AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF 37 LAWS RELATED TO PLANNING
On the basis of the Constitution of the Socialist Republic of Vietnam;

Article 1. Amendments and supplements to certain articles of the Road Traffic Law
1. Amend and supplement Article 6 as follows:
"Article 6. Planning of the road network
1. The planning of the road network is a national sectoral plan, including the system of national roads and expressways, serving as a basis for guiding the development of the transportation network, determining resources for implementation within the framework of infrastructure planning for road transport, regional planning, provincial planning, urban planning, and rural planning.
2. The preparation of the road network planning must comply with legal regulations on planning and ensure connectivity between road transport and other modes of transport.
3. The Ministry of Transport shall organize the preparation of the road network planning to be submitted to the Prime Minister for approval in accordance with legal regulations on planning.
4. Provincial People's Committees shall organize the development plan for the road network within the provincial planning based on the road network planning and regional planning."
2. Add Article 6a after Article 6 as follows:
"Article 6a. Planning of road transport infrastructure
1. The planning of road transport infrastructure is a technical and specialized plan that details the road network planning, determining the development plans for road construction projects and other road transport infrastructure along each road route.
2. The planning of road transport infrastructure includes the following main contents:
a) Determining the alignment, key control points, length, scale of each road route through each locality, region; determining the quantity, scale, main technical parameters of major works including bridges, tunnels, ferry terminals on the road route; specifying specific intersection points, rest stop systems, and other auxiliary facilities;
b) Connection schemes with rail transport, inland waterway transport, maritime transport, air transport for each area, each route; connection with urban systems, economic zones, tourist areas, industrial zones, export processing zones;
c) Determining land use requirements, investment capital needs, implementation schedule of the plan according to priority investment order;
d) Developing detailed solutions to implement the plan.
3. The planning period for road transport infrastructure is 10 years, with a vision from 20 to 30 years.
4. The planning of road transport infrastructure shall be reviewed every five years to adjust it appropriately to the socio-economic development situation in each stage.
5. The Ministry of Transport shall organize the preparation of the planning of road transport infrastructure to be submitted to the Prime Minister for approval.
6. Public disclosure of the planning of road transport infrastructure shall be carried out in accordance with legal regulations on planning and road transport.
7. The Government shall stipulate detailed regulations on the preparation, review, approval, public disclosure, implementation, evaluation, and adjustment of the planning of road transport infrastructure."
3. Amend and supplement Clause 2 of Article 46 as follows:
"2. Investment in the construction of road transport infrastructure must be consistent with the road network planning, planning of road transport infrastructure, regional planning, provincial planning, urban planning, and rural planning approved by competent authorities; comply with the procedures for managing investment and construction and other provisions of the law; ensure technical standards, landscape, environmental protection, and biodiversity conservation."
4. Amend and supplement Clauses 2, 3, and 4 of Article 51 as follows:
"2. Bus stations, parking lots, rest stops must be constructed in accordance with technical standards
3. A toll station is a location where fees for vehicles participating in road traffic are collected, constructed according to an investment project approved by a competent state agency. The operation of toll stations must ensure smooth and safe traffic.
4. A vehicle weight inspection station is a place where the road management agency collects, analyzes, and evaluates the impact of vehicle load and size limits on road safety; inspects and handles violations by vehicles exceeding size limits, permissible load weights, and tracked vehicles traveling on roads, constructed according to a decision of a competent authority.”
5. Amend and supplement Clause 7 of Article 61 as follows:
“7. The examination for issuing automobile driving licenses must be conducted at driving examination centers. Driving examination centers must have sufficient material and technical facilities to meet the requirements for driving examinations as prescribed.”
6. Repeal Clause 3 of Article 64.
7. Amend and supplement Clause 1 of Article 84 as follows:
“1. Develop the network planning for roads, infrastructure planning for road transport, plans and policies for developing road transport; develop and direct the implementation of the national program on road traffic safety.”
Article 2. Amend and supplement some articles of the Maritime Code of Vietnam
1. Amending and supplementing Clause 2, Article 7 as follows:
“2. Prioritize the development of maritime infrastructure through preferential policies in the overall planning for the development of the port system, detailed planning for groups of ports, berths, wharves, pontoons, water areas, sea areas, detailed planning for the development of port land and water areas, planning for the development of inland container depots; attract investment capital for the construction and exploitation of maritime infrastructure.”
2. Amend and supplement Clause 12 of Article 12 as follows:
“12. Constructing and operating illegally port facilities, other facilities within the scope of the overall planning for the development of the port system, detailed planning for groups of ports, berths, wharves, pontoons, water areas, sea areas, detailed planning for the development of port land and water areas, planning for the development of inland container depots, and other related planning as provided by law on planning, within shipping lanes and the protection zones of maritime works.”
3. Amend and supplement Clause 1 of Article 77 as follows:
“1. Ports, offshore oil ports, berths, wharves, pontoons, water areas, sea areas shall be named when planning, establishing investment projects, and announcing their commissioning upon the proposal of the investor, relevant agencies, and organizations.”
4. Amend and supplement Article 81 as follows:
“Article 81. Overall Planning for the Development of the Port System
1. The overall planning for the development of the port system is a national industry planning.
2. The preparation of the overall planning for the development of the port system must comply with the provisions of the law on planning and be based on defense and security tasks, needs, resources, and trends in global maritime development.
3. Ministries, ministerial-level agencies, and provincial People's Committees when preparing related planning must seek written opinions from the Ministry of Transport.”
5. Amend and supplement Article 82 as follows:
“Article 82. Responsibilities for Establishing and Managing the Overall Planning for the Development of the Port System
1. The Ministry of Transport organizes the preparation of the overall planning for the development of the port system and submits it to the Prime Minister for approval in accordance with the law on planning.
2. Ministries, ministerial-level agencies, and provincial People's Committees are responsible for:
a) Cooperating with the Ministry of Transport to manage the overall planning for the development of the port system;
b) Ensuring land and water areas for the development of the port system according to the approved planning.”
6. Supplement Article 82a following Article 82 as follows:
"Article 82a. Detailed Planning for Groups of Ports, Berths, Wharves, Pontoons, Water Areas, Sea Areas, Detailed Planning for the Development of Port Land and Water Areas
1. Detailed planning for groups of ports, berths, wharves, pontoons, water areas, sea areas, detailed planning for the development of port land and water areas is specialized technical planning that further elaborates on the overall planning for the development of the port system.
2. Detailed planning for groups of ports, berths, wharves, pontoons, water areas includes the following main contents:
a) Forecasting cargo throughput needs, allocating cargo volumes to each berth, port area within the group of ports;
b) Determining the type of port; reasonable cargo flow adjustment schemes; supporting the development of economic zones, tourist areas, industrial zones, export processing zones;
c) Determining the number of wharves, berths, port areas in phases of planning, prioritized investment projects;
d) Preliminary layout of the berthing areas, port areas within the group of ports;
đ) Implementation solutions for the planning.
3. Detailed planning for the development of port land and water areas includes the following main contents:
a) Forecasting cargo throughput needs, allocating cargo volumes to each berth, port area within the port;
b) Determining the location, scale, function, area of land and water, warehouse area, hinterland area of the port; allocation of functional areas of the port within the planned land and water area; design capacity of wharves and berths; determining basic technical parameters of ship channels, standard vessel sizes on the channel;
c) Determining the location, basic technical parameters of wharves, berths, public maritime infrastructure works; determining the scale and location of works serving state management;
d) Determining land use needs, investment capital needs, phased implementation plan of the planning according to priority investment order;
đ) Implementation solutions for the planning, management of the implementation of the planning; projected investment sources for channel and berth construction.
4. The Ministry of Transport organizes the preparation of detailed planning for groups of ports, berths, wharves, pontoons, water areas, sea areas and submits them to the Prime Minister for approval. The Minister of Transport approves detailed planning for the development of port land and water areas.”
5. The public announcement of detailed planning for groups of seaports, wharfs, docks, mooring buoys, water areas, and detailed development planning for land and water areas of seaports shall be carried out in accordance with the laws on planning and maritime laws.
6. The Government shall specify detailed regulations on the establishment, review, approval, public announcement, implementation, evaluation, and adjustment of detailed planning for groups of seaports, wharfs, docks, mooring buoys, water areas, and detailed development planning for land and water areas of seaports.
7. Amend and supplement Clause 1 of Article 83 as follows:
“1. Investment in constructing seaports and maritime channels must be consistent with the overall planning for the development of the seaport system, detailed planning for groups of seaports, wharfs, docks, mooring buoys, water areas, and detailed development planning for land and water areas of seaports, as stipulated in this Code, investment laws, construction laws, and other relevant laws.”
8. Repeal Clause 1 and amend and supplement Clause 3 of Article 88 as follows:
“3. Investment in building and developing seaport infrastructure according to the overall planning for the development of the seaport system, detailed planning for groups of seaports, wharfs, docks, mooring buoys, water areas, and detailed development planning for land and water areas of seaports, which have been approved.”
9. Amend and supplement Clause 1 of Article 92 as follows:
“1. Participate in the development of overall planning for the seaport system, detailed planning for groups of seaports, wharfs, docks, mooring buoys, water areas, and detailed development planning for land and water areas of seaports, and organize the supervision of implementation after being approved by competent state authorities.”
10. Amend and supplement Article 102 as follows:
“Article 102. Planning for the Development of the Inland Port System
1. Planning for the development of the inland port system is technical and specialized planning that concretizes national-level planning, regional planning, and provincial planning. The establishment of planning for the development of the inland port system is based on economic and social development strategies, national defense and security tasks, national-level planning, regional planning, and provincial planning.
2. Planning for the development of the inland port system includes the following main contents:
a) Forecasting cargo demand, allocating cargo volumes to transport corridors and cargo zones;
b) Developing traffic connection plans for ports; reasonable cargo flow regulation plans linked to the development of economic zones, tourist areas, industrial zones, export processing zones, creating conditions for economic and social development in the region;
c) Determining the location, scale, functions, and area of ports; allocating the functions of each port within the planned land area; arranging facilities for state management;
d) Determining land use needs, investment capital needs, phased implementation plan of the planning according to priority investment order;
d) Implementation organization solutions for planning, management of planning implementation; projected investment capital for ports.
3. The Ministry of Transport shall organize the development of planning for the development of the inland port system and submit it to the Prime Minister for approval.
4. The Ministry of Transport shall organize the public announcement and guide, supervise the implementation of the approved planning for the development of the inland port system in accordance with the laws on planning and maritime laws.
5. Ministries, ministerial-level agencies, and provincial People's Committees shall have the responsibility:
a) To coordinate with the Ministry of Transport to manage the implementation of planning for the development of the inland port system in accordance with this Code and other relevant laws;
b) To ensure land funds for the construction and development of inland ports in accordance with the approved planning for the development of the inland port system.
6. The Government shall specify detailed regulations on the establishment, review, approval, public announcement, implementation, evaluation, and adjustment of planning for the development of the inland port system.”
11. Amend and supplement Clause 2 of Article 108 as follows:
“2. Organizing and managing maritime safety assurance is the establishment and operation of a maritime safety assurance system, including the implementation of planning, management of investment in building infrastructure, exploitation of the maritime safety assurance system; standardization, assessment, and supervision of the quality of maritime safety assurance service provision.”
12. Amend and supplement Point d of Clause 1 of Article 126 as follows:
“d) For above-water and underground marine works, the protection range shall be specifically determined for each work based on the overall planning for the development of the seaport system, detailed planning for groups of seaports, wharfs, docks, mooring buoys, water areas, and detailed development planning for land and water areas of seaports, technical standards, and other relevant legal provisions.”
13. Repeal Article 44, Article 46, and Clause 1 of Article 48.
Article 3. Amending and supplementing some articles of the Law on Railways
1. Amending and supplementing Article 7 as follows:
"Article 7. Railway network planning
1. Railway network planning is a national industry planning, serving as the basis for investment orientation, development, and operation of the railway network.
2. The Ministry of Transport shall organize the preparation of railway network planning to submit to the Prime Minister for approval in accordance with the provisions of the law on planning."
2. Supplement Article 7a following Article 7 as follows:
"Article 7a. Railway line planning and railway station planning
1. Railway line planning and railway station planning is technical and specialized planning that details the overall national planning, railway network planning, and is prepared for national railway lines, railway stations in cities, major railway stations, and international transit railway stations.
2. Railway line planning and railway station planning includes the following main contents:
a) Determining the route direction, starting point, end point, length of the line, track gauge, key control points, bridge and tunnel projects, intersection points; positions of stations and depots;
b) Connection schemes with road transport, inland waterway transport, maritime transport, air transport; connection with urban systems, economic zones, tourist areas, industrial zones, export processing zones;
c) Determining land use requirements, investment capital needs, implementation schedule of the plan according to priority investment order;
d) Implementation solutions for the planning.
3. The Ministry of Transport shall organize the preparation of railway line planning and railway station planning to submit to the Prime Minister for approval.
4. Public disclosure of railway line planning and railway station planning shall be carried out in accordance with the provisions of the law on planning and the law on railways.
5. The Government shall provide detailed regulations on the preparation, review, approval, public disclosure, implementation, evaluation, and adjustment of railway line planning and railway station planning."
3. Amending and supplementing Clause 1 of Article 27 as follows:
"1. In line with railway network planning and the strategy for the development of Vietnam's railway industry during each period."
4. Amending and supplementing Clause 2 of Article 29 as follows:
"2. Training and developing human resources for the railway industry must be consistent with railway network planning and synchronized with transferred technology."
5. Amending and supplementing Clause 1 of Article 70 as follows:
"1. Developing urban rail transit must be consistent with regional planning, provincial planning, urban planning, and serve as a driving force for urban development."
6. Amending and supplementing Clause 1 of Article 83 as follows:
"1. Implementing railway network planning, railway line planning, railway station planning, and other related planning as prescribed by the law on planning; implementing plans and policies for railway development."
Article 4. Amending and supplementing some articles of the Law on Inland Waterway Transport
2. Amending and supplementing Article 7 as follows:
“1. Inland waterway transport activitiesinclude the activities of persons and means participating in inland waterway transport; infrastructure planning, construction, exploitation, protection of inland waterway infrastructure; inland waterway transport search and rescue operations and state management of inland waterway transport."
4. Supplementing Clause 6 after Clause 5 of Article 4 as follows:
"3. Developing inland waterway transport must be consistent with inland waterway infrastructure planning and other related planning as prescribed by the law on planning, ensuring national defense and security.
Developing inland waterway infrastructure should move towards modernization and synchronization regarding routes, ports, wharfs, cargo handling technology; ensuring traffic safety, disaster prevention, environmental protection, and response to climate change.
Developing inland waterway transport must be synchronized with other modes of transport."
"Article 10. Point calculation for urban classification
"Article 10. Planning of inland waterway infrastructure
1. Planning of inland waterway infrastructure is a national industry planning.
2. The preparation and approval of inland waterway infrastructure planning must comply with the provisions of the law on planning and ensure consistency with water resource planning, flood and drought prevention planning, irrigation planning, and other related planning as prescribed by the law on planning.
Ministries, ministerial-level agencies, and provincial People's Committees when organizing the preparation of plans and construction projects related to inland waterway transport must seek written opinions from competent state management agencies for inland waterway transport, except for flood and dike protection projects.
3. The Ministry of Transport shall organize the preparation of inland waterway infrastructure planning to submit to the Prime Minister for approval in accordance with the law on planning; organize the preparation of development directions for inland waterway infrastructure in regional planning.
4. Provincial People's Committees shall organize the preparation of development plans for inland waterway infrastructure in provincial planning based on national planning and regional planning."
4. Amending and supplementing Clause 3 of Article 13 as follows:
"3. Construction of inland waterway ports and wharfs must be consistent with inland waterway infrastructure planning and other related planning as prescribed by the law on planning and comply with relevant laws.
Organizations and individuals wishing to construct inland waterway ports and wharfs must obtain written approval from competent state management agencies for inland waterway transport."
5. Amending and supplementing Clause 4 and Clause 5 of Article 99 as follows:
"4. The Ministry of Agriculture and Rural Development shall take the lead in coordinating with the Ministry of Transport in the construction of fishing port and anchorage planning for fishing vessels according to the law on planning and directing the implementation of measures to ensure safe transportation in the fishing area and for fishing vessels operating on inland waterways.
5. The Ministry of Agriculture and Rural Development shall take the lead in coordinating with the Ministry of Transport and relevant ministries and sectors in the construction of dike and irrigation project planning and flood and drought prevention plans related to inland waterway transport; directing the timely placement, maintenance, and removal of unused irrigation structures that affect navigation channels and protected navigation corridors."
6. Amending and supplementing Clause 2 of Article 100 as follows:
"2. Implement the planning of inland waterway infrastructure structure within the scope of authority; develop and implement the contents of the development plan for the inland waterway infrastructure structure as stipulated in the provincial planning."
7. Replace the phrase "inland waterway transportation infrastructure structure" with "inland waterway infrastructure structure" in Clause 2 Article 4, Article 5, Clause 3 Article 8, Chapter II, Article 9, Article 11, Article 14, Article 18, Article 19, Clause 1 Article 22, Clause 4 Article 98h, Clause 1 Article 100, and Clause 1 Article 101.
