DECREE
Regulations on the framework of land prices

Pursuant to the Law on the Organization of the Government dated December 25, 2001;
Pursuant to the Land Law dated November 29, 2013;
At the proposal of the Minister of Natural Resources and Environment,
The Government issues this Decree on the framework of land prices.
Article 1. Scope of Regulation
This Decree stipulates the framework of land prices for each type of land, as specified in Article 113 of the Land Law.
Article 2. Applicability
1. State management agencies responsible for land; agencies with functions to establish, adjust, and review the framework of land prices and land price lists.
Organizations providing consultancy services for determining land prices, individuals practicing consultancy services for determining land prices.
MECHANISMS AND POLICIES REGARDING THE PRICE OF AUCTION SERVICES FOR ASSETS THAT MUST BE SOLD THROUGH AUCTIONS AS PRESCRIBED BY LAW
Article 3. Framework of land prices
1. Agricultural land group:
a) Framework of land prices for annual crop cultivation including rice fields and other annual crop cultivation lands - Appendix I;
b) Framework of land prices for perennial crop cultivation - Appendix II;
c) Framework of land prices for production forests - Appendix III;
d) Framework of land prices for aquaculture - Appendix IV;
đ) Framework of land prices for salt production - Appendix V.
2. Non-agricultural land group:
a) Framework of land prices for residential purposes in rural areas - Appendix VI;
b) Framework of land prices for commercial and service purposes in rural areas - Appendix VII;
c) Framework of land prices for non-agricultural production and business purposes that are not commercial or service purposes in rural areas - Appendix VIII;
d) Framework of land prices for residential purposes in urban areas - Appendix IX;
đ) Framework of land prices for commercial and service purposes in urban areas - Appendix X;
e) Framework of land prices for non-agricultural production and business purposes that are not commercial or service purposes in urban areas - Appendix XI.
Article 4. Economic zones for establishing the framework of land prices
The economic zones for establishing the framework of land prices include:
1. North midland and mountainous region comprising the provinces of Dien Bien, Lai Chau, Son La, Hoa Binh, Ha Giang, Tuyen Quang, Cao Bang, Bac Kan, Lao Cai, Yen Bai, Phu Tho, Lang Son, Thai Nguyen, Bac Giang, and Quang Ninh.
2. Red River Delta region comprising the provinces and centrally governed cities of Vinh Phuc, Bac Ninh, Hanoi, Hai Phong, Hai Duong, Hung Yen, Ha Nam, Nam Dinh, Thai Binh, and Ninh Binh.
3. North Central region comprising the provinces of Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, and Thua Thien Hue.
4. South Central Coast region comprising the provinces and centrally governed cities of Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Ninh Thuan, and Binh Thuan.
5. Central Highlands region comprising the provinces of Kon Tum, Gia Lai, Dak Nong, Dak Lak, and Lam Dong.
6. Southeast region comprising the provinces and centrally governed cities of Dong Nai, Binh Duong, Binh Phuoc, Ba Ria-Vung Tau, Tay Ninh, and Ho Chi Minh City.
7. Mekong Delta region comprising the provinces and centrally governed cities of Long An, Tien Giang, Ben Tre, Dong Thap, Vinh Long, Tra Vinh, Can Tho, Hau Giang, Soc Trang, An Giang, Kien Giang, Bac Lieu, and Ca Mau.
Article 5. Application of the framework of land prices
The framework of land prices shall be used as the basis for provincial People's Committees to establish and adjust land price lists at their localities. The land prices in the land price list and adjusted land price list shall comply with the provisions set out in Point a Clause 3 Article 11 of Decree No. 44/2014/NĐ-CP dated May 15, 2014 of the Government on land prices (hereinafter referred to as Decree No. 44/2014/NĐ-CP).
Article 6. Responsibility for Implementation
1. The Ministry of Natural Resources and Environment shall be responsible for:
a) Direct, guide, and inspect the application of the framework of land prices stipulated in this Decree when provincial People's Committees establish and adjust land price lists at their localities;
b) Organize the adjustment of the framework of land prices in accordance with the provisions of the Land Law and Decree No. 44/2014/NĐ-CP.
2. The Ministry of Finance shall be responsible for reviewing the establishment and adjustment of the framework of land prices in accordance with the law.
3. Other ministries and sectors shall, within their assigned functions and tasks, cooperate with the Ministry of Natural Resources and Environment in guiding and inspecting the application of the framework of land prices.
4. Provincial People's Committees shall base themselves on the framework of land prices stipulated in this Decree to organize the establishment and issuance of land price lists and adjusted land price lists at their localities.
Article 7. Effective Date
1. This Decree takes effect from December 29, 2014.
2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, organizations, and individuals concerned shall be responsible for implementing this Decree./.
