DECREE
Regulations on the organization of specialized agencies under provincial People's Committees, municipal People's Committees directly under the central government, and communal People's Committees, ward People's Committees, and special economic zones under provincial and municipal People's Committees directly under the central government.

The Government promulgates this Decree to regulate the organization of specialized agencies under provincial People's Committees directly under the central government and communal People's Committees, ward People's Committees, and special economic zones under provincial and municipal People's Committees directly under the central government.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Decree regulates the organization of specialized agencies under provincial People's Committees directly under the central government (hereinafter referred to collectively as provincial level) and communal People's Committees, ward People's Committees, and special economic zones under provincial and municipal People's Committees directly under the central government (hereinafter referred to collectively as communal level).
3. The following agencies are not subject to this Decree:
a) Industrial Park Management Boards, High-Tech Zone Management Boards, Economic Zone Management Boards, and other management boards with different names under provincial-level People's Committees;
b) Offices of Delegations of the National Assembly and People's Councils at the provincial level; public service units directly under provincial-level People's Committees; public service units directly under communal-level People's Committees; and organizations under central agencies established vertically in localities.
1. Ensuring the full performance of state management functions and tasks of provincial-level People's Committees and communal-level People's Committees, and ensuring unity and smoothness in sectoral and field management from the central to the communal levels.
2. Ensuring efficiency, effectiveness, and streamlined operations, meeting the requirements for professional and modern local governance, effectively implementing information technology applications and digital transformation in organizational structure and activities.
3. Clearly defining the authority between provincial-level local governments and communal-level local governments; it is not necessary for there to be ministries or agencies equivalent to ministries at the central level for provincial and communal levels to have corresponding organizations.
4. Being suitable to the natural conditions, population, socio-economic development situation of each locality, and the requirements of administrative reform.
5. Not overlapping with the functions, tasks, and powers of agencies and organizations under higher-level agencies located in the locality.
Chapter II
REGULATIONS ON SPECIALIZED AGENCIES UNDER PROVINCIAL PEOPLE'S COMMITTEES
Article 3. Position and Functions of Departments
Departments are specialized agencies under provincial-level People's Committees. Departments have legal personality, seals, and separate bank accounts according to the provisions of the law; they perform advisory and assistance functions to provincial-level People's Committees in managing state affairs in their respective sectors and fields in accordance with the law.
Article 4. Tasks and Powers of Departments
1. Submit to the provincial People's Committee:
a) Drafting resolutions of provincial-level People's Councils, decisions of provincial-level People's Committees related to sectors and fields within the scope of management of the department, and other documents assigned by provincial-level People's Committees;
b) Drafting plans for sectoral and field development; programs and measures to organize the implementation of tasks related to sectors and fields within the province's jurisdiction in the scope of management of the department;
c) Drafting decisions specifying the functions, tasks, powers, and organizational structures of the department; drafting decisions specifying the functions, tasks, powers, and organizational structures of bureaus and public service units (except where otherwise provided by specific laws) under the department (if any);
d) Drafting decisions to implement socialization of service provision activities in sectors and fields within the jurisdiction of provincial-level People's Committees.
2. Submitting draft documents within the authority to issue by the Chairman of the People's Committee of the provincial level as assigned.
3. Implementing normative legal documents, plans, and programs after approval; providing information, propaganda, guidance, dissemination, education, and monitoring the enforcement of laws in areas within the scope of national administration assigned.
4. Organizing the implementation and being responsible for inspection, registration, issuance of permits, certificates, and licenses within the scope of responsibility of provincial-level specialized agencies according to the law.
5. Managing enterprises, collective economic organizations, private economic organizations, associations, and non-governmental organizations within the scope of sectors and fields according to the law.
6. Managing the activities of public service units both inside and outside the public sector within the scope of sectors and fields.
7. Implementing international cooperation in sectors and fields managed according to the law.
8. Providing professional guidance to specialized agencies under communal-level People's Committees in sectors and fields managed.
9. Organizing research, application of scientific and technological progress, innovation, and digital transformation; building information systems and archives to serve administrative work and professional activities.