Article 5. Amend and supplement some articles of the Law on Water Resources
1. Amending and supplementing Clause 8 of Article 3 as follows:
"8. Relevant plans according to the laws on planning, programs, projects for economic and social development, national defense, and security must be aligned with water resource capacity, protect water resources; ensure minimum flow rates on rivers without exceeding extraction thresholds for aquifers and have measures to ensure civilian livelihoods."
2. Amending and supplementing Clause 11 as follows:
"Article 11. Comprehensive basic investigation planning for water resources"
1. Comprehensive basic investigation planning for water resources is a technical and specialized planning. The preparation of comprehensive basic investigation planning for water resources must meet the following requirements:
a) Meet the needs for building strategies, plans for economic and social development, national defense, security, overall national planning, regional planning, and water resource strategies;
b) Serve as a basis for activities related to basic investigations of water resources.
2. The basis for preparing comprehensive basic investigation planning for water resources includes:
a) Strategies, plans for economic and social development, national defense, security, and water resource strategies;
b) Higher-level plans;
c) Results from implementing comprehensive basic investigation planning for water resources in previous periods.
3. Comprehensive basic investigation planning for water resources includes the following main contents:
a) Determine the requirements for information and data on water resources, exploitation, and utilization of water resources nationwide;
b) Review and evaluate the results of basic investigations or the implementation of comprehensive basic investigation planning for water resources in previous periods;
c) Determine the basic investigation activities that need to be carried out in river basins, regions, and water sources subject to basic investigation during the planning period;
d) Determine the priority order of the basic investigation activities specified in point c of this clause;
đ) Solutions, funding, plans, and schedules for implementation.
4. The planning period for comprehensive basic investigation planning for water resources is 10 years, with a vision of 20 years."
3. Amend and supplement point a of Clause 1 Article 14 as follows:
"a) Consistent with the national strategies and plans for economic and social development, national defense, and security; overall national planning;"
4. Amend and supplement Article 15 as follows:
"Article 15. Planning for water resources"
1. Planning for water resources includes:
a) Water resources planning is a sectoral national planning;
b) Comprehensive planning for inter-provincial river basins and inter-provincial water sources is a technical and specialized planning that details the overall national planning, water resources planning, regional planning, and is prepared for a 10-year period with a vision of 20 to 30 years;
c) Protection, exploitation, and utilization planning for inter-national water sources is a technical and specialized planning prepared when there is cooperation among countries sharing the same water source, and the content of the planning must be based on agreements between countries sharing the same water source.
2. The objects of planning for water resources are surface water and groundwater.
3. Provincial People's Committees direct specialized agencies on water resources to organize the development of exploitation, utilization, protection plans for water resources and measures to mitigate adverse effects caused by water in provincial planning based on national planning, regional planning, comprehensive planning for inter-provincial river basins, and inter-provincial water sources.
5. Amend and supplement Article 16 as follows:
"Article 16. Principles for planning water resources"
1. The preparation of water resources planning, comprehensive planning for inter-provincial river basins, and inter-provincial water sources must comply with the laws on planning and the following principles:
a) Ensure comprehensiveness between surface water and groundwater, between the exploitation and utilization of water resources and their protection, prevention, and mitigation of adverse effects caused by water;
b) Ensure harmonious distribution of benefits from water use among localities, sectors, and between upstream and downstream areas;
c) Ensure the basis on the results of basic investigations of water resources.
2. The preparation of protection, exploitation, and utilization planning for inter-national water sources must comply with agreements between countries sharing the same water source and the principles stipulated in points a and b of Clause 1 of this Article.
3. In cases where the content of water resource exploitation and utilization in planning conflicts with approved comprehensive planning for inter-provincial river basins and inter-provincial water sources, it must be adjusted and implemented according to the water resources planning.
Organizations and individuals submit directly or send through postal service or via the Online Public Service Portal 01 set of application documents for issuing, extending, amending, and supplementing permits as stipulated in Article 15 of this Decree to the One-stop Service Center of the People's Committee of provinces and centrally-run cities (or the Receipt and Delivery Department of the Department of Natural Resources and Environment).
"Article 17. Basis for comprehensive planning for inter-provincial river basins and inter-provincial water sources"
1. Water resources strategy, water resources planning.
2. Natural characteristics, socio-economic conditions, and specific circumstances of each river basin, region, actual potential of water sources, and forecast impacts of climate change on water resources.
3. Needs for water exploitation and utilization by sectors and localities and environmental protection.
4. Results of basic investigations of water resources.
5. Standards, technical regulations already issued by competent authorities.
6. Provisions of international treaties to which the Socialist Republic of Vietnam is a member in cases related to inter-national water sources.
7. Approved planning tasks.
7. Repeal Article 18.
8. Amend and supplement Article 20 as follows:
"Article 20. Tasks for comprehensive planning for inter-provincial river basins and inter-provincial water sources"
1. Tasks for comprehensive planning for inter-provincial river basins and inter-provincial water sources include the following contents:
a) A general assessment of natural characteristics, socio-economic conditions, current status of water resources, the situation regarding protection, exploitation, utilization of water resources, prevention, control, and mitigation of adverse effects caused by water;
b) Preliminary determination of the functions of water sources, water usage needs, drainage requirements, issues to be addressed in the protection, exploitation, utilization of water resources, prevention, control, and mitigation of adverse effects caused by water;
c) Determination of the subjects, scope, and content of the comprehensive watershed planning to ensure the functions of water sources and address the issues identified in point b of this clause;
d) Determination of solutions, funding, plans, and timelines for the preparation of the comprehensive watershed planning.
2. The agency responsible for organizing the comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources shall have the responsibility to approve the tasks of preparing such planning.
9. Amend and supplement Article 21 as follows:
"Article 21. Competence to organize the preparation and approval of comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources
1. The Ministry of Natural Resources and Environment shall take the lead and coordinate with the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade, the Ministry of Construction, and other ministries, agencies at the ministerial level, and provincial People's Committees related to organize the comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources to submit to the Prime Minister for approval.
2. Comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources must obtain written opinions from relevant ministries, agencies at the ministerial level, provincial People's Committees, river basin organizations, and related organizations before submitting to the competent authority for approval.
3. The agency organizing the comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources has the right to hire consulting units to prepare the planning.
4. Standards, unit prices, technical regulations, and planning documentation for comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources shall comply with the provisions of the Ministry of Natural Resources and Environment."
10. Amend and supplement Article 22 as follows:
"Article 22. Adjustment of comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources
1. Comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources shall be adjusted in the following cases:
a) There are adjustments in national strategies, socio-economic development plans, defense, security, national-level planning, regional planning, and water resource strategies that change the objectives of the approved planning;
b) The approved planning does not comply with the principles stipulated in Clause 1 of Article 16 of this Law;
c) New national key projects are formed, significantly affecting water resources;
d) There are significant changes in natural conditions affecting water resources.
2. The content of the adjustment of comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources must be consistent with water resource planning, regional planning, and must be based on the results of analyzing and evaluating the implementation of the approved planning, factors influencing the adjustment of planning, ensuring continuity and only adjusting changed contents.
3. The state agency with the authority to approve comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources decides on the adjustment of the approved planning.
4. The preparation, solicitation of opinions, and review for the adjustment of comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources shall be carried out like the preparation of planning.
11. Amend and supplement Article 23 as follows:
"Article 23. Conditions for consulting units preparing comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources
1. Consulting units preparing comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources must have legal personality, meet the quantity and professional capacity conditions of individuals participating in consulting for comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources, management capacity, and appropriate technical conditions for the work undertaken.
2. The Government shall provide detailed regulations on the capacity conditions of consulting units preparing comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources."
12. Amend and supplement Article 24 as follows:
"Article 24. Publicizing and implementing comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources
1. Within no more than 15 days from the date of approval of the planning, the Ministry of Natural Resources and Environment shall organize the publicizing of comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources. The form of publicizing the planning shall be implemented according to the laws on planning.
2. River basin organizations shall be responsible for proposing and recommending to the competent state agencies measures to ensure the implementation of comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources; recommending solutions to issues arising during the implementation of comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources.
3. Organizations, individuals, and community residents shall be provided with opportunities to exercise their rights to supervise and propose measures to implement comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources.
4. The Ministry of Natural Resources and Environment shall be responsible for guiding, inspecting, and organizing the implementation of comprehensive watershed planning for inter-provincial rivers and inter-provincial water sources.
5. For technical and specialized planning involving the exploitation and utilization of water resources prepared by ministries and agencies at the ministerial level, approval letters from the Ministry of Natural Resources and Environment shall be required."
13. Amend and supplement Clause 1 of Article 26 as follows:
"1. Activities related to the exploitation and utilization of water resources must comply with relevant planning as prescribed by the laws on planning; if causing a reduction in the functions of water sources, subsidence, land subsidence, pollution, salinization of water sources, there must be responsibility for remedying the consequences, and if causing damage, compensation must be made according to the provisions of the law."
14. Amend and supplement Clause 2 of Article 47 as follows:
"2. The construction of hydropower projects must be consistent with relevant planning as prescribed by the laws on planning, comply with the provisions of Article 53 of this Law, and other relevant laws."
15. Amend and supplement Clause 2 of Article 48 as follows:
"2. Organizations and individuals are only permitted to use water that meets technical standards and norms regarding water quality for aquaculture. The exploitation and utilization of water resources for aquaculture must be in accordance with relevant planning as prescribed by laws on planning, without causing pollution, degradation, depletion of water sources, obstruction of flow, damage to river structures, hindrance to inland waterway transportation, and without causing salinization of water sources."
16. Amend and supplement Clause 3 of Article 50 as follows:
"3. The construction of waterway transport projects must comply with relevant planning as prescribed by laws on planning."
17. Amend and supplement Clause 3 of Article 52 as follows:
"3. Issuing permits for underground water extraction must be based on water resource planning, comprehensive river basin planning across provinces, inter-provincial water sources, provincial planning, and the results of basic investigations, exploration of underground water, potential, and reserves of underground water, and the provisions stipulated in Clause 4 of this Article."
18. Amend and supplement some clauses and points of Article 53 as follows:
a) Amend and supplement Clause 1 as follows:
"1. Planning as prescribed by laws on planning which includes plans to construct reservoirs on rivers and streams must be consistent with water resource planning, comprehensive river basin planning across provinces, inter-provincial water sources, and must include the following contents:"
a) The necessity to construct reservoirs compared to other engineering solutions to implement the tasks of the planning;"
b) Determining the required flow rate on the river and stream over time downstream of the proposed reservoir;"
c) Determining and prioritizing tasks for each proposed reservoir in the planning and ensuring water supply levels for each task;"
d) Reservoir capacity allocated to perform each task of the reservoir under normal weather conditions and abnormal weather conditions taking into account climate change factors;"
đ) The role of existing reservoirs on the river basin in ensuring the implementation of each task of the proposed reservoir;"
e) During the planning process, opinions from beneficiaries and those at risk due to the exploitation and utilization of water resources caused by the construction of the proposed reservoir must be solicited. All comments must be explained and incorporated into the report submitted to the competent state agency for planning review."
"a) Deposits of microfinance organizations at credit institutions, branches of foreign banks, except deposits at credit institutions under special control according to Clause 9, Article 174 of the Law on Credit Institutions;"
"a) Consistent with water resource planning, comprehensive river basin planning across provinces, inter-provincial water sources, provincial planning, and other related planning as prescribed by laws on planning;"
19. Amend and supplement Point b of Clause 1 of Article 55 as follows:
"b) Water resource planning, comprehensive river basin planning across provinces, inter-provincial water sources, provincial planning, and other related planning as prescribed by laws on planning, development plans of localities and sectors related to water exploitation and utilization on river basins;"
20. Amend and supplement Points a and b of Clause 2 of Article 70 as follows:
"a) Issue by authority or submit to the competent state agency for issuance and implementation of legal normative documents on water resources; issue technical standards, quotas, unit prices for comprehensive river basin planning across provinces, inter-provincial water sources, overall basic investigation planning of water resources, basic investigation, exploration, exploitation, utilization, protection of water resources;"
b) Organize the preparation, submit to the Prime Minister for approval or approve within authority and organize the implementation of the water resources strategy, water resource planning, comprehensive river basin planning across provinces, inter-provincial water sources, overall basic investigation planning of water resources; inter-reservoir operation procedures, list of river basins, list of water sources; basic investigation plans, regulation, distribution of water resources, restoration of polluted and depleted water sources;"
21. Amend and supplement Point b of Clause 1 of Article 71 as follows:
"b) Organize the preparation and implementation of the content of the plan for water resource exploitation, utilization, protection, and remediation of adverse effects caused by water in provincial planning; basic investigation plans, regulation, distribution of water resources, restoration of polluted and depleted water sources;"
22. Replace the phrase in the name of Chapter II, the name of Section 2 Chapter II, and the following articles and clauses:
a) Replace the phrase "water resource planning" with the phrase "water resource planning and other related planning as prescribed by laws on planning" in Clause 3 of Article 3, Clause 2 and Clause 5 of Article 4, Clause 1 of Article 54;"
b) Replace the phrase "comprehensive river basin planning across provinces, inter-provincial water sources, and provincial water resource planning" with the phrase "comprehensive river basin planning across provinces, inter-provincial water sources" in the title of Article 19; replace the phrase "Comprehensive river basin planning includes" with the phrase "Comprehensive river basin planning across provinces, inter-provincial water sources includes" in Article 19;"
c) Replace the phrase "comprehensive river basin planning" with the phrase "water resource planning and other related planning as prescribed by laws on planning" in Clause 2 of Article 54;"
d) Replace the phrase "water resource planning" with the phrase "planning on water resources" in Clause 10 of Article 9, the title of Chapter II, the title of Section 2 Chapter II.
Article 6. Amending and supplementing certain articles of the Land Law
1. Amend and supplement Chapter IV as follows:
“CHAPTER IV
PLANNING AND LAND USE PLANS
Article 35. Principles for establishing planning and land use plans
1. The establishment of land use planning must comply with the provisions of the law on planning and the following principles:
a) National land use planning must ensure the specificity and connectivity of regions; land use planning at the district level must reflect the content of land use at the commune level;
b) Strictly protect specialized rice-growing land, protective forest land, and special-use forest land;
c) Ensure balance between the land use needs of various sectors, fields, and localities and the country's capacity and land fund to use land efficiently and economically;
d) Reasonably exploit natural resources; adapt to climate change;
đ) The content of allocation and land use in national sectoral planning, regional planning, and provincial planning must be consistent with the national land use planning.
2. The establishment of land use plans must comply with the following principles:
a) Consistent with economic and social development strategies and plans, national defense, and security;
b) Land use plans must be consistent with approved land use planning at the same level by competent state agencies; for provincial land use plans, they must be consistent with land allocation and zoning schemes in provincial planning;
c) Use land efficiently and economically;
d) Reasonably exploit natural resources and protect the environment; adapt to climate change;
đ) Protect and restore historical and cultural relics, scenic spots;
e) Plans of sectors, fields, and localities using land must be consistent with approved land use planning and plans by competent state agencies.
Article 36. System of land use planning and plans
1. Land use planning includes:
a) National land use planning;
b) District-level land use planning;
c) National defense land use planning;
d) Security land use planning.
For provinces, land allocation and zoning schemes according to functional zones and land types down to each district administrative unit are part of provincial planning.
2. Land use plans include:
a) National land use plan;
b) Provincial land use plan;
c) District-level land use plan;
d) National defense land use plan;
đ) Security land use plan.
Article 37. Planning period for land use planning and plans
1. The planning period for land use planning is ten years. The vision for national land use planning is from thirty to fifty years, and for districts, it is from twenty to thirty years.
2. The planning period for the national land use plan, provincial land use plan, national defense land use plan, and security land use plan is five years; the district-level land use plan is established annually.
Article 38. National land use planning and plans
1. The basis for establishing national land use planning includes the bases stipulated by the law on planning and the following bases:
a) Natural conditions, economic and social conditions;
b) Current land use status, land potential, and results of implementing the previous national land use planning period;
c) Land use needs of various sectors, fields, and provinces.
2. The content of national land use planning shall be implemented in accordance with the provisions of the law on planning.
3. The basis for establishing the national land use plan includes:
a) National land use planning;
b) Five-year and annual national economic and social development plans;
c) Five-year land use needs of various sectors, fields, and provinces;
d) Results of implementing the previous national land use plan period;
đ) Investment capacity and resource mobilization capability to implement the land use plan.
4. The content of the national land use plan includes:
a) Analysis and evaluation of the results of implementing the previous national land use plan period;
b) Determination of the area of each type of land in the national land use planning according to the five-year land use planning periods;
c) Five-year land use plan for each socio-economic region and provincial administrative unit;
d) Implementation solutions for the land use plan.
Article 39. Scheme for Allocation and Zoning of Land by Functional Zones and by Type to Each District within the Provincial Master Plan; Provincial Land Use Plan
1. The basis for establishing the scheme for allocation and zoning of land by functional zones and by type to each district within the provincial master plan includes the bases for planning as prescribed by laws on planning and the following bases:
a) Potential of land and results of implementing the provincial land use scheme in the previous period;
b) Demand for land use of sectors and fields, at provincial and district levels;
c) Land use standards;
d) Scientific and technological progress related to land use
2. The contents of the scheme for allocation and zoning of land by functional zones and by type to each district within the provincial master plan shall be implemented in accordance with the provisions of laws on planning.
