Circular No. 26/2025/TT-BGDĐT amends and supplements certain provisions of Circulars issued by the Minister of Education and Training on decentralization, delegation, and determination of authority to perform state management tasks at two levels of local government in the field of education.

 

CIRCULAR

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE GUIDELINES ISSUED BY THE MINISTER OF EDUCATION AND TRAINING ON DELEGATION OF AUTHORITY, GRADATION, AND DEFINITION OF AUTHORITY IN IMPLEMENTING STATE MANAGEMENT TASKS OF TWO-LEVEL LOCAL ADMINISTRATIONS IN THE FIELD OF EDUCATION

Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the organization and staffing of state agencies;

Pursuant to Decree No. 37/2025/NĐ-CP dated February 26, 2025 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 142/2025/NĐ-CP dated June 12, 2025 of the Government on defining the authority of two-level local administrations in the field of state management by the Ministry of Education and Training;

Pursuant to Decree No. 143/2025/NĐ-CP dated June 12, 2025 of the Government on delegation and gradation of authority in the field of state management by the Ministry of Education and Training;

At the proposal of the Director of the Legal Department;

The Minister of Education and Training promulgates this Circular amending and supplementing certain articles of the Circulars issued by the Minister of Education and Training on delegation of authority, gradation, and definition of authority in implementing state management tasks of two-level local administrations in the field of education.

PART I

AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 10/2025/TT-BGDĐT DATED JUNE 12, 2025 ON DELEGATION, GRADATION, AND DEFINITION OF AUTHORITY IN IMPLEMENTING STATE MANAGEMENT TASKS OF TWO-LEVEL LOCAL ADMINISTRATIONS FOR GENERAL EDUCATION

Article 1. Amend and supplement Point d, Point đ Clause 5, some Points of Clause 10 Article 18; Supplement Clause 18 Article 18

1. Amend and supplement Point d, Point đ Clause 5 Article 18 as follows:

“d) Replace the phrase “Chairman of the People's Committee of district, town, city under province, centrally governed city” with the phrase “Chairman of the People's Committee of commune, ward, special administrative region” in Article 3 of Circular No. 32/2020/TT-BGDĐT;

Replace the phrase “People's Committee at district level” with the phrase “People's Committee at commune level” in Clause 1 Article 6 and Point đ, e Clause 1 Article 10; replace the phrase “Department of Education and Training cooperates with the People's Committee at district level to build content for joint management” with the phrase “Department of Education and Training builds content for management” in Clause 2 Article 6; replace the phrase “ethnic minority boarding school at district level” with the phrase “ethnic minority boarding school” in Point đ, e Clause 1 Article 10 of the Charter of junior high schools, high schools, and multi-grade schools issued together with Circular No. 32/2020/TT-BGDĐT;

đ) Remove the phrase “Director of the Department of Education and Training” in Article 3 of Circular No. 32/2020/TT-BGDĐT.”

2. Amend and supplement some Points of Clause 10 Article 18 as follows:

a) Amend and supplement Point a, b, c Clause 10 Article 18 as follows:

“a) Amend and supplement Clause 1 Article 7 of the Regulation on Recognition of Graduation from Junior High School issued together with Circular No. 31/2023/TT-BGDĐT as follows:

“1. The Examination Board for Recognition of Graduation (hereinafter referred to as the Board) shall be established by a decision of the Chairman of the People's Committee at commune level. Each educational institution that has students completing grade 9 in the year of examination for recognition of graduation shall establish one (1) Board.”;

b) Amend and supplement Clause 4 Article 8 of the Regulation on Recognition of Graduation from Junior High School issued together with Circular No. 31/2023/TT-BGDĐT as follows:

“4. The Board shall send the minutes and list of candidates proposed for graduation recognition to the Chairman of the People's Committee at commune level for approval.”;

c) Amend and supplement Clause 5 Article 8 of the Regulation on Recognition of Graduation from Junior High School issued together with Circular No. 31/2023/TT-BGDĐT as follows:

“5. The Chairman of the People's Committee at commune level shall issue a decision recognizing graduation for students based on the proposal of the educational institution.”

b) Amend and supplement Clause 5 (above Point e) and Point e Clause 10 Article 18 as follows:

“e) Amend and supplement Clause 2 and Clause 7 Article 14 of the Regulation on Recognition of Graduation from Junior High School issued together with Circular No. 31/2023/TT-BGDĐT as follows:

“2. Submit to the Chairman of the People's Committee at commune level for issuance of a decision establishing the Examination Board for Recognition of Graduation of the educational institution.”