10. Inspecting sectors and fields under assigned responsibility regarding compliance with legal regulations by organizations and individuals; receiving citizens, handling complaints and denunciations, preventing corruption, waste, and negative practices according to the law.
12. Managing organizational structures, civil servant quotas, civil servant ranks, and job positions, staff structures by occupational titles and number of employees in public service units; implementing salary systems and incentive policies, training, rewards, and disciplinary actions for civil servants, staff members, and workers under the department's jurisdiction according to the law.
13. Managing and being responsible for financial resources and assets allocated according to the law.
14. Implementing regular and ad hoc reporting on the implementation of assigned tasks to provincial-level People's Committees, ministries, and agencies equivalent to ministries.
15. Performing other tasks and powers delegated, authorized, and defined by competent authorities according to the law.
16. Specifically for the Provincial Inspectorate, it shall perform tasks and powers as prescribed by laws on inspection.
Article 5. Organizational structure of the department and criteria for establishing organizational units of the department
1. The organizational structure of the department includes:
a) Specialized and professional departments;
b) Office (if any);
c) Inspection units and equivalent organizations (if any);
d) Public service units (if any).
2. Criteria for establishing specialized and professional departments under the department
a) Having functions and tasks to advise on state management in the industry and field within the functions and tasks of the department;
b) The workload requires at least 07 civil servant positions.
3. Criteria for establishing the Office under the department shall be applied according to point b, Clause 2 of this Article. In cases where the Office under the department is not established, one specialized and professional department shall undertake the functions and tasks of the Office.
4. Criteria for establishing inspection units and equivalent organizations under the department (hereinafter referred to collectively as inspection units)
a) Having objects of management in the specialized industry and field within the functions and tasks of the department as prescribed by specialized laws;
b) Being delegated authority to decide on issues within the scope of state management in the specialized industry and field;
c) The workload requires at least 12 civil servant positions.
5. Criteria for establishing departments and equivalent units under inspection units under the department (hereinafter referred to collectively as departments under inspection units)
a) Having functions and tasks to advise on state management in the industry and field within the functions and tasks of the inspection unit or advising on internal administrative work of the inspection unit;
b) The workload requires at least 05 civil servant positions.
At the time of restructuring the state apparatus, the number of deputy heads of agencies, organizations, and units may exceed the prescribed number. No later than five years from the date the decision on restructuring the state apparatus of the competent authority takes effect, the number of deputy heads of agencies, organizations, and units after restructuring shall comply with the regulations, specifically as follows:
1. Heads and deputy heads of the department
a) The head of a provincial department (hereinafter referred to collectively as the Director of the Department) shall be appointed by the Chairman of the People's Committee of the province, responsible before the People's Committee, the Chairman of the People's Committee of the province, and before the law for performing the functions, tasks, and powers of the department according to the Working Regulations and division of labor by the People's Committee of the province;
b) Deputy heads of a provincial department (hereinafter referred to collectively as Deputy Directors of the Department) shall be appointed by the Chairman of the People's Committee of the province upon the proposal of the Director of the Department, assisting the Director of the Department in performing specific tasks assigned by the Director of the Department and being responsible before the Director of the Department and before the law for performing the assigned tasks. When the Director of the Department is absent, one Deputy Director of the Department shall be authorized by the Director of the Department to act in place of the Director of the Department to manage the activities of the department. Deputy Directors of the Department shall not concurrently hold the position of head of organizational units under and directly subordinate to the department, except as otherwise provided by law;
c) Number of Deputy Directors of the Department
On average, each department has three Deputy Directors. Based on the number of departments established and the total number of Deputy Directors, the People's Committee of the province shall decide specifically on the number of Deputy Directors of each department appropriately. For Hanoi City and Ho Chi Minh City, in addition to the total number of Deputy Directors according to the general average provision, each city may increase up to ten Deputy Directors.
2. Number of Deputy Heads of specialized and professional departments under the department
a) A department under the department with less than ten civil servant positions shall be allocated one Deputy Head;
b) A department under the department with ten to fourteen civil servant positions shall be allocated no more than two Deputy Heads;
c) A department under the department with fifteen civil servant positions or more shall be allocated no more than three Deputy Heads.
