Amending and supplementing certain articles in legal normative documents within the purview of the Minister of Science and Technology related to the National Standardization, Measurement, and Quality Control Committee

Pursuant to Decree No.28/2023/NĐ-CP dated June 2, 2023 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Acting Chairman of the National Standardization, Measurement, and Quality Control Committee, the Director of the Legal Department;

The Minister of Science and Technology issues this Circular amending and supplementing certain articles in legal normative documents within the purview of the Minister of Science and Technology related to the National Standardization, Measurement, and Quality Control Committee.

Article 1. Amending and supplementing certain articles in Circular No. 27/2007/TT-BKHCN dated October 31, 2007 of the Minister of Science and Technology guiding the signing and implementation of Mutual Recognition Agreements and Mutual Recognition Arrangements for Conformity Assessment Results

Replace the phrase "General Department of Standardization, Measurement, and Quality Control" with the phrase "National Standardization, Measurement, and Quality Control Committee" in Clause 3 Section III; Clause 1, 2 and Clause 3 Section IV.

Article 2. Amending and supplementing certain articles in Circular No. 15/2009/TT-BKHCN dated June 2, 2009 of the Minister of Science and Technology guiding the procedures and formalities for registering the use of non-common additives for the production, processing, and blending of gasoline and diesel fuel

1. Replace the phrase "General Department of Standardization, Measurement, and Quality Control" with the phrase "National Standardization, Measurement, and Quality Control Committee" in Clause 2 Section II; Clause 1, Clause 2 Section III; and Clause 1 and the name of Clause 2 Section IV.

2. Replace the phrase "General Department of Standardization, Measurement, and Quality Control" with the phrase "National Standardization, Measurement, and Quality Control Committee" in the Appendix attached to Circular No. 15/2009/TT-BKHCN.

Article 3. Amending and supplementing certain articles in Circular No. 06/2009/TT-BKHCN dated April 3, 2009 of the Minister of Science and Technology guiding the conditions and procedures for awarding product and commodity quality awards to organizations and individuals

1. Replace the phrase "General Department of Standardization, Measurement, and Quality Control" with the phrase "National Standardization, Measurement, and Quality Control Committee" in Point 3.1 Clause 3 Section II; Points 3.1, 3.2, 3.3, and 3.4 Clause 3 Section III; and Clause 2 Section IV.

2. Replacing certain phrases in Appendix I and Appendix II attached to Circular No. 06/2009/TT-BKHCN as follows:

a) Replace the phrase "General Department of Standardization, Measurement, and Quality Control" with the phrase "National Standardization, Measurement, and Quality Control Committee" in Appendix I.

b) Replace the phrase "General Department of Standardization, Measurement, and Quality Control" with the phrase "National Standardization, Measurement, and Quality Control Committee" in Appendix II.

c) Replace the phrase "Director General" with the phrase "Chairman" in Appendix II.

Article 4. Amending and supplementing certain articles in Circular No. 01/2009/TT-BKHCN dated March 20, 2009 of the Minister of Science and Technology stipulating the List of Products and Commodities with Potential Safety Risks under the Management Responsibility of the Ministry of Science and Technology

Replace the phrase "General Department of Standardization, Measurement, and Quality Control" with the phrase "National Standardization, Measurement, and Quality Control Committee" in Clause 1 and Clause 3 Section III.

Article 5. Amend and supplement some provisions of Circular No. 19/2009/TT-BKHCN dated June 30, 2009, issued by the Minister of Science and Technology, stipulating measures to manage quality for products and goods that need enhanced management before being circulated on the market.

Replace the phrase "General Department of Standardization, Metrology and Quality" with the phrase "National Standardization, Metrology and Quality Control Committee" in Article 6.

Article 6. Amend and supplement some provisions of Circular No. 21/2009/TT-BKHCN dated September 30, 2009, issued by the Minister of Science and Technology, promulgating and implementing the "National Technical Regulation on Safety for Electrical and Electronic Equipment."