“7. Submit to the Chairman of the People's Committee at commune level for issuance of a decision recognizing graduation and announcement of the list of students recognized for graduation after receiving the decision recognizing graduation from the Chairman of the People's Committee at commune level; issue a temporary certificate of graduation; organize the distribution of graduation certificates to students recognized for graduation.”

c) Amend and supplement Point g Clause 10 Article 18 as follows:

“g) Replace the phrase “Prepare a list of students meeting the conditions for recognition of graduation and submit it to the Director of the Department of Education and Training for approval” with the phrase “Prepare a list of students meeting the conditions for recognition of graduation and submit it to the Chairman of the People's Committee at commune level for approval” in Point b Clause 2 Article 7.”

d) Supplement Point i after Point h Clause 10 Article 18 as follows:

“i) Replace the phrase “Director of the Department of Education and Training” with the phrase “Chairman of the People's Committee at commune level” in Article 3 of Circular No. 31/2023/TT-BGDĐT.”

3. Supplement Clause 18 Article 18 as follows:

“18. Amend, supplement, and abolish certain contents in Appendix II, Appendix III, and Appendix IV issued together with Circular No. 15/2022/TT-BGDĐT dated November 8, 2022 of the Minister of Education and Training on teaching the volume of cultural knowledge of general secondary education in vocational education institutions as follows:

a) Amend and supplement the content at Note 3 on the back of the Model Certificate of Meeting the Requirements of the Volume of Cultural Knowledge of General Secondary Education - Appendix II as follows: “(3) Based on the Birth Certificate, record the name of the province, centrally governed city at the time of issuing the Certificate”;

b) Remove the phrase “District (Quận/Thị xã/TP under province)” on the back of the Model Certificate of Meeting the Requirements of the Volume of Cultural Knowledge of General Secondary Education - Appendix II;

c) Remove the phrases: “District/Quận/Thị xã” and “District (Quận, TX, TP under province)” in the Model Record and Evaluation Form for Students - Appendix III, Appendix IV;

d) Remove the phrases “Ministry of Labor, Invalids and Social Affairs”, “Department of Labor, Invalids and Social Affairs”, and “Director of the Department of Labor, Invalids and Social Affairs” in Articles 14, 15, and 18.”

Chapter II

AMENDMENTS AND SUPPLEMENTS TO SOME ARTICLES OF CIRCULAR NO. 11/2025/TT-BGDĐT OF JUNE 12, 2025 REGULATING THE DELEGATION, GRADATION, AND DEFINITION OF AUTHORITY IN IMPLEMENTING STATE MANAGEMENT TASKS OF TWO-TIER LOCAL ADMINISTRATION FOR VOCATIONAL EDUCATION AND CONTINUOUS EDUCATION

Article 2. Supplement Article 8a following Article 8

"Article 8a. Amend and supplement the content of Point 3 of Topic 1 in the table at Clause 2 Section II Part Two of the Education Program to meet the requirements of learners; update knowledge, skills, and technology transfer issued together with Circular No. 18/2024/TT-BGDĐT dated November 28, 2024 of the Minister of Education and Training"

2. Specific content and requirements for achievement

Article 3. Amend and supplement Clause 3 and supplement Clauses 5, 6, 7, 8 of Article 9 1. Amend and supplement Clause 3 of Article 9 as follows:

"3. Replace and abolish some phrases in certain articles and clauses of Circular No. 10/2022/TT-BGDĐT dated July 12, 2022 of the Minister of Education and Training on the assessment of learners in the illiteracy eradication program as follows:

a) Replace the phrase “Department of Education and Training” with the phrase “Education and Training Department” in Clause 2 Article 14, Clause 1 Article 15;

b) Remove the phrase “Department of Education and Training” from the title and Clause 3 Article 14."

