PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Law defines statistical activities, state information usage; rights, obligations, and responsibilities of agencies, organizations, and individuals in state statistical information collection and usage activities; organization of state statistics and statistical activities, usage of external statistical information outside state statistics.
Article 2. Scope of Application
This Law applies to databases, organizations providing personal information, implementing system activity lists, and using statistical information lists.
Article 3. Explanation of Terms
In this Law, the following terms shall be understood as follows:
1. Statistical Report Form is a model form and guidance for copying the form to collect data, statistically inform about the research object according to the best research method system determined within a certain period in the statistical report regime.
2. Statistical Reporting System is regulations and guidelines issued by state management agencies with verification authority regarding the implementation of a set of related reports to compile standard lists belonging to a statistical indicator system and aggregate other managed statistical information.
3. Statistical Indicator reflects characteristics about scale, development speed, infrastructure, level of dissemination, ratio relationship of economic-social components or the whole in specific spatial and temporal conditions. A statistical indicator includes the name and value of the indicator.
4. the Program statistics is a document approved by a state agency including a list of indicator systems, statistical program lists, reporting system lists, and other programs related to activity lists.
5. Statistical Database is a collection of data and related information organized in a specific structure for management, updating, and exploitation for statistical purposes and other purposes as prescribed by law. The statistical database is mainly formed from data and statistical information from statistical surveys, administrative records, statistical reports, and national databases, sectoral databases, local databases.
6. Administrative Data is state data copied, stored, updated in formal paper or electronic diagram form.

Statistical classification includes a category list and statistical classification content. The classification category system includes number codes and names of each part. 16. Estimated Statistical Data is statistical data predicting the overall results of ongoing economic and social phenomena, compiled from data of previous periods, updated according to reality, and data of future periods, using specialized methods for calculation.
17. Statistical Information is statistical data processed, compiled, and analyzed according to statistical methods, procedures, expertise, and professional practices to reflect the characteristics and attributes of the studied phenomenon. Statistical information includes statistical data and analysis figures.
18. TState Statistical Information is statistical information created by state statistical activities, having legal value, published by competent state agencies. Comprehensive Statistical Survey

Article 4. Purpose of the activity list
1. State statistical activities aim to provide statistical information for the following purposes:
a) Meeting the requirements, reporting situations, strategic orientations, planning, management, and economic and social development operations;
b) Meeting the requirements for monitoring and supervising the implementation of economic and social development strategies, plans, and policies;
c) Meeting the needs of using statistical information by agencies, organizations, and individuals.
2. Non-state statistical activities aim to provide statistical information for research, production, and business of organizations and individuals, and to meet other legitimate needs.
Article 5. Basic Principles of Statistical Activities and Data Usage
1. The basic principles of state statistical activities include:
a) Honesty, objectivity, accuracy, completeness, and timely response;
b) Professional and operational independence in statistics;
c) Uniformity in services, without duplication or overlap;
d) Transparency and openness;
đ) Comparability.
2. The basic principles of non-state statistical activities include:
a) The principles defined in points a, b, and c of Clause 1 of this Article;
b) Voluntariness and self-responsibility;
c) Not infringing upon national interests, rights, and benefits of agencies, organizations, and individuals.
3. The basic principles of data usage and statistical information usage include:
a) Citing the source of data and statistical information when using them;
b) Equality in subsequent and state statistical information data usage that have been published;
c) Ensuring the confidentiality of data and statistical information in accordance with the law.
Article 6. State Management of Statistics
1. Developing and implementing strategies, plans, policies for the development of statistical activities.
2. Drafting, prohibiting actions, organizing the enforcement of legal regulations on statistics.
3. Popularizing and educating about statistical laws.
4. Building state statistical organizations, training and enhancing statistical skills.
5. Organizing scientific research, applying advanced statistical methods and information technology to statistical activities.
6. International cooperation in statistics.
7. Inspecting and checking compliance with statistical laws and handling violations of such laws.
8. Resolving complaints and awards related to statistics.
Article 7. State Management Agencies for Statistics
1. The Government shall uniformly manage state affairs concerning statistics.
2. The Ministry of Planning and Investment is responsible before the Government for the unified state management of statistics.
3. Ministries and ministerial-level agencies within their respective functions and powers shall be responsible for managing state affairs concerning statistics in their sectors and fields of responsibility.
4. People's Committees at all levels within their respective duties and powers are responsible for state management of statistics in their localities.
Article 8. Specialized Statistical Inspection
1. Specialized statistical inspection is an inspection activity of authorized state agencies regarding organizations and individuals in the implementation of statistical laws and regulations concerning professional and operational matters in the field of statistics.
The central statistical agency is responsible for directing and organizing large-scale specialized statistical inspections nationwide.
The centralized statistical agencies at provincial level (hereinafter referred to as provincial-level statistical agencies) are responsible for organizing specialized statistical inspections locally.
2. Specialized statistical inspectors have the following tasks and powers:
a) Inspecting compliance with statistical laws and regulations concerning professional and operational matters in the field of statistics by agencies, organizations, and individuals;
b) Detecting, preventing, and handling violations of statistical laws within their authority or recommending competent state agencies to handle such violations.
3. Specialized statistical inspection activities, the rights and obligations of the head of the inspection team, inspectors, and civil servants performing specialized statistical inspection tasks shall be carried out in accordance with the law on inspection.