3. The bases for establishing the provincial land use plan include:
a) National land use plan; contents of allocation and zoning of land in the provincial master plan;
b) Five-year and annual socio-economic development plans of the province;
c) Demand for land use over five years of sectors and fields, at provincial and district levels;
d) Results of implementing the provincial land use plan in the previous period;
đ) Investment capacity and resource mobilization capability to implement the land use plan.
4. The contents of the provincial land use plan include:
a) Analysis and evaluation of the results of implementing the provincial land use plan in the previous period;
b) Determination of the area of each type of land according to the scheme for allocation and zoning of land in the provincial master plan during the planning period, annually and for each district;
c) Determination of the area of each type of land that needs to change land use purpose as stipulated in points a, b, c, d, and e of Clause 1, Article 57 of this Law during the planning period, annually and for each district;
d) Determination of the scale, location of national and provincial projects using land for purposes specified in Articles 61 and 62 of this Law during the planning period, annually and for each district. For infrastructure construction projects, urban renovation projects, and rural residential areas, the location and area of land to be reclaimed in the surrounding area for auctioning land use rights for housing, commercial, service, production, and business projects must also be determined simultaneously;
đ) Preparation of a map of the provincial land use plan;
e) Measures to implement the provincial land use plan.
Article 40. Planning and Land Use Plan at the District Level
1. The bases for establishing the land use planning at the district level include:
a) Provincial master plan;
b) Natural conditions, socio-economic conditions of the district, town, city under the province;
c) Current land use status, potential of land, and results of implementing the district land use planning in the previous period;
d) Demand for land use of sectors and fields, at district and commune levels;
đ) Land use standards;
e) Scientific and technological progress related to land use.
2. The contents of the land use planning at the district level include:
a) Orientation for land use over ten years;
b) Determination of land use indicators by type of land including indicators allocated by the provincial master plan for the district and indicators based on the demand for land use of the district and commune;
c) Determination of land use areas by function to each commune;
d) Determination of the area of each type of land as specified in point b of this clause for each commune;
đ) Preparation of a map of the district land use planning; for areas planned for rice cultivation and areas planned for changing land use purpose as stipulated in points a, b, c, d, and e of Clause 1, Article 57 of this Law, detailed to each commune;
e) Measures to implement the land use planning.
3. The bases for establishing the district land use plan include:
a) Provincial land use plan;
b) District-level land use planning;
c) Demand for land use in the planning year of sectors and fields, at district and commune levels;
d) Capacity for investment and mobilization of resources to implement the land use plan.
4. The contents of the district land use plan include:
a) Analysis and evaluation of the results of implementing the land use plan in the previous year;
b) Determination of the area of each type of land allocated in the provincial land use plan and the area of each type of land based on the demand for land use of the district and commune in the planning year;
c) Determination of the location and area of land to be reclaimed for implementing projects using land for purposes specified in Articles 61 and 62 of this Law in the planning year for each commune. For infrastructure construction projects, urban renovation projects, and rural residential areas, the location and area of land to be reclaimed in the surrounding area for auctioning land use rights for housing, commercial, service, production, and business projects must also be determined simultaneously;
d) Determination of the area of each type of land that needs to change land use purpose for types of land requiring permission as stipulated in points a, b, c, d, and e of Clause 1, Article 57 of this Law in the planning year for each commune;
đ) Preparation of a map of the annual district land use plan; for areas planned for changing land use purpose as stipulated in points a, b, c, d, and e of Clause 1, Article 57 of this Law, detailed to each commune;
e) Measures to implement the provincial land use plan.
5. For districts that have urban planning approved by competent state agencies, there is no need to establish land use planning but must establish an annual land use plan; if the district's urban planning does not match the area allocated in the provincial master plan, it must be adjusted to align with the provincial master plan.
Article 41. Defense land planning and security land planning, defense land use plan, security land use plan
1. The basis for establishing defense land use planning and security land use planning includes the provisions of the law on planning and the following bases:
a) Natural conditions, economic and social conditions;
b) Current land use status, land potential, and results of implementing defense land use planning and security land use planning in the previous period;
c) Defense and security land use needs;
d) Land use standards.
2. The content of defense land use planning and security land use planning shall be carried out in accordance with the provisions of the law on planning.
3. The basis for establishing defense land use plans and security land use plans includes:
a) National land use plan, defense land planning, security land planning;
b) Five-year defense and security land use needs;
c) Results of implementing defense land use plans and security land use plans in the previous period;
d) Investment capacity and resource mobilization to implement defense land use plans and security land use plans.
4. The content of defense land use plans and security land use plans includes:
a) Analysis and evaluation of the results of implementing defense land use plans and security land use plans in the previous period;
b) Determining areas and land areas to be used for defense and security purposes during the five-year planning period and specifically each year;
c) Specifically determining the location and area of defense land and security land to be transferred back to local management during the five-year planning period;
d) Solutions to implement defense land use plans and security land use plans.
Article 42. Responsibilities for organizing land use planning and plans
1. The Government organizes the establishment of national land use planning and plans. The Ministry of Natural Resources and Environment takes the lead in assisting the Government in establishing national land use planning and plans.
2. Provincial People's Committees organize the allocation and zoning of land according to functional zones and land types down to each district administrative unit within provincial planning, organize provincial land use plans; District People's Committees organize district land use planning and plans.
Provincial land management agencies are responsible for allocating and zoning land according to functional zones and land types down to each district administrative unit within provincial planning, establish provincial land use plans; district land management agencies are responsible for establishing district land use planning and plans.
3. The Ministry of National Defense organizes the establishment of defense land use planning and plans; The Ministry of Public Security organizes the establishment of security land use planning and plans.
4. The organization of national land use planning, defense land use planning, security land use planning, allocation and zoning of land according to functional zones and land types down to each district administrative unit within provincial planning shall be carried out in accordance with the provisions of the law on planning.
5. The Government shall provide detailed regulations on this matter.
Article 43. Soliciting opinions on land use planning
1. Soliciting opinions on national land use planning, defense land use planning, and security land use planning shall be carried out in accordance with the provisions of the law on planning.
2. Soliciting opinions on district land use planning shall be carried out as follows:
a) The district People's Committee is responsible for soliciting opinions on district land use planning;
b) Soliciting contributions from agencies, organizations, individuals, and community residents on district land use planning shall be conducted through organizing meetings, direct solicitation, and publicly disclosing information about the content of district land use planning on the websites of the provincial People's Committee and the district People's Committee;
c) The content of soliciting opinions on district land use planning includes planning indicators for land use and projects to be implemented during the land use planning period;
d) The time for soliciting opinions on district land use planning is thirty days from the date the competent state agency decides to organize the solicitation of opinions;
đ) The district People's Committee is responsible for compiling a comprehensive report, incorporating, explaining public opinions, and perfecting the district land use planning proposal before submitting it to the district land use planning review board.
Article 44. Review of land planning and land use plans
1. The review of national land use planning, defense land use planning, security land use planning shall be carried out in accordance with the provisions of the law on planning.
2. The authority to establish the National Land Use Plan Review Board, defense land use plan review board, security land use plan review board, provincial land use plan review board, district-level land use planning and land use plan review board is stipulated as follows:
a) The Prime Minister establishes the National Land Use Plan Review Board.
The Ministry of Natural Resources and Environment is responsible for assisting the Review Board during the review process of the national land use plan;
b) The Minister of Natural Resources and Environment establishes the Defense Land Use Plan Review Board, Security Land Use Plan Review Board, Provincial Land Use Plan Review Board.
Central land management agencies are responsible for assisting the Review Board during the review process of land use plans;
c) The Chairman of the People's Committee at the provincial level establishes the District-Level Land Use Planning and Land Use Plan Review Board.
Provincial and district-level land management agencies are responsible for assisting the Review Board during the review process of district-level land use planning and land use plans.
3. The Review Boards established under Clause 2 of this Article are responsible for reviewing and sending notification of the results of the review of land use planning and land use plans to the competent agencies organizing the land use planning and land use plans as stipulated in Article 42 of this Law. The agencies organizing the land use planning and land use plans are responsible for incorporating and explaining according to the content of the notification of the results of the review of land use planning and land use plans.
In cases where necessary, the Review Board organizes inspections and field surveys of areas proposed for land use purpose conversion, especially the conversion of rice cultivation land, protective forest land, special-use forest land.
4. The contents of the review of district-level land use planning include:
a) Legal and scientific basis for establishing land use planning;
b) The degree of compatibility of the land use planning scheme with economic and social development strategies, national-level planning, regional planning, provincial planning;
c) Economic and social efficiency, environmental impact;
d) Feasibility of the land use planning scheme.
5. The contents of the review of land use plans include:
a) The degree of compatibility of the land use plan with the land use planning;
b) The degree of compatibility of the land use plan with the economic and social development plan;
c) Feasibility of the land use plan.
6. The budget for organizing the review of the national land use plan, defense land use plan, security land use plan, provincial land use plan, district-level land use planning and land use plan is determined as a separate item in the budget for establishing the land use plan and land use planning accordingly.
Article 45. Authority to decide and approve land use planning and land use plans
1. Authority to decide and approve land use planning:
a) The decision and approval of the national land use planning, defense land use planning, security land use planning shall be carried out in accordance with the provisions of the law on planning;
b) The People's Committee at the provincial level approves the district-level land use planning.
The People's Committee at the district level submits the district-level land use planning to the People's Council at the same level for approval before submitting it to the People's Committee at the provincial level for approval.
2. Authority to decide and approve land use plans:
a) The National Assembly decides the national land use plan;
b) The Prime Minister approves the defense land use plan, security land use plan, provincial land use plan;
c) The People's Committee at the provincial level approves the district-level land use plan.
The People's Committee at the provincial level submits the list of projects requiring land acquisition as stipulated in Clause 3 of Article 62 of this Law to the People's Council at the same level for approval before approving the district-level land use plan.
Article 46. Adjustment of Land Use Planning and Plan
1. The adjustment of national land use planning, defense land use planning, and security land use planning shall be carried out in accordance with the provisions of the law on planning.
2. The adjustment of district-level land use planning shall be implemented when there is one of the following bases:
a) There is an adjustment to the national economic and social development strategy, national defense, and security strategy, national planning, regional planning, or provincial planning that changes the structure of land use.
b) Due to the impact of natural disasters or war, which alters the purpose, structure, location, or area of land use.
c) There is an adjustment to the administrative boundaries of the locality.
3. The adjustment of the land use plan can only be implemented when there is an adjustment to the land use planning or a change in the ability to implement the land use plan.
4. The content of the adjustment to the land use planning is part of the land use planning that has been decided and approved. The content of the adjustment to the land use plan is part of the land use plan that has been decided and approved.
The adjustment of district-level land use planning and land use plans shall be carried out in accordance with Articles 42, 43, 44, and 48 of this Law.
5. The state agency authorized to decide and approve the land use planning and plan at a certain level shall have the authority to decide and approve the adjustment of the land use planning and plan at that level.
Article 47. Consulting for the Preparation of Land Use Planning and Plan
1. During the process of preparing land use planning and plan, the agency responsible for the main preparation of the land use planning and plan may hire consultants to prepare the land use planning and plan.
2. The selection of consultants for the preparation of national land use planning, defense land use planning, and security land use planning shall be carried out in accordance with the provisions of the law on planning.
3. The Government shall stipulate the conditions for organizations and individuals engaged in consulting for the preparation of district-level land use planning and land use plans.
Article 48. Public Disclosure of Land Use Planning and Plan
1. The public disclosure of national land use planning, defense land use planning, and security land use planning shall be carried out in accordance with the provisions of the law on planning.
2. All contents of the district-level land use planning after being approved by the competent state agency must be publicly disclosed according to the following regulations:
a) The People's Committee of the district shall be responsible for publicly disclosing the district-level land use planning at its office and on the electronic portal of the People's Committee of the district; and publicly disclose the content of the district-level land use planning related to communes, wards, and towns at the office of the People's Committee of the commune.
b) The public disclosure must be completed no later than fifteen days from the date of approval by the competent state agency.
c) The public disclosure must be maintained throughout the period of the land use planning.
3. All contents of the land use plan after being decided and approved by the competent state agency must be publicly disclosed according to the following regulations:
a) The Ministry of Natural Resources and Environment shall be responsible for publicly disclosing the national land use plan at its office and on the electronic portal of the Ministry of Natural Resources and Environment; the People's Committee of the province shall be responsible for publicly disclosing the provincial land use plan at its office and on the electronic portal of the People's Committee of the province; the People's Committee of the district shall be responsible for publicly disclosing the district-level land use plan at its office and on the electronic portal of the People's Committee of the district, and publicly disclose the content of the district-level land use plan related to communes, wards, and towns at the office of the People's Committee of the commune.
b) The public disclosure must be completed no later than fifteen days from the date of decision and approval by the competent state agency.
c) The public disclosure must be maintained throughout the period of the land use plan.
Article 49. Implementation of land use planning and plans
1. The implementation of national land use planning, defense land use planning, and security land use planning shall be carried out in accordance with the provisions of the law on planning and other relevant laws.
2. The Government organizes and directs the implementation of the national land use plan.
3. The Prime Minister allocates land use targets for provinces and centrally governed cities, the Ministry of National Defense, and the Ministry of Public Security based on the national land use targets decided by the National Assembly.
4. Provincial and district People's Committees are responsible for implementing land use planning and plans at the local level.
5. Commune People's Committees are responsible for implementing land use planning and plans within their communes.
6. The Ministry of National Defense and the Ministry of Public Security are responsible for implementing defense land use plans and security land use plans.
7. In cases where land use planning has been announced but there is no annual land use plan at the district level, land users may continue to use the land and exercise their rights as land users as provided by law.
If there is an annual land use plan at the district level, land users in the area must change the purpose of land use and have land recovered according to the plan; they may continue to exercise their rights as land users but may not build new houses or structures, nor plant perennial crops; if land users need to renovate or repair existing houses or structures, they must obtain permission from competent state authorities in accordance with the law.
8. The area of land recorded in the annual land use plan of the district that has been announced and must be recovered for a project or changed in land use purpose, but has not received a decision on land recovery or permission to change land use purpose within three years, the state authority approving the land use plan must adjust, revoke, and announce the adjustment or revocation of the land recovery or change in land use purpose for the recorded land area in the land use plan.
If the state authority approving the land use plan does not make adjustments or revocations, or makes adjustments or revocations but does not announce them, the land user will not be restricted in their rights as stipulated in Clause 7 of this Article.
9. At the end of the land use planning period, if the planning targets have not been fully implemented, they will continue to be implemented until the next land use planning period is decided and approved by the competent state authority.
10. The Government shall provide detailed regulations on organizing the implementation of land use planning and plans.
Article 50. Reporting on the Results of Implementing Land Use Planning and Plans
1. Reporting on the results of implementing national land use planning, defense land use planning, security land use planning, and land allocation and zoning schemes in provincial planning shall be carried out in accordance with the provisions of the law on planning.
2. Commune and district People's Committees are responsible for sending reports on the results of implementing land use planning and plans to the higher-level People's Committee; before October 31 each year, provincial People's Committees are responsible for sending reports on the results of implementing land use planning and plans to the Ministry of Natural Resources and Environment.
3. The Ministry of Natural Resources and Environment shall have the following responsibilities:
a) Report on the results of implementing land use planning in accordance with the provisions of the law on planning;
b) Aggregate the results of implementing the national land use plan to report to the Government in the final year of the land use plan period.
Article 51. Resolution of Planning and Land Use Plans Arising from January 1, 2019
1. The continuation processing of national land use planning, defense land use planning, security land use planning, provincial land use planning decided, approved before January 1, 2019, or established, reviewed before January 1, 2019 but not yet decided or approved shall be carried out in accordance with the laws on planning.
2. Land use plans decided and approved by competent state agencies before January 1, 2019 shall be implemented until the end of the land use plan period, except for cases provided for in Article 46 of this Law.
3. District-level land use planning and land use plans that have been initiated to establish, adjust, review before January 1, 2019 shall continue to be established, adjusted, reviewed, and approved according to the Land Law No. 45/2013/QH13 and detailed regulations of the Land Law No. 45/2013/QH13, but must be approved before July 1, 2019.”
2. Amend and supplement Clause 1 of Article 151 as follows:
“1. Land used for economic zones includes land for establishing economic zones, border economic zones established by the Prime Minister's decision. Land used for economic zones is the area of land used for functional zones including: duty-free zones, bonded zones, export processing zones, industrial zones, entertainment zones, tourist zones, urban zones, residential zones, administrative zones, and other functional zones suitable for the characteristics of each economic zone to create a particularly favorable investment and business environment for investors.”
3. Replace the phrase "national level" with "national" in Clause 1 of Article 21.
Article 7. Amend and Supplement Some Articles of the Environmental Protection Law
1. Amend and supplement Clause 21 of Article 3 as follows:
“21. Environmental protection planning is sectoral national planning, spatial arrangement, environmental zoning, natural conservation and biodiversity management, waste management, environmental monitoring and warning on defined territory to protect the environment, serving the sustainable development goals of the country for a defined period.”
2. Amend and supplement Article 8 as follows:
“Article 8. Basis for Establishing and Period of Environmental Protection Planning
1. The basis for establishing environmental protection planning includes the bases prescribed by the law on planning and the following bases:
a) Environmental protection strategy in the same development phase;
b) Climate change scenarios in the same development phase.