3. Number of Deputy Heads of the Office of the department shall be implemented according to the provisions of Clause 2 of this Article.
4. Number of Deputy Chiefs of inspection units under the department
a) An inspection unit with one to three departments and equivalent units shall be allocated one Deputy Chief;
b) An inspection unit without departments or with four or more departments and equivalent units shall be allocated no more than two Deputy Chiefs.
5. Number of Deputy Heads of departments under inspection units under the department shall be applied according to the provisions of Clause 2 of this Article.
Article 7. Working regime of the department and responsibilities of the Department Director
1. The department under the provincial People's Committee operates under the head system and according to the Working Regulations of the provincial People's Committee, ensuring the principle of democratic centralism.
2. Based on legal provisions and the division of work by the provincial People's Committee, the Department Director promulgates the Working Regulations of the department and directs, supervises the implementation thereof.
3. The Department Director is responsible before the People's Committee and the Chairman of the provincial People's Committee for performing the functions, tasks, and state management powers in the industry and field at the local level and other tasks assigned or delegated by the People's Committee and the Chairman of the provincial People's Committee; shall not transfer tasks within their duties up to the People's Committee and the Chairman of the provincial People's Committee. For issues exceeding authority or within authority but lacking capability and conditions to resolve, the Department Director must proactively work with relevant Department Directors to complete the dossier for submission to the People's Committee and the Chairman of the provincial People's Committee for consideration and decision; practice thrift, combat waste, and bear responsibility for corruption and damage occurring in organizations and units under their management.
4. The Department Director is responsible for reporting to the People's Committee and the Chairman of the provincial People's Committee; ministries and ministerial-level agencies on the organization and activities of their agency; report work to the provincial People's Council when required; provide necessary documents upon request of the provincial People's Council; respond to citizens' petitions and questions from provincial People's Council representatives regarding matters within the scope of their management; coordinate with other Department Directors, heads of political-social organizations, and related agencies in implementing the department's tasks.
5. The Department Director appoints, transfers, rotates, rewards, disciplines, dismisses, implements systems and policies for heads and deputy heads of subordinate agencies and units according to regulations and local cadre management levels.
Article 8. Departments organized uniformly in localities
1. Department of Home Affairs
Advising and assisting the provincial People's Committee in performing state management functions concerning: Administrative organization, public service institutions; local administration, administrative unit boundaries; cadres, civil servants, public officials and civil service; administrative reform; associations, non-governmental organizations; commendation and reward; state archives; youth affairs; labor, wages; employment; social insurance; occupational safety and health; war veterans; gender equality.
Advising and assisting the provincial People's Committee in performing state management functions concerning ethnic groups and beliefs, religions in cases where the Department of Ethnic Minorities and Religion is not established.
2. Department of Justice
Advising and assisting the provincial People's Committee in performing state management functions concerning: Legal system construction and enforcement; monitoring the implementation of normative legal documents; inspecting and handling normative legal documents; popularizing and educating about laws, grassroots mediation; civil status registration; nationality; adoption; lawyers, legal consultation; legal aid; notarization, authentication; judicial expertise; asset auction; commercial arbitration; trade mediation; bankruptcy administrators, enterprise management and liquidation activities and professional management and liquidation activities; judicial scribes; state compensation; legal system; managing law enforcement activities concerning administrative violations and other judicial works as prescribed by law.
3. Department of Finance
Advising and assisting the provincial People's Committee in performing state management functions concerning: Economic and social development planning; zoning; domestic and foreign investment development and business; finance; state budget; local government borrowing (domestic and foreign); foreign aid to Vietnam and Vietnamese aid to foreign countries; fees, charges, and other revenues of the state budget not managed by tax authorities under the authority of the provincial People's Committee; public assets; financial matters for state funds outside the budget; accounting, independent auditing; prices and financial services activities at the local level as prescribed by law; tendering; enterprises, collective economy, individual businesses.