4. The Government shall specify detailed regulations on large-scale specialized statistical inspections.
Article 9. Funding for statistical activities
1. The State ensures funding for state statistical activities. Management, allocation, and utilization of funds for state statistical activities shall be carried out in accordance with the laws on the State budget.
2. Funding for statistical tables outside the scope of state organization lists shall be automatically guaranteed by the entities or individuals implementing such statistical activities.
Article 10. Serious Prohibited Acts in Statistical Activities and Information Usage
1. Serious violations in state statistical activities and the use of state statistical information include:
a) Failure to implement or incomplete implementation, failure to provide information promptly according to the prescribed statistical reporting methods and systems, and from administrative databases as decided by competent state authorities;
b) Misreporting, distorting statistical data;
c) Interfering, coercing, imposing, bribing, threatening, or enticing others to misreport, distort data, statistical information, and misuse statistical information;
d) Implementing regulations on statistical method adjustments, reporting systems, and primary data usage for statistical activities; automatically modifying information when making adjustments, statistical reports, and providing information from primary data;
đ) Reporting, publishing, disseminating inaccurate statistics;
e) Disclosing classified state statistical information; disclosing unpublished data and information; using data and information from sources, organizations, or individuals outside the target list without the consent of relevant agencies or organizations;
g) Deciding on statistical adjustments and prohibitions contrary to the provisions of the law on statistical reporting systems;
2. Serious violations in non-state statistical activities and information usage include:
a) Actions stipulated in points b, c, and e of Clause 1 of this Article;
b) Collecting and disseminating classified state statistical information, infringing upon the interests of the State, and the legitimate rights and interests of organizations and individuals.
Article 11. Handling Violations
Any person who violates the law on statistics shall be subject to disciplinary action, administrative violation handling, or criminal prosecution depending on the nature and severity of the violation; if damage is caused, compensation must be provided in accordance with the law.
Chapter II
NATIONAL STATISTICAL INFORMATION SYSTEM
Article 12. National Statistical Information System
1. National statistical information system.
2. Statistical information system of ministries, ministerial-level agencies, government agencies, Supreme People's Court, Supreme People's Procuracy, State Audit Agency (hereinafter referred to collectively as ministries and sectors).
3. Provincial-level statistical information system.
4. District-level statistical information system.
Article 13. National Statistical Information System
1. The national statistical information system reflects the main economic and social conditions of the country.
2. Statistical information in the national statistical information system includes:
a) Comprehensive statistical information;
b) Statistical information on ministries and sectors implementing and providing basic comprehensive statistics.
3. Developing plans and investing in, managing the national statistical information system, provincial-level, and district-level statistical information systems effectively; organizing and coordinating connections, data, and information provision among national statistical information systems.
Article 14. Specialized Information Statistical System
1. The specialized information statistical system of ministries and sectors reflects the main economic and social situation of the industry and field.
2. Information statistics within the specialized information statistical system include the following specialized fields:
a) Statistics of information implemented by ministries and sectors.
b) Information statistics of specialized agencies under provincial People's Committees, High People's Courts, Provincial People's Courts, High People's Procuratorates, and Provincial People's Procuratorates provided to ministries and sectors for consolidation.
3. The Minister, Head of a ministry-level agency, government management body, President of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy, and State Auditor are responsible for building and managing the specialized information statistical system.
Article 15. Provincial Information Statistical System
1. The provincial information statistical system reflects the main economic and social situation of the provincial administrative unit.
2. The provincial information statistical system includes:
a) Statistics of information implemented by the provincial statistical office.
b) Information of specialized agencies under the provincial People's Committee, Provincial People's Court, Provincial People's Procuracy, and specialized agencies under ministries and ministry-level agencies at the provincial administrative unit provided to the provincial information statistical system for consolidation.
3. The head of the provincial statistical office is responsible for managing the provincial information system.
The heads of agencies specified in point b, Clause 2 of this Article are responsible for managing statistical information within their assigned industries and fields.
Article 16. District Information Statistical System
1. The district information statistical system includes:
a) Statistical information implemented by the centralized statistical office at the district administrative unit (hereinafter referred to as the district statistical office).
b) Statistical information of specialized agencies under the district People's Committee, District People's Court, District People's Procuracy, and specialized agencies under ministries and ministry-level agencies at the district administrative unit, and the People's Committee of communes provided to the district information statistical system for consolidation.
2. The head of the district statistical office ensures responsibility for managing the district information statistical system.
The heads of agencies specified in point b, Clause 1 of this Article are responsible for managing statistical information within their assigned industries and fields.
Article 17. National Indicator Statistical System
1. The national indicator statistical system is a collection of key indicators issued by state agencies with authority to collect information for forming the national statistical information system.
2. The construction of the national indicator statistical system must meet the following requirements:
a) Reflecting the national economic and social situation.
b) Being consistent with Vietnam's reality.
c) Meeting international standards.
3. The national indicator statistical system includes:
a) National indicators compiled by the national statistical file system.
b) National indicators implemented by ministries and sectors.
4. The list of national statistics is stipulated in the Appendix attached to this Law.
5. The national statistical system serves as the basis for coordinating and integrating between ministries and sectors in developing national statistical control programs, using data for operational statistics, reporting systems, and other related programs.
6. The Minister of Planning and Investment directs ministries and sectors in managing the content of statistical indicators within the national statistical system; guides, monitors, and reports on the implementation of the national indicator statistical system.
Article 18. Adjustment and Supplement to the National Statistical Indicators Catalogue
Based on the tasks of economic and social development, state management requirements, and international integration during each period, the Government shall promptly submit to the National Assembly for amending and supplementing the National Statistical Indicator Catalogue through a simplified procedure.