2. The period of environmental protection planning is 10 years, with a vision from 30 to 50 years.”
3. Amend and supplement Article 9 as follows:
“Article 9. Environmental Protection Planning and Environmental Protection Content in Regional Planning and Provincial Planning
1. The establishment, review, approval, adjustment of environmental protection planning, the construction of environmental protection content in regional planning and provincial planning must comply with the provisions of the law on planning.
2. The Ministry of Natural Resources and Environment organizes the establishment of environmental protection planning; constructs environmental protection content in regional planning; guides provinces and centrally-administered cities to construct environmental protection content in provincial planning.
3. Specialized agencies for environmental management at the provincial level are responsible for constructing environmental protection content in provincial planning.”
4. Amend and supplement Clause 1 of Article 13 as follows:
“1. Subjects required to implement strategic environmental assessment include:
a) National resource exploitation and utilization strategies; national-scale industry and sector development strategies with significant impacts on the environment;
b) National overall planning; national marine space planning; national land use planning; national sectoral planning; urban planning; rural planning; and technical and specialized planning with significant impacts on the environment; regional planning; provincial planning; special administrative-economic unit planning;
c) Adjustments to the strategies and plans under points a and b of this clause that change the objectives of the strategies and plans must undergo strategic environmental assessment.”
5. Amend and supplement Point a of Clause 3 of Article 21 as follows:
“a) Consistent with the decision approving the environmental impact assessment report for the initial stage of infrastructure construction in concentrated production, business, and service areas;”
6. Amend and supplement Article 40 as follows:
“Article 40. Integration of Climate Change Response Content into Strategic and Planning Systems
1. Climate change response content must be reflected in the strategic and planning systems within the scope of subjects required to implement strategic environmental assessment as stipulated in Article 13 of this Law.
2. The integration of climate change response content into strategic and planning systems must be based on the assessment of the mutual impacts between the activities of the strategies and plans and the environment, climate change, and the development of a system of environmental protection and climate change response solutions.”
7. Amend and supplement Clause 5 of Article 49 as follows:
“5. Strategies and plans for exploiting marine resources, island resources, nature reserves, mangrove forests, and natural heritage sites must be consistent with environmental protection strategies and plans.”
8. Amend and supplement Clause 1 of Article 74 as follows:
“1. Transportation activities must comply with the provisions of the law on environmental protection.”
9. Amend and supplement Clause 1 of Article 88 as follows:
“1. Establish, approve, and organize the implementation of planning related to technical infrastructure for waste treatment on the local area.”
10. Amend and supplement Article 94 as follows:
“Article 94. Hazardous Waste Management in Environmental Protection Planning
Hazardous waste management is a component of environmental protection planning and is implemented in accordance with the laws on planning, environmental protection laws, and international treaties to which the Socialist Republic of Vietnam is a member.”
11. Amend and supplement Article 98 as follows:
“Article 98. Solid Waste Management in Environmental Protection Planning
Solid waste management is a component of environmental protection planning and is implemented in accordance with the laws on planning and environmental protection laws.”
12. Add Article 121a after Article 121 as follows:
"Article 121a. National Environmental Monitoring Master Plan
1. The National Environmental Monitoring Master Plan is a technical and specialized plan comprising the following main contents:
a) Analysis and evaluation of the current status of the national environmental monitoring network; laboratory system, environmental analysis system, and data management system for environmental monitoring;
b) Views, objectives, and selection of options for the National Environmental Monitoring Master Plan that are appropriate to environmental zoning, monitoring, and early warning directions within the environmental protection planning;
c) Layout of the national environmental monitoring network, including guidance on points, parameters, and frequency of land, water, and air environmental monitoring across the country and automatic monitoring stations; guidance on the development of the laboratory system, environmental analysis system, and data management system for environmental monitoring;
d) List of national environmental monitoring projects;
đ) Guidance on linking the national environmental monitoring network, database, and monitoring data with provincial monitoring networks, databases, and monitoring data, and connecting the monitoring network;
e) Implementation roadmap and resources for the master plan.
2. The Ministry of Natural Resources and Environment shall establish, review, and submit the National Environmental Monitoring Master Plan to the Prime Minister for approval. Provinces and centrally governed cities shall build environmental monitoring networks in accordance with provincial plans, ensuring connectivity, hierarchical division, and coordination."
13. Amend Clause 10 of Article 141 as follows:
"10. Participate in building the national master plan and regional plans; direct and guide the establishment of environmental protection content in provincial plans and special administrative-economic units."
14. Amend Point a of Clause 3 of Article 142 as follows:
"a) The Minister of Planning and Investment shall take the lead and coordinate with the Minister of Natural Resources and Environment, other ministers, and chairpersons of provincial people's committees to ensure environmental protection requirements in the national economic and social development strategy and plan, the national master plan, regional plans, projects, and works under the jurisdiction of the National Assembly, Government, Prime Minister, investment attraction activities, and organize the implementation of environmental protection laws in their respective fields;"
15. Amend Point đ of Clause 1 of Article 143 as follows:
"đ) Organize the review and approval of environmental impact assessment reports, confirmation of completion of environmental protection works, provide guidance and organize inspections to confirm environmental protection plans according to their authority;"
16. Repeal Articles 10, 11, 12, and Clause 1 of Article 52.
Article 8. Amend and supplement some articles of the Law on Minerals
1. Add Clause 8 to Article 2 as follows:
“8. Mineral Planning includes basic geological survey planning for minerals; exploration, exploitation, processing, and utilization planning for mineral types; exploration, exploitation, processing, and utilization planning for radioactive ores; exploration, exploitation, processing, and utilization planning for construction materials."
2. Amend and supplement Clause 1 of Article 4 as follows:
"1. Mineral activities must be consistent with the national mineral strategy, provincial mineral protection, exploration, exploitation, and utilization plans, and be linked with environmental protection, natural scenery, historical and cultural relics, scenic spots, and other natural resources; ensure national defense, security, public order, and social safety;"
3. Amend and supplement Point a of Clause 1 of Article 9 as follows:
"a) Consistent with the national economic and social development strategy and plan, national defense and security, and the national master plan;"
4. Amend and supplement Article 11 as follows:
"Article 11. Basic Geological Survey Planning for Minerals
1. Basic geological survey planning for minerals is a national industry planning.
2. The basis for establishing basic geological survey planning for minerals includes the bases stipulated by the law on planning and the following bases:
a) Results of implementing previous basic geological survey planning for minerals;
b) Geological premises and signs related to newly discovered minerals.
3. The establishment, review, approval, publication, and organization of implementation of basic geological survey planning for minerals must comply with the provisions of the law on planning."
5. Amend and supplement Article 13 as follows:
"Article 13. Exploration, Exploitation, Processing, and Utilization Planning for Mineral Types, Radioactive Ores, and Construction Materials
1. Exploration, exploitation, processing, and utilization planning for mineral types, radioactive ores, and construction materials is a national industry planning.
2. The basis for establishing exploration, exploitation, processing, and utilization planning for mineral types, radioactive ores, and construction materials includes the bases stipulated by the law on planning and the following bases:
a) Demand for minerals from various economic sectors;
b) Results of basic geological surveys for minerals;
c) Progress in science and technology in mineral exploration and exploitation;
d) Results of implementing previous planning periods; results of strategic environmental assessments as prescribed by environmental protection laws.
3. The establishment, review, approval, publication, and organization of implementation of exploration, exploitation, processing, and utilization planning for mineral types, radioactive ores, and construction materials must comply with the provisions of the law on planning."
6. Amend and supplement Article 14 as follows:
"Article 14. Adjustment of Mineral Planning
The adjustment of mineral planning shall be carried out when there is one of the following bases:
1. One of the bases for adjusting planning as prescribed by the law on planning;
2. New discoveries about minerals affecting the nature and content of the planning."
3. In case the situation provided for in Clause 4, Article 28 of this Law occurs.”
7. Amend and supplement Clause 3, Article 17 as follows:
“3. The agency organizing the preparation of regional construction planning involving multiple districts, district-level regional construction planning, general urban planning, and rural residential area construction planning shall submit along with the approval request the written opinion of the competent state management agency authorized to issue permits as stipulated in Article 82 of this Law.”
8. Amend and supplement Clause 1, Article 26 as follows:
“1. A mineral resource operation area is an area where minerals have been subject to basic geological surveys on minerals and delineated by a competent state agency within relevant planning as prescribed by laws on planning.”
9. Amend and supplement Clause 4, Article 28 as follows:
“4. In cases where it is necessary to conduct exploration or exploitation of minerals in areas prohibited from mineral activities or temporarily prohibited from such activities, the competent state agency authorized to issue permits as stipulated in Article 82 of this Law must report to the Prime Minister for consideration and decision on adjusting relevant planning as prescribed by laws on planning.”
10. Amend and supplement Point b, Clause 2, Article 40 as follows:
“b) Have an exploration plan that is consistent with relevant planning as prescribed by laws on planning; for hazardous minerals, written permission from the Prime Minister is also required;”
11. Amend and supplement Point b, Clause 1, Article 47 as follows:
“b) An exploration plan for minerals that is consistent with relevant planning as prescribed by laws on planning;”
12. Amend and supplement Point a, Clause 2, Article 53 as follows:
“a) Have a mining investment project in an area that has been explored and approved for reserves, consistent with relevant planning as prescribed by laws on planning. Such a mining investment project must include a human resources utilization plan, equipment, technology, and advanced extraction methods suitable for the purpose; for hazardous minerals, written permission from the Prime Minister is also required;”
13. Amend and supplement some Clauses and Points of Article 80 as follows:
a) Amending and supplementing point b Clause 2 as follows:
“b) Develop and submit to the Prime Minister for approval a mineral strategy; organize the preparation of geological survey planning on minerals and submit to the Prime Minister for approval according to laws on planning;”
b) Amend and supplement Clause 3 as follows:
“3. Ministries and ministerial-level agencies within their respective functions and powers shall implement state management and coordinate with the Ministry of Natural Resources and Environment in managing minerals.
The Ministry of Industry and Trade shall organize the preparation of planning for exploration, exploitation, processing, and utilization of various types of minerals, including radioactive ore exploration, exploitation, processing, and utilization planning, and submit to the Prime Minister for approval according to laws on planning.
The Ministry of Construction shall organize the preparation of planning for exploration, exploitation, processing, and utilization of construction materials, and submit to the Prime Minister for approval according to laws on planning.”
14. Amend and supplement Point c, Clause 1, Article 81 as follows:
“c) Develop the content of the protection, exploration, exploitation, and utilization of mineral resources plan in provincial planning to be submitted to the competent authority for approval;”
15. Repeal Articles 10, 12, and 15.
Article 9. Amending and supplementing certain articles of the Law on Meteorology and Hydrology
1. Amend and supplement Article 11 as follows:
"Article 11. National network planning for meteorological and hydrological stations
1. The national network planning for meteorological and hydrological stations is a national sectoral planning.
2. The establishment of the national network planning for meteorological and hydrological stations must comply with the provisions of the law on planning and the following principles:
a) Ensuring that observations on the network reflect the spatial and temporal changes of the meteorological and hydrological factors to be observed, meeting the purposes of exploiting and using meteorological and hydrological information and data, serving the provision of national weather and climate basic data sets, meteorological and hydrological forecasting and warning activities, risk assessment and zoning of meteorological and hydrological disasters, monitoring of meteorological and hydrological disasters, climate change, ensuring national defense and security, and socio-economic development;
b) Ensuring uniformity and synchronization, meeting the requirements for data sharing among observation networks, effectively and economically utilizing state budget funds.
3. The bases for establishing the national network planning for meteorological and hydrological stations include the bases prescribed by the law on planning and the following bases:
a) The national strategy on climate change; the national strategy on disaster prevention and control; the national strategy on water resources; the national strategy on the development of information technology and telecommunications; the national land use planning; the national marine space planning; the information and communication infrastructure planning and other relevant strategies and plans;
b) The results of implementing the development strategy of the meteorological and hydrological sector, the national strategy on climate change, the national network planning for meteorological and hydrological stations in the previous period, the results of activities assessing, evaluating, and zoning meteorological and hydrological disaster risks, and the needs for exploiting and using meteorological and hydrological information and data for related sectors, fields, and localities;
c) Scientific and technological progress in observation, measurement, transmission, forecasting, warning of meteorological and hydrological conditions, and monitoring of climate change.
4. The planning period, planning content, and adjustment of the national network planning for meteorological and hydrological stations shall be carried out in accordance with the provisions of the law on planning.
5. The Ministry of Natural Resources and Environment shall organize the establishment of the national network planning for meteorological and hydrological stations and submit it to the Prime Minister for approval in accordance with the provisions of the law on planning."
2. Supplementing point d of Clause 5, Article 32 as follows:
"d) Serving the planning activities in accordance with the provisions of the law on planning."
3. Amending and supplementing point d of Clause 2, Article 52 as follows:
"d) The Minister of Information and Communications shall take the lead and coordinate with the Minister of Natural Resources and Environment to organize planning, prioritizing frequency allocation for meteorological and hydrological work and climate change monitoring in accordance with this Law and the law on radio frequencies; developing comprehensive strategies for the development of telecommunication and information technology infrastructure and information and communication infrastructure planning suitable for meteorological and hydrological activities; directing the publication of meteorological and hydrological information and data, and climate change monitoring on mass media in accordance with this Law and the law on press."
Article 10. Amending and supplementing certain articles of the Law on Biological Diversity
1. Supplement Clause 31 to Article 3 as follows:
“31. Comprehensive conservation planning for biological diversityis a national sectoral plan, arranging and distributing spatially areas with high biological diversity, important ecological landscapes, biodiversity corridors, natural reserves, and biodiversity conservation facilities within a defined territory to conserve nature and biological diversity for sustainable development goals during a specified period.”
2. Amend and supplement Article 8 as follows:
"Article 8. Basis for establishment and planning period of comprehensive conservation planning for biological diversity
1. The basis for establishing comprehensive conservation planning for biological diversity includes the bases prescribed by laws on planning and the following bases:
a) Environmental protection strategy, biological diversity conservation strategy in the same phase;
b) Environmental protection planning;
c) Results of implementing comprehensive conservation planning for biological diversity in the previous period; current status and trends of biological diversity; actual conditions and needs for exploitation and utilization of biological diversity."
2. The planning period for comprehensive conservation planning for biological diversity is 10 years, with a vision from 30 to 50 years.”
"Article 10. Point calculation for urban classification
"Article 10. Organization of establishment, approval, adjustment of comprehensive conservation planning for biological diversity and content of biological diversity conservation in provincial planning
1. The Ministry of Natural Resources and Environment organizes the establishment and adjustment of comprehensive conservation planning for biological diversity, submits it to the Prime Minister for approval in accordance with the laws on planning; guides provinces and centrally-administered cities to organize the construction of biological diversity conservation content in provincial planning.
2. Provincial People's Committees organize the construction of biological diversity conservation content in provincial planning in accordance with the laws on planning.”
4. Amend and supplement Article 11 as follows:
"Article 11. Announcement, provision of information, implementation, and evaluation of comprehensive conservation planning for biological diversity and content of biological diversity conservation in provincial planning
The announcement, provision of information, implementation, and evaluation of comprehensive conservation planning for biological diversity and content of biological diversity conservation in provincial planning shall be carried out in accordance with the laws on planning.”
5. Replace the phrase "provincial biodiversity conservation planning" with the phrase "content of biological diversity conservation in provincial planning" in Clause 3 of Article 18, Clause 3 of Article 19, Clause 3 of Article 20, and Clause 1 of Article 24.
6. Repeal Article 9 and Section 2 Chapter II.
Article 11. Amending and supplementing certain articles of the Law on Marine and Coastal Resources
1. Amending and supplementing some clauses of Article 3 as follows:
a) Amending and supplementing Clause 5 as follows:
“5. National marine space use planningis a component of the national marine space planning and is implemented in accordance with the laws on planning.”
b) Amend and supplement Clause 7 as follows:
“7. Comprehensive planning for sustainable exploitation and use of coastal resourcesis a national sectoral plan, detailing the national comprehensive planning and national marine space planning, guiding and organizing space for the exploitation and use of various types of resources and environmental protection within the coastal area.”
2. Amend and supplement Article 26 as follows:
"Article 26. Principles and basis for establishment of comprehensive planning for sustainable exploitation and use of coastal resources
1. The establishment of comprehensive planning for sustainable exploitation and use of coastal resources must comply with the provisions of the laws on planning and the following principles:
a) Consistent with the strategy for sustainable exploitation and use of resources, marine and coastal environmental protection, national marine space planning; linked with planning having content on resource exploitation and use, industry-specific planning within the coastal area;
b) Ensuring harmony in resource exploitation and use, environmental protection, and sustainable coastal development; protecting national sovereignty, ensuring national defense and security;
c) Ensuring public access to the sea.
2. The basis for establishing comprehensive planning for sustainable exploitation and use of coastal resources includes the bases prescribed by the laws on planning and the following bases:
a) Natural conditions, socio-economic conditions, and specific characteristics of each area within the coastal zone, resource potential, current coastal environment status; forecast impacts of climate change, sea level rise;
b) Results of basic surveys of coastal resources and environment; statistics of coastal resources;
c) Needs for resource exploitation and use and requirements for coastal environmental protection;
d) Results of implementing comprehensive planning for sustainable exploitation and use of coastal resources in the previous period.”