4. Department of Industry and Trade
Advising and assisting the provincial People's Committee in performing state management functions concerning industry and trade, including sectors and fields: Machinery; metallurgy; electricity; new energy; renewable energy; energy conservation and efficiency; oil and gas; chemicals; industrial explosives; mining and mineral processing industries (excluding common building materials and cement production); consumer goods industry; food industry; supporting industry; environmental industry; other processing industries; small-scale handicrafts; promoting small-scale industry; trade activities and commodity circulation on the territory; sustainable production and consumption; exports, imports; market management; border trade (for provinces with borders); logistics services; trade promotion; e-commerce; trade services; competition management; protecting consumer rights and managing multi-level marketing business activities; anti-dumping; international economic integration; industrial clusters on the territory.
5. Department of Agriculture and Environment
Advising and assisting the provincial People's Committee in performing state management functions concerning: Agriculture; forestry; salt industry; fisheries; water resources; disaster prevention and control; poverty reduction; rural development; land; water resources; mineral resources, geology; environment; meteorology and hydrology; climate change; surveying and mapping; comprehensive resource management and marine and island environmental protection (for coastal and island provinces); remote sensing; state management of public services in areas under their jurisdiction as prescribed by law.
6. Department of Construction
Advise and assist the Provincial People's Committee in performing state management functions regarding: Urban planning and architecture; construction investment activities; urban development; technical infrastructure for urban and rural areas (including: Clean water supply (excluding clean water for rural areas); drainage and wastewater treatment (excluding on-site wastewater treatment; drainage for agricultural production, salt production); urban parks and greenery; urban lighting; cemeteries (excluding martyrs' cemeteries) and crematoriums; transportation infrastructure structure; underground space management; common use of urban technical infrastructure and rural residential areas; housing; public offices; real estate market; building materials; road, railway, inland waterway transport; traffic safety (excluding driver licensing and issuing motor vehicle driving licenses).
In Hanoi City and Ho Chi Minh City where there is a Department of Planning and Architecture, the advisory function regarding urban planning and architecture is performed by the Department of Planning and Architecture.
7. Department of Science and Technology
Advise and assist the Provincial People's Committee in performing state management functions regarding: Scientific research activities; technological development; innovation and creativity; high technology and strategic technology development; scientific and technological potential development; standards, measurement, quality; intellectual property; radiation and radioactive isotope application; radiation and nuclear safety; postal services; telecommunications; radio frequency spectrum; information technology industry, digital industry; information technology application (excluding information security and cyber security); electronic transactions; digital government; digital economy, digital society, and digital transformation; communication infrastructure.
8. Department of Culture, Sports and Tourism
Advise and assist the Provincial People's Committee in performing state management functions regarding: Culture; family; physical education and sports; tourism; press; publishing, printing, distribution; broadcasting and television; electronic information; news agencies; grassroots information and foreign information; advertising; the use of National Flag, National Emblem, National Anthem, and portraits of President Ho Chi Minh.
For localities with a Department of Tourism, the advisory and assistance function for state management of tourism shall be performed by the Department of Tourism, and the name of the Department of Culture, Sports and Tourism will be changed to the Department of Culture and Sports.
9. Department of Education and Training
Advise and assist the Provincial People's Committee in performing state management functions regarding: Early childhood education; general education; vocational education and continuing education; higher education (if applicable).
10. Department of Health
Advise and assist the Provincial People's Committee in performing state management functions regarding: Preventive health care; medical examination and treatment; rehabilitation; forensic medicine, forensic psychiatry; maternal and child health; population; social evil prevention (excluding drug rehabilitation and post-drug rehabilitation management); management and use of the Child Welfare Fund; social welfare; traditional medicine and pharmacy; drugs and cosmetics; food safety; medical equipment; health insurance.
11. Provincial Inspectorate
Advise and assist the Provincial People's Committee in performing state management functions regarding inspection work, citizen reception, complaint and denunciation resolution, and anti-corruption; carry out inspection tasks within the scope of provincial people's committee management; perform citizen reception, complaint and denunciation resolution, and anti-corruption and anti-waste tasks according to the law.