Article 19. System of Specialized Statistical Indicators
1. The system of statistical indicators of ministries and specialized sectors is a collection of statistical indicators issued by the Minister, Head of a ministry-level agency, President of the Supreme People's Court, Rector of the Supreme People's Procuracy Academy, State Auditor General to collect information forming the system of information for the statistical system of ministries and specialized sectors.
2. The system of statistical indicators includes:
a) Statistical indicators that ministries and sectors implement themselves;
b) Statistical indicators that ministries and sectors implement through related agencies under the Government, High People's Courts, High People's Procuracies according to sectoral management requirements;
c) Statistical indicators that provincial-level People's Committees, Provincial People's Courts, Provincial People's Procuracies, specialized agencies under ministries and ministry-level agencies at the provincial administrative level provide to ministries and specialized sectors for consolidation.
3. The system of statistical indicator catalogues is established in accordance with the national and international statistical indicator systems. The system of statistical indicator catalogues serves as the basis for distribution among state agencies in developing adjustment programs, using action data for statistical activities, and reporting levels at the sectoral and specialized levels.
4. The Minister, Head of a ministry-level agency, President of the Supreme People's Court, Procurator-General of the Supreme People's Procuracy, State Auditor General shall issue the system of statistical indicators of ministries and specialized sectors within their areas of responsibility.
5. Agencies under the Government shall bear the responsibility for building and submitting the statistical indicators of their assigned fields to the Minister in charge of the respective ministry or sector for issuance.
Article 20. Review of the System of Statistical Indicators, Specialized Sectors
1. The system of statistical indicators of specialized sectors must be verified by an independent statistical body regarding professional and technical aspects before implementation.
2. The submitted documents include:
a) A document requesting review;
b) Draft statistical indicator table;
c) List of contents of the draft.
3. The verification content includes the purpose; group, name of the indicator; concept; calculation method; main classification; publication period; data source.
4. The verification period is 20 days from the date the verification body receives all submitted documents.
5. Ministries and specialized sectors have the responsibility to study and respond in writing to the central statistical agency, clearly stating whether they will adopt or not adopt the review comments and adjust the system of statistical indicators of ministries and specialized sectors. The Minister, Head of a ministry-level agency, President of the Supreme People's Court, Procurator-General of the Supreme People's Procuracy, State Auditor General shall bear responsibility for the statistical indicator systems they issue.
Article 21. Adjustment and supplementation of the system of statistical indicators and specialties
1. The Minister, Head of a ministerial-level agency, President of the Supreme People's Court, Prosecutor General of the Supreme People's Procuracy, State Auditor adjust and supplement the system of statistical indicators of the ministry, specialty in accordance with the adjustment and supplementation of related statistical indicators in the national index system and management requirements of the ministry, specialty.
2. The adjustment and supplementation of the statistical indicators of the ministry, specialty must be professionally and technically verified by the statistical agency before implementation. Verification shall be carried out in accordance with Article 20 of this Law.
Article 22. System of Statistical Indicators at Provincial, District, and Commune Levels
1. The system of statistical indicators at the provincial level is a collection of statistical indicators to form the national statistical information system and the provincial statistical system.
The system of statistical indicators at the district level is a collection of statistical indicators to form the provincial statistical information system and the district statistical information system.
The system of statistical indicators at the commune level is a collection of statistical indicators to form the district statistical information system.
2. The system of statistical indicators at the provincial, district, and commune levels serves as the basis for analysis and distribution among state agencies in statistical activities at each level and the establishment of reporting statistical systems at different levels and specialties.
3. The system of statistical indicators at the provincial, district, and commune levels is established in accordance with the national statistical indicator system and meets local management requirements.
4. The Ministry of Planning and Investment has the following responsibilities:
a) To develop and submit for approval
b) To guide, inspect, and report on the implementation results of the system of statistical indicators at the provincial, district, and commune levels.
Article 23. Classification of Statistics
1. The classification of statistics is uniformly used in state statistical activities and serves as the basis for uniform application in state administration.
2. The classification of statistics includes:
a) National statistical classification;
b) Specialized and sectoral statistical classification.
Article 24. National Statistical Classification
1. The national statistical classification is a general statistical classification applied across multiple sectors and nationwide scope.
2. The national statistical classification includes:
a) Specialized economic system;
b) Specialized product system;
c) List of export and import goods;
d) List of export and import services;
đ) List of main units of action;
e) List of regions;
g) List of occupations;
h) List of education and training;
i) List of ethnic groups in Vietnam;
k) List of religions in Vietnam;
l) Other types of national statistics.
3. The national statistical classification is developed in accordance with international information and Vietnamese reality, used in state statistical activities, building administrative registration systems, national databases, sectoral databases, local databases, and other related state management activities.
4. Planning and investment owner, distribution, construction, specialized section establishment
Article 25. Specialized and Sectoral Statistical Classification
1. The specialized and sectoral statistical classification is a statistical classification applied to sectors and fields and consistent with the corresponding national statistical classification.
2. The Minister, Head of a ministerial-level agency, President of the Supreme People's Court, Prosecutor General of the Supreme People's Procuracy, State Auditor issue the specialized and sectoral statistical classification not covered by the national statistical classification.
3. Government-affiliated entities bear responsibility for developing and submitting to the Minister or Head of a ministerial-level agency managing the state administration of the sector or field for issuance of the specialized and sectoral statistical classification assigned to them.
