, and management of primary school teachers in public primary schools within the national education system."
11. Amend point a, Clause 2, Article 11 as follows:
"a) Develop plans for appointing occupational titles and determining salaries for primary school teachers in public primary schools under their management authority, submit them for review and decision by the competent authority or decide according to the delegated authority;"
12. Repeal Clause 2, Article 3, Clause 2, Article 4, and Clause 2, Article 5.
Article 3. Amending and supplementing some articles of Circular No. 03/2021/TT-BGDĐT dated February 2, 2021 of the Ministry of Education and Training on code numbers, job title standards, and appointment and salary grading for teaching staff in public junior high schools.
2. Continuously improving professional ethics, demonstrating a sense of responsibility, maintaining personal integrity, honor, and reputation as a teacher; serving as a role model for children.
3. Loving the profession and children; managing emotions effectively; treating children fairly and with respect; protecting their legitimate rights and interests; fostering teamwork and mutual assistance among colleagues.
1. Implementing the Party's guidelines and policies, state laws, and regulations of the education sector and localities regarding junior high school education.
2. Continuously improving ethics, demonstrating a high sense of responsibility, maintaining the integrity, honor, and reputation of educators; setting a good example for students.
3. Loving, treating students fairly and respecting them; protecting their legitimate rights and interests; fostering unity and mutual assistance among colleagues.
3. Amending Point b Clause 4 Article 3 as follows:
"b) Possessing knowledge and skills in organizing nurturing, caring, and educational activities for children; having pedagogical competence suitable for the requirements of implementing the kindergarten education program;"
“b) Hold a certificate for training according to the job title standard for junior high school teachers.”
3. Amend Point h Clause 4 Article 3, Point h Clause 4 Article 4, and Point h Clause 4 Article 5 as follows:

“k) Teaching staff participating in the examination or assessment for promotion to the second-level job title of junior high school teacher (code number V.07.04.31) must have held the third-level job title of junior high school teacher (code number V.07.04.32) or equivalent for at least nine years (excluding probationary period) up to the deadline for submitting application forms for the examination or assessment for promotion.”
5. Amend Point b Clause 1 Article 5 as follows:
“b) Serve as a lecturer, share experience, or demonstrate teaching in training and development classes for professional skills of teachers at district level or higher, or participate in teaching on television;”
6. Amend Point a Clause 3 Article 5 as follows:
“a) Hold a bachelor’s degree or higher in teacher training for junior high school teachers.
In cases where there is a shortage of teachers with a bachelor’s degree in teacher training, they must hold a bachelor’s degree in a relevant field and have a certificate for training in teaching methods for junior high school teachers according to the program issued by the Minister of Education and Training;”
7. Amend Point k Clause 4 Article 5 as follows:
“k) Teaching staff participating in the examination or assessment for promotion to the first-level job title of junior high school teacher (code number V.07.04.30) must have held the second-level job title of junior high school teacher (code number V.07.04.31) or equivalent for at least six years up to the deadline for submitting application forms for the examination or assessment for promotion.”
8. Amend Article 7 as follows:
“Article 7. Cases of appointment to the job title of junior high school teacher
1. Teaching staff who have been appointed to various levels of job titles of junior high school teachers as stipulated in Joint Circular No. 22/2015/TTLT-BGDĐT-BNV shall be appointed to the job title of junior high school teacher as stipulated in this Circular as follows:
a) Appointed to the third-level job title of junior high school teacher (code number V.07.04.32) for junior high school teachers holding the third-level job title (code number V.07.04.12) meeting the educational qualification requirements for the third-level job title of junior high school teacher (code number V.07.04.32);
b) Appointed to the second-level job title of junior high school teacher (code number V.07.04.31) for junior high school teachers holding the second-level job title (code number V.07.04.11) who have held the third-level job title of junior high school teacher (code number V.07.04.12) and the second-level job title (code number V.07.04.11) or equivalent for at least nine years (excluding probationary period);
c) Appointed to the first-level job title of junior high school teacher (code number V.07.04.30) for junior high school teachers holding the first-level job title (code number V.07.04.10).”