12. People's Committee Office
Advise and assist the Provincial People's Committee in: The program and plan of work of the People's Committee and the Chairman of the Provincial People's Committee; administrative procedure control; organization and implementation of the single window mechanism in handling administrative procedures within the locality's jurisdiction; organization, management, and publication of official information about the activities of the People's Committee and the Chairman of the Provincial People's Committee; serve as the focal point for the Electronic Information Portal, connecting the administrative electronic information system to support leadership and management operations of the People's Committee and the Chairman of the Provincial People's Committee; manage the Official Gazette and support the common activities of the Provincial People's Committee; assist the Chairman and Deputy Chairmen of the Provincial People's Committee in performing their duties and powers according to their authority; manage internal administrative affairs of the Office.
Advise and assist the Provincial People's Committee in performing state management functions regarding local external relations in cases where a Foreign Affairs Department is not established.
Article 9. Special Departments to be established in some localities
1. Department of Foreign Affairs
Advising and assisting the People's Committee at the provincial level in performing state management functions regarding local foreign affairs work, including national border territory work (for provinces with international borders).
The Department of Foreign Affairs shall be established when meeting one of the following criteria:
a) Having an international land border checkpoint;
b) Having an international air checkpoint;
c) Having an international seaport;
d) Having 500 or more foreign-invested projects in operation (or having total foreign investment capital reaching over 100,000 billion Vietnamese dong), with over 4,000 foreigners currently residing or working in the locality, annual import and export turnover reaching 100,000 billion Vietnamese dong or more, and having signed cooperation agreements with five or more localities.
For localities that do not establish a separate Department of Foreign Affairs, its functions and tasks shall be transferred to the Office of the People's Committee at the provincial level.
2. Department of Ethnic Minorities and Religion
Advising and assisting the People's Committee at the provincial level in performing state management functions regarding ethnic minorities and religious beliefs.
The Department of Ethnic Minorities and Religion shall be established when meeting all of the following criteria:
a) Having at least 20,000 ethnic minority people living concentrated in village communities;
b) Having at least 5,000 ethnic minority people requiring focused assistance and support for development from the State;
c) Having ethnic minority people living in areas critical for security and defense; intercropping, inter-settlement, or border areas where there are large numbers of ethnic minority people from both countries frequently crossing back and forth.
For localities that do not establish a separate Department of Ethnic Minorities and Religion, its functions and tasks shall be transferred to the Department of Home Affairs.
3. Department of Tourism
Advising and assisting the People's Committee at the provincial level in performing state management functions regarding the tourism sector.
The Department of Tourism shall be established when meeting all of the following criteria:
a) Having tangible cultural heritage listed as World Heritage by the United Nations Educational, Scientific and Cultural Organization (UNESCO) or having outstanding tourism resources and potential (having a national tourist area, national tourist site, or large-scale, prominent tourist city, sightseeing and resort area);
b) The tourism industry being identified as a leading economic sector in the socio-economic development orientation of the locality, contributing an economic value from tourism accounting for 10% or more of the locality's Gross Regional Domestic Product (GRDP) annually for five consecutive years.
For localities that do not establish a separate Department of Tourism, its functions and tasks shall be merged and transferred to the Department of Culture and Sports, which will then be renamed the Department of Culture, Sports and Tourism.
4. Department of Planning and Architecture shall be established in Hanoi City and Ho Chi Minh City
Advising and assisting the People's Committee of the city in performing state management functions regarding construction planning and architecture.
In cases where Hanoi City and Ho Chi Minh City do not establish a separate Department of Planning and Architecture, its functions and tasks shall be merged and transferred to the Department of Construction.
Article 10. Framework for the number of departments under the People's Committee at the provincial level
1. Based on the provisions of Articles 8 and 9 of this Decree, provinces and cities may organize up to 14 departments, while Hanoi City and Ho Chi Minh City may have up to 15 departments.
2. A single-level Public Service Center directly under the People's Committee at the provincial level shall operate in accordance with the regulations of the Government.
Chapter III
PROVISIONS ON SPECIALIZED ORGANIZATIONS UNDER THE PEOPLE'S COMMITTEE AT THE COMMUNE LEVEL
Article 11. Position and functions of the Department
2. The Department under the People's Committee at the commune level is subject to the direction and management regarding organizational structure, job positions, civil servant quota, rank structure of civil servants, number of staff, and cadre structure according to occupational titles in public service units by the People's Committee at the commune level. It is also subject to the direction, inspection, and guidance on professional matters by specialized agencies under the People's Committee at the provincial level.