Article 26. Review of Specialized and Sectoral Statistical Classification
1. Specialized and sectoral statistical classification must be professionally verified by the central statistical agency before implementation.
2. The submitted documents include the request for determination and the draft list of proposed classifications.
3. The contents to be determined include objectives, basis, scope, and the list of positions for statistical classification.
4. The verification period is 20 days from the date the verification body receives all submitted documents.
5. Ministries and specialized sectors are responsible for researching and resolving through written documents sent to the central statistical agency, detailing whether to collect or not to collect opinions on review and adjustment, and promulgating specialized and sectoral statistical classification. The Minister, Head of a ministry-level agency, President of the Supreme People's Court, Procurator General of the Supreme People's Procuracy, State Auditor General shall bear responsibility for the statistical classification of their respective sectors.
Chapter III
NATIONAL STATISTICAL INFORMATION COLLECTION
Section 1
STATISTICAL INVESTIGATION
Article 27. Types of National Statistical Surveys
1. National comprehensive statistical surveys and surveys within the national statistical survey program.
2. Surveys outside the national statistical survey program.
Article 28. National Statistical Survey Program
1. The national statistical survey program is decided by the Prime Minister and conducted periodically to collect essential information for compiling national statistical indicators.
The national statistical survey program includes the name of the survey, purpose, subjects, units, type of survey, content, period, time of survey, and the leading and cooperating agencies.
2. Planning and investment responsibilities include:
a) Drafting, submitting to the Prime Minister for issuance or amendment of the national statistical survey program;
b) Guiding, inspecting, and reporting on the implementation results of the national statistical survey program.
3. The authority to decide on conducting surveys within the national statistical survey program is as follows:
a) The Prime Minister decides on conducting national comprehensive statistical surveys;
b) The Minister, Head of a ministry-level agency, government agency, President of the Supreme People's Court, Procurator General of the Supreme People's Procuracy, State Auditor General decide on conducting statistical surveys assigned within the national statistical survey program.
Article 29. National Comprehensive Statistical Surveys
1. National comprehensive statistical surveys include:
a) Population and housing census;
b) Rural and agricultural census;
c) Economic census;
d) Other national censuses.
2. The basis for implementing national statistical compilation includes:
a) Central statistical management and distribution bases for ministries, sectors, and localities implementing adjustments and compilations as specified in points a, b, and c of this Article;
b) The Prime Minister assigns the implementation base for the census specified in point d of Clause 1 of this Article.
3. Planning and investment ownership, distribution of programs, and construction of special sections
Article 30. Surveys Outside the National Statistical Survey Program
1. Surveys outside the national statistical survey program include:
a) Statistical surveys of exports when natural disasters, epidemics, or other exceptional cases occur;
b) Statistical surveys collecting information on statistical indicators required for management by ministries and specialized sectors under their jurisdiction but not dependent on the national statistical indicator system;
c) Statistical surveys collecting information with specific characteristics serving the management requirements of provincial People's Committees.
2. The authority to decide on conducting statistical surveys outside the national statistical survey program is as follows:
a) The Minister, Head of a ministry-level agency, government agency, President of the Supreme People's Court, Procurator General of the Supreme People's Procuracy, State Auditor General decide on the program and organization of statistical surveys specified in points a and b of Clause 1 of this Article;
b) The Chairman of the provincial People's Committee decides on the program and organization of statistical surveys specified in point c of Clause 1 of this Article.
Article 31. Survey Plan
1. Each statistical survey must have a survey plan attached to the decision on conducting the statistical survey issued by the competent state agency.
2. The survey plan includes the following main contents:
a) Purpose and requirements of the survey;
b) Scope, subjects, and units of the survey;
c) Survey location;
d) Time points, duration, and methods of the survey;
đ) Content and survey forms;
e) Statistical classification used in the survey;
g) Processing procedures and output presentation of the survey;
h) Action plan;
i) Survey organization;
k) Budget and material conditions for the survey.
Article 32. Review of Survey Methods
1. The survey plan for national statistical surveys programs under Article 30(1) of this Law must be reviewed by the central statistical agency regarding professional and technical aspects before implementation.
2. The submitted documents include the request for review and draft survey plan.
3. The review content includes objectives, scope, subjects, and units of the survey; type of survey; time points, duration, and methods of the survey; content and survey forms, and statistical classifications used in the survey.
4. The verification period is 20 days from the date the verification authority receives all submitted documents. In cases of reviewing survey methods under point a of Article 30(1) of this Law, the verification period is five working days.
5. Ministries, sectors, provincial People's Committees are responsible for researching and providing written comments to the central statistical agency, clearly stating whether to continue or not to collect opinions on the review and adjustment of the survey method, and promulgating the adjusted survey method. Ministers, heads of ministerial-level agencies, Chief Justice of the Supreme People's Court, Procurator General of the Supreme People's Procuracy, State Auditor General, and Chairpersons of provincial People's Committees are accountable for the survey methods they issue.
Article 33. Rights and Obligations of Organizations and Individuals Conducting Statistical Surveys
1. Organizations and individuals conducting statistical surveys have the following rights:
a) To be informed about the decision, objectives, requirements, scope, main contents, and deadlines of the survey;
b) To ensure the confidentiality of information provided to the statistical survey administrator in accordance with Article 57 of this Law;
c) To lodge complaints or reports against violations of laws related to statistical surveys.