9. Amend Article 9 as follows:
“Article 9. Transitional Provisions
1. In cases where junior high school teachers do not meet the conditions for appointment to the job title of junior high school teacher as stipulated in this Circular, they will continue to hold their current rank, code number, and salary coefficient of the job title of junior high school teacher as specified in Joint Circular No. 22/2015/TTLT-BGDĐT-BNV. When they meet the conditions stipulated in Article 7 of this Circular, they will be appointed to the corresponding job title of junior high school teacher without having to go through an examination or assessment for promotion.
2. In cases where junior high school teachers do not meet the required educational qualifications as stipulated in Article 72 of the Education Law 2019 but are not subject to mandatory upgrading of educational qualifications as stipulated in Decree No. 71/2020/NĐ-CP dated June 30, 2020 of the Government on the implementation timeline for upgrading the educational qualifications of kindergarten, primary, and junior high school teachers, they will continue to hold their current rank, code number, and salary coefficient of the job title of junior high school teacher until retirement.”
10. Amend Article 10 as follows:
“Article 10. Provisions on Application
1. The time that junior high school teachers hold the first-level job title of junior high school teacher (code number V.07.04.10) or the senior secondary school teacher rank (code number 15.112) is considered equivalent to the time holding the first-level job title of junior high school teacher (code number V.07.04.30).
2. The time that junior high school teachers hold the second-level job title of junior high school teacher (code number V.07.04.11) or the middle secondary school teacher rank (code number 15a.201) is considered equivalent to the time holding the second-level job title of junior high school teacher (code number V.07.04.31).
3. The time that junior high school teachers hold the third-level job title of junior high school teacher (code number V.07.04.12) or the secondary school teacher rank (code number 15a.202) is considered equivalent to the time holding the third-level job title of junior high school teacher (code number V.07.04.32) from the date when the teacher meets the educational qualification requirements for junior high school teachers under the Education Law 2019.
4. In cases where junior high school teachers participating in the examination or assessment for promotion to the second-level job title of junior high school teacher (code number V.07.04.31) already hold a master’s degree meeting the educational qualification requirements for the second-level job title of junior high school teacher and have held the third-level job title of junior high school teacher (code number V.07.04.32) or equivalent for at least six years (excluding probationary period) up to the deadline for submitting application forms for the examination or assessment for promotion, they will be deemed to meet the requirement for time in rank as stipulated in Point k Clause 4 Article 4 of this Circular.
5. Some cases of teachers currently teaching who are determined to meet the educational qualification requirements for junior high school teachers include:
a) Teachers assigned to teach History and Geography must have a bachelor's degree or higher in teacher training for History or Geography, or a bachelor's degree or higher in a relevant specialty corresponding to History or Geography. In cases where they have a bachelor's degree or higher in a relevant specialty, they must also hold a teaching profession enhancement certificate for junior high school teachers issued according to the program promulgated by the Minister of Education and Training.
b) Teachers assigned to teach Natural Science must have a bachelor's degree or higher in teacher training for Natural Science, Physics, Chemistry, or Biology, or a bachelor's degree or higher in a relevant specialty corresponding to Natural Science, Physics, Chemistry, or Biology. In cases where they have a bachelor's degree or higher in a relevant specialty, they must also hold a teaching profession enhancement certificate for junior high school teachers issued according to the program promulgated by the Minister of Education and Training.
c) Teachers assigned to teach Technology must have a bachelor's degree or higher in teacher training for Technology, Industrial Engineering, or Agricultural Engineering, or a bachelor's degree or higher in a relevant specialty corresponding to Technology, Industrial Engineering, or Agricultural Engineering. In cases where they have a bachelor's degree or higher in a relevant specialty, they must also hold a teaching profession enhancement certificate for junior high school teachers issued according to the program promulgated by the Minister of Education and Training.
d) Teachers assigned to teach Art (Music, Fine Arts) must have a bachelor's degree or higher in teacher training for Art, Music, or Fine Arts, or a bachelor's degree or higher in a relevant specialty corresponding to Art, Music, or Fine Arts. In cases where they have a bachelor's degree or higher in a relevant specialty, they must also hold a teaching profession enhancement certificate for junior high school teachers issued according to the program promulgated by the Minister of Education and Training.”