2. Supplement Clauses 5, 6, 7, 8 of Article 9 as follows:

"5. Replace the phrase “People’s Committee at the district level” with the phrase “People’s Committee at the commune level” in Clause 2 Article 26 of the Regulation on the organization and operation of foreign language and information technology centers issued together with Circular No. 21/2018/TT-BGDĐT dated August 24, 2018 of the Minister of Education and Training, Clause 3 Article 15 of the Regulation on the organization and operation of continuing education centers issued together with Circular No. 10/2021/TT-BGDĐT dated April 5, 2021 of the Minister of Education and Training, and Clause 3 Article 15 of the Regulation on the organization and operation of vocational and continuing education centers issued together with Circular No. 01/2023/TT-BGDĐT dated January 6, 2023 of the Minister of Education and Training.

6. Replace the phrase “Department of Education and Training” with the phrase “Chairman of the Commune People’s Committee” in Clause 3 Article 15 of Circular No. 43/2021/TT-BGDĐT dated December 30, 2021 of the Minister of Education and Training on the assessment of learners in the continuous education program for junior high school and high school.

7. Amend and abolish some contents of Circular No. 04/2014/TT-BGDĐT dated February 28, 2014 of the Minister of Education and Training on the management of life skill education activities and extracurricular education activities (hereinafter referred to as Circular No. 04/2014/TT-BGDĐT) as follows:

a) Replace the phrase “Head of the District or County Education and Training Office” with the phrase “Chairman of the Commune People’s Committee” in Point b Clause 1 Article 8; replace the phrase “Education and Training Office” with the phrase “Commune People’s Committee” and replace the phrase “District People’s Committee” with the phrase “Provincial People’s Committee” in Article 13 of the Management Regulations for Life Skill Education Activities and Extracurricular Education Activities issued together with Circular No. 04/2014/TT-BGDĐT;

b) Abolish Clause 2 Article 11 of the Management Regulations for Life Skill Education Activities and Extracurricular Education Activities issued together with Circular No. 04/2014/TT-BGDĐT;

8. Abolish Clause 3 Article 2, Article 19, and Article 20 of Circular No. 24/2023/TT-BGDĐT dated December 11, 2023 of the Minister of Education and Training on the evaluation and recognition of “learning units” at the county and provincial levels."

AMENDMENTS AND SUPPLEMENTS TO SOME ARTICLES OF CIRCULAR NO. 12/2025/TT-BGDĐT OF JUNE 12, 2025 REGULATING THE DELEGATION, GRADATION, AND DEFINITION OF AUTHORITY IN IMPLEMENTING STATE MANAGEMENT TASKS OF TWO-TIER LOCAL ADMINISTRATION FOR THE FIELD OF TEACHERS AND MANAGEMENT STAFF OF EDUCATIONAL INSTITUTIONS

Chapter III

AMENDMENTS AND SUPPLEMENTS TO SOME ARTICLES OF CIRCULAR NO. 12/2025/TT-BGDĐT OF JUNE 12, 2025 ON THE DELEGATION, GRADATION, AND DEFINITION OF AUTHORITY IN IMPLEMENTING MANAGEMENT TASKS OF LOCAL GOVERNMENTS AT TWO LEVELS IN THE FIELD OF EDUCATION AND MANAGEMENT STAFF OF EDUCATIONAL INSTITUTIONS

Article 4. Amend and supplement Clause 1; add Clause 1a, 1b following Clause 1 of Article 11

1. Amend and supplement Clause 1 of Article 11 as follows:

“1. Replace the phrase “Department of Education and Training, provincial Department of Education and Training” with the phrase “competent authority” in Point b, Clause 3, Article 5; replace the phrases “People's Committee at district level,” “Department of Education and Training” with the phrase “People's Committee at commune level” in Articles 6 and 7 of Circular No. 48/2011/TT-BGDĐT dated October 25, 2011 issued by the Minister of Education and Training on working regulations for kindergarten teachers.”