2. FOR NEWLY STARTED PROJECTS, IN ADDITION TO THE REQUIREMENTS SET OUT IN SUB-CLAUSE 1 OF THIS ARTICLE, THE FOLLOWING REQUIREMENTS MUST ALSO BE MET:
"Article 27. Scope and planning period of comprehensive planning for sustainable exploitation and use of coastal resources
1. Comprehensive planning for sustainable exploitation and use of coastal resources is established for the entire coastal area of the country.
2. The planning period for comprehensive planning for sustainable exploitation and use of coastal resources is 10 years, with a vision of 30 years.”
4. Amend and supplement Clause 1 of Article 28 as follows:
“1. The adjustment of comprehensive planning for sustainable exploitation and use of coastal resources shall be carried out in accordance with the laws on planning.”
5. Amend and supplement Article 29 as follows:
"Article 29. Establishment and approval of comprehensive planning for sustainable exploitation and use of coastal resources
The Ministry of Natural Resources and Environment shall take the lead and coordinate with ministries, agencies at the ministerial level, provincial people's committees of coastal provinces to organize the establishment of comprehensive planning for sustainable exploitation and use of coastal resources, submit it to the Prime Minister for approval in accordance with the laws on planning.”
6. Amend and supplement Article 30 as follows:
"Article 30. Soliciting opinions and announcing comprehensive planning for sustainable exploitation and use of coastal resources
Soliciting opinions and announcing comprehensive planning for sustainable exploitation and use of coastal resources shall be carried out in accordance with the laws on planning.”
7. Amend and supplement Article 31 as follows:
"Article 31. Implementation of comprehensive planning for sustainable exploitation and use of coastal resources
The organization of implementing comprehensive planning for sustainable exploitation and use of coastal resources shall be carried out in accordance with the laws on planning.”
8. Amend and supplement Article 32 as follows:
"Article 32. Relationship between comprehensive planning for sustainable exploitation and use of coastal resources and national sectoral planning, regional planning, provincial planning
1. In case the national industry planning, regional planning, provincial planning contains content related to the exploitation and utilization of coastal resources that conflicts with the approved comprehensive planning for sustainable exploitation and utilization of coastal resources, such planning must be adjusted and implemented according to the national marine space planning, national land use planning, and the overall national planning.
2. Ministries, ministerial-level agencies, and provincial people's committees directly under the central government within their scope of duties and powers shall have the responsibility to review and propose amendments and supplements to the national industry planning, regional planning, and provincial planning related to the exploitation and utilization of coastal resources in accordance with the principle stipulated in Clause 1 of this Article.
9. Amend and supplement Clause 3 of Article 57 as follows:
“3. The marine area designated for disposal must be consistent with the national marine space planning and the comprehensive planning for sustainable exploitation and utilization of coastal resources.”
10. Amend and supplement Point b of Clause 2 of Article 73 as follows:
“b) Develop and submit to the Government for approval and implementation of the strategy for sustainable exploitation and utilization of resources and environmental protection in the marine and island areas; organize the development and submission to the Prime Minister for approval and implementation of the comprehensive planning for sustainable exploitation and utilization of coastal resources and the integrated management program for coastal resources spanning multiple provinces;”
11. Replace the phrase "marine use planning" with "national marine space planning, marine use planning" in Clause 1 of Article 5, Clause 2 of Article 8, Clause 1 of Article 39, Point g of Clause 1 of Article 68, Point b of Clause 1 of Article 74, and Point b of Clause 2 of Article 76.

Article 12. Amend and supplement some articles of the Law on Plant Protection and Quarantine
1. Amend and supplement Point b of Clause 2 of Article 7 as follows:
“b) Develop and direct the implementation of strategies and plans for plant protection and quarantine;”

“a) Issue regulations on plant protection and quarantine within its authority or submit to competent authorities for issuance; establish and organize the implementation of pest-free zones within its jurisdiction;”

1. Amending and supplementing Clause 3 of Article 5 as follows:
“3. Adhere to flood prevention and control planning, flood control planning for dike-protected river systems, and approved dike management planning; ensure systematization, consistency, synchronization, and flood discharge capacity along the entire river system; integrate measures including afforestation and protection of upstream forests, construction of upstream water reservoirs, clearance of obstructions, dredging of riverbeds, ensuring unimpeded flow, and flood diversion and retardation.”

Encourage and create conditions for domestic organizations and individuals, as well as foreign organizations and individuals, to invest in researching and applying advanced science and technology combined with traditional methods in dike construction, repair, upgrading, reinforcement, and protection, and towards proactive solutions in planning activities.”
3. Amending and supplementing Article 8 as follows:
Article 8. Principles and Basis for Developing Flood Prevention Planning for Dike-Protected River Systems
1. The development of flood prevention planning for dike-protected river systems must comply with basic principles of planning as prescribed by law on planning and the following principles:
a) Consistency with the overall national planning; national defense and security objectives; national strategy on disaster prevention and control; flood prevention and control planning and water resource management planning;
b) Ensuring the discharge of designed floods and historical floods of the river system;
c) Ensuring suitability for each region and area across the country and the continuity of flood prevention planning for dike-protected river systems.
2. The basis for developing flood prevention planning for dike-protected river systems includes:
a) Long-term flood forecasts;
b) Natural and socio-economic conditions;
c) Current status of the dike system;
d) Overall national planning, national land use planning, flood prevention and control planning and water resource management planning, and other relevant planning.”
4. Amending and supplementing Article 9 as follows:
Article 9. Content of Flood Prevention Planning for Dike-Protected River Systems
Flood prevention planning for dike-protected river systems is specialized technical planning developed for inter-provincial river systems, mainly comprising the following contents:
1. Determining the direction, goals, and technical standards for flood prevention of the river system to develop and implement flood prevention planning for dike-protected river systems;
2. Determining the designed flood of the river system, including designed flood flow and designed flood level;
3. Determining the technical measures of flood prevention planning for dike-protected river systems, including:
a) Construction of upstream water reservoirs;
b) Afforestation for flood protection in upstream areas and planting trees to protect the dike;
c) Construction and maintenance of dikes;
d) Determination of flood diversion zones, flood retardation zones, and flood discharge capacity into other rivers;
đ) Ensuring unimpeded flow;
e) Organization of management and dike guarding;
4. Anticipating the environmental impact of implementing flood prevention planning for dike-protected river systems and proposing measures to mitigate adverse effects on the environment;
5. Measures for organizing the implementation of flood prevention planning for dike-protected river systems.”
5. Amending and supplementing Clause 1 of Article 10 as follows:
“1. Flood prevention planning for dike-protected river systems must be reviewed every five years or when there are changes due to natural disasters, changes in overall national planning, national defense and security objectives, national strategy on disaster prevention and control, flood prevention and control planning and water resource management planning.”
6. Amending and supplementing Article 12 as follows:
Article 12. Authority for Organizing Development, Approval, and Adjustment of Flood Prevention Planning for Dike-Protected River Systems
1. The Ministry of Agriculture and Rural Development organizes the development and adjustment of flood prevention planning for dike-protected river systems and submits it to the Prime Minister for approval.
2. The Government shall provide detailed regulations on the development, review, approval, and adjustment of flood prevention planning for dike-protected river systems.
7. Amend and supplement Article 13 as follows:
Article 13. Announcement and Implementation of Flood Prevention Planning for Dike-Protected River Systems
1. Within fifteen days from the date of approval of the flood prevention and control plan for the river with dykes, the Ministry of Agriculture and Rural Development shall organize the publication of the flood prevention and control plan for the river with dykes. The form of publication shall be carried out in accordance with the laws on planning.
2. The implementation of the flood prevention and control plan for the river with dykes shall be regulated as follows:
a) The Ministry of Agriculture and Rural Development shall take the lead in coordinating with ministries, ministerial-level agencies, and provincial People's Committees to implement the flood prevention and control plan for the river with dykes;
b) Provincial People's Committees shall be responsible for organizing the establishment and reviewing the contents of the flood prevention and control plans for the river with dykes within their management scope in the provincial planning in accordance with the laws on planning;
c) Based on the approved flood prevention and control plan for the river with dykes by competent state agencies, ministries, ministerial-level agencies, and provincial People's Committees related to the plan shall direct and coordinate in implementing the flood prevention and control plan for the river with dykes.”
8. Add Article 13a before Article 14 in Section 2 Chapter II as follows:
“Article 13a. Dyke Planning
Dyke planning is a technical and specialized planning that specifically implements national-level planning and regional planning, established for the dyke system involving two or more provinces.”
9. Amend and supplement some clauses and points of Article 14 as follows:
a) Amend and supplement Clause 1 as follows:
“1. The preparation of dyke planning must comply with basic principles in planning activities according to the laws on planning and the following principles:
a) Dyke planning must be consistent with the overall national planning; national defense and security objectives; the national strategy for disaster prevention and control; disaster prevention and control planning and water resources planning; regional planning; flood prevention and control planning for the river with dykes; ensuring consistency in the dyke system and the continuity of dyke planning;
b) Sea dykes must ensure protection against typhoons and rising sea levels according to technical standards for sea dyke design and must include areas for planting wave-breaking trees;
c) River dykes must ensure safety corresponding to the designed flood level and have measures to ensure safety during historical floods; there must be coordination among localities within the same watershed without affecting the flood prevention and control planning for the river with dykes and the entire river system.”
b) Amend and supplement point b and point c of Clause 2 as follows:
“b) The national strategy for disaster prevention and control;
c) Disaster prevention and control planning and water resources planning; flood prevention and control planning for the river with dykes;”
10. Amend and supplement Clause 1 of Article 16 as follows:
“1. Dyke planning must be reviewed periodically every five years or when there are changes due to natural disasters, changes in the overall national planning, national defense and security objectives, disaster prevention and control planning and water resources planning, regional planning, flood prevention and control planning for the river with dykes.”
11. Amend and supplement Article 17 as follows:
“Article 17. Authority to Organize the Preparation, Approval, and Adjustment of Dyke Planning
1. The Ministry of Agriculture and Rural Development shall organize the preparation and adjustment of dyke planning and submit it to the Prime Minister for approval.
2. The Government shall provide detailed regulations on the preparation, review, approval, and adjustment of dyke planning.”
12. Amend and supplement Article 19 as follows:
“Article 19. Publication and Implementation of Dyke Planning
1. Within fifteen days from the date of approval of the dyke planning or its adjustment, the Ministry of Agriculture and Rural Development shall organize the publication of the dyke planning or its adjustment. The form of publication shall be carried out in accordance with the laws on planning.
2. The implementation of dyke planning shall be regulated as follows:
a) The Ministry of Agriculture and Rural Development shall take the lead in coordinating with ministries, ministerial-level agencies, and provincial People's Committees to implement the dyke planning;
b) Provincial People's Committees shall be responsible for organizing the establishment and reviewing the contents of the development plan for the dyke system within the provincial planning in accordance with the laws on planning; directing the organization of marking construction boundary markers and protection zones for dykes.”
13. Amend and supplement point b of Clause 3 of Article 26 as follows:
“b) Comply with disaster prevention and control planning and water resources planning, flood prevention and control planning for the river with dykes, dyke planning, provincial planning, land use planning at the district level, and construction planning that have been approved by competent state agencies;”
14. Amend and supplement Clause 1 of Article 27 as follows:
“1. Based on the approved flood prevention and control planning for the river with dykes and provincial planning, provincial People's Committees shall be responsible for organizing the establishment and adjustment of land use planning at the district level and construction planning related to the protection zone of the dyke and riverbank, and submit them to the competent authority for approval or approve them within their authority.”
15. Amend and supplement some points of Article 42 as follows:
a) Amend and supplement Point a Clause 2 as follows:
“a) Take the lead in coordinating with ministries, ministerial-level agencies, and provincial People's Committees in organizing the preparation and implementation of disaster prevention and control planning and water resources planning, flood prevention and control planning for the river with dykes, investment construction plans, repair, upgrading, reinforcement, protection, and utilization of dykes and embankments;”

“a) Organize weather and hydrological forecasting work; direct and guide the establishment of land use planning within the protective zone of the dyke, revetment protecting the dyke, culverts through the dyke, and riverbank in accordance with this Law, laws on planning, and laws on land;”

“a) Plan the infrastructure for inland waterways, construct bridges over rivers to ensure the flood discharge capacity of the river, facilities serving water transport, and the improvement of dyke systems combined with road transportation;”

“a) Organize the establishment of the content of the development plan for the dyke system and flood prevention and control plan for the river with dykes within the provincial planning; organize the construction, repair, upgrading, and reinforcement of dykes, manage and ensure the safety of dykes within the locality in accordance with the dyke planning, flood prevention and control planning for the river with dykes, and provincial planning; ensure consistency in the dyke system across the country;”

"b) Direct the People's Committee of communes to coordinate with relevant agencies in implementing plans for developing dike systems, flood prevention plans for river sections with dikes within the county as stipulated in provincial master plans, investment construction, repair, upgrading, reinforcement, protection, utilization of dikes and dike management;"

Article 14. Amend and supplement some articles of the Waterworks Law
1. Amend and supplement Point a Clause 1 Article 5 as follows:
“a) In formulating waterworks master plans and constructing waterworks projects, solutions for water sources, water supply, water conservation, on-site water use, water reuse, and inter-regional waterworks system connections must be proposed and selected;"
2. Amending and supplementing Clause 11 as follows:
Article 11. Waterworks Master Plans
1. A waterworks master plan is a technical and specialized plan that elaborates on national-level and regional master plans, serving as a basis for investment construction, management, operation, and protection of waterworks facilities.
2. Waterworks master plans include the following types:
a) Waterworks master plans for river basins spanning multiple provinces;
b) Waterworks master plans for waterworks systems involving two or more provinces.
3. Waterworks master plans for waterworks systems involving two or more provinces must align with river basin waterworks master plans spanning multiple provinces.
4. Waterworks master plans are developed for a ten-year period with a vision of thirty to fifty years, and are reviewed every five years.
5. Waterworks master plans shall be adjusted when there are changes in economic and social development strategies, defense and security strategies, waterworks strategies, overall national master plans, disaster prevention and mitigation master plans, water resource master plans, regional master plans, or significant changes affecting the main objectives of the waterworks master plan."
3. Amend and supplement Article 12 as follows:
"Article 12. Principles for Formulating Waterworks Master Plans
The formulation of waterworks master plans must comply with basic principles of planning as prescribed by laws on planning and the following principles:
1. Consistency with waterworks strategies, overall national master plans, disaster prevention and mitigation master plans, water resource master plans, regional master plans; economic and social development plans, defense, and security plans;
2. Integration with national infrastructure master plans and related master plans;
3. Ensuring comprehensive water resource management, unified across river basins and waterworks systems; adapting to climate change impacts and economic and social development within river basins; sustainable development;
4. Serving multiple purposes, ensuring harmony between resource exploitation and environmental protection, disaster prevention and mitigation; prioritizing water supply for islands, coastal areas, border regions, mountainous areas, and reservoirs;
5. Ensuring water balance nationwide, regionally, within river basins, waterworks systems, administrative units; transferring water from surplus to deficit areas; storing rainwater for dry seasons, and water from wet years for dry years."
4. Amendment and supplementation of Article 13 as follows:
"Article 13. Content of Waterworks Master Plans
1. Waterworks master plans determine directions for development, spatial arrangement, and allocation of water resources within the scope of the plan.
2. Waterworks master plans for river basins spanning multiple provinces include the following main contents:
a) Analysis and assessment of natural conditions, water sources; socio-economic conditions; resources; evaluation of current waterworks status and results of previous master plans;
b) Forecasting trends and development scenarios, water sources under the impact of climate change and disasters; forecasting scientific and technological progress and resources directly impacting waterworks;
c) Evaluation of industry and regional linkages; determining requirements for economic and social development and environmental protection for waterworks; opportunities and challenges for waterworks development within the river basin;
d) Determining viewpoints and development goals for waterworks within the river basin;
đ) Analyzing, calculating, and developing waterworks schemes according to development scenarios within the river basin; ensuring water source creation, storage, balance, distribution, risk reduction for droughts, water shortages, salinity intrusion, desertification, floods, inundation, waterlogging, pollution, water resource degradation, and other water-related disasters within the river basin;
e) Proposing solutions, project lists, priority orders;
g) Guidelines for land use needs for new construction, improvement, and upgrading of waterworks facilities; land use needs for material storage, channel expansion;
h) Implementation solutions and resources for the master plan;
i) System of diagrams and maps of the master plan.
3. Waterworks master plans for waterworks systems involving two or more provinces include the following main contents:
a) Analysis and assessment of natural conditions, water sources; socio-economic conditions; resources; evaluation of current waterworks status and results of previous waterworks master plans within the waterworks system;
b) Forecasting trends and development scenarios, water sources under the impact of climate change and disasters; forecasting scientific and technological progress and resources directly impacting waterworks;
c) Evaluation of industry and regional linkages; determining requirements for economic and social development for waterworks; opportunities and challenges for waterworks development within the waterworks system;
d) Determining viewpoints and development goals for waterworks within the waterworks system;

5. Amending and supplementing Article 14 as follows:
"Article 14. Formulation, Approval, Adjustment, Publication, Management, and Implementation of Waterworks Master Plans
1. The Ministry of Agriculture and Rural Development organizes the formulation and adjustment of waterworks master plans, submitting them to the Prime Minister for approval.