11. Amend Clause 1 of Article 11 as follows:
“1. This Circular serves as the basis for implementing the recruitment, utilization, and management of junior high school teachers in public junior high schools within the national education system.”
12. Amend Point a of Clause 2 of Article 11 as follows:
“a. Develop plans for appointing occupational titles and determining salaries for junior high school teachers in public junior high schools under their jurisdiction, submit them to the competent authority for examination and decision-making, or decide according to the delegated authority level;”
13. Repeal Clause 2 of Article 3, Clause 2 of Article 4, and Clause 2 of Article 5.
Article 4. Amend and supplement some articles of Circular No. 04/2021/TT-BGDĐT dated February 2, 2021, of the Ministry of Education and Training on code numbers, occupational title standards, and appointment and salary grading for teaching staff in public secondary schools.

3. Amending Point b Clause 4 Article 3 as follows:
"b) Possessing knowledge and skills in organizing nurturing, caring, and educational activities for children; having pedagogical competence suitable for the requirements of implementing the kindergarten education program;"
“b. Hold a certificate in professional enhancement according to the occupational title standards for secondary school teachers.”
3. Amend Point k of Clause 4 of Article 3, Point g of Clause 4 of Article 4, and Point g of Clause 4 of Article 5 as follows:

“i. Staff members who take the exam or are considered for promotion to the secondary school teacher occupational title grade II (code number V.07.05.14) must have held the secondary school teacher occupational title grade III (code number V.07.05.15) or equivalent for at least nine years (excluding probationary period) up to the deadline for submitting application forms for the exam or promotion.”
5. Amend Point i of Clause 4 of Article 5 as follows:
“i. Staff members who take the exam or are considered for promotion to the secondary school teacher occupational title grade I (code number V.07.05.13) must have held the secondary school teacher occupational title grade II (code number V.07.05.14) or equivalent for at least six years up to the deadline for submitting application forms for the exam or promotion.”
6. Amending Article 9 as follows:
“Article 9. Application Provisions
1. The time that secondary school teachers hold Grade I, Grade II, and Grade III as stipulated in Circular Joint No. 23/2015/TTLT-BGDĐT-BNV shall be equivalent to the time holding Grade I, Grade II, and Grade III as stipulated in this Circular. The time that teachers hold the position of secondary vocational teacher (code 15.112) shall be determined as equivalent to the time holding Grade II (code V.07.05.14). The time that teachers hold the position of secondary school teacher (code 15.113) shall be determined as equivalent to the time holding Grade III (code V.07.05.15).
2. In cases where secondary school teachers apply for or are considered for promotion to Grade II (code V.07.05.14) if they already have a master's degree, meet the training qualification standards for Grade II secondary school teachers, and have held the profession title of Grade III secondary school teacher (code V.07.05.15) or its equivalent for at least six years (excluding probationary period) up to the deadline for submitting application forms for the examination or promotion, then they shall be deemed to satisfy the requirements regarding the time holding grade as stipulated in point i, Clause 4, Article 4 of this Circular.
3. Some cases of teachers currently teaching who are determined to meet the standard training qualifications for secondary school teachers include:
a) Teachers assigned to teach Technology subjects with a bachelor's degree or higher in education majors related to Technology, Industrial Engineering, Agricultural Engineering, or a bachelor's degree or higher in a relevant major for the Technology, Industrial Engineering, or Agricultural Engineering subjects. In cases where there is a bachelor's degree or higher in a relevant major, they must have a professional development certificate for secondary school teachers according to the program issued by the Minister of Education and Training;
b) Teachers assigned to teach Economics and Law Education subjects with a bachelor's degree or higher in education majors related to Civic Education or Political Education, or a bachelor's degree or higher in a relevant major for Civic Education or Political Education subjects. In cases where there is a bachelor's degree or higher in a relevant major, they must have a professional development certificate for secondary school teachers according to the program issued by the Minister of Education and Training.
4. Decisions appointing the profession titles of secondary school teachers according to Circular Joint No. 23/2015/TTLT-BGDĐT-BNV shall continue to be used and do not need to issue replacement decisions."