2. Add Clause 1a, 1b following Clause 1 of Article 11 as follows:

“1a. Amend some phrases in Clause 1, Part IV of Circular No. 33/2005/TT-BGD&ĐT dated December 8, 2005 issued by the Minister of Education and Training guiding temporarily the implementation of allowances for leadership positions in public educational institutions as follows:

a) Replace the phrase “Specialized schools at provincial level enjoy the same benefits as grade I schools” with the phrase “Specialized schools at provincial level enjoy the same benefits as grade I schools, except for those specified in column note number 6 in this table” in the column note of number 5 in the table of leadership position allowance coefficients in educational institutions;

b) Replace the phrase “Specialized schools at district level enjoy the same benefits as grade I schools” with the phrase “Primary schools and junior high schools of ethnic minority boarding schools; primary and junior high schools of ethnic minority boarding schools enjoy the same benefits as grade I schools” in the column note of number 6 in the table of leadership position allowance coefficients in educational institutions.

1b. Replace the phrase “Department of Education and Training” with the phrase “People's Committee at commune level” in Clause 2, Article 4 of Circular No. 27/2017/TT-BGDĐT dated November 8, 2017 issued by the Minister of Education and Training on standards, tasks, authorities, and appointment of teachers to serve as the General Leader of the Ho Chi Minh Communist Youth Union in public general education institutions.”

Article 5. Add Article 5a following Article 5

“Article 5a. Amend and supplement some contents of Circular No. 48/2008/TT-BGDĐT dated August 25, 2008 issued by the Minister of Education and Training guiding the ranking and implementation of allowances for leadership positions in regular education centers

1. Amend and supplement Clause 1, Part I as follows:

“1. Scope of regulation, subjects of application

This Circular guides the ranking and implementation of allowances for leadership positions for regular education centers and vocational training - regular education centers (hereinafter referred to collectively as Regular Education Centers).”

2. Amend and supplement Point c, Clause 3, Part I as follows:

“c) For newly established regular education centers, the Chairman of the People's Committee at provincial level shall determine the ranking in the decision on establishment.”

3. Replace the phrase “provincial regular education center” with the phrase “regular education center” in Point a, Clause 2, Point a, Clause 3, Part II and Point a, Clause 2, Part III.

4. Replace the phrase “district regular education center” with the phrase “vocational training - regular education center” in Point b, Clause 2, Point b, Clause 3, Part II and Point a, Clause 2, Part III.”

Chapter IV

AMEND AND SUPPLEMENT SOME ARTICLES OF CIRCULAR NO. 13/2025/TT-BGDĐT DATED JUNE 12, 2025 REGULATING THE DELEGATION, GRADING, AND ASSIGNMENT OF AUTHORITY TO IMPLEMENT STATE MANAGEMENT TASKS OF LOCAL AUTHORITIES AT TWO LEVELS IN THE FIELD OF EDUCATION

Article 6. Amend and supplement Clause 2 of Article 5

“2. Replace the phrase “Department of Education and Training” with the phrase “People's Committee of the Commune Level” and replace the phrase “Head of the Department of Education and Training” with the phrase “Chairman of the People's Committee of the Commune Level” in Circular No. 21/2019/TT-BGDĐT.”

Article 7. Add Article 17a following Article 17

“Article 17a. Amend and supplement some contents of Circular No. 19/2020/TT-BGDĐT dated June 29, 2020 issued by the Minister of Education and Training on the regular reporting system within the scope of management of the Ministry of Education and Training.

1. Amend and supplement Clause 2 of Article 8 as follows:

“2. Objectives to implement, receiving agencies and reporting procedures:

a) Objectives to implement, receiving agencies: People's Committee of the Commune Level, People's Committee of the Province Level, Ministry of Education and Training.

b) Reporting procedure:

The People's Committee of the Province Level shall take the lead in organizing the collection and consolidation of data on universal education and literacy in the province through the Information Management System for Universal Education and Literacy, specifically:

- The commune level shall enter collected data from Survey Forms into the Information Management System for Universal Education and Literacy and report complete commune-level data to the provincial level via the Information Management System for Universal Education and Literacy;

- The provincial level shall consolidate and verify data reported by the commune level on the Information Management System for Universal Education and Literacy; complete the provincial-level data on universal education and literacy and report to the Ministry of Education and Training via the Information Management System for Universal Education and Literacy.

The process and method of entering data at the commune level, and the use of the system at the provincial level shall be carried out according to the guidance materials provided on the Information Management System for Universal Education and Literacy.”