1. Replace the phrase "Director of the General Department of Standardization, Metrology and Quality" with the phrase "Chairman of the National Standardization, Metrology and Quality Control Committee" in Article 5.

2. Replace the phrase "General Department of Standardization, Metrology and Quality" with the phrase "National Standardization, Metrology and Quality Control Committee" in Point 5.1, Article 5 of QCVN 4:2009/BKHCN "National Technical Regulation on Safety for Electrical and Electronic Equipment" promulgated together with Circular No. 21/2009/TT-BKHCN.

Article 7. Amend and supplement some provisions of Circular No. 22/2009/TT-BKHCN dated September 30, 2009, issued by the Minister of Science and Technology, guiding the procedures and formalities for registering new products that have the potential to cause safety hazards under the responsibility of the Ministry of Science and Technology.

Replace the phrase "General Department of Standardization, Metrology and Quality" with the phrase "National Standardization, Metrology and Quality Control Committee" in Article 9.

Article 8. Amend and supplement some provisions of Circular No. 23/2009/TT-BKHCN dated December 31, 2009, issued by the Minister of Science and Technology, regulating the uniform use of quality marks for motorcycle and bicycle helmets.

Replace the phrase "General Department of Standardization, Metrology and Quality" with the phrase "National Standardization, Metrology and Quality Control Committee" in Clause 2, Article 2; Clause 3, Article 6; Clause 1 and Clause 2, Article 10.

Article 9. Amend and supplement some provisions of Circular No. 03/2010/TT-BKHCN dated April 21, 2010, issued by the Minister of Science and Technology, stipulating activities to train administrative state management knowledge for consultants and assessors of quality management systems according to National Standard TCVN ISO 9001:2008 in administrative state agencies.

1. Replace the phrase "General Department of Standardization, Metrology and Quality" with the phrase "National Standardization, Metrology and Quality Control Committee" in Clause 1, Clause 2, Article 4; Clause 1, Clause 2, Article 5; Clause 1, Clause 5, and Clause 6, Article 8; Article 10.

2. Replace some phrases in Appendices I, IV, and V promulgated together with Circular No. 03/2010/TT-BKHCN as follows:

a) Replace the phrase "General Department of Standardization, Measurement, and Quality Control" with the phrase "National Standardization, Measurement, and Quality Control Committee" in Appendix I.

b) Replace some phrases in Appendix IV as follows:

- Replace the phrase "General Department of Standardization, Metrology and Quality" with the phrase "National Standardization, Metrology and Quality Control Committee" in Appendix IV promulgated together with Circular No. 03/2010/TT-BKHCN.

Article 10. Amend and supplement some articles in Circular No. 16/2010/TT-BKHCN dated September 21, 2010, issued by the Minister of Science and Technology on amending and supplementing Circular No. 21/2009/TT-BKHCN promulgating and implementing National Technical Regulations on safety for electrical and electronic equipment.

Replace the phrase "Director General of the Standardization, Metrology and Quality Control Department" with the phrase "Chairman of the National Standardization, Metrology and Quality Control Committee" in Article 4.

Article 11. Amend and supplement some articles in Circular No. 20/2010/TT-BKHCN dated December 29, 2010, issued by the Minister of Science and Technology on the organization, management, and operation of the National Program to improve productivity and product quality of Vietnamese enterprises until 2020.

Replace the phrase "Standardization, Metrology and Quality Control Department" with the phrase "National Standardization, Metrology and Quality Control Committee" in Clause 3 Article 5; Clause 1 Article 12; Article 19.

Article 12. Amend and supplement some articles in Circular No. 26/2011/TT-BKHCN dated October 4, 2011, issued by the Minister of Science and Technology on uniforms, insignia, identification plates, and quality control cards for civil servants specializing in product and commodity quality control.

Replace the phrase "Director General of the Standardization, Metrology and Quality Control Department" with the phrase "Chairman of the National Standardization, Metrology and Quality Control Committee" in Article 20; Clause 1 and Clause 2 Article 23.