7. Amend Clause 1, Article 10 as follows:
"1. This Circular serves as the basis for implementing the recruitment, utilization, and management of the secondary school teacher workforce in public secondary schools within the national education system."
8. Amend point a, Clause 2, Article 10 as follows:
"a) Develop plans for appointing profession titles and determining salaries for secondary school teachers in public secondary schools under their management authority, submit to the competent authority for consideration and decision-making or make decisions according to the delegated authority;"
9. Repeal Clause 2, Article 3, Clause 2, Article 4, and Clause 2, Article 5.
Article 5. Implementation Provisions
1. This Circular takes effect from May 30, 2023.
2. The duties of teachers are defined for each grade of profession title and are tasks that teachers perform after being appointed to the grade and throughout the time holding the grade if assigned by the head of the public service unit. The head of the public service unit may assign teachers to perform duties of a higher grade if the teachers are capable. For duties according to the profession title that public kindergartens, primary, and secondary schools are not assigned or do not have the conditions to implement, the head of the kindergarten, primary, and secondary schools decides on converting these duties to other related tasks as the basis for evaluating the performance of teachers. There is no requirement for teachers to provide evidence of performing duties of the grade when being appointed to the corresponding grade as stipulated in Circulars No. 01/2021/TT-BGDĐT, 02/2021/TT-BGDĐT, 03/2021/TT-BGDĐT, and 04/2021/TT-BGDĐT.
3. In cases where kindergarten teachers already have one of the certificates for professional development according to the standards of kindergarten teacher profession titles Grade II, Grade III, and Grade IV; primary school teachers already have one of the certificates for professional development according to the standards of primary school teacher profession titles Grade II, Grade III, and Grade IV; lower secondary school teachers already have one of the certificates for professional development according to the standards of lower secondary school teacher profession titles Grade I, Grade II, and Grade III; and secondary school teachers already have one of the certificates for professional development according to the standards of secondary school teacher profession titles Grade I, Grade II, and Grade III as stipulated by law before June 30, 2022, shall be deemed to meet the requirements for certificates for professional development according to the standards of teacher profession titles corresponding to each level of education, which can be used when participating in examinations or applying for promotion of profession titles and do not need to study the professional development programs according to the standards of teacher profession titles corresponding to each level of education stipulated in this Circular.
4. Newly recruited teachers must have certificates for professional development according to the standards of profession titles during the probationary period. Newly recruited teachers who do not need to undergo the probationary period must supplement the certificates within one year from the date of recruitment. As of the effective date of this Circular, cases still having less than one year left in the probationary period must supplement the certificates within one year from the effective date of this Circular.
5. In cases where teachers have not been appointed to the appropriate professional rank corresponding to the grade they are teaching or have changed their job positions and the current professional rank does not meet the requirements of the new position, the head of the public service unit shall propose the competent authority to decide on the examination for transferring the professional rank in accordance with Article 30 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants and ensure the following principles:
a) Appointing to the corresponding professional rank level when meeting the criteria of the appointing professional rank level and transferring to a salary coefficient equal to or higher than the nearest coefficient according to Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding the assignment of salaries when upgrading, changing ranks, and types of civil servants and public officials, and in accordance with the current laws;
b) When transferring the professional rank, it shall not be combined with promotion of the professional rank level, nor with upgrading the salary grade;
c) When transferring the professional rank, it shall not require public officials to hold a training certificate according to the criteria of the professional rank of the transferred position;
d) The time holding the old professional rank shall be recognized as equivalent to the time holding the transferred professional rank.
6. In cases where teachers still retain the code of the civil servant rank, the head of the public service unit shall propose the competent authority to implement the appointment of the teacher's professional rank corresponding to the grade they are teaching according to the procedure for transferring the professional rank stipulated in Clause 5 of this Article. In cases where teachers still retain the ranks of teachers with the first part of the rank code being "15.", "15a.", "15c.", the competent authority shall base on the guidance for appointing the professional rank in Circulars Jointly Issued No. 20/2015/TTLT-BGDĐT-BNV, 21/2015/TTLT-BGDĐT-BNV, 22/2015/TTLT-BGDĐT-BNV, 23/2015/TTLT-BGDĐT-BNV to appoint to the new professional rank level in accordance with Circulars No. 01/2021/TT-BGDĐT, 02/2021/TT-BGDĐT, 03/2021/TT-BGDĐT, 04/2021/TT-BGDĐT.