2. Organizations and individuals conducting statistical surveys have the following obligations:
a) To provide truthful, accurate, complete, and timely information as required by the statistical surveyor or the agency conducting the statistical survey;
b) Not to refuse or delay providing statistical information;
c) To accept inspection by the agency conducting the statistical survey and the large-scale audit regarding the information provided.
Article 34. Rights and Obligations of Statistical Surveyors
1. Statistical surveyors have the following rights:
a) Professional and technical independence in performing tasks of collecting information according to the survey plan and guidance of the agency conducting the statistical survey;
b) To receive training in professional and technical aspects of statistical surveys, to be equipped with tools serving the collection of information, and to be compensated;
c) To require the surveyed organizations and individuals to provide information according to the survey method and guidance of the survey management agency.
2. Statistical surveyors have the following duties:
a) To perform the collection of information according to the survey method and accurate guidance of the agency conducting the statistical survey;
b) To keep confidential the information collected from organizations and individuals subject to the statistical survey;
c) To submit documents and survey forms according to the guidance of the agency conducting the statistical survey.
Article 35. Responsibilities of the investigative agency for statistical purposes
1. Develop adjustment plans for statistics.
2. Direct, organize, supervise, and inspect the implementation of administrative statistical methods.
3. Inspect the provision of information by organizations and individuals listed in the statistical registry.
4. Compile, analyze, and publish results of statistical investigations.
5. Maintain confidentiality of collected statistical information.
6. Report statistical results to the system of database agencies as follows:
a) The agency implementing adjustments defined at points a and b, Clause 1, Article 30 of this Law shall report statistical investigation results to the central statistical agency.
b) The agency implementing adjustments defined at point c, Clause 1, Article 30 of this Law shall report statistical investigation results to the provincial statistical agency.
Section 2
USE OF ADMINISTRATIVE DATA FOR NATIONAL STATISTICAL ACTIVITIES
Article 36. Use of administrative data for national statistical activities
1. Using administrative data for national statistical activities means collecting data and compiling information about research objects from administrative records. The main activity of administrative data for state activities is statistical data compilation.
2. Contents of using administrative data in national statistical activities include:
a) Compiling statistical data, compiling statistical index data, and preparing reports according to reporting systems.
b) Preparing or updating templates for adjustment tables.
c) Building and updating databases.
3. Administrative databases used in national activities include:
a) User databases;
b) Land databases;
c) Economic entity databases;
d) Tax base data;
đ) Naval databases;
e) Insurance databases;
g) Other administrative databases.
4. Prioritize building administrative databases required for management and national statistical activities.
Article 37. Provision of data in databases for national statistical activities
1. The contents of the databases defined in Clause 3, Article 36 of this Law provided for national statistical activities include:
a) Lists of data fields with links and data;
b) Data formats, definitions, and related attributes of data fields;
c) Methods, frequency, and time-based data provision.
2. Conditions ensuring the provision and receipt of data include information infrastructure, human resources, and finance.
3. The central statistical agency has the responsibility to coordinate with the specific administrative database management agencies regarding the contents stipulated in Clause 1 of this Article.
Article 38. Tasks and powers of administrative database management agencies
1. Build administrative databases required for managing sectors, areas, and national statistical activities.
2. Provide data and information from managed databases to the central database as prescribed by this Law.
3. Refuse requests for data and information from managed databases if they contravene legal provisions.
Article 39. Tasks and powers of intermediate databases in managing and using administrative data
1. Receive, manage, and use data and information from primary databases to provide data management for national statistical activities.
2. Protect information as stipulated in Article 57 of this Law.
3. Not to provide third-party data and information from provided primary databases unless the managing database agency gives reasonable consent.
Section 3
STATISTICAL REPORTING REGIME
Article 40. Statistical Reporting System
1. The list of reporting modes includes:
a) National level reporting;
b) Statistical reporting at the level and by specialty.
2. The list of statistical reporting contents includes objectives, scope lists, application objects, reporting positions, receiving units, symbols, any reports, deadlines for receiving reports, methods of sending reports, and accompanying forms according to the explanation of the statistical reporting model tool.
Article 41. National Level Statistical Reporting System
1. The national level reporting system is implemented to collect statistical information belonging to the national statistical indicator system.
2. Agencies and organizations implementing the national level reporting system include:
a) Ministries, sectors; central agencies of political organizations, political-social organizations;
b) Other agencies and organizations as prescribed by law.
3. The Government shall provide detailed content on national-level reporting.
Article 42. Ministry-Level Statistical Reporting System, Specialty
1. The ministry-level and specialty statistical reporting system is implemented to collect statistical information belonging to the national statistical indicator system, the ministry-level statistical indicator system, the provincial-level statistical indicator system, the district-level statistical indicator system, and other information lists to serve specialized management requirements, fields.
2. Agencies and organizations implementing the ministry-level statistical reporting system include:
a) Specialized agencies under provincial and district People's Committees; Provincial and district People's Courts; specialized institutions, parallel institutions located in localities;
b) Other agencies and organizations as prescribed by law.
3. The authority to issue the ministry-level and specialty reporting system is as follows:
a) Ministers, Heads of ministries equivalent to ministers, Chief Justices of the Supreme People's Court, Procurators General of the Supreme People's Procuracy, State Audit Chair promulgate the ministry-level and specialty statistical reporting systems;
b) Agencies under the Government are responsible for drafting, presenting, and issuing the ministry-level and sector-specific statistical reporting systems applicable to assigned fields.