Article 13. Amend and supplement some articles in Circular No. 24/2011/TT-BKHCN dated September 30, 2011, issued by the Minister of Science and Technology on the implementation of tasks under the project to enforce technical barriers to trade agreements during the period 2011-2015.

Replace the phrase "Standardization, Metrology and Quality Control Department" with the phrase "National Standardization, Metrology and Quality Control Committee" in Clause 1 Article 3; Clause 1 Article 7.

Article 14. Amend and supplement some articles in Circular No. 11/2012/TT-BKHCN dated April 12, 2012, issued by the Minister of Science and Technology promulgating "National Technical Regulations on Electromagnetic Compatibility for Household Electrical and Electronic Equipment and Similar Purposes".

1. Replace the phrase "Director of the General Department of Standardization, Metrology and Quality" with the phrase "Chairman of the National Standardization, Metrology and Quality Control Committee" in Article 5.

2. 1. Replace the phrase "Standardization, Metrology and Quality Control Department" with the phrase "National Standardization, Metrology and Quality Control Committee" in Clause 2, Point a Clause 3 and Point d Clause 5 Article 17.

Amending and supplementing some provisions of Circular No. 06/2020/TT-BKHCN dated December 10, 2020 issued by the Minister of Science and Technology detailing and implementing measures for some provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008, Decree No. 74/2018/NĐ-CP dated May 15, 2018, Decree No. 154/2018/NĐ-CP dated November 9, 2018 and Decree No. 119/2017/NĐ-CP dated November 1, 2017 of the Government.

1. Replacing the phrase "General Department of Standardization, Measurement and Quality" with the phrase "National Standardization, Measurement and Quality Control Committee" at Clause 3 Clause 14; point b Clause 2 Clause 16; Clause 1, Clause 2 Clause 21.

2. Replacing the phrase "Quality Management Bureau under the General Department of Standardization, Measurement and Quality" with the phrase "National Standardization, Measurement and Quality Control Committee" at point a Clause 5 Clause 3; Clause 14.

3. Amending and supplementing Clause 4 Clause 14 as follows:

"4. The National Standardization, Measurement and Quality Control Committee shall be responsible for:

a) Organizing the implementation of quality inspections for imported goods such as gasoline, diesel fuel, biofuel, liquefied petroleum gas (LPG), compressed natural gas (CNG), liquefied natural gas (LNG), internal combustion engine lubricating oil and other types of goods when necessary; handling according to the provisions of the law on state management responsibilities for product and commodity quality;

b) Deciding to apply management measures prescribed in Article 5 of this Circular for products and commodities in group 2 as stipulated in point a of this clause; simultaneously notifying the decision to the customs authority for coordination in implementation and publicizing on the website of the inspection agency and the national single window portal."

Article 55. Amend and supplement some provisions of Circular No. 10/2020/TT-BKHCN dated December 30, 2020 issued by the Minister of Science and Technology detailing and providing measures to implement certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008 and Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government on the use of code numbers and barcodes.

Replace the phrase "General Department of Standardization, Metrology and Quality" with the phrase "National Standardization, Metrology and Quality Committee" in Clauses 2, 3, and Clause 4, Article 4; Clause 2, Article 5; Clause 3, Article 6; Point a and Point b, Clause 4, Article 7; Article 9; Clause 1 and Clause 3, Article 10.

Article 56. Amend and supplement some provisions of Circular No. 01/2021/TT-BKHCN dated March 1, 2021 issued by the Minister of Science and Technology guiding the functions, tasks, and authorities of specialized agencies for science and technology under provincial and district People's Committees.

Replace the phrase "General Department of Standardization, Metrology and Quality" with the phrase "National Standardization, Metrology and Quality Committee" in Clause 2, Article 5; Clause 5, Article 6.

Article 57. Amend and supplement some provisions of Circular No. 09/2021/TT-BKHCN dated November 1, 2021 issued by the Minister of Science and Technology amending National Technical Regulation 20:2019/BKHCN on stainless steel.