2. Amend and supplement Clause 6 of Article 8 as follows:

“6. Deadline for submitting reports:

a) In case of paper-based reports:

- The People's Committee of the Commune Level shall submit the report to the People's Committee of the Province Level before October 3 each year.

- The People's Committee of the Province Level shall submit the report to the Ministry of Education and Training before October 10 each year.

b) In case of reports submitted through the information reporting system of the Ministry of Education and Training:

- The People's Committee of the Commune Level shall complete data entry on the Information Management System for Universal Education and Literacy before October 3 each year.

- The People's Committee of the Province Level shall complete data entry on the Information Management System for Universal Education and Literacy before October 10 each year.”

3. Replace the phrase “Department of Education and Training” with the phrase “People's Committee of the Commune Level” in Point a of Clause 2, Point a of Clause 6 of Article 9; Point a of Clause 2, Point a of Clause 6 of Article 10; Point a of Clause 2, Point a of Clause 6 of Article 12; Point a of Clause 2, Point a of Clause 6 of Article 13; Point a of Clause 2, Point a of Clause 6 of Article 21 and Appendix I.

4. Delete the phrases: “People's Committee of the District, County, Town, City under Province, City under Central City (hereinafter referred to collectively as People's Committee of the District Level)” and “Education and Training Department under the People's Committee of the District, County, Town, City under Province, City under Central City (hereinafter referred to collectively as Department of Education and Training)” in Point a of Clause 1 of Article 5; the phrase “People's Committee of the District Level” in Appendix I; the phrase “Total number of civil servants and staff of the Department of Education and Training of districts/cities/towns” in Model Number 05 of Appendix II; the word “district” in the Note “- Column number 3” of Table I.17a/BGDĐT/HTQT in Appendix II.”

Article 8. Supplement Clause 7 and Clause 8 of Article 18

“7. Amend, supplement, and abolish certain phrases in Clause 2 of Article 5 of the Admissions Regulation and Preparatory Higher Education Training Regulation; examine and transfer to study at the undergraduate level or college level in Early Childhood Education for preparatory university students issued together with Circular No. 44/2021/TT-BGDĐT (hereinafter referred to as the Regulation issued together with Circular No. 44/2021/TT-BGDĐT) and the Appendix issued together with Circular No. 44/2021/TT-BGDĐT as follows:

a) Add the phrase “Personal identification number/national identity card number/passport number/citizen identification number” after the section “Candidate’s full name” in the Application for Admission/Direct Admission to Preparatory University Studies in the Appendix issued together with Circular No. 44/2021/TT-BGDĐT;

b) Remove the phrases “Copies of Birth Certificate,” “Confirmation of permanent residence of the candidate and their biological parents or guardian” in Clause 2 of Article 5 of the Regulation issued together with Circular No. 44/2021/TT-BGDĐT.

8. Remove the phrase: “Director of Education and Training Department” in Appendix I and Appendix II issued together with Decision No. 17/2008/QĐ-BGDĐT dated April 17, 2008 of the Minister of Education and Training on the model of secondary school graduation certificates and copies from the original secondary school graduation certificates.”

Chapter V

IMPLEMENTING PROVISIONS

Article 9. Implementation Provisions

1. This Circular shall take effect from December 25, 2025.

2. This Circular shall cease to be effective from March 1, 2027, except where laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, resolutions of the Government, decisions of the Prime Minister, or Circulars of the Minister of Education and Training provide for state management authority, responsibilities, procedures, and formalities stipulated in this Circular through or promulgated from the date this Circular takes effect and become effective before March 1, 2027, then the corresponding provisions in this Circular shall cease to be effective upon the effectiveness of such legal documents.

3. During the period when the provisions of this Circular are effective, if the provisions regarding state management authority, responsibilities, procedures, and formalities in this Circular differ from those in related legal documents promulgated before the date this Circular takes effect, they shall be implemented according to the provisions of this Circular.

Article 10. Responsibility for Implementation

The Director of the Office, Heads of the Legal Affairs Department, Heads of relevant units under the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally governed cities; Directors of Departments of Education and Training; Chairpersons of People's Committees of communes, wards, and special administrative regions; relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