Article 12. Tasks and powers of the Department
1. Submit to the commune-level People's Committee
a) Drafting resolutions of the People's Council at the commune level (if any) and decisions of the People's Committee at the commune level related to the fields within the scope of management of the Department, and other documents assigned by the People's Committee at the commune level;
b) Drafting plans for development in the relevant fields; programs and measures to organize the implementation of tasks in these fields within the commune area within the scope of management of the Department;
c) Drafting decisions specifying the functions, tasks, powers, and organizational structure of the Department.
2. Implementing legal documents, planning, and approved plans; providing information, propaganda, dissemination, and education on laws concerning the fields within the assigned scope of management; monitoring the enforcement of laws.
3. Assisting the People's Committee at the commune level in implementing and being responsible for the examination, registration, issuance of various permits, certificates, and equivalent documents within the scope of responsibility and authority of specialized agencies as prescribed by law and assigned by the People's Committee at the commune level.
4. Assisting the People's Committee at the commune level in managing state affairs concerning collective economic organizations, private enterprises, associations, and non-governmental organizations operating within the assigned fields as prescribed by law.
5. Organizing the application of scientific and technological progress; building information systems, innovation, and digital transformation, and storage services for state management and professional work of specialized agencies at the commune level.
6. Carrying out information and regular and ad hoc reporting on the implementation of assigned tasks in accordance with the regulations of the People's Committee at the commune level and the sectoral management department.
7. Inspecting organizations and individuals in the implementation of legal provisions in the assigned fields; receiving citizens, handling complaints and denunciations; preventing corruption, waste, and negative practices in accordance with the law and assignments by the People's Committee at the commune level.
8. Managing organizational structures, civil servant quotas, civil servant ranks and grading, job positions, cadre structures according to occupational titles, and the number of staff in public service units; implementing salary systems and incentive policies, training, commendation, and disciplinary measures for civil servants, cadres, and workers within the scope of management as prescribed by law and assigned by the People's Committee at the commune level.
9. Managing and being responsible for the financial resources and assets of the Department in accordance with the law.
10. Perform other duties and authorities according to the division of authority, delegated powers, and jurisdiction defined by competent authorities in accordance with the law.
11. Perform other tasks assigned by the People's Committee at the commune level in accordance with the law.
1. The head of a room under the People's Committee of communes (hereinafter referred to as the Room Head) shall be appointed by the Chairman of the People's Committee of communes, responsible before the People's Committee of communes, the Chairman of the People's Committee of communes, and before the law for performing the functions, tasks, and powers of the room.
2. The deputy of the head of a room under the People's Committee of communes (hereinafter referred to as the Deputy Room Head) assists the Room Head in directing certain aspects of work and is responsible before the Room Head for the assigned tasks. Each room is allocated one Deputy Room Head; when the Room Head is absent, the Deputy Room Head is authorized by the Room Head to manage the activities of the room.
3. The appointment, reappointment, extension of time in holding leadership management positions, resignation, removal, transfer, rotation, commendation, disciplinary action, implementation of systems and policies for Room Heads and Deputy Room Heads shall be decided by the Chairman of the People's Committee of communes in accordance with the provisions of the law.
Article 14. Working system and responsibilities of the Room Head
1. Rooms under the People's Committee of communes operate under the chief executive system and according to the Working Regulations of the People's Committee of communes, ensuring the principle of democratic centralism.
2. Based on the provisions of the law and the division of labor of the People's Committee of communes, the Room Head promulgates the Working Regulations of the room and directs, supervises the implementation thereof.
3. The Room Head is responsible before the People's Committee of communes, the Chairman of the People's Committee of communes for performing state management functions, tasks, and powers in the industry and field at the local level and other tasks assigned or delegated by the People's Committee, the Chairman of the People's Committee of communes; does not transfer tasks within their duties and powers up to the People's Committee, the Chairman of the People's Committee of communes. For issues exceeding authority or within authority but lacking capability and conditions to resolve, the Room Head must proactively work with relevant Room Heads to complete the dossier for submission to the People's Committee, the Chairman of the People's Committee of communes for consideration and decision; practices thrift, combats waste, and bears responsibility for corruption, causing losses in organizations and units under their management.