Article 43. Review of Ministry-Level Statistical Reporting Systems, Specialty
1. The ministry-level statistical reporting system must be based on professional and vocational statistical databases before being issued.
2. The dossier submitted for review includes the proposed document, draft document, forms, and explanations of the reporting forms.
3. The determination content includes objectives, application objects, collection scope, compilation, forms, and explanations of the reporting models.
4. The verification period is 20 days from the date the verification body receives all submitted documents.
5. Ministries and specialties have the responsibility to study and resolve by document the average database, clearly stating the subsequent collection or non-collection of review opinions and adjustments, and issuing the ministry-level and specialty statistical reporting systems. Ministers, Heads of ministries equivalent to ministers, Chief Justices of the Supreme People's Court, Procurators General of the Supreme People's Procuracy, State Audit Chair guarantee the ministry-level and sector-specific statistical reporting systems they issue.
Article 44. Rights and Obligations of Agencies and Organizations Implementing Statistical Reporting Systems
1. Agencies and organizations implementing statistical reporting systems have the following rights:
a) Independence in professional and vocational matters in performing tasks of collecting and compiling information;
b) To receive guidance on implementing the statistical reporting system;
c) To access and use data from state-managed databases related to their management base for compiling statistical data;
d) To appeal decisions that violate regulations on the statistical reporting system when there is a basis to believe that the decision is unlawful.
2. Agencies and organizations implementing statistical reporting systems have the following obligations:
a) To collect, compile, set up, and report in accordance with the provisions of the statistical reporting system and the guidance of competent state agencies; bear responsibility for the accuracy of reported information;
b) To ensure confidentiality of information related to entities, organizations, and individuals during the implementation of the reporting system;
c) Not to refuse or obstruct the implementation of statistical reporting;
d) To be subject to inspection by the receiving agency;
e) To be subject to professional and vocational inspection and audit by specialized statistical auditors.
Chapter IV
STATISTICAL ANALYSIS AND FORECASTING, ANNOUNCEMENT AND DISSEMINATION OF NATIONAL STATISTICAL INFORMATION
Article 45. Analysis and Forecast Statistics
1. Analysis and reporting of construction service statistics, evaluation of strategy implementation, policies, plans for socio-economic development.
2. Target zoning to clarify specific indicators of socio-economic phenomena; changes and influencing factors, roles and reciprocal impacts of each factor on the phenomenon over time and space. Statistical forecasting aims to provide directions for the development of socio-economic phenomena.
3. Analysis and forecast statistics must be truthful, objective, comprehensive based on collected, compiled, stored, systematized statistical information data and the actual situation's developments.
4. State statistical organization agencies have the responsibility to analyze and forecast statistics according to the statistical program.
Article 46. Tasks of Ministries and Sectors for National Standard Statistical Indicators
1. The Minister, Head of equivalent ministries, agencies under the Government, Chief Justice of the Supreme People's Court, Procurator General of the Supreme People's Procuracy, State Auditor General shall ensure the accuracy of statistical data assigned to collect and compile within the national statistical indicator system.
2. Ministries and sectors are responsible for collecting and compiling statistical data assigned within the national statistical indicator system and submitting verification files as stipulated in Clause 1, Article 47 of this Law to the determined central statistical agency.
Article 47. Verification of Statistical Data of Ministries and Sectors in the National Statistical Indicator System
1. The verification file includes the request for verification, draft statistical data table, scope decoding, calculation method, and data collection and compilation sources.
2. The content verified includes the scope, calculation method, and data source of the focal point.
3. The verification period starts from the date of receiving complete verification files and is specified as follows:
a) Three working days for estimated statistical data;
b) Seven working days for statistical data diagrams;
c) Twenty days for officially certified statistical data.
4. Based on the central statistical agency's verification opinions, the sector is responsible for researching, following up, explaining in writing, and adjusting the statistical data collected and compiled by the ministry or sector. If the sector cannot follow the central statistical agency's verification structure, the central statistical agency will automatically decide and ensure responsibility.
Article 48. Publication of State Statistical Information
1. Levels of statistical data published include:
a) Estimated statistical data;
b) Statistical data diagrams;
c) Officially certified statistical data.
2. Authority to publish statistical information is defined as follows:
a) Central statistical agencies publish dependent statistical information based on the national statistical system;
b) The Minister, Head of equivalent ministries, agencies under the Government, Chief Justice of the Supreme People's Court, Procurator General of the Supreme People's Procuracy, State Auditor General publish statistical information within their respective fields, except for the information specified herein;
c) Chairman of the Provincial People's Committee publishes statistical information from the results adjusted as stipulated in Point c, Clause 1, Article 30 of this Law;
d) Heads of provincial-level agencies publish statistical information based on the provincial, district, and commune-level statistical systems.
3. Those authorized to publish statistical information are responsible for the published information.
Article 49. Statistics Information Dissemination
1. Statistics information that has been published according to this Law must be disseminated promptly, fully, widely, openly, and transparently.
2. Methods of dissemination include:
a) Electronic information pages of state-dependent systems; electronic information pages of state agencies;
b) Press conferences, media reports;
c) Mass media;
d) Publishing publications, various forms of electronic information storage.
3. The National Statistical Yearbook shall be disseminated in June of the following year.
4. The dissemination schedule for state statistics information is a manifestation of the dissemination of statistics within the system of statistical indicators established and publicly announced by the competent authority.