1. Replace the phrase "Director of the National Standardization Agency" with the phrase "Chairman of the National Committee for Standardization and Metrology" in Clause 1 of Article 5.

2. Replace the phrase "General Department of Standardization, Metrology and Quality" with the phrase "National Standardization, Metrology and Quality Committee" in Point 4.4.2 and Point 4.5.3, Article 4 Amending National Technical Regulation 1:2021 QCVN 20:2019/BKHCN on stainless steel promulgated together with Circular No. 09/2021/TT-BKHCN.

Article 58. Amend and supplement some provisions of Circular No. 04/2021/TT-BKHCN dated June 15, 2021 issued by the Minister of Science and Technology promulgating "National Technical Regulation on Helmets for Motorcyclists and Motorcycle Riders".

1. Replace the phrase "Director of the National Standardization Agency" with the phrase "Chairman of the National Committee for Standardization and Metrology" in Clause 1 of Article 5.

2. Replace the phrase "General Department of Standardization, Metrology and Quality" with the phrase "National Standardization, Metrology and Quality Committee" in Point 5.1 and Point 5.2, Article 5 of National Technical Regulation 02:2021/BKHCN "National Technical Regulation on Helmets for Motorcyclists and Motorcycle Riders" promulgated together with Circular No. 04/2021/TT-BKHCN.

Article 60. Amend and supplement some provisions of Circular No. 01/2022/TT-BKHCN dated February 16, 2022 issued by the Minister of Science and Technology amending and supplementing some provisions of Circular No. 07/2018/TT-BKHCN dated June 6, 2018 and Circular No. 08/2019/TT-BKHCN dated September 25, 2019 issued by the Minister of Science and Technology.

Replace the phrase "Director General of the General Department of Standardization, Metrology and Quality" with the phrase "Chairman of the National Standardization, Metrology and Quality Committee" in Clause 3, Article 3.

Article 61. Amend and supplement some provisions of Circular No. 04/2022/TT-BKHCN dated May 31, 2022, issued by the Minister of Science and Technology on economic and technical norms for public service activities funded by the state budget concerning the maintenance, preservation, and use of national measurement standards; establishing calibration, verification, and testing procedures for measuring instruments and measurement standards.

1. Replace the phrase "General Department of Standardization and Quality" with the phrase "National Standardization and Quality Control Committee" in Clause 2, Article 3.

Article 62. Amend and supplement some provisions of Circular No. 07/2022/TT-BKHCN dated May 31, 2022, issued by the Minister of Science and Technology on economic and technical norms for public service activities funded by the state budget concerning construction consultancy services and the application of the Quality Management System according to the National Standard TCVN ISO 9001:2015 in the operations of agencies and organizations under the administrative system of the state.

Article 63. Amend and supplement some provisions of Circular No. 10/2022/TT-BKHCN dated July 28, 2022, issued by the Minister of Science and Technology amending and supplementing some provisions of Circular No. 28/2013/TT-BKHCN dated December 17, 2013, issued by the Minister of Science and Technology on state inspection in measurement.

Article 69. Article 75. Article 78. Effective Date

This Circular takes effect from November 22, 2024.

Article 79. Transitional Provisions

The contents of tasks assigned to the Standardization, Measurement and Quality Control Agency and the Director General of the Standardization, Measurement and Quality Control Agency to perform in legal normative documents of the Minister of Science and Technology stipulated from Article 1 to Article 77 of this Circular shall be transferred to the National Standardization, Measurement and Quality Control Committee and the Chairman of the National Standardization, Measurement and Quality Control Committee for continued implementation.

Article 80. Implementation Provisions

1. The Minister, Head of a ministerial-level agency, Head of an agency under the Government, Chairman of the People's Committee of a province or centrally governed city, and related organizations and individuals shall be responsible for implementing this Circular.

2. In case difficulties or obstacles arise during implementation, organizations and individuals are requested to report in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements as necessary./.