4. The Room Head has the responsibility to report to the People's Committee of communes, the Chairman of the People's Committee of communes on the organization and operation of their agency; reports work to competent agencies as prescribed.
Article 15. Specialized rooms organized at the commune level
1. The Office of the People's Council and People's Committee advises and assists the People's Committee of communes in performing state management functions in the following areas:
b) The Justice area, including: Legal construction and enforcement work; monitoring the implementation of normative legal documents; inspecting and handling normative legal documents; popularizing and educating the law; grassroots mediation; legal aid; adoption; household registration; certification; managing the implementation of laws on administrative violation handling and other judicial works as prescribed by law;
c) The Foreign Relations area, including: Local foreign relations work, including border territory national boundary work (for administrative units at the commune level with land, sea, and island borders).
2. The Economic Room (for communes, special zones) or the Economic, Infrastructure, and Urban Room (for wards and the special zone Phu Quoc) advises and assists the People's Committee of communes in performing state management functions in the following areas:
a) The Finance and Planning area, including: State finance and budget; planning and investment; statistics; registering business households, cooperative groups, cooperatives, cooperative unions; supporting enterprises, collective economic organizations;
b) The Construction and Industry and Trade area, including: Construction planning and architecture; construction investment activities; urban development; urban technical infrastructure (including: urban water supply, drainage; production facilities for building materials; urban lighting, urban greenery; cemetery management, except for martyrs' cemeteries; underground urban construction management; common use management of urban technical infrastructure); housing; public offices; building materials; transportation; small-scale industries; industry; trade;
c) The Agriculture and Environment area, including: Land; water resources; mineral resources; environment; sea and islands (for administrative units with sea and islands); agriculture; forestry; salt industry; irrigation; aquaculture; rural development; disaster prevention and control; poverty reduction; food quality and safety for agricultural, forest, aquatic, and salt products; household economy, rural farmstead economy, collective economy, agricultural, forestry, fishery, and salt industry linked to professions and rural craft villages.
3. The Culture and Social Affairs Room advises and assists the People's Committee of communes in performing state management functions in the following areas:
a) The Civil Service area, including: Administrative and public service organization; local administration, administrative unit boundaries; civil servants, public officials, and civil service; administrative reform; associations, non-governmental organizations; commendation and reward; state archives; youth; labor, wages; employment; social insurance; occupational safety and health; persons with meritorious service; gender equality; ethnic affairs and beliefs, religions;
b) The Education and Training area, including: Early childhood education; general education (primary education and lower secondary education);
d) The field of Health, including: preventive health care; diagnosis, treatment, and rehabilitation; mother and child health; population; social evil prevention and control (excluding drug rehabilitation and post-drug rehabilitation management); social assistance; traditional medicine; pharmaceuticals; cosmetics; food safety; medical devices; health insurance.
1. Based on the provisions of Article 15 of this Decree and the management requirements of the industry and sector in the locality, the local authority at the commune level decides on the establishment of specialized rooms.
2. The Public Service Center under the People's Committee at the commune level operates in accordance with the regulations of the Government.
Chapter IV
RESPONSIBILITIES OF MINISTRIES, GOVERNMENT-LEVEL AGENCIES AND PROVINCE-LEVEL, COMMUNE-LEVEL PEOPLE'S COMMITTEES
Article 17. Minister of Home Affairs
1. Propose to the Government to establish a framework for the criteria of leadership and management positions at the department level, sub-department level, room level under the department, room level under the sub-department under the department, and room level under the People's Committee at the commune level.
2. Coordinate with ministries managing industries and sectors to guide the functions, tasks, and powers of specialized agencies under the People's Committees at the provincial and commune levels.
3. Aggregate and monitor the reorganization and organizational structure of specialized agencies under the People's Committees at the provincial and commune levels.
