DECREE
Amending and supplementing some articles of Decree No. 49/2010/NĐ-CP
dated May 14, 2010 of the Government on exemption, reduction of tuition fees, support for educational expenses, and mechanisms for collecting and using tuition fees for educational institutions under the national education system from the academic year 2010-2011 to the academic year 2014-2015

Based on the Law on the Organization of the Government dated December 25, 2001;
Pursuant to the Education Law dated June 14, 2005;
Pursuant to the Vocational Training Law dated November 29, 2006;
Pursuant to the Law on Medical Examination and Treatment dated November 23, 2009;
Pursuant to Resolution No. 35/2009/QH12 of the National Assembly, Session V, of the 12th Legislature on the policy and direction for reforming certain financial mechanisms in education and training from the academic year 2010-2011 to the academic year 2014-2015;
At the proposal of the Minister of Education and Training;
The Government promulgates this Decree amending and supplementing some articles of Decree No. 49/2010/NĐ-CP dated May 14, 2010 of the Government on exemption, reduction of tuition fees, support for educational expenses, and mechanisms for collecting and using tuition fees for educational institutions under the national education system from the academic year 2010-2011 to the academic year 2014-2015.
Article 1. Amending and supplementing some articles of Decree No. 49/2010/NĐ-CP dated May 14, 2010 of the Government on exemption, reduction of tuition fees, support for educational expenses, and mechanisms for collecting and using tuition fees for educational institutions under the national education system from the academic year 2010-2011 to the academic year 2014-2015 as follows:
1. Clause 1 of Article 4 shall be amended and supplemented as follows:
“1. Persons who have rendered meritorious service to the revolution and their dependents according to the Preferential Treatment Ordinance for Meritorious Persons to the Revolution No. 26/2005/PL-UBTVQH11 dated June 29, 2005, and the Ordinance No. 04/2012/UBTVQH13 dated July 16, 2012 amending and supplementing certain provisions of the Preferential Treatment Ordinance for Meritorious Persons to the Revolution.”
2. The provision at Clause 2 of Article 4 shall be abolished.
3. Clause 5 of Article 4 shall be amended as follows:
“5. Preschool children and primary and secondary school students whose parents belong to poor households as defined by the Prime Minister.”
4. Clause 9 of Article 4 shall be amended as follows:
“9. Students studying at vocational education and higher education institutions belonging to ethnic minority groups in poor and near-poor households as defined by the Prime Minister.”
5. Clauses 10, 11, and 12 of Article 4 on the subjects exempted from tuition fees shall be added as follows:
“10. University students majoring in Marxism-Leninism and Ho Chi Minh Thought.
11. Students majoring in Labor, Tuberculosis, Mental Health, Forensic Medicine, and Pathological Anatomy.
12. Ethnic minority students from very small ethnic groups living in areas with difficult economic and social conditions and extremely difficult conditions.”
6. Clause 1 of Article 5 shall be amended and supplemented as follows:
“1. The subjects entitled to a 70% reduction in tuition fees include: Students majoring in royal court music, cheo opera, tuong opera, cải lương (reformed opera), dance, and circus; and certain heavy, hazardous, and dangerous trades in vocational training. The list of heavy, hazardous, and dangerous trades is prescribed by the Ministry of Labor, Invalids, and Social Affairs.”
7. Subpoint b of Clause 2 of Article 5 shall be amended as follows:
“b. Preschool children and primary and secondary school students whose parents belong to near-poor households as defined by the Prime Minister.”
8. Subpoint c of Clause 2 of Article 5 shall be amended and supplemented as follows:
“c. Secondary school graduates who go on to vocational training and junior college.”
9. The provision at Clause 1 of Article 6 shall be abolished.
10. Clause 3 of Article 6 shall be amended as follows:
“3. Preschool children and primary and secondary school students whose parents belong to poor households as defined by the Prime Minister.”
11. Clause 2 of Article 7 shall be amended and supplemented as follows:
“2. The State directly subsidizes tuition fees for preschool, primary and secondary schools, vocational education, and higher education public institutions with students eligible for tuition fee exemptions and reductions based on actual student enrollment and tuition fee levels (For vocational education and higher education institutions, the subsidy level is determined according to the industry and profession groups specified in Decree No. 49/2010/NĐ-CP dated May 14, 2010 of the Government). The State directly provides financial support for tuition fee exemptions and reductions for students attending private preschool, primary and secondary schools, vocational education, and higher education institutions (at the same level as public institutions in the region for preschool and primary and secondary education; according to the tuition fee levels specified in Decree No. 49/2010/NĐ-CP corresponding to the industry and profession groups for vocational education and higher education).”
12. Clause 1 of Article 10 shall be amended as follows:
“1. For public preschool and primary and secondary education: Tuition fee levels must be commensurate with the economic conditions of each residential area and the actual contribution capacity of the people.”
13. Clause 4 of Article 11 shall be amended as follows:
“4. Public preschool and primary and secondary education institutions of high quality may independently establish tuition fee levels that correspond to their training costs, subject to approval by the provincial People's Committee, while also implementing the Transparency Regulation prescribed by the Ministry of Education and Training.”
14. Clause 6 of Article 12 shall be amended and supplemented as follows:
“6. Tuition fees for vocational education and higher education institutions of state-owned enterprises: Based on training costs, these institutions may independently establish tuition fee levels for different industry and profession groups following the principle of ensuring cost recovery, and report to the Ministry of Education and Training and the Ministry of Labor, Invalids, and Social Affairs before implementation. For specialized majors supported by the state budget, the tuition fee levels must comply with the framework set out in Decree No. 49/2010/NĐ-CP. Tuition fee levels must be publicly disclosed annually and for the entire duration of the program so that prospective students are aware before enrollment (In cases where students eligible for tuition fee exemptions and reductions study at vocational education and higher education institutions of state-owned enterprises, the State will provide subsidies up to the maximum tuition fee levels specified in Decree No. 49/2010/NĐ-CP).”
15. Clause 7 of Article 12 shall be amended and supplemented as follows:
"7. Tuition fees for continuing education shall not exceed 150% of the regular tuition fees for the same level of education and the same field of training. Tuition fees for other short-term training programs shall be agreed upon between the educational institution and the learner."
Article 2. Responsibility for Implementation
1. The Minister of Education and Training, the Minister of Finance, and the Minister of Labor, Invalids, and Social Affairs, within their respective functions and duties, shall coordinate with relevant ministries and sectors to guide and organize the implementation of this Decree.
2. The ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, and chairpersons of provincial People's Committees directly under the central government shall be responsible for enforcing this Decree.
Article 3. Effectiveness
1. This Decree takes effect from September 1, 2013.
2. Abolish the provision of subsidies, exemptions, and reductions in tuition fees for the groups specified in Point d Clause 3 Article 33 of Decree No. 75/2006/NĐ-CP dated August 2, 2006, of the Government detailing and guiding the implementation of certain provisions of the Education Law.
3. Repeal Clause 2 Article 2 of Decision No. 82/2005/QĐ-TTg dated April 18, 2005, of the Prime Minister on preferential policies for students and trainees in traditional arts and special subjects at cultural-art schools./.