2. The publication, management, and implementation of waterworks master plans are regulated as follows:"
a) Not later than fifteen days from the date the water resources planning or adjustment thereof is approved, the Ministry of Agriculture and Rural Development shall organize the publication of such planning or adjustment in accordance with the laws on planning. The disclosure of the planning content shall be carried out throughout the planning period.
b) The Ministry of Agriculture and Rural Development shall manage and organize the implementation of the water resources planning.
c) The People's Committee of the province shall organize the establishment of the development content of water resources within the provincial planning in accordance with the laws on planning and organize its implementation.
d) Organizations and individuals shall be provided conditions to monitor the implementation of the water resources planning.
3\. The Government shall specify detailed regulations on the establishment, examination, approval, and adjustment of the water resources planning.
6\. Amend and supplement point a, Clause 2, Article 56 as follows:
“a) Issue according to its authority or submit to the competent state agency for issuance, organize the implementation of strategies, plans, policies, and regulatory legal documents on water resources; organize the establishment, adjustment, publication, management, and implementation of disaster prevention and control planning and water resources planning;”
7\. Amend and supplement some points of Article 57 as follows:
a) Amending and supplementing Point b Clause 1 as follows:

The National Council for the Development and Application of Atomic Energy is the advisory body of the Prime Minister on the strategy, policy, and plan for the peaceful development and application of atomic energy, responsible for assisting the Prime Minister in directing and resolving important inter-sectoral issues in the field of atomic energy.”
2. Amend and supplement Article 13 as follows:
Article 13\. Planning for the development and application of atomic energy
1\. Planning for the development and application of atomic energy is a technical and specialized planning established based on the national economic and social development strategy, the strategy for the peaceful application of atomic energy, relevant national industry planning, setting long-term basic orientations and determining general and specific goals for the development and peaceful application of atomic energy.
2\. The content of the planning for the development and application of atomic energy includes: viewpoints on the development and application of atomic energy; general and common targets, indicators for the development and application of atomic energy concerning radiation and radioactive isotope applications, nuclear power development, exploration, exploitation, processing, and utilization of radioactive ores; specific goals for the development and application of atomic energy in health, meteorology, hydrology, geology, mineral resources, environmental protection, agriculture, industry, and other economic and technical sectors; directions for the development of research, application, and training facilities; implementation solutions and resources.
3\. The Ministry of Science and Technology shall take the lead and coordinate with the Ministry of Health, the Ministry of Natural Resources and Environment, the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade, other ministries, agencies at the ministerial level, and provincial people's committees related to organize the establishment of the planning for the development and application of atomic energy to submit to the Prime Minister for approval; organize, guide, supervise, and inspect the implementation of the approved planning for the development and application of atomic energy.
4\. The Government shall specify detailed regulations on the establishment, examination, approval, publication, implementation, evaluation, and adjustment of the planning for the development and application of atomic energy.
3\. Add Article 13a after Article 13 as follows:
"Article 13a\. Planning for the development of nuclear power
1\. Planning for the development of nuclear power is a technical and specialized planning established based on the overall national energy planning, the planning for the development and application of atomic energy, and other relevant planning as prescribed by the laws on planning, setting long-term orientations and specific goals for the development of nuclear power.
2\. The content of the planning for the development of nuclear power includes viewpoints on development, goals, indicators, main tasks, implementation solutions, and strategic environmental assessment that has been examined.
3\. Ministries and agencies at the ministerial level shall organize the establishment of the planning for the development of nuclear power to submit to the Prime Minister for approval.
4\. The Government shall specify detailed regulations on the establishment, examination, approval, publication, implementation, evaluation, and adjustment of the planning for the development of nuclear power."
4. Amending and supplementing Article 14 as follows:
"Article 14\. Planning for the exploration, exploitation, processing, and utilization of radioactive ores
1\. Planning for the exploration, exploitation, processing, and utilization of radioactive ores is a national industry planning, setting long-term orientations and specific goals for the activities of exploration, exploitation, processing, and utilization of radioactive ores.
2\. The Ministry of Industry and Trade shall organize the establishment of the planning for the exploration, exploitation, processing, and utilization of radioactive ores to submit to the Prime Minister for approval in accordance with the laws on planning, laws on minerals, and laws on atomic energy."
5. Amending and supplementing Article 15 as follows:
"Article 15\. Adjustment of planning for the development and application of atomic energy, planning for the development of nuclear power
Planning for the development and application of atomic energy, planning for the development of nuclear power shall be adjusted when there is a change in strategic objectives, economic and social development plans, industry strategies, and relevant planning as prescribed by the laws on planning, which alters the content of the planning."
6\. Add Clause 8a after Clause 8, Article 25 as follows:
"8a\. The location of the national radioactive waste storage facility, the location of radioactive waste disposal sites shall be determined in environmental protection planning, regional planning, and other relevant planning as prescribed by the laws on planning, laws on environmental protection, and laws on atomic energy."

“a) Proposing, building, and submitting to competent state authorities for issuance of legal regulatory documents on metrology; building metrology plans;
b) Organizing the implementation of legal regulatory documents and metrology plans;”
Article 17. Amending and supplementing certain articles of the Law on Technical Standards and Conformity Assessment Procedures
1. Amending and supplementing Article 14 as follows:
“Article 14. Plan for Building National Standards
1. The plan for building national standards includes a five-year plan and an annual plan, established based on the following:
a) Harmonization with international standards according to international treaties and agreements to which the Socialist Republic of Vietnam is a member;
b) Requirements for economic and social development;
c) Proposals from organizations and individuals.
2. The plan for building national standards shall be organized and publicly announced by the Ministry of Science and Technology, in coordination with relevant ministries, ministerial-level agencies, and government bodies before approval to widely solicit opinions. The Minister of Science and Technology shall approve the plan for building national standards and publicly announce it within thirty days from the date of approval.
3. In cases of necessity, the plan for building national standards may be amended and supplemented according to the decision of the Minister of Science and Technology. Such amendments and supplements shall be carried out in accordance with Clause 2 of this Article.”
2. Removing the term “planning” at Clause 1 of Article 15, Point a of Clause 3 of Article 16, Article 29, Clause 1 of Article 31, Point a of Clause 2 of Article 59, Points b and c of Clause 1, Points b and d of Clause 2 of Article 60.
Article 18. Amending and supplementing certain articles of the Law on Cybersecurity
1. Amending and supplementing Clause 1 of Article 51 as follows:
“1. Developing strategies, plans, and policies in the field of cybersecurity; building and directing the implementation of the national program on cybersecurity; organizing the establishment of plans for developing infrastructure ensuring cybersecurity within the planning of information and communication infrastructure, other related planning as prescribed by law on planning.”
2. Amending and supplementing Point a of Clause 2 of Article 52 as follows:
“a) Issuing or building, and submitting to competent authorities for issuance of legal regulatory documents, strategies, plans, national technical standards, and national conformity assessment procedures on cybersecurity; organizing the establishment of plans for developing infrastructure ensuring cybersecurity within the planning of information and communication infrastructure, other related planning as prescribed by law on planning;”
3. Removing the term “planning” at Point a of Clause 1 of Article 42 and Point a of Clause 3 of Article 52.

Article 19. Amending and supplementing some articles of the Publishing Law
1. Amending and supplementing Point a Clause 1 Article 6 as follows:
“a) Building and organizing the implementation of strategies, plans, policies for the development of publishing activities; organizing the establishment of content and development plans for publishing bases within the planning of networks of press, radio, television, electronic information, publishing bases, regional planning, and provincial planning in accordance with the law on planning; issuing by authority normative legal documents on publishing activities and copyright in publishing activities;”
2. Amend and supplement Clause 1, Article 7 as follows:
“1. The State has a strategy for developing networks of publishers, printing bases, distribution bases for publications; development plans for publishing bases within the planning of networks of press, radio, television, electronic information, publishing bases, regional planning, and provincial planning; supporting training of human resources; tax incentives according to the law for publishing activities; policies to attract social resources to participate in publishing activities.”
3. Amending and supplementing Clause 4 Article 13 as follows:
“4. In line with the State's strategies, plans, and policies on the development of publishing activities.”
4. Amending and supplementing Point d Clause 1 Article 32 as follows:
“d) In line with the planning for the development of networks of press, radio, television, electronic information, publishing bases, and other related planning as provided for in the law on planning.”
Article 20. Amending and supplementing some articles of the Press Law
1. Amending and supplementing Clause 1 of Article 5 as follows:
“1. Having a strategy for developing and managing the press system, development plans for press bases within the planning of networks of press, radio, television, electronic information, publishing bases, regional planning, and provincial planning.”
2. Amending and supplementing Clause 1 of Article 6 as follows:
“1. Building, directing, and organizing the implementation of strategies and plans for the development of the press; organizing the establishment of development plans for press bases within the planning of networks of press, radio, television, electronic information, publishing bases, regional planning, and provincial planning.”
3. Sửa đổi, bổ sung điểm c khoản 2 Điều 8 như sau:
“c) Tham gia ý kiến xây dựng chiến lược, kế hoạch, chính sách phát triển báo chí, phương án phát triển cơ sở báo chí trong quy hoạch phát triển mạng lưới cơ sở báo chí, phát thanh, truyền hình, thông tin điện tử, cơ sở xuất bản, văn bản quy phạm pháp luật về báo chí;”.
4. Sửa đổi, bổ sung khoản 5 Điều 17 như sau:
“5. Phù hợp với quy hoạch phát triển mạng lưới cơ sở báo chí, phát thanh, truyền hình, thông tin điện tử, cơ sở xuất bản được Thủ tướng Chính phủ phê duyệt.”.
5. Sửa đổi, bổ sung khoản 1 Điều 33 như sau:
“1. Việc cấp giấy phép biên tập kênh chương trình nước ngoài trên dịch vụ phát thanh, truyền hình trả tiền được thực hiện với từng kênh chương trình và phù hợp với chiến lược, kế hoạch và chính sách của Nhà nước về phát triển và quản lý báo chí toàn quốc.”.
6. Sửa đổi, bổ sung một số điểm của Điều 51 như sau:
a) Sửa đổi, bổ sung điểm b khoản 2 như sau:
“b) Phù hợp với chiến lược, kế hoạch và chính sách của Nhà nước về báo chí, truyền dẫn, phát sóng phát thanh, truyền hình; phát triển dịch vụ phát thanh, truyền hình;”;
b) Sửa đổi, bổ sung điểm b khoản 3 như sau:
“b) Có phương án cung cấp dịch vụ phù hợp với chiến lược, kế hoạch và chính sách của Nhà nước về phát triển dịch vụ truyền dẫn, phát sóng phát thanh, truyền hình;”.
Điều 21. Sửa đổi, bổ sung khoản 3 Điều 8 của Luật Giáo dục quốc phòng và an ninh
Sửa đổi, bổ sung khoản 3 Điều 8 như sau:
“3. Quy hoạch hệ thống trung tâm giáo dục quốc phòng và an ninh phải phù hợp với quy hoạch mạng lưới cơ sở giáo dục đại học và sư phạm, đáp ứng yêu cầu giáo dục quốc phòng và an ninh cho các đối tượng.”.
Điều 22. Sửa đổi, bổ sung một số điều của Luật Quản lý, sử dụng vốn nhà nước đầu tư vào sản xuất, kinh doanh tại doanh nghiệp
1. Sửa đổi, bổ sung khoản 2 Điều 5 như sau:
“2. Phù hợp với chiến lược, kế hoạch phát triển kinh tế - xã hội, quy hoạch ngành quốc gia.”.
2. Sửa đổi, bổ sung khoản 2 Điều 8 như sau:
“2. Xây dựng chiến lược đầu tư phát triển doanh nghiệp theo chiến lược, kế hoạch phát triển kinh tế - xã hội, quy hoạch ngành quốc gia.”.
3. Sửa đổi, bổ sung điểm d khoản 1 Điều 12 như sau:
“d) Đánh giá tác động kinh tế - xã hội của việc thành lập doanh nghiệp đối với các loại quy hoạch có liên quan theo quy định của pháp luật về quy hoạch và chiến lược phát triển ngành, lĩnh vực và vùng kinh tế;”.
4. Sửa đổi, bổ sung khoản 2 Điều 19 như sau:
“2. Việc đầu tư vốn nhà nước để mua lại một phần hoặc toàn bộ doanh nghiệp theo quy định tại khoản 1 Điều này phải phù hợp với chiến lược, kế hoạch phát triển kinh tế - xã hội và quy hoạch ngành quốc gia trong từng thời kỳ.”.
5. Sửa đổi, bổ sung khoản 1 Điều 36 như sau:
“1. Căn cứ phạm vi đầu tư vốn nhà nước để thành lập doanh nghiệp quy định tại Điều 10 của Luật này, Chính phủ quy định lộ trình thoái vốn nhà nước tại doanh nghiệp phù hợp với chiến lược, kế hoạch phát triển kinh tế - xã hội và quy hoạch ngành quốc gia.”.
Điều 23. Sửa đổi, bổ sung một số điều của Luật Thực hành tiết kiệm, chống lãng phí
1. Sửa đổi, bổ sung khoản 10 Điều 27 như sau:
“10. Cấp phép thành lập trường học, cơ sở khám bệnh, chữa bệnh không phù hợp với chiến lược, kế hoạch phát triển giáo dục, y tế, quy hoạch có liên quan theo quy định của pháp luật về quy hoạch và quy định khác của pháp luật có liên quan.”.
2. Sửa đổi, bổ sung khoản 1 Điều 46 như sau:
“1. Phù hợp với quy hoạch có liên quan theo quy định của pháp luật về quy hoạch, kế hoạch liên quan đến khai thác và bảo vệ tài nguyên đã được cấp có thẩm quyền phê duyệt.”.
3. Sửa đổi, bổ sung điểm a khoản 1 Điều 48 như sau:
“a) Đúng quy hoạch có liên quan theo quy định của pháp luật về quy hoạch, kế hoạch tài nguyên nước;”.
4. Sửa đổi, bổ sung điểm a khoản 1 Điều 49 như sau:
“a) Phù hợp với chiến lược thăm dò, khai thác, chế biến và sử dụng các loại khoáng sản, quy hoạch có liên quan theo quy định của pháp luật về quy hoạch;”.
5. Sửa đổi, bổ sung điểm a khoản 1 Điều 50 như sau:
“a) Phù hợp với chiến lược phát triển lâm nghiệp, quy hoạch lâm nghiệp và kế hoạch phát triển lâm nghiệp, quy hoạch có liên quan theo quy định của pháp luật về quy hoạch;”.
6. Sửa đổi, bổ sung khoản 1 Điều 64 như sau:
“1. Các dự án đầu tư phát triển sản xuất, kinh doanh phải thực hiện đúng quy hoạch có liên quan theo quy định của pháp luật về quy hoạch, kế hoạch sử dụng đất và quy định về bảo vệ cảnh quan môi trường do cơ quan nhà nước có thẩm quyền ban hành.”.
7. Bỏ từ “quy hoạch,” tại các khoản 1, 3 và 4 Điều 22, khoản 5 và khoản 7 Điều 27.
Điều 24. Sửa đổi, bổ sung một số điều của Luật Hải quan
1. Sửa đổi, bổ sung khoản 4 Điều 22 như sau:
“4. Cơ quan, tổ chức, cá nhân có thẩm quyền khi quy hoạch, thiết kế xây dựng liên quan đến cửa khẩu đường bộ, ga đường sắt liên vận quốc tế, cảng hàng không dân dụng quốc tế; cảng biển, cảng thủy nội địa có hoạt động xuất khẩu, nhập khẩu, xuất cảnh, nhập cảnh, quá cảnh; cảng xuất khẩu, nhập khẩu hàng hóa được thành lập trong nội địa; khu kinh tế, khu công nghiệp, khu phi thuế quan và các địa điểm khác có hoạt động xuất khẩu, nhập khẩu, xuất cảnh, nhập cảnh, quá cảnh có trách nhiệm bố trí địa điểm làm thủ tục hải quan và nơi lưu giữ hàng hóa xuất khẩu, nhập khẩu đáp ứng yêu cầu kiểm tra, giám sát hải quan theo quy định của Luật này.”.
2. Sửa đổi, bổ sung khoản 1 Điều 99 như sau:
“1. Xây dựng và chỉ đạo thực hiện chiến lược, kế hoạch phát triển Hải quan Việt Nam;”.
Điều 25. Sửa đổi, bổ sung khoản 2 Điều 7 của Luật Chứng khoán
1. Sửa đổi, bổ sung điểm a khoản 2 Điều 7 như sau:
“a) Trình Chính phủ, Thủ tướng Chính phủ ban hành chiến lược, kế hoạch, chính sách phát triển thị trường chứng khoán;”.
2. Sửa đổi, bổ sung điểm c khoản 2 Điều 7 như sau:
“c) Chỉ đạo Ủy ban Chứng khoán Nhà nước thực hiện chiến lược, kế hoạch, dự án, đề án, chính sách phát triển thị trường chứng khoán và các chính sách, chế độ để quản lý và giám sát hoạt động về chứng khoán và thị trường chứng khoán.”.
