On the tasks, powers, and organizational structure of the Ministry of Finance
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Government Decree No. 15/CP dated March 2, 1993 on the tasks, powers, and responsibilities for state management of Ministries and agencies at the ministerial level;
Considering the proposal of the Minister of Finance, the Ministers, and the Head of the Civil Service and Personnel Board of the Government;
DECREE:
Article 1
The Ministry of Finance is a government agency with the function of uniformly managing state affairs in the field of finance, accounting, and the state budget throughout the country.
Article 2
The Ministry of Finance is responsible for performing the tasks and powers regarding state management stipulated in Decree No. 15-CP dated March 2, 1993 of the Government, and the following specific tasks and powers:
1- Directing ministries, ministerial-level agencies, governmental agencies, provincial People's Committees under central cities to develop annual state budget estimates.
Taking the lead in coordinating with the State Planning Commission to prepare the state budget estimate and propose the allocation of the state budget to ministries, sectors, and localities for the Government to submit to the National Assembly. Organizing the implementation of the state budget estimate approved by the National Assembly.
Reviewing and consolidating the final accounts of ministries, ministerial-level agencies, governmental agencies, provincial People's Committees under central cities, and social organizations receiving the state budget.
Preparing the annual consolidated state budget final accounts for the Government to submit to the National Assembly for approval.
2- Cooperating with the State Planning Commission in developing long-term, medium-term financial plans, socio-economic development plans, annual basic construction plans, and other major economic balances related to finance and the state budget.
Participating with ministries, ministerial-level agencies, governmental agencies, provincial People's Committees under central cities on the direction of industry and sector development, financial investment policies, staffing, salaries, prices, and other socio-economic policies related to finance and the state budget.
3- Drafting laws, ordinances, and other legal documents on taxes, fees, and other revenues to be submitted to the Government for promulgation or to the Government for submission to the Standing Committee of the National Assembly or the National Assembly for promulgation.
Uniformly managing and directing the work of collecting taxes, fees, and other revenues for the state budget.
4- Managing the state budget fund, the state financial reserve fund, the centralized foreign currency fund of the state budget, and the temporarily collected and held asset fund. Organizing the disbursement of funds from the state budget, capital investment for basic construction projects, and preferential loans for national economic target programs according to the regulations of the Government.
5- Implementing financial support measures to achieve cultural and social objectives as designated by the Government through programs and projects.
6- Managing capital, asset value, and resources under state ownership.
7- Uniformly managing capital and assets of state-owned enterprises. Acting on behalf of the Government as the owner of capital and assets in state-owned enterprises by delegation from the Government. Approving and consolidating the final accounts of state-owned enterprises.
8- Deciding to stop disbursements and recover funds already disbursed to agencies and units misusing state budget funds for purposes not intended, contrary to approved plans, or violating state financial management regulations; simultaneously reporting to the Prime Minister about these decisions.
9- Uniformly managing government borrowings and repayments (including domestic and foreign borrowings and repayments); managing international aid sources financially. Participating in financial reviews of government-funded foreign loan projects assigned to ministries, ministerial-level agencies, governmental agencies, and provincial People's Committees under central cities. Preparing relevant documents for Vietnam's participation in international financial agreements to be submitted to the Government for decision.
10- Managing state affairs concerning insurance business operations, bond and stock issuance, social funds, lottery sales, auditing services, accounting services, and other financial services; participating in capital market management.
11- Conducting financial inspection and audit activities for all administrative and public service organizations, state-owned enterprises, and entities related to state finances.
12- Representing the Government at international financial organizations as assigned by the Government.
13- Managing civil servants and officials in finance, accounting, and auditing according to Government regulations.
Article 3
The organizational structure of the Ministry of Finance:
A- The machinery assisting the Minister in performing state management functions:
1- Policy Finance Department.
2- Accounting System Department.
3- State Budget Department.
4- Security and Defense Finance Department (also known as Department I).
5- Banking and Financial Organization Finance Department.
6- Administrative and Public Service Finance Department.
7- State Asset Management Bureau.
8- Foreign Finance Department.
9- International Relations Department.
10- International Aid Management and Reception Board.
11- Information Technology Application Management Board.
12- Treasury and Administration Department.
13- Cadre Organization and Training Department.
14- Ministry Office.
B- Specialized state management organizations directly subordinate:
1- General Taxation Department.
2- State Treasury.
3- State Audit Office.
4- State Capital and Asset Management Department at Enterprises.
The tasks, powers, and organizational structures of specialized management organizations shall be regulated separately by the Government.
C- Affiliated public service organizations:
1- Institute of Financial Science.
2- Finance and Accounting Universities in Hanoi, Ho Chi Minh City, and Finance and Accounting Secondary Schools in Hai Hung, Quang Ngai, and Ho Chi Minh City.
3- Cadre Training Center.
The tasks, organizational structures, and staffing levels of affiliated public service organizations shall be decided by the Minister of Finance in accordance with state regulations.
D- Other units directly subordinate to the Ministry of Finance shall be organized and operated according to the regulations of the Government.
Article 4
This Decree takes effect from the date of issuance. Decree No. 155-HĐBT dated October 15, 1988 of the Council of Ministers (now the Government) on the functions, tasks, and organizational structure of the Ministry of Finance and other provisions in previous documents that conflict with this Decree are hereby abolished.
Article 5
The Minister of Finance, ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree./.