4. Inspect and resolve complaints and denunciations within their jurisdiction.
Article 18. Ministers, Heads of Government-Level Agencies
1. Direct, guide, and inspect professional matters concerning departments within their industry and sector.
2. Guide the functions, tasks, and powers of specialized agencies under the People's Committees at the provincial and commune levels within their industry and sector.
3. Guide the functions, tasks, powers, and organizational structure of public service units within their industry and sector in the locality according to the relevant laws.
4. Inspect and resolve complaints and denunciations within their jurisdiction.
Article 19. Provincial People's Committee
2. Specify the functions, tasks, powers, and organizational structure of sub-departments and public service units under the departments according to this Decree, except where otherwise provided by specific laws.
3. Decide on the establishment, restructuring, dissolution of public service units under the departments according to the law, ensuring consistency with the approved network planning of public service units in the industry and sector, guidance from the ministry managing the industry and sector, and the Ministry of Home Affairs.
4. Delegate responsibilities and authorize the implementation of one or more tasks and powers within the province-level People's Committee's jurisdiction according to the law.
5. Based on the framework set by the Government and upon the proposal of the Department of Home Affairs Director, specify the criteria for leadership and management positions at the department level, sub-department level under the department, room (equivalent organization) under the department, room under the sub-department under the department, and specialized rooms under the People's Committee at the commune level, ensuring consistency with the locality's characteristics and not being lower than the Government's framework.
6. Annually report to the Provincial People's Council on the organizational structure and operation of specialized agencies under the People's Committees at the provincial and commune levels.
7. Specifically guide the functions, tasks, powers, and organizational structure of specialized rooms under the People's Committee at the commune level according to this Decree and other related legal documents.
Article 20. Chairman of the Provincial People's Committee
1. Lead and direct departments to perform their assigned functions and tasks.
2. Appoint, reappoint, extend the term of office for leadership positions, accept resignation, remove from office, transfer, temporarily suspend, dismiss, rotate, reward, discipline, and implement systems and policies for directors and deputy directors of departments in accordance with Party regulations and laws.
4. Direct inspection, audit, complaint resolution, and accusation handling work in accordance with the law.
1. Specifically define the functions, tasks, and authorities of specialized offices in accordance with guidelines from the provincial People's Committee, sectoral management bodies, and related documents.
2. Delegate the performance of one or more tasks and authorities within the jurisdiction of the commune-level People's Committee in accordance with the law.
3. Annually report to the Commune People's Council (if any) and the provincial People's Committee on the organization and operation of specialized offices.
Article 22. Chairman of the People's Committee at the Commune Level
1. Lead and direct specialized offices to perform their assigned functions and tasks.
2. Appoint, reappoint, extend the term of office for leadership positions, accept resignation, remove from office, transfer, temporarily suspend, dismiss, rotate, reward, discipline, and implement systems and policies for heads and deputy heads of specialized offices and equivalent positions in accordance with Party regulations and laws.
3. Direct inspection work and complaint resolution in accordance with the law.
Chapter V
IMPLEMENTING PROVISIONS
For the content of transferring functions and tasks between relevant agencies concerning administrative procedures, the following principles shall be followed:
1. In cases where organizations or individuals have submitted applications before this Decree takes effect, they shall continue to follow the legal provisions applicable at the time of application submission.
2. Cases that have been reviewed, approved, authorized, granted certificates, licenses, or certificates before this Decree takes effect shall continue to be used according to the documents issued by competent state agencies; if there is a validity period, it shall be implemented until the end of the period. In cases of amendment, supplementation, adjustment, extension, issuance again, or revocation, they shall be carried out in accordance with the division of responsibilities stipulated in this Decree and related provisions.
This Decree takes effect from June 16, 2025, replacing Decree No. 45/2025/NĐ-CP dated February 28, 2025, of the Government on the organization of specialized agencies under provincial People's Committees and central city People's Committees, and district, town, and city-level People's Committees under provinces and central cities.
Article 25. Responsibilities for Implementation
Ministers, Heads of ministerial-level agencies, Chairmen of People's Councils, and Chairmen of provincial and central city People's Committees are responsible for implementing this Decree.