Điều 26. Sửa đổi, bổ sung một số điều của Luật Điện ảnh
1. Sửa đổi, bổ sung khoản 6 Điều 5 như sau:
“6. Chính phủ quy định cụ thể việc thực hiện các chính sách quy định tại Điều này.”.
2. Sửa đổi, bổ sung khoản 1 Điều 8 như sau:
“1. Xây dựng và tổ chức thực hiện chính sách, chiến lược, kế hoạch phát triển sự nghiệp điện ảnh, định hướng phát triển cơ sở điện ảnh trong quy hoạch mạng lưới cơ sở văn hóa và thể thao; ban hành văn bản quy phạm pháp luật về hoạt động điện ảnh.”.
Điều 27. Sửa đổi, bổ sung khoản 2 Điều 4 của Luật Quảng cáo
Sửa đổi, bổ sung khoản 2 Điều 4 như sau:
“2. Xây dựng và chỉ đạo thực hiện chiến lược, kế hoạch, chính sách phát triển hoạt động quảng cáo, quy hoạch quảng cáo ngoài trời.”.
Điều 28. Sửa đổi, bổ sung một số điều của Luật Xây dựng
1. Sửa đổi, bổ sung một số khoản của Điều 3 như sau:
a) Sửa đổi, bổ sung khoản 25 như sau:
“25. Khu chức năng bao gồm khu kinh tế, khu công nghiệp, khu chế xuất, khu công nghệ cao; khu du lịch; khu nghiên cứu, đào tạo; khu thể dục thể thao.”;
b) Sửa đổi, bổ sung khoản 31 như sau:
“31. Quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện là việc tổ chức hệ thống đô thị, nông thôn, khu chức năng và hệ thống công trình hạ tầng kỹ thuật, hạ tầng xã hội trong địa giới hành chính của liên huyện, một huyện trong tỉnh phù hợp với yêu cầu phát triển kinh tế - xã hội trong từng thời kỳ.”;
c) Sửa đổi, bổ sung khoản 32 như sau:
“32. Quy hoạch xây dựng khu chức năng là việc tổ chức không gian kiến trúc cảnh quan, hệ thống công trình hạ tầng kỹ thuật, hạ tầng xã hội trong phạm vi một khu chức năng quy định tại khoản 25 Điều này. Quy hoạch xây dựng khu chức năng gồm quy hoạch chung xây dựng, quy hoạch phân khu xây dựng và quy hoạch chi tiết xây dựng.”.
2. Sửa đổi, bổ sung Điều 13 như sau:
“Điều 13. Quy hoạch xây dựng
1. Quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện, quy hoạch xây dựng khu chức năng là quy hoạch có tính chất kỹ thuật, chuyên ngành.
2. Quy hoạch đô thị là quy hoạch thuộc hệ thống quy hoạch quốc gia, bao gồm các loại quy hoạch được quy định tại Luật Quy hoạch đô thị.
Việc tổ chức lập, thẩm định, phê duyệt, điều chỉnh và thực hiện quy hoạch đô thị theo quy định của pháp luật về quy hoạch đô thị.
3. Quy hoạch nông thôn là quy hoạch thuộc hệ thống quy hoạch quốc gia, bao gồm các loại quy hoạch được quy định tại khoản 2 Điều 29 của Luật này.
4. Căn cứ lập quy hoạch xây dựng bao gồm:
a) Chiến lược phát triển kinh tế - xã hội, quốc phòng, an ninh; chiến lược phát triển ngành, lĩnh vực trong cùng giai đoạn phát triển;
b) Quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh;
c) Quy hoạch thời kỳ trước;
d) Quy chuẩn kỹ thuật về quy hoạch xây dựng và quy chuẩn khác có liên quan;
đ) Bản đồ, tài liệu, số liệu về hiện trạng kinh tế - xã hội, điều kiện tự nhiên của địa phương.”.
3. Sửa đổi, bổ sung một số điểm của Điều 14 như sau:
a) Sửa đổi, bổ sung điểm a khoản 1 như sau:
“a) Phù hợp với chiến lược phát triển kinh tế - xã hội, chiến lược phát triển ngành, lĩnh vực; phù hợp với quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh; bảo đảm quốc phòng, an ninh, tạo động lực phát triển kinh tế - xã hội bền vững; công khai, minh bạch, kết hợp hài hòa giữa lợi ích quốc gia, cộng đồng và cá nhân;”;
b) Sửa đổi, bổ sung điểm a khoản 2 như sau:
“a) Việc thực hiện chương trình, hoạt động đầu tư xây dựng, quản lý không gian, kiến trúc, cảnh quan phải tuân thủ quy hoạch thuộc hệ thống quy hoạch quốc gia theo quy định của pháp luật về quy hoạch, quy hoạch xây dựng đã được phê duyệt và phù hợp với nguồn lực huy động;”.
4. Sửa đổi, bổ sung khoản 1 Điều 15 như sau:
“1. Quy hoạch xây dựng phải được định kỳ xem xét, rà soát, đánh giá quá trình thực hiện để kịp thời điều chỉnh phù hợp với tình hình phát triển kinh tế - xã hội trong từng giai đoạn. Định kỳ rà soát đối với quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện là 10 năm, đối với quy hoạch chung và quy hoạch phân khu là 05 năm, đối với quy hoạch chi tiết là 03 năm kể từ ngày quy hoạch xây dựng được phê duyệt.”.
5. Sửa đổi, bổ sung khoản 2 Điều 20 như sau:
“2. Điều tra, khảo sát thực địa; thu thập bản đồ, tài liệu, số liệu về điều kiện tự nhiên, hiện trạng kinh tế - xã hội, quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh có liên quan để lập đồ án quy hoạch xây dựng.”.
6. Sửa đổi, bổ sung Mục 2 Chương II như sau:
“Mục 2
QUY HOẠCH XÂY DỰNG VÙNG LIÊN HUYỆN, QUY HOẠCH XÂY DỰNG VÙNG HUYỆN
Điều 22. Trách nhiệm tổ chức lập quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện
1. Ủy ban nhân dân cấp tỉnh tổ chức lập nhiệm vụ và đồ án quy hoạch xây dựng vùng liên huyện thuộc đơn vị hành chính do mình quản lý.
2. Ủy ban nhân dân cấp huyện tổ chức lập nhiệm vụ và đồ án quy hoạch xây dựng vùng huyện.
Điều 23. Nhiệm vụ và nội dung đồ án quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện
1. Nhiệm vụ quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện gồm:
a) Xác định luận cứ, cơ sở hình thành phạm vi ranh giới quy hoạch của vùng liên huyện;
b) Xác định mục tiêu phát triển;
c) Dự báo quy mô dân số, nhu cầu về hạ tầng kỹ thuật và hạ tầng xã hội cho từng giai đoạn phát triển;
d) Xác định yêu cầu về tổ chức không gian đối với hệ thống đô thị, khu vực nông thôn và khu chức năng chủ yếu, hệ thống công trình hạ tầng kỹ thuật, hạ tầng xã hội trên phạm vi lập quy hoạch theo từng giai đoạn.
2. Quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện được phê duyệt là cơ sở để lập quy hoạch nông thôn và dự án đầu tư xây dựng hệ thống công trình hạ tầng kỹ thuật liên huyện, huyện.
3. Chính phủ quy định chi tiết nội dung nhiệm vụ và đồ án quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện.”.
7. Sửa đổi, bổ sung Điều 24 như sau:
“Điều 24. Trách nhiệm lập quy hoạch xây dựng khu chức năng
1. Bộ Xây dựng tổ chức lập nhiệm vụ và đồ án quy hoạch chung xây dựng khu chức năng do Thủ tướng Chính phủ giao, bảo đảm nguyên tắc một khu chức năng chỉ lập một quy hoạch. Đối với khu du lịch cấp quốc gia, việc lập quy hoạch do Thủ tướng Chính phủ phân công.
2. Ủy ban nhân dân cấp tỉnh tổ chức lập nhiệm vụ, đồ án quy hoạch chung xây dựng khu chức năng và nhiệm vụ, đồ án quy hoạch phân khu xây dựng khu chức năng, trừ quy hoạch quy định tại khoản 1 Điều này.
3. Ủy ban nhân dân cấp huyện tổ chức lập nhiệm vụ và đồ án quy hoạch chi tiết xây dựng khu vực được giao quản lý; chủ đầu tư dự án đầu tư xây dựng tổ chức lập quy hoạch chi tiết khu vực được giao đầu tư.”.
8. Sửa đổi, bổ sung điểm a khoản 4 Điều 33 như sau:
“a) Sự phù hợp của nhiệm vụ quy hoạch xây dựng với chiến lược phát triển kinh tế - xã hội, quốc phòng, an ninh, bảo vệ môi trường, ứng phó với biến đổi khí hậu, quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh và với quy hoạch, kế hoạch sử dụng đất;”.
9. Sửa đổi, bổ sung Điều 34 như sau:
“Điều 34. Thẩm quyền phê duyệt nhiệm vụ và đồ án quy hoạch xây dựng
1. Thủ tướng Chính phủ phê duyệt nhiệm vụ và đồ án quy hoạch xây dựng sau:
a) Quy hoạch chung xây dựng khu kinh tế, quy hoạch chung xây dựng khu công nghệ cao;
b) Quy hoạch chung xây dựng khu du lịch, khu nghiên cứu, đào tạo, khu thể dục thể thao cấp quốc gia.
2. Ủy ban nhân dân cấp tỉnh phê duyệt nhiệm vụ và đồ án quy hoạch xây dựng sau:
a) Quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện;
b) Quy hoạch chung xây dựng khu chức năng, trừ các quy hoạch quy định tại khoản 1 Điều này.
3. Ủy ban nhân dân cấp huyện phê duyệt nhiệm vụ và đồ án quy hoạch phân khu, quy hoạch chi tiết xây dựng và quy hoạch nông thôn trong phạm vi địa giới hành chính do minh quản lý sau khi có ý kiến thống nhất bằng văn bản của cơ quan quản lý quy hoạch xây dựng thuộc Ủy ban nhân dân cấp tỉnh.
4. Ủy ban nhân dân các cấp tổ chức lập quy hoạch xây dựng có trách nhiệm trình Hội đồng nhân dân cùng cấp quyết định trước khi được cơ quan nhà nước có thẩm quyền xem xét, phê duyệt.
5. Hình thức, nội dung phê duyệt nhiệm vụ và đồ án quy hoạch xây dựng gồm:
a) Nhiệm vụ, đồ án quy hoạch xây dựng phải được phê duyệt bằng văn bản;
b) Văn bản phê duyệt quy hoạch xây dựng phải có các nội dung chính của đồ án quy hoạch xây dựng được quy định tại các điều 23, 26, 27, 28, 30 và 31 của Luật này và danh mục các bản vẽ được phê duyệt kèm theo.”.
10. Sửa đổi, bổ sung Điều 35 như sau:
“Điều 35. Căn cứ điều chỉnh quy hoạch xây dựng
1. Quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện được điều chỉnh khi thuộc một trong các trường hợp sau:
a) Có sự điều chỉnh mục tiêu của chiến lược phát triển kinh tế - xã hội, chiến lược phát triển ngành, lĩnh vực làm thay đổi mục tiêu của quy hoạch;
b) Có sự điều chỉnh của quy hoạch cao hơn làm thay đổi nội dung quy hoạch hoặc có sự mâu thuẫn với quy hoạch cùng cấp;
c) Có sự thay đổi, điều chỉnh địa giới hành chính làm ảnh hưởng đến tính chất, quy mô không gian lãnh thổ của quy hoạch;
d) Do tác động của thiên tai, biến đổi khí hậu, chiến tranh làm thay đổi mục tiêu, định hướng, tổ chức không gian lãnh thổ của quy hoạch;
đ) Do biến động bất thường của tình hình kinh tế - xã hội làm hạn chế nguồn lực thực hiện quy hoạch;
e) Do sự phát triển của khoa học, công nghệ làm thay đổi cơ bản việc thực hiện quy hoạch;
g) Do yêu cầu bảo đảm quốc phòng, an ninh.
2. Quy hoạch xây dựng khu chức năng được điều chỉnh khi thuộc một trong các trường hợp sau:
a) Có sự điều chỉnh quy hoạch cao hơn hoặc có sự mâu thuẫn với quy hoạch cùng cấp;
b) Hình thành dự án trọng điểm có ý nghĩa quốc gia làm ảnh hưởng lớn đến sử dụng đất, môi trường, bố cục không gian của khu chức năng;
c) Quy hoạch xây dựng không thực hiện được hoặc việc triển khai thực hiện gây ảnh hưởng xấu đến sự phát triển kinh tế - xã hội, quốc phòng, an ninh, an sinh xã hội, di tích lịch sử - văn hóa hoặc môi trường sinh thái được xác định thông qua việc rà soát, đánh giá thực hiện quy hoạch xây dựng và ý kiến cộng đồng;
d) Do tác động của thiên tai, biến đổi khí hậu, chiến tranh làm thay đổi mục tiêu, định hướng, tổ chức không gian lãnh thổ của quy hoạch;
đ) Phục vụ lợi ích quốc gia, lợi ích cộng đồng.
3. Quy hoạch nông thôn được điều chỉnh khi thuộc một trong các trường hợp sau:
a) Có sự điều chỉnh của quy hoạch cao hơn;
b) Có sự biến động về điều kiện địa lý tự nhiên;
c) Thay đổi địa giới hành chính.”.
11. Sửa đổi, bổ sung khoản 2 Điều 37 như sau:
“2. Điều chỉnh cục bộ quy hoạch xây dựng khu chức năng được tiến hành khi nội dung dự kiến điều chỉnh không làm thay đổi tính chất, chức năng, quy mô và các giải pháp quy hoạch chính của khu vực lập quy hoạch; bảo đảm không làm quá tải hạ tầng kỹ thuật, hạ tầng xã hội của khu vực dự kiến điều chỉnh quy hoạch.”.
12. Sửa đổi, bổ sung Điều 39 như sau:
“Điều 39. Trình tự điều chỉnh cục bộ quy hoạch xây dựng
1. Cơ quan tổ chức lập quy hoạch xây dựng có trách nhiệm sau đây:
a) Lập báo cáo về nội dung và kế hoạch điều chỉnh cục bộ quy hoạch xây dựng;
b) Tổ chức xin ý kiến cộng đồng dân cư trong khu vực dự kiến điều chỉnh quy hoạch và các khu vực xung quanh chịu ảnh hưởng trực tiếp về nội dung và kế hoạch điều chỉnh cục bộ quy hoạch xây dựng theo quy định tại Điều 16 và Điều 17 của Luật này.
2. Cơ quan quản lý quy hoạch có thẩm quyền quy định tại Điều 32 của Luật này thẩm định về các căn cứ, điều kiện và nội dung điều chỉnh cục bộ quy hoạch.
3. Cơ quan có thẩm quyền phê duyệt quy hoạch xây dựng xem xét, quyết định việc điều chỉnh cục bộ quy hoạch xây dựng trên cơ sở ý kiến của cơ quan thẩm định quy hoạch xây dựng.
Quyết định điều chỉnh cục bộ quy hoạch xây dựng phải có các nội dung điều chỉnh và bản vẽ kèm theo.
4. Cơ quan tổ chức lập quy hoạch xây dựng có trách nhiệm cập nhật và thể hiện trong hồ sơ quy hoạch những nội dung điều chỉnh. Nội dung điều chỉnh cục bộ quy hoạch xây dựng phải được công bố công khai theo quy định tại các điều 40, 41 và 42 của Luật này.”.
13. Sửa đổi, bổ sung khoản 1 và khoản 2 Điều 40 như sau:
“1. Chậm nhất là 15 ngày kể từ ngày quy hoạch được cơ quan có thẩm quyền phê duyệt, đồ án quy hoạch xây dựng phải được công bố công khai.
2. Nội dung công bố công khai quy hoạch xây dựng bao gồm toàn bộ nội dung của đồ án quy hoạch xây dựng và quy định quản lý theo đồ án quy hoạch xây dựng đã được ban hành, trừ những nội dung liên quan đến quốc phòng, an ninh, bí mật nhà nước.”.
14. Sửa đổi, bổ sung khoản 1 Điều 41 như sau:
“1. Đối với quy hoạch xây dựng vùng liên huyện, quy hoạch xây dựng vùng huyện được quy định như sau:
a) Ủy ban nhân dân cấp tỉnh tổ chức công bố quy hoạch xây dựng vùng liên huyện;
b) Ủy ban nhân dân cấp huyện, cấp xã tổ chức công bố quy hoạch xây dựng vùng huyện.”.
15. Sửa đổi, bổ sung khoản 1 Điều 42 như sau:
“1. Đồ án quy hoạch xây dựng được phê duyệt phải được đăng tải thường xuyên, cập nhật liên tục trên trang thông tin điện tử của cơ quan tổ chức lập quy hoạch, cơ quan lập quy hoạch, cơ quan quản lý nhà nước về quy hoạch xây dựng và được thông tin trên các phương tiện thông tin đại chúng.”.