5. The Government shall provide detailed regulations on the dissemination of state statistics information.
Chapter V
RESEARCH, APPLICATION OF STATISTICAL METHODS, INFORMATION AND COMMUNICATION TECHNOLOGY - INTERNATIONAL COOPERATION IN STATE STATISTICS
Article 50. Research and Application of Advanced Statistical Methods
1. The State prioritizes research and application of advanced statistical methods in statistical activities according to international standards and practices, suitable for the economic and social development conditions of each period in the country.
2. Priority areas for research and application of advanced statistical methods include:
a) Researching measurement methods for new socio-economic phenomena to reflect comprehensively, accurately, and timely the process of development and international integration of the country;
b) Researching and applying statistical classifications according to international standards;
c) Compiling, translating, and disseminating advanced statistical guidance materials.
3. The Minister of Planning and Investment organizes and coordinates the research and application of advanced statistical methods in state statistical activities. The Ministers, Heads of ministerial-level agencies, government agencies, Chief Justices of the Supreme People's Court, Procurators General of the Supreme People's Procuracy, State Auditor General, Chairpersons of provincial and district People's Committees organize the implementation of research and application of advanced statistical methods in their respective fields and regions.
Article 51. Development and Application of Information and Communication Technology
1. The State prioritizes investment in the development and application of advanced information and communication technology in state statistical activities including:
a) The information infrastructure system of the state organization;
b) A system comprising centralized national database, management center database, list databases established from sources defined by this Law; connecting the national database of the system with other national databases, specialized databases to provide and update information;
c) Departmental and specialized system databases and their connection with the national system database;
d) Application software;
e) Advanced information collection and dissemination tools and methods including tablets, smartphones, laptops, electronic forms, online information collection forms, image protection technology, geographic information systems, and other advanced information collection and dissemination tools and methods.
2. The State encourages businesses operating in the field of information and communication technology to provide products and services for the development and application of information and communication technology in statistical activities.
3. The Minister of Planning and Investment organizes and distributes activities for the development and application of information and communication technology, ensuring synchronization, computerization, and standardization in state statistical activities. The Ministers, Heads of ministerial-level agencies, government agencies, Chief Justices of the Supreme People's Court, Procurators General of the Supreme People's Procuracy, State Auditor General, Chairpersons of provincial and district People's Committees organize the implementation of the development and application of information and communication technology in the statistical activities of departments, large units, and means.
Article 52. International Cooperation in Statistics
1. International cooperation in statistics aims to ensure that statistical data meet the requirements for international integration, enhance the position of Vietnamese statistics in the region and globally.
2. Main activities in international cooperation in statistics include:
a) Sharing statistical information;
b) Applying statistical methods;
c) Training human resources;
d) Comparative international cell;
đ) Attracting resources;
e) Applying science and technology.
3. The Minister of Planning and Investment and the advisory body distribute international activities within the state. The Minister, the head of ministerial-level agencies, government agencies, the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the State Auditor General, the Chairmen of Provincial People's Committees, and District People's Committees organize the implementation of international cooperation activities in statistics in their respective fields of management.
Chapter VI
USE OF STATISTICAL DATABASES AND NATIONAL STATISTICAL INFORMATION
Article 53. Use of databases to manage statistical databases
1. The management of statistical databases is regulated and meets the legitimate needs of agencies, organizations, and individuals.
2. The database serving central statistical management (hereinafter referred to as the statistical database) includes:
a) Population statistical database;
b) Economic entity statistical database;
c) Statistical database on rural areas and agriculture;
d) Other specialized databases.
3. Data and information in the statistical database defined in Clause 2 of this Article shall only be provided to agencies, organizations, and individuals using such statistical information after the relevant information has been managed according to the regulations stipulated in Article 48 of this Law.
Article 54. Tasks and Authorities of Central Statistical Database in Managing and Using Statistical Databases
1. Establish databases in accordance with the provisions of this Law.
2. Determine access and usage regimes for data and information related to the list of information already published in the database list.
3. Provide data and information related to the list of information already published in the database to agencies, organizations, and individuals; protect the information of organizations and individuals during the provision of data.
4. Refuse requests for providing data and information if they contravene the provisions of the law.
5. Inspect and handle violations of the law in the use of databases.
Article 55. Rights and Obligations of Agencies, Organizations, and Individuals in the Work of Using Statistical Databases
1. Have the right to use data and information related to the list of information already published in the database list.
2. Protect information as stipulated in Article 57 of this Law.
3. Shall not provide third-party data from the provided database unless permitted by the database management authority.
Article 56. Use of National Statistical Information
1. State agencies use national statistical information that has been published to evaluate situations, report conditions, develop strategic plans, build plans, policies, manage, direct economic and social development, and inspect, audit, and supervise.
2. Agencies, organizations, and individuals use national statistical information that has been published to serve their activities.
3. Statistical organizations under the national statistical system, within their functions and tasks, have the responsibility to meet the legitimate needs for the use of national statistical information arranged by agencies, organizations, and individuals.
Article 57. Confidentiality of State Statistical Information
1. Types of state statistical information that must be kept confidential include:
a) Information linked to the name and specific address of each organization or individual, except where the organization or individual consents or where the law provides otherwise;
b) Unconfirmed statistical information arranged by the person assigning it;
c) Statistical information classified as state secrets.
2. The confidentiality of state statistical information shall be implemented in accordance with the provisions of the law.
