Repealing certain legislative regulatory documents issued by the MinisterThe Ministry of Transport issues this joint issuance

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government Amending and supplementing certain articles of Decree No. 34/2016/NĐ-CPdated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Issuance of Legal Normative Documents;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Legal Department;

The Minister of Transport hereby issues this Circular abolishing some legal normative documents issued by the Minister of Transport and jointly issued.

Article 1. Abolish all legal normative documents issued by the Minister of Transport and jointly issued

1. Circular No. 05/2000/TT-BXD dated June 27, 2000 of the Minister of Construction guiding the implementation of support for people participating in revolutionary activities before the August Revolution of 1945 to improve housing pursuant to Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Prime Minister.

1. Decision No. 31/1999/QĐ-BGTVT dated January 2, 1999 of the Minister of Transport promulgating regulations on management, use, operation, and traffic safety assurance for National Highway 5.

2. Decision No. 1254/1999/QĐ-BGTVT dated May 27, 1999 of the Minister of Transport promulgating regulations on management, operation, use, and traffic safety assurance for National Highway 51.

3. Decision No. 2047/2002/QĐ-BGTVT dated July 2, 2002 of the Minister of Transport promulgating regulations on management, use, operation, and traffic safety assurance for Phap Van - Cau Giay Road.

4. Decision No. 1943/2003/QĐ-BGTVT dated July 4, 2003 of the Minister of Transport promulgating regulations on management, use, operation, and traffic safety assurance for the Lang Son - Hanoi section of National Route 1.

5. Decision No. 1944/2003/QĐ-BGTVT dated July 4, 2003 of the Minister of Transport promulgating regulations on management, use, operation, and traffic safety assurance for the Ho Chi Minh Road - Phase 1.

6. Decision No. 23/2005/QĐ-BGTVT dated March 30, 2005 promulgating regulations on state secrets protection within the Ministry of Transport.

7. Decision No. 25/2005/QĐ-BGTVT dated May 13, 2005 of the Minister of Transport promulgating regulations on the application of standards in construction projects.

8. Decision No. 30/2006/QĐ-BGTVT dated August 10, 2006 of the Minister of Transport promulgating regulations on the application of new materials and technologies in construction projects in Vietnam.

9. Circular No. 04/2009/TT-BGTVT dated May 8, 2009 of the Minister of Transport promulgating standards for Directors of Provincial Department of Transport under People's Committees of provinces and centrally governed cities.

10. Circular No. 45/2011/TT-BGTVT dated June 10, 2011 of the Minister of Transport promulgating regulations on costs for traffic safety review for newly constructed road projects; upgrading and renovation projects.

11. Circular No. 12/2013/TT-BGTVT dated May 30, 2013 of the Minister of Transport promulgating regulations on the use of concrete pavement structures in investment and construction of transportation projects.

12. Joint Circular No. 21/2013/TTLT-BGTVT-BTNMT dated August 22, 2013 of the Minister of Transport and the Minister of Natural Resources and Environment guiding management and environmental protection in inland waterway transport activities.

13. Circular No. 57/2013/TT-BGTVT dated December 27, 2013 of the Minister of Transport promulgating regulations on security at inland water ports receiving foreign vessels.

14. Joint Circular No. 71/2014/TTLT-BGTVT-BTC dated December 10, 2014 of the Minister of Transport and the Minister of Finance promulgating regulations on costs for traffic safety review for operational road projects.

15. Circular No. 32/2015/TT-BGTVT dated July 24, 2015 of the Minister of Transport promulgating regulations on environmental protection in infrastructure development.

16. Circular No. 56/2015/TT-BGTVT dated October 8, 2015 of the Minister of Transport promulgating regulations on management of environmental tasks funded by the State budget under the Ministry of Transport.

17. Joint Circular No. 10/2016/TTLT-BGTVT-BTC dated May 10, 2016 of the Minister of Transport and the Minister of Finance guiding management and use of public funds for performing public welfare tasks in national railway infrastructure maintenance managed by the State.

18. Circular No. 16/2017/TT-BGTVT dated May 22, 2017 of the Minister of Transport guiding transit cargo routes through Vietnam's territory.

19. Circular No. 20/2017/TT-BGTVT dated June 21, 2017 of the Minister of Transport amending and supplementing certain articles of Circular No. 32/2015/TT-BGTVT dated July 24, 2015 of the Minister of Transport promulgating regulations on environmental protection in infrastructure development.

20. Circular No. 34/2017/TT-BGTVT dated October 5, 2017 of the Minister of Transport amending and supplementing Circular No. 56/2015/TT-BGTVT dated October 8, 2015 of the Minister of Transport promulgating regulations on management of environmental tasks funded by the State budget under the Ministry of Transport.

21. Circular No. 44/2017/TT-BGTVT dated November 16, 2017 of the Minister of Transport promulgating regulations on model tender request documents and tender invitation documents for leasing the operation of infrastructure terminals, bridges, and inland container depots invested with State capital.

Article 2. Repeal part of the regulatory legal text issued by the Minister of Transport

Repealing part of the following legislative regulatory documents:

1. Article 1, Article 2, Article 3, Article 4, Article 5, Article 6, Article 7, Article 8, Article 9, Article 10, Article 11, Article 12, Article 13, Article 14, Article 15, Article 16, Article 17, Article 18, Article 19, Article 20, Article 21, Article 22, Article 23, Article 24, Clause 1, Clause 2 and Clause 3 of Article 25; Clause 1, Clause 2, Clause 3 and Clause 5 of Article 26; Clause 1, Clause 2 and Clause 4 of Article 27; Article 28 and Samples 1, Sample 2, Sample 3, Sample 4, Sample 5, Sample 6, Sample 7, Sample 8, Sample 9, Sample 10, Sample 11, Sample 12, Sample 13, Sample 14, Sample 15, Sample 16 in the Appendix of Circular No. 50/2014/TT-BGTVT dated October 17, 2014 of the Minister of Transport on inland waterway port management.

2. Article 4, Article 5, Article 6, Article 7, Article 8, Article 11, Article 12, Article 13, Article 14, Article 15, Article 16, Article 17, Article 19, Article 20, Article 21, Appendix 1, Appendix 2 and Appendix 5 of Circular No. 15/2016/TT-BGTVT dated June 30, 2016 of the Minister of Transport on the management of inland waterways.

3. Article 10 of Circular No. 35/2020/TT-BGTVT dated December 23, 2020 of the Minister of Transport amending and supplementing certain articles of Circulars stipulating regular reporting procedures in the field of inland waterways.

Article 3. Implementation Provisions

1. This Circular shall take effect from January 20, 2022.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Directors of the Vietnam Highway Administration, the Heads of Bureaus, the Directors of Provincial and Central City Departments of Transport, the heads of agencies, organizations and individuals concerned are responsible for implementing this Circular./.