7. In cases where kindergarten and general education teachers have implemented the appointment from Circulars Jointly Issued No. 20/2015/TTLT-BGDĐT-BNV, 21/2015/TTLT-BGDĐT-BNV, 22/2015/TTLT-BGDĐT-BNV, 23/2015/TTLT-BGDĐT-BNV to the corresponding professional rank according to Circulars No. 01/2021/TT-BGDĐT, 02/2021/TT-BGDĐT, 03/2021/TT-BGDĐT, 04/2021/TT-BGDĐT when implementing the appointment of the professional rank and salary assignment according to the amended and supplemented provisions of this Circular, if there is a change in the appointed professional rank level, the competent authority issuing the decision shall appoint a substitute professional rank and not carry out the recovery of the difference in salary paid. In cases where there is no change in the appointed professional rank level when implementing the appointment of the professional rank and salary assignment according to the amended and supplemented provisions of this Circular, the existing professional rank level shall be retained and there is no need to issue a substitute professional rank appointment decision.
8. In cases where general education teachers already have a bachelor's degree in a relevant major and a secondary teacher training diploma or a college teacher training diploma, or in cases where general education teachers already have a bachelor's degree in a relevant major and a vocational teacher training certificate issued before May 22, 2021, they shall be recognized as having a bachelor's degree in a relevant major and a vocational teacher training certificate of the grade they are teaching according to the program issued by the Minister of Education and Training.
9. A bachelor's degree in a relevant major as prescribed in the qualification standards for primary school, lower secondary school, and upper secondary school teachers shall be recognized as a bachelor's degree in teacher training or a bachelor's degree in a major not belonging to the teacher training field but which includes subjects or courses (belonging to the specialized knowledge field) that meet the requirements for teaching specific subjects in the General Education Program. The head of the competent authority managing the educational institution decides or cooperates with the training institution (where the degree was issued) to determine the suitability of the bachelor's degree with specific subjects in the General Education Program.
10. For subjects in the General Education Program without a teacher training major code, the head of the educational institution shall assign existing teachers and send teachers to participate in suitable training and development classes to ensure they meet the criteria for professional competence and teaching skills for the assigned subject. In cases where teachers already have a bachelor's degree or higher in a teacher training major, or have a bachelor's degree and a vocational teacher training certificate assigned to teach a subject different from their major and are evaluated by the head of the educational institution as meeting the criteria for professional competence and teaching skills for the assigned subject, they may be appointed to the professional rank, assigned salary, and registered to take the examination or be promoted to the professional rank according to the regulations.
11. In cases where teachers are within the disciplinary action period or during the implementation of regulations related to disciplinary actions for civil servants stipulated in Article 56 of the Civil Servant Law amended and supplemented at Clause 8 of Article 2 of the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law, or were assessed and classified as failing to complete tasks in the 2021-2022 academic year, they shall retain their current code number and salary coefficient until the end of the disciplinary action period or until they are assessed and classified as completing tasks or better, then they shall be appointed to the professional rank and assigned salary according to the regulations.
12. From November 3, 2015 to the date this Circular takes effect, in cases where kindergarten and primary-secondary school teachers are appointed to a higher rank after completing their probation period or after obtaining a higher qualification than required but have not yet met other criteria or passed the promotion examination organized by the competent authority, they must be reappointed to the appropriate rank as prescribed (including cases hired before November 3, 2015 and completed the probation period according to regulations after November 3, 2015).
13. The appointment and salary grading of kindergarten and primary-secondary school public teachers must be completed and reported to the Ministry of Education and Training within six months from the date this Circular takes effect.
14. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, implementation shall follow the new documents.
15. The Director of the Office, the Director of the Department of Teachers and Educational Management Staff, the Heads of relevant units under the Ministry of Education and Training; the Chairmen of Provincial People's Committees and Municipal People's Committees directly under the Central Government; the Directors of Departments of Education and Training are responsible for implementing this Circular./.