Article 58. Rights and Obligations of Agencies, Organizations, and Individuals in Using Statistical Data and Information
1. Equality in using published information tables hereinafter.
2. Using published statistical information lists.
3. Citing and using published statistical information lists must be truthful and identify the source of the information.
4. Participating in opinions on the quality of statistical databases.
5. Complaining and reporting violations of the law in the use of data and statistical information.
6. Having the responsibility to reasonably distribute with the intermediate statistical agency in performing the tasks specified in Clause 2, Article 59 of this Law.
Article 59. Tasks and Authorities of Intermediate Statistical Agencies in Using Statistical Data and Information
1. Implementing the provisions of Clause 3, Article 56 and maintaining the confidentiality of statistical information as stipulated in Article 57 of this Law.
2. Periodically or unexpectedly inspecting the functions of using statistical data and information lists of national statistics indicators, provincial, district, and commune-level statistics indicators that have been granted certification rights.
3. The content of the inspection includes:
a) The accuracy and appropriateness of the statistical data being used compared to the published statistical data;
b) Citing the source of the information.
4. In cases where violations are discovered in the use of published statistical data, they will be handled within the authority or referred to the competent state agency for handling violations of the law on statistics.
Article 60. Seeking Opinions from Users of State Statistical Information
1. State statistical organizations under the state statistical organization system are responsible for seeking opinions from users of state statistical information on the quality of statistical data to improve the quality of statistical parameters and perfect the statistical system.
2. Forms of seeking user opinions include surveys of user needs and satisfaction with statistical information, user information conferences, and online surveys.
3. The Ministry of Planning and Investment leads, distributes activities, and reports on the results of seeking opinions from users of state statistical information.
Chapter VII
STATE STATISTICAL ORGANIZATIONS
Article 61. State Statistical Organization System
1. Centralized statistical system.
2. Statistical organizations of ministries and sectors.
Article 62. Centralized Statistical Organization System
1. The centralized statistical organization system is organized vertically and includes central statistical agencies and local statistical agencies.
2. The independent central statistical foundation is under the Ministry of Planning and Investment.
3. The central statistical agency is the national statistical agency, performing advisory functions to assist the Minister of Planning and Investment in managing state affairs related to statistics, coordinating statistical activities, organizing statistical activities, and providing economic and social statistical information to organizations and individuals.
4. Local statistical agencies include provincial statistical agencies and district statistical agencies.
5. The Government shall specify the functions, tasks, authorities, and organizational structure of the centralized statistical organization system.
Article 63. Statistics of Ministries and Sectors
1. The Government shall determine the functions, tasks, and organizational structure of statistics at the ministerial level and sectoral foundations.
2. Ministers, Heads of ministerial-level agencies, agencies under the Government, Chief Justices of the Supreme People's Court, Procurators General of the Supreme People's Procuracy, State Auditors, according to their assigned tasks, shall be responsible for organizing and implementing statistical work within their ministries and sectors.
Article 64. Statistics in Units Engaged in Main Social Activities
The People's Committee at the commune level shall be responsible for organizing and implementing the census work required for commune-level management, implementing conditions for statistical management, and the state's statistical reporting system.
Article 65. Statistical Work in State Agencies and Public Service Units
State agencies and public service units established according to their tasks and authorities shall be responsible for organizing statistical services to meet management requirements and provide information to centralized statistical organizations, implementing statistical management and the state's statistical reporting system as prescribed by law.
Article 66. Persons Engaged in Statistical Work
1. The list of persons engaged in statistical work includes those working in the national statistical system, at the commune level, in state agencies, public service units, and statistical surveyors.
2. The job list of persons engaged in statistical work must include the following criteria:
a) Having good moral character, honesty, objectivity, and a sense of compliance with the law;
b) Possessing professional qualifications in statistical services.
3. Persons engaged in statistical work shall operate independently in terms of profession and business within the scope of statistical activities.
4. Persons engaged in statistical work must comply with legal regulations on statistics, implement, and ensure responsibility for the tasks assigned to them.
Chapter VIII
STATISTICAL ACTIVITIES AND THE USE OF STATISTICAL INFORMATION OUTSIDE THE NATIONAL STATISTICAL SYSTEM
Article 67. Scope of Statistical Activities Outside the National Statistical System
1. Collecting, processing, summarizing, analyzing, and forecasting statistical information for research, production, business, and legitimate needs of organizations, individuals, or other entities.
2. Implementing statistical services.
Article 68. Requirements for Statistical Activities Outside the National Statistical System
1. Adhering to laws and legal commitments regarding professional activities, statistical information, and the use of statistical information outside the national statistical system created by themselves.
2. Implementing the basic principles of statistical activities outside the national statistical system as stipulated in Clause 2 of Article 5 of this Law.
3. Conducting data collection based on voluntary consent and agreement to provide information from organizations and individuals being surveyed.
Article 69. Value of Statistical Information Outside the National Statistical System
Statistical information outside the national statistical system does not have the value to replace the statistical information of the national statistical system as prescribed in Clause 1 of Article 56 of this Law.
Chapter IX
IMPLEMENTING PROVISIONS
Article 70. Effective Date
Article 70. Effective Date
1. This Law takes effect from July 1, 2016.
2. The Statistics Law No. 04/2003/QH11 ceases to be effective from the date this Law takes effect, except for reasonable provisions specified in Article 71 of this Law.
Article 71. Transitional Provisions Categorized statistics and statistical reports according to the regulations of the Statistics Law No. 04/2003/QH11
Article 72. Detailed provisions
The Government and competent authorities shall issue detailed regulations for the clauses and accounts assigned in this Law.