16. Sửa đổi, bổ sung Điều 43 như sau:
“Điều 43. Cung cấp thông tin về quy hoạch xây dựng
1. Việc cung cấp thông tin về quy hoạch xây dựng được thực hiện dưới các hình thức sau:
a) Công khai hồ sơ đồ án quy hoạch xây dựng, đăng tải trên trang thông tin điện tử và phương tiện thông tin đại chúng;
b) Giải thích trực tiếp theo yêu cầu của cơ quan, tổ chức, cá nhân;
c) Cung cấp thông tin bằng văn bản giấy, văn bản điện tử theo yêu cầu của cơ quan, tổ chức, cá nhân;
d) Phát hành ấn phẩm về quy hoạch.
2. Ủy ban nhân dân các cấp có trách nhiệm tổ chức việc tiếp nhận, xử lý và cung cấp thông tin khi có yêu cầu. Cơ quan quản lý quy hoạch xây dựng có trách nhiệm cung cấp thông tin về địa điểm xây dựng, chỉ giới xây dựng, chỉ giới đường đỏ, cốt xây dựng và thông tin khác liên quan đến quy hoạch xây dựng khi cơ quan, tổ chức, cá nhân có yêu cầu trong phạm vi đồ án quy hoạch xây dựng do mình quản lý.
Đối với trường hợp cung cấp thông tin bằng văn bản, trong thời hạn 15 ngày kể từ ngày có yêu cầu, cơ quan quản lý quy hoạch xây dựng có trách nhiệm cung cấp thông tin cho cơ quan, tổ chức, cá nhân có yêu cầu.
3. Cơ quan, tổ chức cung cấp thông tin phải chịu trách nhiệm trước pháp luật về thời gian cung cấp thông tin và độ chính xác của các tài liệu, số liệu đã cung cấp.”.
17. Sửa đổi, bổ sung khoản 1 Điều 51 như sau:
“1. Phù hợp với quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh, quy hoạch xây dựng, quy hoạch và kế hoạch sử dụng đất tại địa phương nơi có dự án đầu tư xây dựng.”.
18. Thay thế cụm từ tại tên mục và các điều, khoản, điểm sau đây:
a) Thay thế cụm từ “quy hoạch xây dựng nông thôn” bằng cụm từ “quy hoạch nông thôn” tại khoản 33 Điều 3, tên Mục 4 Chương II và Điều 29;
b) Thay thế cụm từ “khu chức năng đặc thù” bằng cụm từ “khu chức năng” tại khoản 30 Điều 3, điểm đ khoản 1 Điều 14, khoản 3 Điều 18, tên Mục 3 Chương II, các điều 25, 26, 27 và 28, khoản 1 Điều 38, khoản 2 và khoản 3 Điều 41, khoản 2 Điều 46, Điều 47 và khoản 1 Điều 48;
c) Thay thế cụm từ “các cấp độ sau” bằng cụm từ “các loại quy hoạch sau đây” tại khoản 2 Điều 29.
19. Bãi bỏ khoản 45 Điều 3, khoản 5 Điều 41 và Điều 47.
Điều 29. Sửa đổi, bổ sung một số điều của Luật Quy hoạch đô thị
1. Sửa đổi, bổ sung khoản 2 Điều 3 như sau:
“2. Đô thị mới là đô thị dự kiến hình thành trong tương lai theo quy hoạch hệ thống đô thị và nông thôn, được đầu tư xây dựng từng bước đạt các tiêu chí của đô thị theo quy định của pháp luật.”.
2. Sửa đổi, bổ sung khoản 1 Điều 6 như sau:
“1. Cụ thể hóa quy hoạch hệ thống đô thị và nông thôn, quy hoạch vùng, quy hoạch tỉnh; phù hợp với chiến lược phát triển kinh tế - xã hội, quốc phòng, an ninh; phù hợp với quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh; bảo đảm công khai, minh bạch và kết hợp hài hòa giữa lợi ích quốc gia, cộng đồng và cá nhân.”.
3. Sửa đổi, bổ sung điểm a khoản 1 Điều 18 như sau:
“a) Quy hoạch chung được lập cho thành phố trực thuộc trung ương, thành phố thuộc tỉnh, thị xã, thị trấn và đô thị mới.
Quy hoạch chung thành phố trực thuộc trung ương cụ thể hóa quy hoạch tỉnh được lập ở thành phố trực thuộc trung ương về tổ chức không gian, hệ thống các công trình hạ tầng kỹ thuật, công trình hạ tầng xã hội và nhà ở cho thành phố trực thuộc trung ương;”.
4. Bãi bỏ khoản 2 và sửa đổi, bổ sung khoản 1 Điều 24 như sau:
“1. Chiến lược phát triển kinh tế - xã hội, quốc phòng, an ninh, quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh, quy hoạch có tính chất kỹ thuật, chuyên ngành cao hơn đã được phê duyệt.”.
5. Sửa đổi, bổ sung khoản 2 và khoản 3 Điều 41 như sau:
“2. Cơ quan quản lý quy hoạch đô thị cấp tỉnh thẩm định nhiệm vụ và đồ án quy hoạch đô thị thuộc thẩm quyền phê duyệt của Ủy ban nhân dân cùng cấp.
3. Cơ quan quản lý quy hoạch đô thị cấp huyện thẩm định nhiệm vụ và đồ án quy hoạch đô thị thuộc thẩm quyền phê duyệt của Ủy ban nhân dân cùng cấp.”.
6. Sửa đổi, bổ sung điểm a khoản 1 Điều 43 như sau:
“a) Sự phù hợp của nhiệm vụ quy hoạch đô thị với yêu cầu phát triển kinh tế - xã hội, quốc phòng, an ninh và quy hoạch cao hơn;”.
7. Sửa đổi, bổ sung Điều 44 như sau:
“Điều 44. Thẩm quyền phê duyệt nhiệm vụ và đồ án quy hoạch đô thị
1. Thủ tướng Chính phủ phê duyệt nhiệm vụ và đồ án quy hoạch đô thị sau đây:
a) Quy hoạch chung thành phố trực thuộc trung ương, quy hoạch chung thành phố thuộc tỉnh là đô thị loại I, quy hoạch chung đô thị mới có quy mô dân số dự báo tương đương với đô thị loại III trở lên và đô thị mới có phạm vi quy hoạch liên quan đến địa giới hành chính của hai tỉnh trở lên;
b) Quy hoạch chuyên ngành hạ tầng kỹ thuật đô thị của thành phố trực thuộc trung ương là đô thị loại đặc biệt;
c) Quy hoạch chung, quy hoạch phân khu, quy hoạch chi tiết của khu vực có ý nghĩa đặc biệt quan trọng về chính trị, kinh tế - xã hội, văn hóa, lịch sử của quốc gia theo quy định của Chính phủ.
2. Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương phê duyệt nhiệm vụ và đồ án quy hoạch đô thị sau đây:
a) Quy hoạch chung thành phố thuộc tỉnh, thị xã, thị trấn, đô thị mới, trừ các quy hoạch đô thị quy định tại điểm a khoản 1 Điều này; đối với đồ án quy hoạch chung đô thị loại II, III, IV và đô thị mới, trước khi phê duyệt phải có ý kiến thống nhất bằng văn bản của Bộ Xây dựng;
b) Quy hoạch chuyên ngành hạ tầng kỹ thuật đô thị của thành phố trực thuộc trung ương, trừ các quy hoạch quy định tại điểm b khoản 1 Điều này, sau khi có ý kiến thống nhất bằng văn bản của Bộ Xây dựng;
c) Quy hoạch phân khu thuộc đô thị loại đặc biệt và loại I; quy hoạch phân khu và quy hoạch chi tiết các khu vực trong đô thị có phạm vi liên quan đến địa giới hành chính của hai quận, huyện trở lên, khu vực có ý nghĩa quan trọng, khu vực trong đô thị mới, trừ các quy hoạch quy định tại điểm c khoản 1 Điều này.
3. Ủy ban nhân dân thành phố thuộc tỉnh, thị xã, quận, Ủy ban nhân dân huyện thuộc thành phố trực thuộc trung ương phê duyệt nhiệm vụ và đồ án quy hoạch phân khu, quy hoạch chi tiết trong phạm vi địa giới hành chính do mình quản lý, trừ các quy hoạch đồ thị quy định tại khoản 1 và khoản 2 Điều này, sau khi có ý kiến thống nhất bằng văn bản của cơ quan quản lý quy hoạch đô thị cấp tỉnh.
4. Ủy ban nhân dân huyện thuộc tỉnh phê duyệt nhiệm vụ và đồ án quy hoạch chi tiết thị trấn, trừ các quy hoạch đô thị quy định tại khoản 1 và khoản 2 Điều này, sau khi có ý kiến thống nhất bằng văn bản của cơ quan quản lý quy hoạch đô thị cấp tỉnh.
5. Ủy ban nhân dân thành phố, thị xã, thị trấn có trách nhiệm báo cáo Hội đồng nhân dân cùng cấp về quy hoạch chung đồ thị trước khi trình cơ quan nhà nước có thẩm quyền phê duyệt quy hoạch này.
Cơ quan tổ chức lập quy hoạch đô thị có trách nhiệm phối hợp với Ủy ban nhân dân thành phố, thị xã, thị trấn trong việc báo cáo Hội đồng nhân dân cùng cấp về quy hoạch chung đô thị của thành phố, thị xã, thị trấn.
6. Chính phủ quy định cụ thể trình tự, thủ tục phê duyệt nhiệm vụ và đồ án quy hoạch đô thị.”.
8. Sửa đổi, bổ sung khoản 1 Điều 47 như sau:
“1. Có sự điều chỉnh về chiến lược phát triển kinh tế - xã hội, quốc phòng, an ninh, quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh hoặc điều chỉnh về địa giới hành chính làm ảnh hưởng lớn đến tính chất, chức năng, quy mô của đô thị hoặc khu vực lập quy hoạch;”.
9. Sửa đổi, bổ sung điểm a khoản 2 Điều 49 như sau:
“a) Điều chỉnh cục bộ quy hoạch đô thị được tiến hành khi nội dung dự kiến điều chỉnh không làm thay đổi tính chất, ranh giới, định hướng phát triển chung của đô thị; tính chất, chức năng, quy mô và các giải pháp quy hoạch chính của khu vực lập quy hoạch phân khu hoặc quy hoạch chi tiết; bảo đảm không làm quá tải hạ tầng kỹ thuật, hạ tầng xã hội của khu vực dự kiến điều chỉnh quy hoạch;”.
10. Sửa đổi, bổ sung Điều 51 như sau:
“Điều 51. Trình tự tiến hành điều chỉnh cục bộ quy hoạch đô thị
1. Cơ quan tổ chức lập quy hoạch đô thị có trách nhiệm sau đây:
a) Lập báo cáo về nội dung và kế hoạch điều chỉnh cục bộ quy hoạch đô thị;
b) Tổ chức xin ý kiến cộng đồng dân cư trong khu vực dự kiến điều chỉnh quy hoạch và các khu vực xung quanh chịu ảnh hưởng trực tiếp về nội dung và kế hoạch điều chỉnh cục bộ quy hoạch đô thị theo quy định tại Mục 2 Chương II của Luật này.
2. Cơ quan quản lý quy hoạch đô thị có thẩm quyền quy định tại Điều 41 của Luật này thẩm định về các căn cứ, điều kiện và nội dung điều chỉnh cục bộ quy hoạch.
3. Cơ quan có thẩm quyền phê duyệt quy hoạch đô thị xem xét, quyết định việc điều chỉnh cục bộ quy hoạch đô thị trên cơ sở ý kiến của cơ quan thẩm định quy hoạch đô thị.
Quyết định điều chỉnh cục bộ quy hoạch đô thị phải có các nội dung điều chỉnh và bản vẽ kèm theo.
4. Cơ quan tổ chức lập quy hoạch đô thị có trách nhiệm cập nhật và thể hiện trong hồ sơ quy hoạch những nội dung điều chỉnh. Nội dung điều chỉnh cục bộ quy hoạch đô thị phải được công bố công khai theo quy định tại Điều 53 của Luật này.”.
11. Sửa đổi, bổ sung khoản 1 Điều 52 như sau:
“1. Trường hợp cần phải điều chỉnh ranh giới hoặc một số chỉ tiêu sử dụng đất quy hoạch đô thị để thực hiện dự án đầu tư xây dựng công trình tập trung hoặc công trình riêng lẻ trong khu vực đã có quy hoạch chi tiết đã được phê duyệt, cơ quan có thẩm quyền căn cứ vào Quy chuẩn về quy hoạch đô thị, điều kiện hạ tầng kỹ thuật, hạ tầng xã hội của đô thị hoặc khu vực, Quy chế quản lý quy hoạch, kiến trúc đô thị để quyết định việc điều chỉnh quy hoạch.
Chính phủ quy định chi tiết khoản này.”.
12. Sửa đổi, bổ sung khoản 1 và khoản 2 Điều 53 như sau:
“1. Chậm nhất là 15 ngày, kể từ ngày quy hoạch được cơ quan có thẩm quyền phê duyệt, đồ án quy hoạch đô thị phải được công bố công khai bằng các hình thức sau đây:
a) Thông tin trên các phương tiện thông tin đại chúng; đăng tải thường xuyên, liên tục trên trang thông tin điện tử của cơ quan tổ chức lập quy hoạch, cơ quan lập quy hoạch;
b) Tổ chức hội nghị, hội thảo công bố quy hoạch đô thị có sự tham gia của đại diện tổ chức, cơ quan có liên quan, Mặt trận Tổ quốc Việt Nam, đại diện nhân dân trong vùng quy hoạch, cơ quan thông tấn báo chí;
c) Trưng bày thường xuyên, liên tục bản vẽ, mô hình, hệ thống cơ sở dữ liệu về quy hoạch đô thị tại trụ sở cơ quan quản lý nhà nước các cấp có liên quan về quy hoạch đô thị, trung tâm triển lãm và thông tin về quy hoạch đô thị, tại khu vực được lập quy hoạch;
d) In ấn, phát hành rộng rãi bản đồ quy hoạch đô thị, quy định về quản lý quy hoạch đô thị được phê duyệt.
2. Nội dung công bố công khai bao gồm toàn bộ nội dung của đồ án quy hoạch đô thị và Quy định quản lý theo đồ án quy hoạch đô thị, thiết kế đô thị đã được ban hành, trừ những nội dung liên quan đến quốc phòng, an ninh, bí mật nhà nước.”.
13. Sửa đổi, bổ sung khoản 2 và khoản 3 Điều 55 như sau:
“2. Việc cung cấp thông tin về quy hoạch đô thị được thực hiện dưới các hình thức sau đây:
a) Giải thích trực tiếp theo yêu cầu của cơ quan, tổ chức, cá nhân;
b) Cung cấp thông tin bằng văn bản giấy, văn bản điện tử theo yêu cầu của cơ quan, tổ chức, cá nhân;
c) Đăng tải trên trang thông tin điện tử của cơ quan quản lý nhà nước về quy hoạch đô thị và phương tiện thông tin đại chúng;
d) Cung cấp ấn phẩm về quy hoạch.
3. Ủy ban nhân dân các cấp có trách nhiệm tổ chức việc tiếp nhận, xử lý và cung cấp thông tin khi có yêu cầu. Các thông tin được cung cấp phải căn cứ vào đồ án quy hoạch đô thị, thiết kế đô thị đã được phê duyệt và Quy định quản lý theo đồ án quy hoạch, thiết kế đô thị đã được ban hành.
Đối với trường hợp cung cấp thông tin bằng văn bản, trong thời hạn 15 ngày, kể từ ngày có yêu cầu, cơ quan quản lý quy hoạch đô thị có trách nhiệm cung cấp thông tin cho cơ quan, tổ chức, cá nhân có yêu cầu.”.
14. Sửa đổi, bổ sung khoản 1 Điều 67 như sau:
“1. Việc xây dựng công trình ngầm phải tuân thủ quy hoạch không gian ngầm được xác định trong quy hoạch đô thị đã được phê duyệt, Quy chuẩn về xây dựng công trình ngầm do Bộ Xây dựng ban hành, Giấy phép xây dựng.”.
15. Bãi bỏ khoản 16 và khoản 17 Điều 3, khoản 5 và khoản 6 Điều 16, các điều 17, 56 và 71.
Điều 30. Bỏ từ, cụm từ tại các luật
1. Bỏ từ “quy hoạch,” tại các điều, khoản, điểm của các luật sau đây:
a) Khoản 1 Điều 69 và điểm a khoản 1 Điều 70 của Luật Chất lượng sản phẩm, hàng hóa;
b) Điểm a khoản 2 Điều 38 của Luật Dầu khí;
c) Khoản 2 Điều 235 của Bộ luật Lao động;
d) Khoản 1 Điều 10 của Luật Bảo hiểm xã hội;
đ) Khoản 2 Điều 6 của Luật Bảo hiểm y tế;
e) Khoản 1 Điều 58 của Luật Phòng, chống bệnh truyền nhiễm;
g) Khoản 1 Điều 48 của Luật Bảo vệ quyền lợi người tiêu dùng.
2. Bỏ cụm từ “quy hoạch và” tại khoản 1 Điều 40 của Luật Giám định tư pháp.
Điều 31. Hiệu lực thi hành
Luật này có hiệu lực thi hành từ ngày 01 tháng 01 năm 2019.
Luật này được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XIV, kỳ họp thứ 6 thông qua ngày 20 tháng 11 năm 2018.
